2232109.1.Boardofeducationspecificpowersanddutiessafeschoolplanconductanddiscipline
codesafeschoolreportingrequirementsschoolresponseframeworkschoolresourceofficers
definitions

(1)Definitions.Asusedinthissection,unlessthecontextotherwiserequires:

(a)"Actiontaken"meansaspecifictypeofdiscipline,includingbutnotlimitedtothefollowing
categoriesofdiscipline:

(I)Inschoolsuspension;

(II)Outofschoolsuspension;

(III)Classroomremovalinaccordancewithboardpolicy;

(IV)Expulsion;

(V)Referraltoalawenforcementagency;or

(VI)Anyotherformofdiscipline,whichshallbeofficiallyidentifiedaspartofaboard
policy.

(b)"Bullying"meansanywrittenorverbalexpression,orphysicalorelectronicactorgesture,or
apatternthereof,thatisintendedtocoerce,intimidate,orcauseanyphysical,mental,or
emotionalharmtoanystudent.Bullyingisprohibitedagainstanystudentforanyreason,
includingbutnotlimitedtoanysuchbehaviorthatisdirectedtowardastudentonthebasisof
hisorheracademicperformanceoragainstwhomfederalandstatelawsprohibitdiscrimination

uponanyofthebasesdescribedinsection2232109(1)(ll)(I).Thisdefinitionisnotintendedto
infringeuponanyrightguaranteedtoanypersonbythefirstamendmenttotheUnitedStates
constitutionortopreventtheexpressionofanyreligious,political,orphilosophicalviews.

(b.5)"Communitypartners"means,collectively,localfiredepartments,stateandlocallaw
enforcementagencies,local911agencies,interoperablecommunicationsproviders,the
safe2tellprogramdescribedinsection2431606,C.R.S.,localemergencymedicalservice
personnel,localmentalhealthorganizations,localpublichealthagencies,localemergency
managementpersonnel,localorregionalhomelandsecuritypersonnel,andschoolresource
officers.

(c)"Dangerousweapon"hasthesamemeaningassetforthinsection2233102(4).

(d)"Fulltimeteacher"meansapersonwhoislicensedpursuanttoarticle60.5ofthistitle,oris
authorizedpursuanttosection2260.5111toteach,andisprimarilyengagedinteachingduring
amajorityoftheinstructionalminutesperschoolday.

(e)"Habituallydisruptivestudent"hasthesamemeaningassetforthinsection2233106(1)
(c.5).

(f)

(I)"Referraltolawenforcement"meansacommunicationbetweenaschool
administrator,teacher,orotherschoolemployeeandalawenforcementagency,which
communication:

(A)Isinitiatedbytheschooladministrator,teacher,orotherschoolemployee;
and

(B)Concernsbehaviorbyastudentthattheschooladministrator,teacher,or
otherschoolemployeebelievesmayconstituteaviolationoftheschoolconduct
anddisciplinecodeoracriminalordelinquentoffenseandforwhichtheschool
administrator,teacher,orotherschoolemployeerequestsaninvestigationor
otherinvolvementbyalawenforcementagency.

(II)"Referraltolawenforcement"doesnotinclude:

(A)Contactwithalawenforcementagencythatismadeforthepurposeof
education,prevention,orinterventionregardingastudent'sbehavior;or

(B)Routineorincidentalcommunicationbetweenaschooladministrator,
teacher,orotherschoolemployeeandalawenforcementofficer.

(g)"Restorativejustice"hasthesamemeaningassetforthinsection2232144(3).

(g.5)"Schoolresourceofficer"meansapeaceofficer,asdescribedinsection162.5101,C.R.S.,
whohasspecializedtraining,asdescribedinsection2431312,C.R.S.,toworkwithschoolstaff
andstudentsandwhoisassignedtoapublicschoolorcharterschoolforthepurposeofcreating
asafelearningenvironmentandrespondingtoallhazardthreatsthatmayimpacttheschool.

(h)"Schoolvehicle"shallhavethesamemeaningassetforthinsection421102(88.5),C.R.S.

