Liquor License Probable Cause Complaint Hearing.


High 5, Tavern Liquor License

I.

REQUEST OR ISSUE:
To review the attached written complaint of one alleged violation by High 5 for
service to a habitual drunkard, or to a visibly intoxicated person.

II.

RECOMMENDED ACTION:
Based upon the attached written complaint, staff recommends that the Steamboat
Springs Liquor Licensing Authority Hearing Officer find probable cause that the
Licensee has violated a provision of the Liquor and Beer Code, and set the matter
to a Show Cause Hearing on January 12, 2017.

The City Clerks Office submits, for consideration by the Steamboat Springs Liquor
Licensing Authority, the attached Alcohol-related Incident Summary.
Alleged Violations:
One count of Section 12-47-901(5)(a)(I), C.R.S., service to a habitual drunkard, or to a
visibly intoxicated person on or about September 4, 2016.
Other Issues and Considerations:
This establishment has a Tavern liquor license. Therefore, all alcohol servers/sellers
of alcoholic beverages should be alcohol server trained. At this time, it is not clear
whether the employee involved in the violation was trained.
Decision Options:
1) Request additional information on the allegation; or
2) Provide staff with some other direction on the alleged violation; or
3) Support staffs recommendation and set a Show Cause Hearing date.
City Clerks Recommended Action:
Proceed with Steamboat Springs Liquor Licensing Authority Revocation or
Suspension Hearing (also known as a Show-Cause Hearing).

NOTE: All documents distributed at the City Council meeting are on file in the
Office of the City Clerk.
ROLL CALL
Compliance Officer Moylan called the meeting to order at 11:05am.
LIQUOR LICENSE SHOW CAUSE HEARING
The following establishment has one alleged violation.
1.

La Mex Mexican Grill, Inc.; dba The Pit on 5th BBQ, Hotel & Restaurant
Liquor License.

Mr. Moylan read the license violation into the record.


Mr. Edgar Navarro, owner/manager, was present and sworn in.
Ms. Bock stated that there is a signed settlement for a seven day suspension, five
days held in abeyance, and two served September 24-25, 2016. Staff supports a fine
in lieu and Navarro has agreed to that as well.
Mr. Navarro reiterated that he agrees with the agreement. Ms. Bock spoke to how the
City calculates the fine, which is a percentage of the receipts from those days.
Mr. Moylan accepted the settlement.

meeting.
