Several students and parents have called me this past school year regarding Woznicki’s treatment of them. talked to me about Woznicki’s attitude and treatment of on October 29, 1993. said that he is too demanding and inconsiderate of parents and students in the classroom and during the rehearsals of the one-act play. demanded that I have a conference with him about his actions and behavior. On November 9, 1993 _ of , called on behalf of felt that Woznicki was abusive to children in his use of power and his behavior as an adult was unacceptable and inappropriate. was subjected to ridicule and embarrassment as Woznicki teased about and . had a number of disagreements with Woznicki which led to arguments and intimidation. At one point Woznicki According to » Worznicki dressed down after made a comment about the one-act play blocking. _ said Woznicki said if he continues to act like this he would kick his F---ing ass out of here. said that the kids are putting up with this because thev want to be involved in the play. was fearful of repercussions later by Mr. Woznicki. was not happy with the situation and said that Woznicki said he would hold no grudges. requested that not have Woznicki as a teacher in class in the future. On November 10 I received a letter from regarding left the theater. When returned to put her chair away, Woznicki and got into an argument and was kicked out of the play. asked me to investigate the incident and report back to him. requested that if this incident went beyond a misunderstanding and represents a pattern of verbal and character abuse he wanted it stopped. Woznicki stopped him again and said, Woznicki said thought it was a joke and laughed it off. did not come to me because thought it would get better after quitting the play. said that Woznicki could care less about other people’s rules but strictly enforces his own. He expects respect but does not respect other people. 1 met with Woznicki on November 23. He brought along Debra Reynolds to the conference. I stated this was about the incidences that happened Thold him that his strengths were that he was @ good director and manager of the dramaties program, that he selected plays that were challenging and fun, and he was concerned with ‘opportunities for his students in the program. { then pointed out that his behavior toward students is at times unacceptable and inappropriate. Talso caid that his use of language, although it may be used for effect, is not necessary. T said that he intimidates students at times and it is never necessary to make students cry- [told him that I trust that this thing won’t happen again and that he not hold any grudges toward any of his students. 1 told him that they meant no harm to him. I told him that parents had ‘come to me with their concerns for the student not the students themselves. In summary T said Iwas pleased with the direction of the dramatics program but that his handling of students under his care needed refinement. He responded that he would take my counsel under advisement but could not respond unless he knew ‘who was charging him with mistreatment. I said that the kids were afraid of repercussions if I mentioned their names. He said he would try not to be so sarcastic but he would not be the same director. I spoke with ‘on November 24, 1993. _ did not think this fair. was very botherea vy the way he treats people and said that earlier Woznicki asked to leave his room. He had made embarrassing comments to and now wanted out of his room. Also on November 24, 1993 came to see me about Woznicki and the one-act play, said that the play was bad trouble from the beginning and it was because of ‘Nobody on the cast was getting along with anyone. Wornicki was not to blame for the troubles. The ‘students chose to act in an immature way. thought that Woznicki was a great director and teacher and should not be held to blame for the plays difficulties. On December 8, 1993 . of , called requesting that be removed from Woznicki’s English class. - said that Woznicki gave __ the creeps when went to see him about requested a grade but ‘Woznicki said he did not have them made out. said Woznicki makes uncomfortable in. ADJOURNMENT In the Matter of: Thomas Woznicki FINDINGS OF FACT, CONCLUSIONS OF LAW Before the School Board AND ORDER of the School District of New Richmond The School Board of the School District of New Richmond having conducted a hearing into allegations and charges made against Thomas Woznicki at session held on January 12, 13, 14 and 15, 1995, and having heard testimony presented by the administration represented by Kathryn Prenn and Victoria Seltun of Weld, Riley, Prenn & Ricci and testimony presented by Thomas Woznicki represented by Melissa Cherney of Wisconsin Education Association Counsel and having considered such evidence and the arguments of counsel, makes the following finds and conclusions as its decision in the matter: FINDINGS OF FACT Thomas Woznicki engaged in inappropriate conduct with