(1.5)Missionstatement.Eachschooldistrictboardofeducationshalladoptamissionstatementforthe
schooldistrict,whichstatementshallincludemakingsafetyforallstudentsandstaffapriorityineach
publicschooloftheschooldistrict.

(2)Safeschoolplan.Inordertoprovidealearningenvironmentthatissafe,conducivetothelearning
process,andfreefromunnecessarydisruption,followingconsultationwiththeschooldistrict
accountabilitycommitteeandschoolaccountabilitycommittees,parents,teachers,administrators,
students,studentcouncilswhereavailable,and,whereappropriate,thecommunityatlarge,each
schooldistrictboardofeducationshalladoptandimplementasafeschoolplan,orreviewandrevise,as
necessaryinresponsetoanyrelevantdatacollectedbytheschooldistrict,anyexistingplansorpolicies
alreadyineffect.Inadditiontotheaforementionedparties,eachschooldistrictboardofeducation,in
adoptingandimplementingitssafeschoolplan,mayconsultwithvictimsadvocacyorganizations,school
psychologists,locallawenforcementagencies,andcommunitypartners.Theplan,ataminimum,shall
includethefollowing:

(a)Conductanddisciplinecode.

(I)Aconciselywrittenconductanddisciplinecodethatshallbeenforceduniformly,
fairly,andconsistentlyforallstudents.Copiesofthecodeshallbeprovidedtoeach
studentuponenrollmentattheelementary,middle,andhighschoollevelsandshallbe
postedorkeptonfileateachpublicschoolintheschooldistrict.Theschooldistrictshall
takereasonablemeasurestoensurethateachstudentofeachpublicschoolinthe
schooldistrictisfamiliarwiththecode.Thecodeshallinclude,butneednotbelimited
to:

(A)Generalpoliciesonstudentconduct,safety,andwelfare;

(B)Generalpoliciesandproceduresfordealingwithstudentswhocausea
disruptiononschoolgrounds,inaschoolvehicle,orataschoolactivityor
sanctionedevent,includingaspecificpolicyallowingateachertoremovea
disruptivestudentfromhisorherclassroom.Thepolicyshallstatethat,upon
thethirdsuchremovalfromateacher'sclass,theteachermayremovethe

disruptivestudentfromtheteacher'sclassfortheremainderofthetermofthe
class;exceptthatadisruptivestudentshallnotberemovedfromateacher's
classfortheremainderofthetermoftheclassunlesstheprincipalofthe
student'sschoolorhisorherdesigneehasdevelopedandimplementeda
behaviorplanforthestudent.Abehaviorplanmaybedevelopedafterthefirst
suchremovalfromclassandshallbedevelopedafterthesecondremovalfrom
class.Thegeneralpoliciesandproceduresshallincludeadueprocess
procedure,whichataminimumshallrequirethat,assoonaspossibleaftera
removal,theteacherortheschoolprincipalshallcontacttheparentorlegal
guardianofthestudenttorequesthisorherattendanceatastudentteacher
conferenceregardingtheremoval.Anypolicyorprocedureadoptedshall
complywithapplicablefederalandstatelaws,includingbutnotlimitedtolaws
regardingstudentswithdisabilities.

(C)Provisionsfortheinitiationofsuspensionorexpulsionproceedingsfor
studentswhoqualifyashabituallydisruptivestudents;

(D)Policiesandproceduresfortheuseofactsofreasonableandappropriate
physicalinterventionorforceindealingwithdisruptivestudents;exceptthatno
boardshalladoptadisciplinecodethatincludesprovisionsthatareinconflict
withthedefinitionofchildabuseinsection186401(1),C.R.S.,andsection19
1103(1),C.R.S.;

(E)Generalpoliciesandproceduresfordeterminingthecircumstancesunder
andthemannerinwhichdisciplinaryactions,includingsuspensionand
expulsion,shallbeimposedinaccordancewiththeprovisionsofsections2233
105and2233106;

(F)Aspecificpolicyconcerninggangrelatedactivitiesonschoolgrounds,in
schoolvehicles,andatschoolactivitiesorsanctionedevents;

