Dear Mayor Peterson and Council,

It has been the tradition of the Wyandotte Knights of Columbus Council 111802 and the Knights of
Columbus Councils thru out the State of Michigan to participate in the annual "Menta lly lmoaired Drive"
also known as the "Tootsie Roll Drive". All proceeds from this event are used to assist the mentally
impaired and related organizations in our area and througho ut the State.

The Wyandotte Knights of Columbus in our 102,d year in the City of Wyandotte respectfully requests
your approval to solicit donations for this drive in the tradit ional manner, on the streets of Wyandotte.
The event dates are April 7th, 8th & 9t h 2017. Solicitation will be primarily of those motorists sto pped at
traffic signals at the Northline and Biddle, Oak and Biddle, Eureka and Fort and the tu re"d t urna ro und
intersections. All persons soli citing will be wearing vests clearly identifying the Knights of Columbus.

The Brother Knights of the Wyandotte Knights of Columbus Council #1802 look forwa rd to this very
successful event and greatly appreciate your support.

RESOLUTION by Councilperson ________________________________________________

WHEREAS, the Wyandotte Knights of Columbus Council #1802 is requesting permission to


participate in the annual "Mentally Impaired Drive", also known as the "Tootsie Roll Drive" on
April 7th, 8th, and 9th, 2017.

WHEREAS, the fundraising event will consist of soliciting donations from motorists stopped at
traffic signals at the intersections of Ford and Biddle, Oak and Biddle, Eureka and Fort, and the
Eureka turnarounds by persons wearing vests that clearly identify the Knights of Columbus.

BE IT RESOLVED that Council permits the Knights of Columbus Council #1802 to solicit
donations for their annual "Tootsie Roll Drive" in April 2017, provided a Hold Harmless
Agreement is executed as prepared by the Department of Legal Affairs.

ITEM: Appointment to the Downtown Development Authority

BACKGROUND: Section 28-32 of the Wyandotte Code of Ordinance establishes a Downtown


Development Authority consisting of the Mayor and eight members. The term of each member
shall be four (4) years in June.

Commissioner Gregory Gilbert has fulfilled his term and has submitted a letter of resignation. I
am requesting that the City appoint Vanessa Morse to fill the vacancy. Vanessa is a Downtown
Wyandotte resident and business owner in the City.

STRATEGIC PLAN/GOALS: To encourage and respect citizen participation and provide


transparency in all city matters and to comply with and enforce all the requirements of our laws
and regulations.

ACTION REQUESTED: Adopt a resolution to concur with the Mayors request to appoint
Vanessa Morse to the Downtown Development Authority. Term to expire June 2020.

RESOLVED by the City Council that Council hereby ACCEPTS the resignation of
Gregory Gilbert from the Downtown Development Authority and thanks Mr. Gilbert for his
service; and

BE IT FURTHER RESOLVED the City Council that Council hereby CONCURS with the
recommendation of Mayor Peterson to appoint Vanessa Morse to the Downtown Development
Authority. Term to expire June 2020.

It has been my privilege and honor to have served on the DDA Board si nce 2005, during which
time the city business district has prospered. I have been able to learn and participate with some of
Wyandotte's best and brightest during that time period. I would like to thank former Mayor James
DeSana for appointing me and to Mayor Peterson for re-appointing me.

I have recently been advised that my most recent term has expired. I have decided that I would
like to ask Mayor Peterson not to re-appoint me to a new term. My business interests are consuming a
growing percentage of my available time.

I have been the "residential" board member for the district. I remain hopeful that the Board will
allocate resources to beautify and better maintain the city parking lots abutting Van Alystyne Street in
the future.

Further, I believe it is important the city and future DDA Boards protect DDA revenue streams
from erosion, and the DDA's powers under the state statute remain intact. Lastly, always recogni ze the
valuable resource that is the WBA and work to enhance that relationship.

Dear Mayor Peterson,

Ive been a Wyandotte resident since 2001 and moved to Biddle with my husband to
renovate Glow Fish Studios in 2012. We opened our doors in March 2013 and adopted
our son that July. We brought him home the first day of the Wyandotte Art Fair. Thank
goodness for friends and family!

My Great Grandpa Joe owned a shoe shop on 17th and Eureka and his son, my
Grandpa Joe owned Derers Wine and Beer next door. My Grandpa also helped start
Wyandotte Alarm Co. and would fix watches for Milkins Jewelers. Who would have
known that I would follow in my families footsteps after teaching for twelve years?

We currently run Glow Fish Studios, an art and gift store, and live above it. We love
living in the city and enjoy all the conveniences it offers. There have been many
changes in the short time that we have moved downtown and I hope there are many
more. This is a great city and we are very pleased to be raising our son here. He is a
regular at Sanders for peanut butter cups and Nannas Kitchen for grilled cheese
sandwiches.

Im actively involved in the Wyandotte Business Association and have served on its
board. I am also a regular attendee at the Downriver Development Authority meetings
and have worked with them on several projects in the past.