a minor female student which include A. Meeting with that student at his home; RB. Meeting with that student at Centzal Station in Roberts for one hour in a vehicle; C. Taking student to movie and supper in Twin Cities without parental consent; _. D. faking student to second movie in Twin Cities without parental consent; | E. Giving student his calling card and encouraging calls; F. Conducting phone relationship including pyrgreus calls on bill and 125 calls on Woznicki’s LLG G. Failure to report threat of runaway by student to any authority or parents. . H. Failing to refer student to school for counselling; . I. Having inappropriate sexual contact with that student; pre ares J. The breaching of the student’s confidentiality. CONCLUSIONS The Schocl District of New Richmond has just cause to terminate the teaching contract of Thomas Woznicki based on those findings. OD gn SF 7712014 Piease complete Equal Rights Process Information Sheet on Page 4 Having participated in three interviews for the position of superintendent at the Northern Ozaukee School district, the last interview with the board of directors having been held on 16 May 2011, | received a phone call from NOSD board president Paul Krause offering a two-year contract at a salary of $95,000 per year. | indicated that | was interested in the position and that | would like for the board to consider a higher salary given that the average salary for conference members (similar schools) was over $115,000 per year. He agreed to take my request to the board at their next meeting. He also invited me to attend the interview for the principalship finalist on 19 May 2011. On 19 May, Paul Krause called to ask me, ithout explanation, not to attend the principalship interview. Mr. Krause committed to meeting with the board of directors on 27 June 2011 or 31 June (or both) at which time he would ask the board to consider my request. At no time did | decline the offer of 95K or make a higher salary a condition of acceptance of contract; neither did | make a counter offer which was alleged ina letter dated 3 June 2011; neither did Mr. Krause ever declare that my request for additional consideration was refused. Mr. Krause further committed to contact me with a response from the board ‘on 31 May 2011 oF 1 June 2011. Mr. Krause never contacted me with an answer. I received a letter from attorney Tom O'Day of Godfrey & Kahn dated 3 June 2011 in which he informed me that his firm had been retained to investigate additional questions concerning my background. | attended a meeting with Mr. O'Day on 16 June 2011 in his Green Bay office during which | was Interrogated at-length by Mr. O'Day and his associate about criminal charges that had been brought in, St. Croix County on 27 June 1994 and dismissed with prejudice on 8 July 2012. it was clear that | was being investigated concerning the dismissed charges. In the Ozaukee Press, on the NOSD website, and in @ posting on the WASB.ORG website dated 5 July 2011, the NOSD made it clear that they intended to pursue and to hire an interim superintendent and then a permanent superintendent. Mr. Krause also substantially misrepresented the situation and ‘outcome of my candidacy. { have never been noticed that | am still being considered; only that they would continue to investigate me. | am unaware that any other candidate has been investigated beyong the DOJ criminal background check, the sole purpose for which invesigation was permissioned by this candidate. This made it clear de facto that | was no longer under consideration as a candidate. Mr. O'Day continues to investigate my background without my authorization in spite of the fact that | have been denied the employment de facto. It is clear to the complainant that this discrimination and refusal to employ is related in-whole or in-part to an arrest record where the charges, dismissed with prejudice 17 years ago, are prohibited from consideration. Defendant Brian Johnston (hereinafter “ohnston”) is employed by the School District of New Richmond as the Director of Fiscal and Building Operations, and was the Records Custodian at the time the request was made for the record at issue. 3. Inearly 1994, Woznicki was accused of having had inappropriate contact with a student in 1993 or 1994. In April 1994, charges were filed against Woznicki, and in July 1994, all charges were dismissed with prejudice 4. Woznieki applied for the position of superintendent with the Northern Ozaukee School District (hereinafter “NOSD”) in or around March 2011. 5. After an initial interview on April 7, 2011, Woznicki participated in two interviews in May 2011, as a finalist for the superintendent position. His status as a finalist was published in a local newspaper, the Ozaukee Press, on May 4, 2011. 6. OnMay 18, 2011, Woznicki was offered the position of superintendent via a telephone call from Paul Krause, the President of the NOSD School Board. When Woznicki asked if the Board might consider offering a salary that is more competitive with other area school districts’, he was told that Mr. Krause would consult with the other Board members. 