(G)Writtenprohibition,consistentwithsection2233106,ofstudentsfrom
bringingorpossessingdangerousweapons,drugs,orothercontrolled
substancesonschoolgrounds,inaschoolvehicle,orataschoolactivityor
sanctionedeventandfromusingdrugsorothercontrolledsubstancesonschool
grounds,inaschoolvehicle,orataschoolactivityorsanctionedevent;

(H)Writtenprohibitionofstudentsfromusingorpossessingtobaccoproducts
onschoolgrounds,inaschoolvehicle,orataschoolactivityorsanctioned
event;

(I)Awrittenpolicyconcerningsearchesonschoolgrounds,includingsearchesof
studentlockers;

(J)Adresscodepolicythatprohibitsstudentsfromwearingapparelthatis
deemeddisruptivetotheclassroomenvironmentortothemaintenanceofa
safeandorderlyschool.Thedresscodepolicymayrequirestudentstoweara
schooluniformormayestablishminimumstandardsofdress;

(K)OnandafterAugust8,2001,aspecificpolicyconcerningbullyingprevention
andeducation.Eachschooldistrictisencouragedtoensurethatitspolicy,ata
minimum,incorporatesthebiennialadministrationofsurveysofstudents'
impressionsoftheseverityofbullyingintheirschools,asdescribedinsection
2293104(1)(c);characterbuilding;andthedesignationofateamofpersons
ateachschooloftheschooldistrictwhoadvisetheschooladministration
concerningtheseverityandfrequencyofbullyingincidentsthatoccurinthe
school,whichteammayinclude,butneednotbelimitedto,lawenforcement
officials,socialworkers,prosecutors,healthprofessionals,mentalhealth
professionals,schoolpsychologists,counselors,teachers,administrators,
parents,andstudents.Eachschooldistrict'spolicyshallsetforthappropriate
disciplinaryconsequencesforstudentswhobullyotherstudentsandforany
personwhotakesanyretaliatoryactionagainstastudentwhoreportsingood
faithanincidentofbullying,whichconsequencesshallcomplywithall
applicablestateandfederallaws.

(II)Increatingandenforcingaschoolconductanddisciplinecodepursuantto
subparagraph(I)ofthisparagraph(a),eachschooldistrictboardofeducation,onand
afterAugust1,2013,shall:

(A)Imposeproportionatedisciplinaryinterventionsandconsequences,including
butnotlimitedtoinschoolsuspensions,inresponsetostudentmisconduct,
whichinterventionsandconsequencesaredesignedtoreducethenumberof
expulsions,outofschoolsuspensions,andreferralstolawenforcement,except
forsuchreferralstolawenforcementasarerequiredbystateorfederallaw;

(B)Includeplansfortheappropriateuseofprevention,intervention,restorative
justice,peermediation,counseling,orotherapproachestoaddressstudent
misconduct,whichapproachesaredesignedtominimizestudentexposureto
thecriminalandjuvenilejusticesystem.Theplansshallstatethataschool
administrationshallnotorderavictim'sparticipationinarestorativejustice
practiceorpeermediationiftheallegedvictimofanoffendingstudent's
misconductallegesthatthemisconductconstitutesunlawfulsexualbehavior,as
definedinsection1622102(9),C.R.S.;acrimeinwhichtheunderlyingfactual

basisinvolvesdomesticviolence,asdefinedinsection186800.3(1),C.R.S.;
stalkingasdefinedinsection183602,C.R.S.;orviolationofaprotectionorder,
asdefinedinsection186803.5,C.R.S.;

(C)Ensurethattheimplementationofthecodecomplieswithallstateand
federallawsconcerningtheeducationofstudentswithdisabilities,asdefinedin
section2220103(5);and

(D)Ensurethat,inimplementingthecode,eachschooloftheschooldistrict
showsdueconsiderationoftheimpactofcertainviolationsofthecodeupon
victimsofsuchviolations,inaccordancewiththeprovisionsoftitleIXofthe
UnitedStatesCodeandotherstateandfederallaws.