My education/work background:

Bachelor of Science in Mathematics with a minor in physics from Wayne State


2 masters degrees in administration from Concordia University
Yoga Teacher Training certification 200 hours from Rising Sun Yoga; now Yoga 4
Peace
Taught yoga at Rising Sun Yoga from 2002-2009
Taught mathematics and physics at Melvindale High School from 2000-2012

BACKGROUND: Wyandotte Municipal Services has a 2002 DODGE RAM PICK-UP TRUCK that is 15 IS
years old, at end oflife, has rust issues and meets the criteria for replacement. This resolution is a request for
a replacement. It has been determined given its intended use that a light duty truck would be the logical
replacement for this vehicle.

STRATEGIC PLAN/GOALS: Providing the public with friendly, responsive, reliable and customer-
focused services that are fiscally responsible.

ACTION REOUESTED: Authorize the General Manager to approve purchase of a new Ford F-150 truck in
the amount of$ 22,290 as detailed in the attached quote from Gomo Ford utilizing the Michigan Vehicle State
(MI-Deal) Bid Price, as recommended by WMS management.

ITEM: Arrowhead Pavilion Fundraiser

BACKGROUND:

As approved by City Council and the Downtown Development Authority (DDA), we are launching an
official MEDC/MSHDA Patronicity Fundraising Campaign throughout the entire month of March 2017.
The plan of this campaign is to design and construct a public gathering area at the green space and plaza
area in front of Wyandotte City Hall located at 3200 Biddle Avenue. The goal of this campaign is to
generate $100,000: $50,000 from community fundraising and $50,000 from a matching grant from
MEDC and MSHDA.

The DDA is requesting City Council permission to host a fundraiser at the Waterfront Restaurant located
at 507 Biddle Avenue. The Arrowhead Pavilion Fundraiser will take place on Friday, March 31st, 2017
from 7:00 PM to 10:00 PM. For detailed information, please reference the attached contract.

STRATEGIC PLAN/GOALS:

As stated in the DDAs Mission Statement, The Wyandotte Downtown Development Authority shall
initiate and coordinate downtown development through design, business recruitment, promotion and the
effective use of private and public space for an attractive, festive downtown atmosphere.

Additionally, as stated in the DDA Strategic Plan of 2014, Downtown Wyandotte has a limited number of
public gathering spaces additions of smaller pocket parks, more seating and gathering spaces should be
added throughout the district.

We are requesting your support and approval in installing a promotional sign on City of Wyandotte Property.

Fundraiser Agreement
A fundraiser shall be held in the name of the City of Wyandotte: Downtown
Development Authority (DDA) whose location is 3200 Biddle Avenue, Suite 300,
Wyandotte, MI 48192 at the Waterfront Restaurant (Waterfront) whose location is 507
Biddle Avenue, Wyandotte, MI 48192.

The Arrowhead Pavilion Fundraiser will take place on Friday, March 31st, 2017 from
7:00 PM EST to 10:00 PM EST.

Waterfront shall provide complete dining room service including plated dinner service
(see attached menu for details), black linen table covers, white napkins and table
decoration, band musical entertainment, Cash Bar Service. Cash Bar Service implies that
all guests are responsible for purchasing his or her own alcoholic beverages.

Waterfront shall be responsible for printing and selling tickets. The Waterfront Restaurant
shall serve as the point of sale for all ticket sales purchased by guests.

Waterfront agrees to donate 50% of all funds raised from the sale of event tickets only

BACKGROUND: The 56th Annual Wyandotte Street Art Fair will be held on July 12-15, 2017. This letter is
sent to request that the Public Works Department be notified to close Biddle Avenue, from Oak to Eureka,
for the 2017 Wyandotte Street Art Fair from Sunday, July 10, starting at 12:01 AM through Monday, July
17,8 AM. North and southbound traffic will be rerouted on Third Street with detours at Oak Street and
Eureka, all truck traffic to be rerouted to M-85 (Ford Street) via Eureka or Ford (Northline).

STRATEGIC PLAN/GOALS: The City of Wyandotte hosts several quality of life events throughout the year.
These events serve to purpose the goals of the City of Wyandotte by bringing our community together with
citizen participation and supporting the local businesses and non-profit organizations.

ACTION REOUESTED: The Chief of Police is requested to apply to the Wayne County Office of Public
Service for a road closing permit; he should be designated and authorized to sign said street closing
permit document on behalf of the City of Wyandotte. Responsibility for all damage claims which may
arise from the road closing must be assumed by the City of Wyandotte. The Fire Department should also
be notified of this event to reroute emergency vehicles.

Also, the Wyandotte Street Art Fair would like to request the following:

1. Permission to allow the city sidewalks listed below to be used during the Art Fair only, July 13-16, and

Fair.

Integrity Shows will receive 30% of received gross sponsorship dollars for the fair. This fee will be

This agreement is between Integrity Shows, PO Box 21667, Detroit, MI 48221
(contractor) and the City of Wyandotte, 3200 Biddle, Wyandotte, MI 48192 (city) and
concerns producing the Wyandotte Street Art Fair (fair) July 12-15, 2017.