7. OnMay 25, 2011, Woznicki called Mr. Krause to leam whether or not the Board had discussed a more competitive salary. Mr. Krause said that he would contact Woznicki by the following Wednesday (June 1, 2011). Woznicki was never contacted by Mr. Krause. 8. On June 6, 2011, Woznicki received a letter from Tom O’Day (hereinafter “O’Day”), an attorney with Godfrey & Kahn, 8.C. who had been retained by NOSD to investigate “additional questions” that had arisen “concerning your (Woznicki’s) background.” Woznicki was asked to contact O'Day if he wished to continue with the application process. 9. On June 7, 2011, Woznicki called O’Day as requested by the letter. O’Day asked to meet with Woznicki to discuss a concer raised by a community member. A meeting was scheduled for June 13, 2011, however due to a scheduling conflict, the meeting was rescheduled for June 16, 2011. 10. On June 8, 2011, an article in the Ozaukee Press stated that the NOSD Board had re-opened its search for a superintendent. Woznicki inferred that he was no longer being considered for the position. 11. OnJune 18, 2011, Woznicki met with O’Day at Godfrey & Kahn’s Green Bay office, where O’Day explained that the meeting was a continuation of the interview process. It lasted approximately 75 minutes, and about half of the time was spent interrogating Woznicki about the circumstances surrounding the charges that were filed against him in 1994. Wis. Stat. §111.335(1)(a) states that requesting an applicant to supply information regarding any arrest record of the individual, excluding pending charges, is employment discrimination. 12, On June 29, 2011, Johnston received an email from O'Day. In an attachment, O'Day requests, pursuant to Wisconsin’s open records law, Wis. Stat. §§19.31-19.39, copies of the following documents from the School District of New Richmond: a) The personnel file and any other documents related to the employment of Thomas J. Woznicki a.k.a. Thomas S. Woznicki, a teacher in the School District of New Richmond, ftom approximately August 1987 — July 1997; b) To the extent they are not in Mr. Woznicki’s personnel file, any documents, statements or testimony that Mr. Woznicki submitted to or provided to the School District of New Richmond during any investigation and/or resolution of a matter involving allegations of inappropriate contact with a student in 1993 or 1994; ¢) To the extent they are not in Mr. Woznicki’s personnel file, any internal correspondence, documents, summaries, or other communication from any school board member, employee, agent, or contractor of the District during any investigation and/or resolution of a matter involving allegations of inappropriate contact with a student in 1993 or 1994; and d) Any and all documents related to attorneys’ fees, legal bills or other costs incurred by the School District of New Richmond, the insurance company ot any other indemnifying entity on behalf of the School District of New Richmond in litigation involving Mr. Woznicki, including, but not limited to, St. Croix County Case No. St_ Croix County Case No. (ERMINE and St. Croix County 13. Inan email dated June 30, 2011, O’Day asked Woznicki to let him know if Case No. Woznicki objected to O'Day releasing Woznicki’s mailing address to the School District of New Richmond. This is also when Woznicki first learned that O’Day was requesting Woznicki’s “personnel file, as well as other information related to any investigation and proceedings in 1993 and 1994, from the New Richmond School District.” 14, On July 5, 2011, the position of NOSD Superintendent was posted under “Superintendent Search & PAR Program: Wisconsin Searches” on the Wisconsin Association of School Boards’ website. The posting boasts a “multi-year contract” and a salary that is “competitive with arca school districts.” The deadline for applications is August 22, 2011 15. On July 18, 2011, Woznicki received notice from Johnston about the above- mentioned request. The letter states that, after conducting a balancing test, Johnston determined that the requested records are subject to disclosure. It also informs Woznicki of his right of action under Wis. Stat. §19.356, Woznicki notified Johnston of his intent to seck a court order to restrain Johnston from providing access to the requested records in a letter dated July 2: 2011 WHEREFORE, plaintiff demands judgment against defendant as follows: 1. (Please note that Woznicki denies making a “counteroffer of $120,000" as stated in the letter.) On June 7, Woznicki called O’ Day to schedule a meeting as requested by the letter. On June 8, 2011, an article in the Ozaukee Press stated that the District had re-opened its search for a superintendent (see Exhibit C). Woznicki met with O'Day at Godfrey & Kahn’s Green Bay office on June 16, 2011. The meeting lasted approximately 75 minutes, and about half