(b)Safeschoolreportingrequirements.Apolicywherebytheprincipalofeachpublicschoolina
schooldistrictshallsubmitannually,inamannerandbyadatespecifiedbyruleofthestate
board,awrittenreporttotheboardofeducationofsuchschooldistrictconcerningthelearning
environmentintheschoolduringthatschoolyear.Theboardofeducationoftheschooldistrict
annuallyshallcompilethereportsfromeveryschoolinthedistrictandshallsubmitthe
compiledreporttothedepartmentofeducationinaformatspecifiedbyruleofthestateboard.
Thecompiledreportshallbemadeavailabletothegeneralpublic.Suchreportshallinclude,but
neednotbelimitedto,thefollowingspecificinformationfortheprecedingschoolyear:

(I)Thetotalenrollmentfortheschool;

(II)Theaveragedailyattendancerateattheschool;

(III)Dropoutratesforgradesseventhroughtwelve,ifsuchgradesaretaughtatthe
school;

(IV)Thenumberofconductanddisciplinecodeviolations,eachofwhichviolationsshall
bereportedonlyinthemostseriouscategorythatisapplicabletothatviolation,
includingbutnotlimitedtospecificinformationidentifyingthenumberof,andthe
actiontakenwithrespectto,eachofthefollowingtypesofviolations:

(A)Possessingadangerousweapononschoolgrounds,inaschoolvehicle,orat
aschoolactivityorsanctionedeventwithouttheauthorizationoftheschoolor
theschooldistrict;

(B)Useorpossessionofalcoholonschoolgrounds,inaschoolvehicle,orata
schoolactivityorsanctionedevent;

(C)Use,possession,orsaleofadrugorcontrolledsubstanceonschoolgrounds,
inaschoolvehicle,orataschoolactivityorsanctionedevent;

(D)Useorpossessionofatobaccoproductonschoolgrounds,inaschool
vehicle,orataschoolactivityorsanctionedevent;

(E)Beingwillfullydisobedientoropenlyandpersistentlydefiantorrepeatedly
interferingwiththeschool'sabilitytoprovideeducationalopportunitiesto,and
asafeenvironmentfor,otherstudents;

(F)Commissionofanactonschoolgrounds,inaschoolvehicle,orataschool
activityorsanctionedeventthat,ifcommittedbyanadult,wouldbeconsidered
firstdegreeassault,asdescribedinsection183202,C.R.S.,seconddegree
assault,asdescribedinsection183203,C.R.S.,orvehicularassault,as
describedinsection183205,C.R.S.;

(G)Behavioronschoolgrounds,inaschoolvehicle,orataschoolactivityor
sanctionedeventthatisdetrimentaltothewelfareorsafetyofotherstudents
orofschoolpersonnel,includingbutnotlimitedtoincidentsofbullyingand
otherbehaviorthatcreatesathreatofphysicalharmtothestudentortoother
students;

(H)Willfuldestructionordefacementofschoolproperty;

(I)Commissionofanactonschoolgrounds,inaschoolvehicle,orataschool
activityorsanctionedeventthat,ifcommittedbyanadult,wouldbeconsidered
thirddegreeassault,asdescribedinsection183204,C.R.S.,ordisorderly
conduct,asdescribedinsection189106(1)(d),C.R.S.,butnotdisorderly
conductinvolvingfirearmsorotherdeadlyweapons,asdescribedinsection18
9106(1)(e)and(1)(f),C.R.S.;

(J)Commissionofanactonschoolgrounds,inaschoolvehicle,orataschool
activityorsanctionedeventthat,ifcommittedbyanadult,wouldbeconsidered
robbery;and

(K)Otherviolationsofthecodeofconductanddisciplinethatresultedin
documentationoftheconductinastudent'srecord;

(V)and(VI)(Deletedbyamendment,L.2012.)

(VII)Theaverageclasssizeforeachpublicelementaryschool,middleschoolorjunior
highschool,andseniorhighschoolinthestatecalculatedasthetotalnumberof

studentsenrolledintheschooldividedbythenumberoffulltimeteachersinthe
school;and

(VIII)Theschool'spolicyconcerningbullyingpreventionandeducation,including
informationrelatedtothedevelopmentandimplementationofanybullyingprevention
programs.

(c)Internetsafetyplan.