1) Contractor is responsible for finding family friendly sponsors for the fair. The city
special events office will have the right of approval for all participants. Only the city
can issue and receive contracts

2) City will pay contractor 30% of received gross sponsorship dollars for the fair.
Sponsorship commission is due fourteen days after invoiced. Sponsors obtained
directly by the city in any manner with no assistance of the contractor will not require
a commission.

3) City will provide a list of potential sponsors wanted for that years fair. Contractor
agrees to approach these sponsors first before offering opportunities to other
prospects. The city reserves the right to use other contractors as well as Integrity
Shows.

4) Contractor and city agree to indemnify and hold each other harmless from any and all
liability, claims, demands or requirements imposed by federal or state law arising from
this Agreement.

5) Should city accept any "inkind" or other non cash sponsorship's arranged by
contractor, commission will be based on an agreed to value of the sponsorship.

6) Contractor will make no representation, warranties or commitments binding the fair


beyond the scale of this agreement, without the city's prior consent.

7) Both parties covenant, warrant and represent that they will keep confidential, both
during the term of this Agreement and forever after its termination, all information
obtained from the each other with respect to all trade secrets, proprietary matters,
business procedures, customer lists, needs of customers, compilation processes and
all matters which are competitive and confidential in nature, and will not disclose this
information to any person, firm, corporation or other entity for any purpose or reason
whatsoever, unless required by law.

8) Service of any and all documents and papers may be made by First Class Mail,
addressed to either party at the addresses listed in the Agreement.

9) The Agreement is being made by each of the parties after each party has had an
opportunity to fully review, analyze, and obtain legal counsel with respect to this
Agreement and all of its terms.

10) This Agreement forms the entire understanding between the parties. It cancels and
supersedes all prior agreements and understandings.

11) There shall be no change, amendment or modification of any of the terms of this
Agreement unless it is reduced to writing and signed by both parties.

12) If any provision of the Agreement is held by a court of competent jurisdiction or


arbitration to be unenforceable, the remainder of the Agreement shall remain in full
force and effect and shall in no way be impaired.

13) It is understood that the contractor is not soliciting for charitable donations. Funds are
solicited for promotional value, presense at the event and other marketing functions.

14) This Agreement shall be govemed by the laws ofthe State of Michigan.

The Chief of Police is requested to apply to the Wayne County Office of Public Service for a road
closing permit; he should be designated and authorized to sign said street closing permit document
on behalf of the City of Wyandotte. Responsibility for all damage claims which may arise from the
road closing must be assumed by the City of Wyandotte. The Fire Department should also be notified
of this event to reroute emergency vehicles.

BACKGROUND: Below please find the requested dates for streets/property Rockin the Shores LLC
would like to utilize for a New Years Eve event downtown Wyandotte. Rockin the Shores LLC. requests
permission to host Rockin NYE (New Years Eve Ball Drop Event) on December 31, 2017-2020 starting
at 5 p.m. and ending on January 1, 2017-2019 at 1a.m. Rockin the Shores LLC is owned and operated by
Julie Law and Vin Dombroski, booth who are highly experienced in producing large-scale events. In
2016, Rockin' the Shores LLC and the Wyandotte Police Department estimated the attendance to
be around 12,000 people. Approx. 5,000 people came out for the 9p.m. ball drop and 7,000 people were
in attendance for the midnight ball drop. The event received an extensive number of
media coverage highlighting the City of Wyandotte. Some of the highlights include:

WXYZ did two live segments pre-promoting the event on Friday, Dec 30.
WDIV did a live shot from the event on Saturday, Dec 31, 2016.
The News Herald did a feature story on the event that received over 500 shares on Facebook.
The Detroit News named the event last the BIG 3 events.
Comcast Cable aired 454 :60 commercials promoting the event. The same commercial was
shared on Facebook over 1,000 times and viewed by 45,000 people.
Nash-FM 93.1 aired promotional announcements and broadcast live from the event.
101 WRIF aired promotional announcements leading up to the event, award tickets to the
Whiskey's on the Water VIP event and also had a promotional team on site.

Like last year, Rockin NYE will be an event for people of all ages featuring an outdoor concert with
national and local bands. The evening will culminate with a Time Square-style ball drop at 9 p.m. for
families and again at 12 mid-night. Vendors will set up within the permitted footprint area.
Several heated tents will be erected and food and alcohol sales will take place near the stage and tent
area on Maple and Biddle and First Street. The event may also entail family activities such as a slide,
train and games.

The event company met with the DDA Director and myself and we are in full support of these exciting
events during one of the hardest time of years for our businesses. They are asking permission for the
following items:

Set up for the event will be constructed at Biddle and Maple on the Friday before the events no later
than 12 pm. Requesting street closures on the Dec 30 before the events at 12 noon and reopen them on
the following Jan 1 at 12 noon.

can provide, we will need to bring in a 60KW 100KW generator to run the stage and light the ball.
Requesting small dumpsters be placed in the gravel lot on Biddle. Requesting garbage cans and liners
are placed around the area. Clean up will begin at 1 a.m. Organizers will have charity volunteers help
pick up garbage.

Rockin the Shores LLC is requesting first right of refusal to host the NYE event in 2021.

