Honorable Fatou Bensouda,

My name is Isaiah X. Smith and I am sending you this letter out of serious
concern as to the violence and the riots that are currently going on in the United
States of America and other things in which need to be brought to your attention. I
urge you to read this letter and to analyze the details listed in this letter and to take
all appropriate and necessary actions as to making sure that international law is
upheld.

The current President of the Untied States of America is the Honorable Donald J.
Trump. As you may already know, their has been a countless number of riots,
disorder and violence that has spread across the United States due to President
Donald J. Trump being inaugurated as the 45th President of the United States of
America.1

Since the inauguration2 of Donald J. Trump as the President of the United
States of America, there have been a countless number of riots that have spread
across the United States of America.3 Many Americans feel cheated and as if voter
fraud has occurred as to the reason Donald J. Trump won the election against Hillary
Clinton. Regardless as to whether or not that is true, their has been a countless
number of election violence and there is currently violence and rioting that is

ongoing in the United States due to Donald J. Trump being elected as the 45th
President of the Untied States of America.
As you may already know, your office has opened probes into election
violence in foreign countries, such as Kenya.4 To my knowledge your office has not
investigated or analyzed violence that has occurred inside of the Untied States of
America. Even though the United States is not a party of the Rome Statute, the
United States of America and its government has to be in compliance with
international law and is not immune from being in compliance with the law.

As a citizen of the United States of America, it is very scary and even
concerning that homes, stores, and vehicles are being burned and destroyed. 5 A lot
of Americans even feel as if Donald J. Trump has been and is deliberately and
intentionally igniting the fire.6 Individuals are absolutely angry as to the election
results and many Americans want our government to be progressive as how the
Obama Administration has been. Many Americans want the government of the
Untied States of America to continue to support members of the LGBT community,
ethnic minorities, and to not fund or fuel discrimination against minorities in which
they have done so in the past. Even the past Secretary of State, the Honorable John
Kerry, has been apologetic as to the way in which the government of the Untied
States of America has treated members of the lesbian, gay, bisexual and transgender
community. 7

This is one of the first times of my life that I am extremely concerned and
worried as to living in the United States, being a citizen of the United States and even
in regards and pertaining to the way in which the Donald J. Trump Administration
will operate and the things in which the new administration supports. For instance,
agents and officials employed and contracted with intelligence agencies of the
United States of America have in the past tortured individuals that were suspected
as to committing terrorism. 8 In fact a United States government memo as to their
torture program was released to members of the general public. 9 It has been known
the new Trump Administration is seeking to bring back torture10 while the past
Obama administration had ordered torture to stop. 11 Torture is unacceptable and

as a human I believe that type of illegal conduct has to stop and cannot be accepted
by fellow citizens or by the international community.

Currently as you may already know, the Trump Administration issued an
executive order in which he has attempted to ban individuals from entering the
country on the basis as to their religion and their ethnic origin. 12 For instance, in his
executive order, President Donald J. Trump has banned citizens from Iran, Iraq,
Syria, Yemen, Sudan and Libya from entering the United States. He has however
stated that now the United States will prioritize accepting Christian refugees into
the country. 13 The so-called travel ban on refugees has caused total chaos in
airports across the United States. 14 There was an attempt by the Trump
Administration to forcibly transfer many non-refugees, refugees and their families
out of the United States on the basis as to their religion and their ethnic origin back
to other countries even when their immigration statuses were and are legal. 15
However a federal Judge has issued a nationwide temporary restraining order16 on
the Trump Administration in which is preventing the new administration from
enacting the travel ban and a federal appeals court has even denied the Trump
Administration has even upheld the lower federal courts decision. 17

In conclusion, I am extremely concerned and worried as to all of the violence
that has been occurring in the United States of America due to Donald J. Trump
being elected as the 45th President of the United States of America. Further as an
American and most importantly as a human, I am extremely concerned and worried
as to the direction in which the United States is headed, the newly started torture
program that the Trump Administration supports, the forcible transfer of
individuals on the basis as to their ethnic origin and religion and the election
violence that is currently taking place throughout the United States of America.

I hope that you and your office will publically condemn the violence that is
currently occurring and has occurred in the Untied States of America due to Donald
J. Trump being elected as the current President of the United States of America.
Further it is of my hope that you will publically condemn the torture program that
the Trump Administration supports because as you my already know, torture
violates international law and cannot be tolerated by any country or by any political

figure. I hope that you are aware that the past torture programs in which officials
employed by and contracted by, through and with the United States of America were
involved in have occurred in countries that are a part of the Rome Statute, such as
countries in the European Continent in which are members of the Rome Statute. 18
Regardless as to whether or not torture is occurring in a country that is a party of
the Rome Statute, all countries must be in compliance with international law. All
lives matter as with respect as to this issue. 19

Respectfully,

19 Myself stating that all lives matter in this letter is not in any way contradicting

the black lives movement in the United States of America. That is because the black
lives movement does have and does raise legitimate political and social concerns
over the way in which black individuals are treated by local, state and federal
government officials on the basis as to their skin color inside of the United States.