(I)Eachschooldistrictisencouragedtoprovideacomprehensive,ageappropriate
curriculumthatteachessafetyinworkingandinteractingontheinternetingrades
kindergartenthroughtwelve.Ataminimum,thecurriculummayaddressthefollowing
topics:

(A)Interactionwithpersonsinthecybercommunity;

(B)Personalsafetyininteractingwithpersonsontheinternet;

(C)Recognitionandavoidanceofonlinebullying;

(D)Technology,computervirusissues,andwaystoavoidcomputervirus
infection;

(E)Predatoridentification;

(F)Intellectualproperty,includingeducationconcerningplagiarismand
techniquestoavoidcommittingplagiarismandlawsconcerningdownloadingof
copyrightedmaterialsincludingmusic;

(G)Privacyandtheinternet;

(H)Onlineliteracy,includinginstructioninhowtoidentifycredible,factual,
trustworthywebsites;and

(I)Homelandsecurityissuesrelatedtointernetuse.

(II)Eachschooldistrictisencouragedtostructuretheinternetsafetyplansoasto
incorporatetheinternetsafetytopicsintotheteachingoftheregularclassroom
curricula,ratherthanisolatingthetopicsasaseparateclass.Eachschooldistrictis
encouragedtouseavailableinternetsafetycurricularesources,includingbutnotlimited
tomaterialsavailablethroughnonprofitinternetsafetyfoundationsthatareendorsed
bythefederalgovernment.Eachschooldistrictisalsoencouragedtoworkwiththelocal

lawenforcementagenciesforthejurisdictioninwhichtheschooldistrictislocatedin
developingtheinternetsafetycurricula,especiallywithregardtotopicsthataddress
personalsafetyontheinternet,internetpredatoridentification,privacyissues,and
homelandsecurityissues.Eachschooldistrictisalsoencouragedtocollaboratewith
parentsandteachersindevelopingtheinternetsafetycurricula,includingcollaborating
withdistrictandstatewideorganizationsthatrepresentparentsandteachers.

(III)Eachschooldistrictisencouragedtobeginimplementingtheinternetsafetyplan
withthe200506schoolyearandtoannuallyreviewand,asnecessary,revisetheplan.
Eachschooldistrictisencouragedtoidentifyapersonwhoisresponsibleforoverseeing
implementationoftheinternetsafetyplanwithineachpublicschooloftheschool
districttoensurethateachpublicschoolcomplieswiththerequirementsoftheplan.

(IV)Ifaschooldistrictchoosestoadoptaninternetsafetyplanandtoidentifyaperson
whoisresponsibleforoverseeingimplementationoftheplan,thepersonisencouraged
toannuallysubmitaninternetsafetyplanimplementationreporttotheschooldistrict
boardofeducationspecifyingthelevelofimplementationachievedbyeachpublic
schooloftheschooldistrictandprovidinganoverviewoftheinternetsafetycurricula
adoptedandimplementedineachpublicschooloftheschooldistrict.Theschooldistrict
boardofeducationofeachschooldistrictthatchoosestoadoptaninternetsafetyplan
isencouragedtosubmittothedepartmentofeducationanannualreportsummarizing
theinternetsafetyplanimplementationreportandisencouragedtomaketheannual
summaryreportavailableontheschooldistrictwebsite.

(3)Agreementswithstateagencies.Eachboardofeducationshallcooperateand,totheextentpossible,
developwrittenagreementswithlawenforcementofficials,thejuvenilejusticesystem,andsocial
services,asallowedunderstateandfederallaw,tokeepeachschoolenvironmentsafe.Eachboardof
educationshalladoptapolicywherebyprocedureswillbeusedfollowinginstancesofassaultupon,
disorderlyconducttoward,harassmentof,themakingknowinglyofafalseallegationofchildabuse
against,oranyallegedoffenseunderthe"ColoradoCriminalCode"directedtowardaschoolteacheror
schoolemployeeorinstancesofdamageoccurringonthepremisestothepersonalpropertyofaschool
teacherorschoolemployeebyastudent.Suchproceduresshallinclude,ataminimum,thefollowing
provisions:

(a)Suchschoolteacherorschoolemployeeshallfileacomplaintwiththeschooladministration
andtheboardofeducation.