If there are any costs for any city staff/material/property for said event, Rockin the Shores LLC will be
responsible for those fees no later than 30 days after said event date. Any tents on the street or sidewalk
must be weighted (no stakes are allowed to be used to anchor tents) to prevent collapse. Clean up
before/during and after the event must be done by Rockin the Shores LLC. This means any glass, spills;
broken items will need to be cleaned during the event. Rockin the Shores LLC must add the City of
Wyandotte as additional insured to their insurance policy and sign a hold harmless agreement. Any
requests made after this letter is reviewed and approved will be evaluated by the Special Events
Coordinator and necessary Department Heads for approval/denial (Please see the attached agreement).
STRATEGIC PLAN/GOALS: The City of Wyandotte hosts several quality of life events throughout the
year. These events serve to purpose the goals of the City of Wyandotte by bringing our community
together with citizen participation and supporting the local businesses and non-profit organizations.

ROCKIN' NYE HOSTING AGREEMENT

This Hosting Agreement is made on the date herein, by and between Rockin'
The Shores, LLC a Michigan Corporation (herein referred to as "RTS,LLC"),
located at 27700 Gratiot Ave., Suite 307 Roseville, MI 48021 and the City of
Wyandotte (herein referred to as Wyandotte) whose government offices is
located at 3200 Biddle Avenue, Wyandotte, MI 48192 (collectively referred to as
the Parties. This agreement shall be effective on the date of its execution by both
Parties.

Recitals

Whereas, Wyandotte and RTS, LLC desire to enter into an agreement for RTS,
LLC to exclusively host an event in the City of Wyandotte on New Year's Eve
2017 through 2020. The terms and conditions of the agreement are as follows.

Specific Terms

1. The event shall be called "Rockin' NYE". All rights to the name shall
be retained by RTS, LLC and RTS, LLC shall indemnify, defend, and
hold Wyandotte harmless from any claims of infringement of
intellectual property rights by third parties with respect to said name.
This will be an all ages event featuring an outdoor concert with national
and local bands. The evening will culminate with a Time Square-style
ball drop at 9 p.m. for families and again at 12 midnight. Vendors will
set up within the permitted footprint area. Several heated tents will be
erected and food and alcohol sales will take place near the stage and
tent area on Maple and Biddle and First Street. The event may also
entail family activities such as a slide, train and games.

2. The event shall run from 5:00 p.m. on New Year's Eve, 2017, 2018,
2019, and 2020 and conclude at 1:00 a.m. on New Year's Day.
Notwithstanding the foregoing, either party may opt out of the
remaining years of the event by giving written notice to the other party
of such intent within 30 days of the conclusion of the most recent
event. If a party chooses to opt out of the remaining years of this
agreement, said party agrees not to hold an outdoor New Years Eve
festival within a 10 miles radius from the site of the most recent event
for the remaining years of the agreement. Additionally, if Wyandotte
intends to permit a New Years Eve event for the years 2021 and 2022,
then RTS, LLC shall have a right of first refusal to host said event
under similar terms and conditions as set forth in this agreement.

3. Event set up shall be permitted from 12:00 p.m. on December 30th
Event set up will include the closing of the following streets from said
time until 12:00 p.m. on New Year's Day:

Biddle Avenue between Oak and Eureka Road


Sycamore from Biddle to Alley - East
Maple from Biddle to Alley - East
Elm to Biddle to Alley - East
Sycamore and Biddle to just past Coastal Thai
Maple from Biddle to parking lot
Elm from Biddle to the Alley - West
First Street between Elm and Maple

The Parties understand and agree that County road closures require
approval from Wayne County. Wyandotte shall use its best efforts to
obtain approval for such closures. However, Wyandotte shall not be in
breach of this agreement if, despite their efforts, Wayne County does
not approve the same.

4. Use of the following sidewalks shall be permitted for the event:

Oak Street, Van Alstyne to Third Street
Elm Street, Van Alstyne to Third Street
Maple Street, Van Alstyne to Third Street
Sycamore Street, Van Alstyne to Third Street

5. Merchants may utilize the space in front of their store upon approval
from Wyandotte. However, no merchant may set up a tent, or sell food,
beverages (including alcohol), glow items or New Years Eve
merchandise in the space in front of their store. Additionally, no
merchant may subcontract their space and this policy shall be enforced
by the Wyandotte Police Department under Ordinance 32-1.

6. The following parking lots shall be used for paid parking:

Yack Lot # 8
Riverfront lot #1
Parking lot #11

7. Proceeds from the parking shall be split equally between RTS, LLC
and a charity of RTS, LLC's choosing. RTS will give Wyandotte non-

profit organizations first right to man the lots. Parking attendants will be
manned by charities and organized by RTS, LLC. All other proceeds
from the events shall be retained by RTS, LLC.

Local businesses and lor residents who need access to the parking lot
#1 will be given a parking pass 5 days prior to the event.

Wyandotte's Duties

8. Wyandotte shall provide the fencing and barricades to close the roads
and backstage barrier for the bands and crane. Green rack will be
provided and used in front of stage.

9. Upon request and if available, Wyandotte shall provide a mobile stage.


If not used, RTS, LLC shall provide a professional stage with a roof. In
either event, the stage shall be placed on Biddle, south of Maple,
facing north.

