1 Update on ASEAN The linking of Singapore to Malaysia and Thailand was now in 4 Nov 2016 Contractor Done

The execution of test scenarios was expected to commence, once 7 Nov 2016 Contractor Done
the linking of the Pilot Member States (PMS) systems had been
completed.

The PMS were encouraged to continue working closely with Pilot Member Done
Intrasoft and their internal departments to avoid further postponing States,
of the pilot due to the process to obtain approval from related Contractor
agencies.

Malaysia and Thailand to provide the required list of identified 7 Nov 2016 Malaysia and Done
cooperating partners from the private sector to prepare for the Thailand
private sector training.

Malaysia updated that her list of transporters had already been Malaysia Done
finalised and would be shared once the list was endorsed by her
Ministry of Transport.

2 ACTS Guarantee System On Krung Thai Banks proposal, Malaysia pointed out that the term
Beneficiaries (plural form) should be used in the guarantee form

as there was no identified claimant yet. Singapore was also
agreeable to the use of the plural form. ARISE also preferred to
keep the existing terminology.

On the proposal to specify SWIFT MT799 in the guarantee form,


Singapore and Malaysia agreed that there would not be a need as
it would complicate claims if there were changes in the module
name in future.

Thailand would bring back the comments to her bank. The RAPM As soon as Thailand
confirmed that the key points discussed would be reflected in the possible
document and requested for Thailand to convey to her bank.

Viet Nam also asked whether amendments could still be made to


this guarantee form subsequently, when the other countries in the
East-West corridor come on board. The agreed forms at this stage
would be used as a source document and that subsequent
amendments could still be proposed at the next stage.

3 Mutual Assistance for The Meeting agreed that the term accepted for release would be Done
Recovery Claims used as the basis to count the 90 and 270 days under the recovery
procedures.

4 Update on Protocol 7 and Memorandum of Understanding (MOU) for the Implementation of Cambodia
The MOU for the the Pilot Phase ratified Protocol
Implementation of ACTS 1. The RAPM updated the Meeting on the following outcomes of the 7 on 11 Jan
Pilot Phase 2nd MOU Meeting held in the ASEAN Secretariat office on 22 2017
23 September 2016:
i. Thailand informed that the MOU would be legally-binding
and the signatory would be her Director-General (DG) of
Customs. The approval of the Cabinet would also need to
be sought.
ii. Malaysia preferred a legally-binding MOU and the signatory
would be from the Transport Authority (level of the DG).
iii. Singapore wanted a non-legally binding MOU with
signatory from the Transport Authority.

The plan was for the Draft MOU to be ready for signing at the
ASEAN Transport Ministers Meeting (ATMM) on 17 18
November 2016. However, if this could not be done, the RAPM
would further table this for discussion at that meeting.

5 Project Management On the ACTS Information Portal, all the information agreed by the As soon as RAPM, ONGOING

cross-border vehicles permits and other documents.

was the standard for all those that used the ASEAN logo. This
would be done when the ACTS Information Portal was transferred

On the scenarios for the pilot Phase A, the start dates had not
been indicated in the documents at this point in time. Intrasoft
highlighted that the time indicated would be Jakarta time.

6 Private Sector The Training will be attended by 8-9 participants per PMS, ARISE Pilot Member Done.
Involvement also highlighted that the training was meant as a precursor to the States, Bangkok,
Parallel Run (Phase B) and it was important to ensure that the Thailand 10-12

7 Options for the Long Term The AOB 2017 would be reviewed and subject to approval of the 2017 ASEAN Sec
Governance of the ACTS ASEAN Coordinating Committee (ACC) by November 2016. Upon

(HRD) may proceed to recruit the CMT staff by next year, 2017.

The Chair sought clarification on what would happen with the CMT As soon as
if Phase C (live run) of the pilot was not implemented. ARISE possible ASEAN Sec
confirmed that without the signed MOU, which would serve as the
legal framework to operationalize the pilot, the live run would be
delayed. In this case, they would have to monitor the progress of
the signing of the MOU to pace the recruitment process of the
CMT staff.

8 Issues Related to the ARISE updated that they were in the process of working with the As soon as ARISE
Implementation of ACTS Asian Development Bank (ADB) to deliver capacity building possible
After Pilot Phase projects in Cambodia, Lao PDR, Myanmar and Viet Nam to
prepare for their system infrastructure to link up with the ACTS
system. In response to Viet Nams request for a time line on the
project, ARISE updated that they were in the process of working
this out and would provide it once it was ready.

9 Other Matters Singapore and Malaysia would be willing to submit information on As soon as Singapore and
their seals to be uploaded in the Members only section of the possible Malaysia
website since it would serve as a useful reference to Customs
officers.

ASEAN Harmonised Tariff Nomenclature (AHTN) 2017 that would Pilot Member
be implemented next year and requested that sufficient resources States,
to be allocated at national level in ACTS PMS for the reference

the live run. This could be taken as an offline discussion with PMS.
ARISE would provide guidance on the timelines and the
procedures to be undertaken after the AHTN 2017 was officially
announced.