of the time was spent interrogating Woaznicki about the circumstances surrounding charges that were filed against him in 1994 alleging that he had inappropriate contact with a student while he was employed by the Schoo! District of New Richmond. These charges were subsequently dismissed with prejudice. Wis. Stat. §111.335(1a) states that requesting an applicant to supply information regarding any arrest record of the individual, excluding pending charges, is employment discrimination. At that ieeting, O'Day also questioned Woznicki about changing his name from Thomas J. Woznicki to ‘Thomas S. Woznicki, and Woznicki explained that he had taken his wife's maiden name as his miiddle name in honor of her father who passed away shortly after their wedding. O'Day did inform Woznicki that the District would be requesting his personnel file from the School District of New Richmond, Because Woznicki did not know the contents of his personnel file, he told O'Day that he would be willing to provide the parts of the file that were relevant but that he was not willing to allow access to the entire file, O'Day also asked for the names of people who could provide information regarding the 1994 charges, including the accuser, which Woznicki willingly provided. On July 5, 2011, the position of Northern Ozaukee School District Superintendent was posted under “Superintendent Search & PAR Program: Wisconsin Searches” on the Wisconsin Association of School Boards’ website. The deadline for applications was August 22, 20{ 1. In an email dated June 30, 2011, O'Day asked Worznicki to let him know if Woznicki objected to O'Day releasing Wo: ing address to the School District of New Richmond so that it could send notice to him as it is required to do under Chapter 19 of the Wisconsin statutes. When Woznicki called to grant permission to release his mailing address, he also asked O’Day to confirm in writing that Woznicki was still a candidate for the superintendent position with the District. O'Day said that he would not do so, and he would advise the District not to do so. On July 18, 2011, Woznicki received notice from the School District of New Richmond via certified mail that O'Day had requested Woznicki’s personnel file and other documents under Wisconsin’s Open Records Law. Attorney Cieslewicz included this correspondence with his September 30, 2011 response as Exhibit B. ‘That same day, the Northern Ozaukee School District Board of Education posted a message on the District’s website saying that the superintendent position had been reposted and the Board was actively seeking candidates (see Exhibit D). Because Woznicki had no reasonable a e that the ict was still considering him for the position of superintendent, he exercised his rights under Wis. Stat. § 19,356(4) by seeking an injunction to prevent the School ict of New Richmond from releasing the requested records. Woznicki cooperated fully in the District’s interview proces it was clear that he was longer a candidate for the position of superintendent. He provided both his date of birth and security number to the therefore the change of his middle initial would have had no effect on the District's ability to conduct a complete background check. Woznicki also thoroughly answered O"Day’s questions during the June 16, 2011 meeting and gave bim the names of witnesses to contact for additional information. The Complainant was interviewed and considered for the position of superintendent in June 2014 ‘The Complainant alleged in his complaint that he was offered the position at a specific salary, but he requested the Board to reconsider the salary range. The Complainant claimed that he was then interrogated, harassed, and denied hire by Board President, Paul Krause, and Attomey, Tom O'Day, based on his past arrest record, for which charges were dismissed. ‘The Respondent expressed interest in hiring the Complainant for the position of superintendent after his interview in June 2011. During the negotiation process of his hire, the Respondent discovered the Complainant had been criminally charged in St. Croix County with legal sexual contact with a minor. The Respondent undertook its own investigation with its attomey, Tom O'Day, of Godfrey and Kahn. During its investigation, the Respondent found that the Complainant (Thomas S. Woznicki) was once known as “Thomas J. Woznicki.” li an interview with Attorney O'Day, the Complainant admitted he changed his name and had been charged with sextial contact with a minor student while employed at the New Richmond School District (NRSD) in April 1994. As part of its investigation, the Respondent requested the Complainant's personnel file from the NRSD, under the Wisconsin Open Records Law. On July 12, 2011, the NRSD sent a response that the request was subject to disclosure to the Complainant. Shortly thereafter, the Complainant responded to the NRSD letter, and pursued a court order to restrain NRSD from providing the Respondent with gocess to his personnel