The question ask to give definition of land and explain the English maxim of Quic

quid plantatur solo solo cedit in establishing whether such property or goods are
fixture or chattel.
The definition of land is given in Section 5 of National Land Code (NLC). The section
stated that land include (a) the surface of earth for example grass, trees, rock and
hill, (b) the earth below the surface foe example clay, rock mineral, mineral water
and iron ore, (c) all vegetation and all natural product on or below surface likes
example fruit trees, potatoes, carrot and wild mushrooms, (d) all things attached to
the earth or all things permanently fastened to anything attached to the earth
whether on or below the surface likes example road, swimming pool, cabinet, and
air conditioner unit, (e) land covered by water for example lake, pond and river.
The maxim quic quid plantatur solo solo cedit is the Latin phrase which is means
whatever is affixed to the soil, belongs to the soil. In our NLC, the maxim is provided
in paragraph (d). it is also provided in the case of Holland vs Hodgson, states that all
things attached to the land are fixtures, thus shall from the part of the land.
However the NLC does not defined what is the fixture and chattel. So we will follow
English Law of fixture.
In determine an item is a chattle or fixture, we have to carry out two tests. First,
degree of annexation test. To what extent an item is attached to the land. If it is
affixed with bolts and nuts, it is fixture but if to what extent the item will be damage
if we removed it from the floor or wall. If removing the item cause the damaged to
the item it is a fixture. The second test is purpose of annexation test. If the
purposed we have the items is to enhanced, the value of the land it is a fixture. But
if the purpose that have the item it just enjoy the beauty or comfort the item, it is a
chattel. For example the painting on the wall is the chattle because we hang it on
the wall just enjoy the beauty of the painting.
In conclusion the maxim quic quid plantatur solo solo cedit is applicable in Malaysia.
