ISLAMIC JURISPRUDENCE

Literal meaning:
It is the understanding or knowledge

Imam Abu Hanifa:


It is the knowledge of what is for man self and what is against a man
self

Imam Shafi:
Fiqa is the knowledge of sharia

Imam Malik:
It is the science of command of sharia

Characteristics of Islamic jurisprudence:


So far as the characteristic are concern it means the essentials of
Islamic fiq that which is

important and mandatory, those are as under

Complete law
Quran & Sunnah
Universality
Flexible
Forever

1. Complete law:
The Quran is the complete code of conduct and the God Almighty said to
hold the rope of
Allah if you want to succeed the law. The Prophet (PBUH) explained and
said during the last
Serum that today the Quran is completed, religion is completed and
everything has been
transpired to the people

2. Quran & Sunnah:


The unification of Quran & sunnah is that Quran is the direct words of
Allah Almighty while the

sunnah is words of Prophet (PBUH).

3. Universality:
The holy book of Quran as well as the Islam is the complete code of
conduct and it is
Universal. Some time God says in the holy book of Quran that yhe, the
Muslim people and

some time says yhe, the people at large thus the Quran says that it is a
holy book as well as
the Islamic jurisprudence is the knowledge of universe. It is for the rest of
the world till the Day
of Judgment

4. Quran:
The Quran is basically procreated and revealed on the Prophet
Muhammad (PBUH) and
being as a student of law we can bifurcate it in the following stages. The
first stage relates
with the incidents of old people from Adam to Prophet Muhammad (PBUH).
The second stage
is the matter related to the companions, companions companion.
Similarly in Islamic
jurisprudence we must concise our selves the leader verses of Holy Quran.
The Quran and its
words neither abrogate nor amend or alter. The following Quranic verses
relates with the law

Law of succession
Law of marriage
Law of divorce
Hadud laws
Muslim law

Muslim family law ordinance:


Section 4:
In the event of the debt of any son or daughter before the opening
of succession the children of son or daughter shell Perl stripe receive a share
equallent to share which such son or daughter if alive.

Section 5:
Any marriage which is not documented there is no marriage and
penalty of 3 months (extended to 1 year) imprisonment or 5000 Rs.

Polygamy:
More than one marriage.

Section 6:
If a person wants 2nd marriage he should first get the permission of
1st wife and wives. If a person who fails to comply with this permission shall be
awarded for the punishment of 1 year as well as 5000 Rs fine or the both.

Section 7:
Any man who wishes to divorce his wife as soon as after the
pronouncement of Talak in any form what so ever gives the chairman notice in
writing of his having done so and shell supply a copy to the wife.
Any person who will not be doing so according to section 7 of Muslim family law
ordinance shall be imprisoned for 1 year or 5000 fine or with both.
If at the time of divorce the wife is pregnant I will be affective after the
procreation of baby.
That the union council shall recall the spouses for the reconciliation and if the
reconciliation is failed what so ever may be the union council shall issue the
notice of divorce.