10. Upon request and if available, Wyandotte shall provide the power for
the event.

11 . Wyandotte shall provide small dumpsters in the gravel lot on Biddle


and provide garbage cans and liners in the area to handle the
expected turnout of 12,000 people.

RTS, LLC's Duties

12. Within 30 days of being presented with an invoice, RTS, LLC shall
reimburse all reasonable and foreseeable costs that Wyandotte has
incurred for city staff, material, and property for the event. Said costs
from Rockin NYE 2016, which are deemed reasonable by the Parties
are as follows:

Police $1578.61
Municipal Services $670.00
Stage $800.00
DPS $2517.76
Dumpster Rental $150.00

These cost amounts will vary from year to year (and the parties
acknowledge there may be other reasonable and foreseeable costs in
the futu re ).

13. RTS, LLC agrees to weight any tents set up for the event and shall not
secure the same with stakes or other anchors that could cause
damage.

14. RTS shall be responsible for all cleanup, before, during, and after the
event.

15. RTS, LLC shall add Wyandotte as an additional insured on their


insurance policy.

General Terms

16. Indemnification. RTS, LLC agrees to defend, indemnify, and hold


Wyandotte harmless for any and all liability that arises out of the event
unless such active arises out of the intentional or grossly negligent
conduct of Wyandotte's agents. In such case, Wyandotte agrees to
defend, indemnify and hold RTS, LLC harmless for said liability.

17. Default. If a party fails to perform the duties set forth herein, said
party shall be in breach of this agreement and the nonbreaching party
may pursue any and all remedies available in law or equity against the
breaching party including injunctive relief. If a party shall succeed in
pursuing legal action as a result of any breach of this agreement, then
the other party shall be responsible for the prevailing party's costs and
reasonable attorney fees incurred as a result of such action. Force
Majeure. Neither party will be responsible for fires, strikes, civil
disorders, severe inclement weather, acts or threats of terrorism, acts
of war or other casualties or events beyond its reasonable control.
Upon the occurrence of such an event, the Parties will have the right to
cancel or reschedule the Event.

18. Intellectual Property Rights. The Parties acknowledge and agree that:
(i) the other Party's Marks, copyrights or other Intellectual Property
Rights will remain the sole property of the other Party; and (ii) nothing
in this Agreement will confer in the Party any title to, right of ownership,
or interest in the other Party's Marks, copyrights or other intellectual
property, except to the extent expressly provided for herein.

19. Limitation of Liability. In no event shall either party be liable to the


other party, its agents, employees or any third party for any incidental,
indirect, special or consequential damages arising out of, or in
connection with, this contract, whether or not such party was advised
of the possibility of such damages.

20. Authority to Execute. The undersigned represent and warrant that
he/she has full authority to bind the Parties to all of the terms and
conditions of this Agreement.

21. Entire Agreement. This agreement is the entire understanding of the


Parties. There are no promises, terms, conditions, or obligations other
than those contained in this Agreement, and this Agreement
supersedes all previous communications or agreements, either oral or
written between the Parties. This Agreement may be amended only by
written instruments signed by the Parties.

22. Choice of Law. This Agreement will be interpreted and its provisions
enforced in accordance with the laws of the State of Michigan.

23. Waiver. Any waiver of any term, requirement or condition imposed


under this agreement shall be deemed a limited and specific waiver
and shall not be deemed to be continuing in nature or effect any other
term of this Agreement

DIAGRAM OF SIDEWALK CAFE:
Cafes adjacent to residential properties or shares an alley with residential properties shall be
screened with a solid fence at minimum of six (6) feet in height.
For additional requirements, please refer to the Zoning Ordinance and the Outdoor Cafe
Ordinance pertaining to the zoning of the property.
INSURANCE FOR OUTDOOR CAFES ON PUBLIC PROPERTY:
For outdoor cafes on public property, Liability Insurance, Liquor Liability Coverage and Property
Damage Coverage naming the City of Wyandotte as an insured party must be provided before
an outdoor cafe may be set up and be maintained for as long as the outdoor cafe is in operation .
See attached example of a Certificate of Insurance for minimum coverages and minimum limits
required. A primary general liability policy with limit of $2million per occurrence with a $4
million policy aggregate is acceptable in lien of the $1 million per occurrence with a $2 million
policy aggregate plus the $1 million umbrella as shown on the sample certificate provided.
NOTE: For those cafes on public property that serve alcohol you will also be required to have liquor liability coverage
in the amount of $1 million per occurrence and $1 million policy aggregate.