file. The Respondent indicated that because of the Complainant's lack of cooperation with its investigation, it made its decision to no longer pursue his hire. During the Respondent's investigation, the Complainant stated that he would release relevant portions of his NRSD personnel file, but was not willing to release the entire fle, as he did not know what details it contained. Additionally, the Complainant confirmed that his name change was due to a personal family matter, rather than anything related to his arrest record 3 The Complainant argued that though the Respondent's investigation continued, he was not assured he was stil! a candidate for the position. The Complainant asserted that in several media outlets, including the Ozaukee Press Newspaper, during the month of June 2011, the Respondent announced it had reopened its search for a superintendent. Though the Complainant argued that the Respondent's investigation was unnecessary and intrusive, the Respondent has the right to conduct its own independent investigation under the Act. Tom Woznicki told us that he had told Greg Bell twice to stop sending kids to the stores and had warned Rhonda Scallon about it also. Tom says he tries to strike balance between buildings Some work is done outside the office. He has documents & hours/weeks where he is. His cellphone usage during meetings? He says he uses it to check time during board meeting. Uses phone only during district time. He doesn't think weekly meetings are a great ides because not all people have to discuss the same things at the same time. But if that was the board's wishes then he would start having weekly meetings. Administration Evaluations - Woznicki explained that a negative effect — not to do it then they don't have to. Positive effect ~ Helps things move forward. Have them done by a certain time but doesn't want to damage a relationship with administration. Could have them by July meeting if not sooner. Effective Educator ~ Superintendent and principals, both of them took. Overtime ~ Can't find any use of time that is not being utilized unnecessarily. Community involvement — He has 6 kids ~ spends time at home, at job. 2 kids are in basketball and 3 in baseball and then also the kids are in swimming. He is at the library 6 times a week. Curriculum Development — Written by teachers, mended by teachers, adjusted by teachers; Must have a license to teach that curriculum. Common Core: Math, reading, language arts. Presence at the office: Can't be in the other buildings if he is in the office; greater presence in other buildings; has not put in less than 40 hours since he has come to Boscobel. Woznicki (“Admi strator") (or collectively: “the parties") desiring to conclude all issues relative to Administrator's employment as District Administrator and his resignation from employment with the District: WHEREAS, the District employs Administrator as District Administrator and he is presently under contract to be employed through June 30. 2015; and WHEREAS. Administrator wishes to resign from his position; and WHERE S. the parties wish to facilitate and resolve Administrator's resignation from employment with the District by reducing their mutual agreements to writing. NOW, THEREFORE, in consideration of the mutual agreements and covenants contained herein, it is hereby agreed as follows: 1, Administrator hereby voluntarily and irrevocably resigns from his employment with the District effective July 31, 2014, upon the Board’s approval of all terms of this Agreement, and such resignation is hereby accepted by the District. Until July 31, 2014. Administrator shall be on paid leave. 2. In consideration of the promises and covenants in this Agreement, the District shall pay Administrator the lump sum of seventy-five thousand and no/100 dollars ($75,000.00). subject to withholding for taxes, social security and Medicare, no later than August 29, 2014. 3. The District agrees that it solicited Administrator's resignation and that said resignation was not voluntary within the meaning of Wis, Stat. sec. 108.04(7). The District shall not oppose Administrator's claim for unemployment benefits. The parties agree that Administrator's resignation was not related to misconduct connected with his employment within the meaning of Wis. Stat. sec. 108.04(5). The District agrees not to contest any claim by Administrator for unemployment insurance benefits subsequent to July 31, 2014. Noone has believed this shit was going on when they heard about It. I do think you thought there was something to ft. But | have lived with this for years and finally the proof is here. At a time when the school needs to come together we stili have a few that are trying to cut throats, think no matter who moves in to the admin position the cancer will win until it is removed. This Is very serious and | have talked to someone that greg has told that all the bullshit that has come down from the district office Is what made his decision final.