(b)Theschooladministrationshall,afterreceiptofsuchreportandproofdeemedadequateto
theschooladministration,suspendthestudentforthreedays,suchsuspensiontobein
accordancewiththeproceduresestablishedtherefor,andshallinitiateproceduresforthe
furthersuspensionorexpulsionofthestudentwhereinjuryorpropertydamagehasoccurred.

(c)Theschooladministrationshallreporttheincidenttothedistrictattorneyortheappropriate
locallawenforcementagencyorofficer,whoshall,uponreceivingsuchreport,investigatethe
incidenttodeterminetheappropriatenessoffilingcriminalchargesorinitiatingdelinquency
proceedings.

(4)Schoolresponseframeworkschoolsafety,readiness,andincidentmanagementplan.Eachboardof
educationshallestablishaschoolresponseframeworkthatshallconsistofpoliciesdescribedinthis
subsection(4).Bysatisfyingtherequirementsofthissubsection(4),aschoolorschooldistrictshallbein
compliancewiththenationalincidentmanagementsystem,referredtointhissubsection(4)as"NIMS",
developedbythefederalemergencymanagementagency.Ataminimum,thepoliciesshallrequire:

(a)

(I)Eachschooldistrict,onorbeforeJuly1,2009,toestablishadatebywhicheach
schooloftheschooldistrictshallbeincompliancewiththerequirementsofthis
subsection(4);exceptthatthedatemaybechangedbytheschoolboardforcause.

(II)Eachschooldistrictshallmakethedatesestablishedpursuanttosubparagraph(I)of
thisparagraph(a)availabletothepublicuponrequest.

(b)Eachschooldistricttoadoptthenationalresponseframeworkreleasedbythefederal
departmentofhomelandsecurityandNIMSformallythroughordersorresolutions;

(c)Eachschooldistricttoinstitutionalizetheincidentcommandsystemastaughtbythe
emergencymanagementinstituteofthefederalemergencymanagementagency;

(d)Eachschooldistrict,onorbeforeJuly1,2009,tostarttodevelopaschoolsafety,readiness,
andincidentmanagementplan,including,totheextentpossible,emergencycommunications,
thatcoordinateswithanystatewideorlocalemergencyoperationplans.Indevelopingtheplan,
aschooldistrictmaycollaboratewithcommunitypartners.Theschoolsafety,readiness,and
incidentmanagementplanshall,ataminimum,identifyforeachpublicschoolintheschool
district:

(I)Safetyteamsandbackupswhoareresponsibleforinteractingwithcommunity
partnersandassumingkeyincidentcommandpositions;and

(II)Potentiallocationsforvarioustypesofoperationallocationsandsupportfunctions
orfacilities;

(e)Totheextentpossible,eachschooldistricttoenterintomemorandaofunderstandingwith
thecommunitypartnersspecifyingresponsibilitiesforrespondingtoincidents;

(f)Totheextentpossible,eachpublicschooltocreateanallhazardexerciseprogrambasedon
NIMSandtoconducttabletopexercisesandotherexercisesincollaborationwithcommunity
partnersfrommultipledisciplinesand,ifpossible,multiplejurisdictionstopracticeandassess
preparednessandcommunicationsinteroperabilitywithcommunitypartners;

(g)Totheextentpossible,eachpublicschool,incollaborationwithitsschooldistrict,tohold
coordinatedexercisesamongschoolemployeesandcommunitypartners,includingata
minimum:

(I)Orientationmeetingstoinformallpartiesaboutemergencyoperationplansand
procedures;

(II)Allhazarddrills,inadditiontofiredrills,toimproveindividualandstudent
emergencyproceduresandtotestcommunicationsinteroperability;and

(III)Tabletopexercisestodiscussandidentifyrolesandresponsibilitiesindifferent
scenarios;

(h)Eachpublicschooltoconductawrittenevaluationfollowingtheexercisesandcertain
incidentsasidentifiedbytheschoolorschooldistrictandidentifyandaddresslessonslearned
andcorrectiveactionsinupdatingresponseplansandprocedures;

(i)Eachpublicschool,atleasteveryacademicterm,toinventoryemergencyequipmentandtest
communicationsequipmentanditsinteroperabilitywithaffectedstateandlocalagencies;