GRANT OF LICENSE/HOLD HARMLESS AGREEMENT FOR OUTDOOR CAFES ON PUBLIC


PROPERTY:
A Grant of License and Hold Harmless Agreement will be required to be executed by the property
owner and tenant if applicable . The Grant of License and Hold Harmless Agreement will be
prepared by the City's Attorney and require approval by the City Council.
ANNUAL INSPECTON:
An Annual Inspection will be required. The Applicant shall apply to the Engineering and Building
Department each year after receiving approval by the Planning Commission.
CERTIFICATION:
Applicant covenants and agrees to strictly comply with all terms and conditions of the Outdoor
Cafe Ordinance, all other ordinances and requirements of State and Federal laws. Applicant
further understands and agrees that the Planning Commission in its sole and absolute discretion,
may approve, deny or set any conditions or limitations on any outdoor cafe which may be
approved on private property. In addition, the City Council in its sole and absolute discretion
may approve, deny or set any conditions or limitations on any outdoor cafe which may be
approved on public property.
Approval of an outdoor cafe is on a calendar year basis and a renewal request must be filed each
year. Approval of an outdoor cafe is subject to revocation by the City.

INDEMNIFICATION :

By signing this Application and upon approval by the Planning Commission for cafes on private
property or upon approval by the City Council for cafes on public property, the Applicant agrees
to indemnify the City of Wyandotte per the following; The applicant and pennittee shall indemnify, hold
hannless and defend the City of Wyandotte and Wayne County, its agents, employees, elected officers, against
any and all claims, expenses (including attorney ' s fees) demands, payments, suits, actions, recoveries, and
judgments of every name and description, brought or recovered against them or either or any of them for or on
account of loss of life, any personal injury, or damages to property received or sustained by any person or
persons whomsoever by reason of any act or omission of the said applicant and pennittee, their agents, servants,
or subcontractors in the operation of said outdoor cafe, or by or in consequence of any negligence or
carelessness in connection with the same or on account of the death of or injuries to persons who shall be
engaged in the operation of the outdoor cafe; and on account of liability or obligation imposed directly or
indirectly upon the City of Wyandotte or Wayne County by reason of any law of the State of Michigan or the
United States, now existing or which shall hereafter be enacted imposing any liability or obligation, or
providing for compensation to any person or persons on account of or arising from the date hereof, for injuries
to employees or others. Said applicant and pennittee shall pay, settle, compromise, and procure the discharge
of any and all such claims and all such losses, damages, expenses, liabilities, and obligations, and shall defend
at his own cost and expense any and all claims, demands, suits, and actions made or brought against the City of
Wyandotte and Wayne County for or upon any such claim. In case the said applicant and pennittee shall fail ,
neglect, or refuse to comply with any of the provisions of this paragraph, said City of Wyandotte or Wayne

BACKGROUND: Based on Wyandotte's population the City receives Community Development Block Grant
(CDBG) dollars through Wayne County. The County receives grant dollars via the Housing Urban Development
(HUD). The City is anticipating receiving approximately $137,397 in funding. In the past, these funds have been
used for street improvements, youth assistance, housing rehabilitation and administrative costs to run the program.
In order to receive these funds, two (2) public hearings are required to seek input from the public. The Engineering
Department is requesting the hearings be held on February 13, and February 27, 2017. These public hearings will
provide an opportunity for public comment.

The application for this grant program is due on March 1, 2017.

STRATEGIC PLAN/GOALS: We are committed to maintaining and developing excellent neighborhoods by


matching tools and efforts to the conditions in city neighborhoods; tracking infrastructure conditions in all
neighborhoods. The city will work to establish and sustain the quality of street lighting, sidewalks, curbs, gutters
and pavement; continuing neighborhood renewal projects, where needed, in order to revitalize structures and
infrastructures in residential and commercial areas.

ACTION REOUESTED: Adopt a Resolution concurring with the City Engineer to set a public hearing for
February 13, 2017.

BUDGET IMPLICATIONS & ACCOUNT NUMBER: The grant allows for reimbursement of the Citymomes
spent as part of the CDBG Program.

NOTICE OF PUBLIC HEARING

A Public Hearing will be held immediately following the regular session of the Mayor and
Council on Monday, February 13, 2017, at 7:00 P.M. in the Council Chambers of the Wyandotte
City Hall, 3200 Biddle Avenue, Wyandotte, Michigan. Purpose of the Hearing is to receive
suggestions or comments for the 2017 Community Development Block Grant Program (CDBG).
The City of Wyandotte expects to receive an estimated $137,397 in CDBG funding. In addition,
the City also plans to request Housing Rehabilitation funds in the amount of $20,000. Program
Income is often generated from the Housing Rehabilitation Program as houses sell and loans
are repaid. We anticipate received approximately $20,000 in Program Income to be generated
during the 2017 Program Year. If Program Income is generated, it will be allocated back to the
Housing Rehabilitation Program to assist additional homeowners.

The public should note that these figures are an estimate based upon expected allocations to
the program. If changes need to be made based on the final allocation received from HUD by
Wayne County, then a proportional reduction or increase for all projects will occur.

The primary objectives of the CDBG Program are to assist low to moderate income families
directly or provide benefits in areas where 51 % of the residents are low to moderate income,
such as replacing the urban infrastructure of streets, improve recreational facilities and
programs and assist in meeting special needs of the physically disabled.

BE IT RESOLVED that the communication from Jeremy Sladovnik regarding a review of the
mechanical amusement device and arcade business license ordinances is hereby received and placed on
file.
BE IT FURTHER RESOLVED that the City Engineer and City Attorney are hereby directed to review
the current ordinance and to report back to the City Council on or before March 6, 2017, with
recommendations concerning possible amendments to the definition of arcades and the license fees
charged for each device and annual license fee for an arcade.

