The family has made attempts to file a complaint with the Mount Vernon Police Department regarding the incident but have been unable to get any answers or assistance. | have stated on record many times that | am deeply disturbed and troubled with the conflict of interest surrounding Deputy Police Commissioner Joseph Spiezio and his ability to use his influence to enrich himself through R&S Waste Services, Inc., a carting company that is licensed to operate in the City of Mount Vernon Earlier in the year | voiced my concern in reference to violations issued to R&S Waste Services, Inc. for illegally storing their dumpsters in the city. The matter was scheduled for a hearing in the Mount Vernon City Court; however, the violations were dismissed by Corporation Counsel Lawrence A. Porcari. When | questioned Mr. Porcari about his decision, he stated to me that he received a call from Mr. Spiezio. Mr. Porcari's decision to dismiss the violations not only allows R&S Waste Services, Inc. to continue to violate the City Code, his decision also denies Mount Vernon's taxpayers thousands of dollars in fines that should have been paid. For your information, the dumpsters have been placed back in the yard and the abuse of power continues. Section 24- 3A (3) of the City Code states, "No employee or officer shall: ...invest or hold any investment directly or indirectly in any financial, business, commercial or other private transaction which creates a conflict with his official duties" (emphasis added).Deputy Commissioner Fatigate December 22, 2016 Re: Hit and Run Complaint Against R&S Waste Services Page 2 For the reasons stated above and as chair of Legislation and Public Works, | am requesting that the private carting license issued to R&S Waste Services, Inc. to cart refuse in the City of Mount Vernon be revoked effective immediately pending an investigation.