(j)Eachschooldistricttoadoptwrittenproceduresfortakingactionandcommunicatingwith
locallawenforcementagencies,communityemergencyservices,parents,students,andthe
mediaintheeventofcertainincidentsasidentifiedbytheschoolorschooldistrict;

(k)Keyemergencyschoolpersonnel,includingbutnotlimitedtosafetyteamsandbackups,to
completecoursesprovidedbythefederalemergencymanagementagency'semergency
managementinstituteorbyinstitutionsofhighereducationinthestatesystemofcommunity
andtechnicalcolleges;

(l)Schooldistrictemployeesafetyandincidentmanagementtraining,includingprovisions
statingthatcompletionofanycoursesidentifiedbythedepartmentofpublicsafetypursuantto
section2433.51606.5(3),C.R.S.,asrelatedtoNIMScounttowardtheprofessional
developmentrequirementsofapersonlicensedpursuanttoarticle60.5ofthistitle;

(m)Eachschooldistricttoworkwithcommunitypartnerstoupdateandreviseallstandard
operatingprocedures,ensuringthatallaspectsofNIMSareincorporated,includingbutnot

limitedtopoliciesandprinciples,planning,procedures,training,response,exercises,
equipment,evaluation,andcorrectiveactions;

(n)Eachschooldistricttocoordinatewithcommunitypartnerstoassessoverallalignmentand
compliancewithNIMS;identifyrequirementsalreadymet;establishabaselineforNIMS
compliance;anddetermineactionsteps,includingdevelopingaplanandtimeline,toachieve
andmaintainallNIMSgoals;

(o)Eachschooldistricttodevelopatimelineandstrategyforcompliancewiththerequirements
ofthissubsection(4)andtostrategicallyplan,schedule,andconductallactivitieswith
communitypartners;and

(p)Schoolresourceofficerstobefamiliarwiththeschoolresponseframeworkoutlinedinthis
subsection(4),theallhazardexerciseprogram,andtheinteroperablecommunicationsofthe
schooltowhichheorsheisassigned.

(5)Safetyandsecuritypolicy.Eachboardofeducationshalladoptapolicyrequiringannualschool
buildinginspectionstoaddresstheremovalofhazardsandvandalismandanyotherbarrierstosafety
andsupervision.

(6)Sharinginformation.Notwithstandinganyprovisiontothecontraryintitle24,C.R.S.,eachboardof
educationshallestablishpoliciesconsistentwithsection2472204(3),C.R.S.,andwithapplicable
provisionsofthefederal"FamilyEducationRightsandPrivacyActof1974"(FERPA),20U.S.C.sec.
1232g,andallfederalregulationsandapplicableguidelinesadoptedthereto,toshareandrelease
informationdirectlyrelatedtoastudentandmaintainedbyapublicschoolorbyapersonactingforthe
publicschoolintheinterestofmakingschoolssafer.Sharingofinformationconcerninganoutofhome
placementstudentwhoisbeingtransferredtoapublicschoolshallcomplywiththerulesestablishedby
thestateboardpursuanttosection222139(9).

(7)Openschoolpolicy.Eachboardofeducationshalladoptanopenschoolpolicytoallowparentsand
membersoftheschooldistrictboardofeducationreasonableaccesstoobserveclasses,activities,and
functionsatapublicschooluponreasonablenoticetotheschooladministrator'soffice.

(8)Employeescreenings.Eachboardofeducationshalladoptapolicyofmakinginquiriesupongood
causetothedepartmentofeducationforthepurposesofscreeninglicensedemployeesand
nonlicensedemployeeshiredonorafterJanuary1,1991.Licensedemployeesemployedbyschool
districtsonorafterJanuary1,1991,shallbescreenedupongoodcausetocheckforanynewinstances
ofcriminalactivitylistedinsection2232109.9(1)(a).Nonlicensedemployeesemployedbyaschool
districtonorafterJanuary1,1991,shallbescreenedupongoodcausetocheckforanynewinstancesof
criminalactivitylistedinsection2232109.8(2)(a).

(9)Immunity.