2017-46 RRC PRIORITY REDEVELOPMENT SITES LIST

WHEREAS, the MEDC has developed a program for certifying Redevelopment Ready Communities,
and the City of Wyandotte desires to achieve that certification by implementing best practices and
recommended strategies for redevelopment; and
WHEREAS, the City of Wyandotte has engaged in the MEDC Redevelopment Ready Communities
Program, in order receive Redevelopment Ready Communities Certification from the MEDC.
NOW, THEREFORE, BE IT HEREBY RESOLVED, that the City of Wyandotte, Michigan through its
City Council, accepts Wyandottes Priority RRC Redevelopment Sites List.

1. Call to Order: The meeting was called to order by John at 6:05 pm.

2. Introduction of New Members: John introduced and welcomed Patricia Iacopelli and April Treece as
the Beautification Commissions new members!

3. Approval of Agenda: Motion was made by Alice, seconded by Kelly, to approve this meetings
agenda as presented. The motion was approved.

4. Reading and Approval of Previous Minutes:


a. November 9, 2016 Regular Meeting: After review of the minutes, Alice made a motion, seconded
by Andrea, to approve the draft minutes of the November 9, 2016 regular meeting of the
Beautification Commission without change. The motion was approved.
b. December 14, 2016 Special Meeting: After review of the minutes, Alice made a motion, seconded
by Andrea, to approve the draft minutes of the December 14, 2016 special meeting of the
Beautification Commission without change. The motion was approved.

5. Chairpersons Report:
a. Appointments of Ms. Patricia Iacopelli & Ms. April Treece to the Beautification Commission: John
reported that Pat and April were appointed to the Beautification Commission by Mayor Peterson,
and their appointments approved by the City Council, on Monday, December 19, 2016, with terms
to expire April, 2019. They were both congratulated and welcomed onto the Commission!
b. Documents: An updated Attendance Log, updated Commission Roster, and list of 2017
Beautification Commission Officers and Coordinators were distributed.
c. City of Wyandotte Training Budget for the Beautification Commission: John reported that the City
Council approved a $50 training budget for the Beautification Commission for the 2018 Fiscal
Year. The related Request for Council Action was distributed and reviewed.
d. City of Wyandotte Travel and Education Policy & Approval Request Form: John reviewed the
City of Wyandotte policy that all expenditures over $25 for education and travel have to be
approved by the City Councils Education Committee. The Request for Travel/Education
Approval Form was distributed and reviewed. Requests should be submitted to Julie Sadlowski
for processing for approval in advance of the course or event date.
e. City of Wyandotte Vendor Electronic Payment Policy & Authorization Agreement Form: John
reviewed the City of Wyandotte policy that encourages vendors to accept payments by direct
deposit electronically. The Authorization Agreement Form was distributed and reviewed. All new
vendors must be given a copy of this form for them to complete and return to the Accounting
Department.
f. Status of Tree Planting in City Parking Lot 11: John reviewed the current status of the October,
2016 request by the DDA for to plant trees in parking lot 11. The Beautification Commission has
not budgeted for this project, and will rely on future allocated funds from the DDA or other source
to fund tree purchase and planting, should the Commission agree to participate in the project.
According to Engineering and DDA representatives, the status of future parking lot repairs or re-
build is under review for possible implementation in Spring, 2017. The Commission has no plans
at the present time to plant any trees in this parking lot. We will wait for Spring, and assess what
the plans are for that area, and evaluate options at that time. It was noted that the parking lot
does need urgent work on the center main walkway to avoid potential trip-and-fall risks for the city
and for the DDA.

6. Treasurers Report:
a. FY 2016-2017 YTD Expense Report: The FY 2016-2017 YTD Expense Report was distributed
and reviewed. There were posted expenses totaling $952.60 for various seasonal holiday &
winter decorations, leaving a current balance of $8,829.22 in the DDA-funded budget. There was
one posted expense from the GoFundMe proceeds budget of $115.88 for mixed evergreens for
the Nannas Kitchen area, leaving a current balance of $471.82.

7. Communications, Event Marketing, & Volunteer Recruitment Report: Andrea reported that the
promotion of the Outdoor Holiday Lighting Awards on the Commissions Facebook page has received
over 5000 hits, and has been very successful in reaching out to the community! Andrea was
congratulated on her hard work in promoting this new awards program!

8. Residential Holiday Lighting Award Program: The First Annual Residential Outdoor Holiday Lighting

Awards were presented at the January 9 City Council meeting. This was a highly-successful event,
with 10 awards being presented, and 25 additional Honorable Mention residences being recognized!
Michael was congratulated on an excellent event that really caught the imagination of a number of

residents! The Commission is looking forward to the 2 Annual Awards in 2017. There was much
discussion and a number of suggestions on how to further enhance this program going forward.