(a)Aschooldistrictboardofeducationorateacheroranyotherpersonactingingoodfaithin
accordancewiththeprovisionsofsubsection(2)ofthissectionincarryingoutthepowersor
dutiesauthorizedbysaidsubsectionshallbeimmunefromcriminalprosecutionorcivilliability
forsuchactions;exceptthatateacheroranyotherpersonactingwillfullyorwantonlyin
violationofsaidsubsectionshallnotbeimmunefromcriminalprosecutionorcivilliability
pursuanttosaidsubsection.Ateacheroranyotherpersonclaimingimmunityfromcriminal
prosecutionunderthisparagraph(a)mayfileamotionthatshallbeheardpriortotrial.Atthe
hearing,theteacherorotherpersonclaimingimmunityshallbeartheburdenofestablishingthe
righttoimmunitybyapreponderanceoftheevidence.

(b)Ateacheroranyotherpersonactingingoodfaithandincompliancewiththeconductand
disciplinecodeadoptedbytheboardofeducationpursuanttoparagraph(a)ofsubsection(2)of
thissectionshallbeimmunefromcivilliability;exceptthatapersonactingwillfullyand
wantonlyshallnotbeimmunefromliabilitypursuanttothisparagraph(b).Thecourtshall
dismissanycivilactionresultingfromactionstakenbyateacheroranyotherpersonpursuant
totheconductanddisciplinecodeadoptedbytheboardofeducationpursuanttoparagraph(a)
ofsubsection(2)ofthissectionuponafindingbythecourtthatthepersonactedingoodfaith
andincompliancewithsuchconductanddisciplinecodeandwasthereforeimmunefromcivil
liabilitypursuanttoparagraph(a)ofthissubsection(9).Thecourtshallawardcourtcostsand
reasonableattorneyfeestotheprevailingpartyinsuchacivilaction.

(c)Ifateacheroranyotherpersondoesnotclaimorisnotgrantedimmunityfromcriminal
prosecutionpursuanttoparagraph(a)ofthissubsection(9)andacriminalactionisbrought
againstateacheroranyotherpersonforactionstakenpursuanttotheconductanddiscipline
codeadoptedbytheboardofeducationpursuanttoparagraph(a)ofsubsection(2)ofthis
section,itshallbeanaffirmativedefenseinthecriminalactionthattheteacherorsuchother
personwasactingingoodfaithandincompliancewiththeconductanddisciplinecodeandwas
notactinginawillfulorwantonmannerinviolationoftheconductanddisciplinecode.

(d)Anactofateacheroranyotherpersonshallnotbeconsideredchildabusepursuantto
sections186401(1)and191103(1),C.R.S.,if:

(I)Theactwasperformedingoodfaithandincompliancewiththeconductand
disciplinecodeadoptedbytheboardofeducationpursuanttoparagraph(a)of
subsection(2)ofthissection;or

(II)Theactwasanappropriateexpressionofaffectionoremotionalsupport,as
determinedbytheboardofeducation.

(e)Ateacheroranyotherpersonwhoactsingoodfaithandincompliancewiththeconductand
disciplinecodeadoptedbytheboardofeducationpursuanttoparagraph(a)ofsubsection(2)of
thissectionshallnothavehisorhercontractnonrenewedorbesubjecttoanydisciplinary
proceedings,includingdismissal,asaresultofsuchlawfulactions,norshalltheactionsofthe
teacherorotherpersonbereflectedinanywrittenevaluationorotherpersonnelrecord
concerningsuchteacherorotherperson.Ateacheroranyotherpersonaggrievedbyanalleged
violationofthisparagraph(e)mayfileacivilactionintheappropriatedistrictcourtwithintwo
yearsaftertheallegedviolation.

(10)Compliancewithsafeschoolreportingrequirements.Ifthestateboarddeterminesthataschool
districtoroneormoreofthepublicschoolsinaschooldistrictisinwillfulnoncompliancewiththe
provisionsofparagraph(b)ofsubsection(2)ofthissection,thestate'sshareoftheschooldistrict'stotal
program,asdeterminedpursuanttoarticle54ofthistitle,maybesubjecttoforfeitureuntiltheschool
districtandeachschoolinthedistrictattainscompliancewiththeprovisionsofparagraph(b)of
subsection(2)ofthissection.