9. Adopt-A-Spot in Wyandotte Program Update: There was nothing new to report.

10. Community Garden Update: There was nothing new to report. The ground is still frozen.

11. Downtown Plantings Update: Noel reported that the power to the lighted ornaments by Nannas
Kitchen has been cut, likely because it is the end of the holiday lighting season, per city protocol.

12. Winter & Holiday Baskets Update: Alice reported that she will contact DPS to request that the red
ribbons in the arbor hanging baskets be removed, and the greens to be retained through the winter.
It was noted that the winter baskets looked great!

13. Old Business: There was no Old Business to report.

15. Round-Table Reports and Announcements: There were no Round-Table Reports or Announcements.

4. Chairpersons Report:
a. Documents: An updated Attendance Log was distributed.
b. City of Wyandotte 2017 Disclosure Statement for Elected & Appointed Officials: John reported
that the City Clerks Office is requiring that all Commissioners complete and submit a notarized
Disclosure Statement for Elected & Appointed Officials by the deadline date of April 28, 2017.
The related Disclosure Statement and cover letter was distributed and reviewed. It was clarified
by John that the form may be notarized (signature and identity confirmed) by any Notary Public,
and that notary service is available at no charge through the City Clerks Office.

5. Treasurers Report: The FY 2016-2017 YTD Expense Report was distributed and reviewed. There
were posted expenses totaling $15.00 for reimbursement of a BCSEM meeting registration fee,
leaving a current balance of $8,814.22 in the DDA-funded budget. There were no expenses from the
GoFundMe proceeds, leaving a current balance of $471.82.

6. Communications, Event Marketing, & Volunteer Recruitment Report: There was nothing new to
report.

7. Adopt-A-Spot in Wyandotte Program Update: There was nothing new to report.

8. Community Garden Update: John reported the following items for April:
a. Updated Community Garden Application and Hold Harmless Form: April has been working with
John to revise and update the Community Garden Application and Hold Harmless Agreement to
consolidate multiple documents, clarify Terms & Conditions, and strengthen and standardize the
Hold Harmless Agreement. The revisions have been completed, and the draft document has
been submitted to the City Attorney for review. A copy of the draft Application was circulated for
review, but was not distributed or released for implementation at this time.
b. Mailings to Community Gardeners: April is planning to mail the new Community Garden
Application and Hold Harmless Agreement, when approved, with cover letter to all 2016
gardeners, and to all new applicants who have submitted applications for consideration in 2017.
c. Removal of Plant Refuse and Clean-Up of the Garden Area: It was noted that there are a few
piles of residual plant refuse from gardens remaining in the community garden area. April is
contacting the Work Force to have this plant material removed and taken to the citys Recycling
Center for composting. In the Spring, the Work Force will be contacted to distribute the
remaining topsoil mix to top off all of the beds, which have settled over the past year. April will
come up with a system to ensure the community garden grounds are kept neat and tidy. John
will contact Joe Gruber to request a city trash container to be placed on the sidewalk on Oak
Street by the community garden for trash disposal to minimize littering in the area. Yellow &
green recycling totes for composting plant materials and for recycling plastic plant trays will be
requested through the DDA in the Spring, and will need to be on a regular Waste Management
pick-up schedule.

9. Downtown Plantings Update: There was much discussion on potential plantings and expansion of
the Commissions planted areas. Both planter pots and free-standing hanging baskets were
anticipated. Noel requested that the topic of Spring-Clean Up be considered on the March agenda,
which was agreed to by consensus. Other follow-up activities include:
a. John recommended that the Commissioners take informal tours of the downtown area to identify
and catalog the open plaza spaces that would be appropriate for multiple large plant pot
placements and/or free-standing hanging baskets. These plaza spaces will be reviewed at the
Commissions March meeting. It was noted that the 2 existing free-standing hanging may need to
be relocated if the Patronicity Campaign is successful, and their current location is re-designed.
b. It was requested that Gary Ellison, DPS Superintendent, be invited to an upcoming Commission
meeting to discussion landscape and grounds maintenance issues or concerns. John will contact
Mr. Ellison to make arrangements.
c. It was requested that clarification be obtained from the city regarding any requirement for all
plantings to be the same in the tree boxes on Biddle. John will contact Engineering to inquire and
report back.

10. Old Business: There was no Old Business to report.

11. New Business:


a. Patronicity Campaign: Noel reviewed the proposal and renderings for the citys entry into the
Patronicity Campaign (MEDC?). There is a fund-raising goal of $50,000 between March 1-31,
with matching funds if the fund-raiser is successful within the 30-day window. The funds will be
spent to re-design the grounds of city hall as a people-friendly outdoor gathering space. The
campaign is being conducted by the DDA. There was a motion by Noel, seconded by John, that
the Beautification Commission support and promote the Patronicity Campaign in the
Commissions social media. The motion was approved. Noel will contact Andrea to coordinate
the promotion.
b. Area to Plant at City Hall for Spring Dig-In: There was discussion regarding spaces along the
north foundation of city hall for plantings by the Beautification Commission during the Spring Dig-
In. It is a very shady area. Noel will form a sub-committee to conduct an on-site review for
appropriate plant materials for that space with report back in March.

13. Next Meeting: The next Regular Meeting of the Beautification Commission is scheduled for
