Be it enacted by the Sangguniang Bayan of Binmaley in session assembled, THAT: Section 4. Certain Seetions af Ordinance No. 8, $-1993 otherwise known as the Binmaley Revenue Code of 1993 as amended by Ordinance No.3, Series of 1998, are iereby further amended, to wit: Section 5AJ.02 of Municipal Ordinance No. 8, $1993 as amended shail further be amended and further include the following; as the case may be: 2. The Pangasinan Fish Center. - It not being covered by the zonification, except during big market days (MONDAYS), is hercby declared to be cleared of any business operation until the Sangguniang Bayan shall have determined its fruitful economic purpose for the good of the public, aside from eradicating the worsening garbage disposal and sanitation problems around its peripheries. For this purpose, the Pangasinan Fish Center shall not in anyway be used as parking area or garage of any vehicle, sleeping quarters, unloading station of any articles of commerce or market goods or depository of stands (dalagan, estante) and containers which are used by vendors during big market days (MONDAYS). 18. Strict Adherence to the Market Zonification, -It shall be the duty of all market vendors and stall holders to strietly adhere to and comply with to the Market Zonification as determined by the Sangguniang Bayan, Any violation thereto shall result in the closure of the business establishment. 19. Sectioning and Numbering of Stalls. - In consonance with the provisions of this ordinance, ‘the Municipal Treasurer shall make the corresponding numbering of the different market stalls and their respective Sections as zonified under this Ordinance, which will be in uniform sizes and colors, and be painted immediately beneath the business name of the stall owner, in the following manner: Letters and numbers shall be five (5) inches in height and in red color with a white back- ground.” Section 5AJ.03, a), 2. of Ordinance No.3, Series of 1998 is hereby amended to be read as, follows: #20. On occupation of market premises, not occupying stalls/booths/stands per day or fraction thereof, per sq, m. which is applicable only during big market days (MONDAYS) covered P 10,00 open 5,00" Section 5AJ.03, b. of Ordinance No.3, Series of 1998, is hereby further amended to be read as, follows “B, Market Entrance Fee and/or Occupancy of Market Premises during big market days (MONDAYS). - There is hereby imposed market entrance fee in lieu of the regular market fee based ‘on space occupied by all ambulant, transient or itinerant vendors of any commodity or merchandise being brought into the public market for sale on the basis of weight, bundle, sack, can, kaing, crate, cartload and jeep load or any convenient unit of measure.” Section 5AJ.04 of Ordinance No. 3, Series of 1998 entitled INSPECTION AND VERIFICA- TIONFEES fromthe Office of Licensing Officer with al its paragraph contents shall be crossed- out, and in its place, shall be susbtituted the following: gection SAI.04 Market Committes. - There is hereby created a permanent Market Comriit- tee composed of the Municipal Mayor as Chairman; Municipal Vice Mayor as ‘Vice-Chairman; Mu- nicipal Market Supervisor; Municipal Treasurer or his representative; Chairman, Committee on Trade and Industry, ofthe Sangguniang Bayan; two (2) representatives ofthe duly recognized market vendor's aoviation and two (2) representatives from the buying public to be appointed by the ‘Municipal Mayor, as members, respectively, whose duties and functions are - (a) To conduct the drawing of ots and opening of bids for the adjudication of vacant or newly constructed stalls or booths in the public market; (b) Tomake a study of the transfer of stallholders from one section to another or from one stall to another, (@) To make a study of all phases on market matters and to submit, comment on, and recommend such study to the Sangguniang Bayan; and, (a) Torecomrend changes, modifications or amendments in the zoning ordinance vis-a-vis the Binmaley Public Market, for approval by the Sangguniang Bayan. Application - No person or partnership shall be permitted to engage in any form of business in the market without first securing an application from the Municipal Treasurer oF his duly authorized representative and having said application duly approved by the same; provided that the lease award granted to stallholders shall constitute a permit or privilege to do business and the basis of collection of the fees as herein provided. Filipino citizens and residents of Binmaley shall be given preference in the award of market stalls, Al applications for the award of stalls shal be fled at the Office of the Municipal Tresurer in a prescribed form and in triplicate copies. ‘The application shall be signed by the applicant in person or by his/her attomney-inefact, with three copies of his/her picture, each to be pasted on the application if the same is approved. ‘The Market Supervisor shall acknowledge receipt of the duplicate copy and keep a record book for such purpose. The triplicate copy shall be retained by the applicant. Contents of the Contract of Lease: ‘The contract of lease between the Municipality as represented by its Municipal Mayor and the stallholder shall be prepared in quadruplicate copies and shall be worded as follows: CONTRACT OF LEASE, KNOW ALL MEN BY THESE PRESENTS: ‘The Municipality of Binmaley, Province of Pangasinan, Philippines, 4 public corporation duly organized and existing under the laws of the Republic of the Philippines herein represented by the Municipal Mayor of Binmaley, ROLANDO D. DOMALANTA, hereinafter called the LESSOR, and , of legal age, Filipino and with postal address at __ hereinafter called the LESSEE. w ‘That the LESSOR lets and leases unto the LESSEE and the latter hereby agrees and accepts to ease a stall located at the Public Market Binmaley, in the Section of __ intended for the sale of ___ under the following terms and conditions: 1. That the term of the lease is for a period of Five (5) years from 2001, but may be renewed upon mutual agreement of the parties under such terms and conditions that they may agree upon, However, this contract may be terminated by either party by giving a written notice of termination, at least thirty (30) days in advance; 10, u 12. ‘That no building structure, stall, booth, or improvements of any nature shall be into, rane thin the lease premises without the written prior consent ofthe LESSOR and saree the same is in accordance with the kind and specifications approved by the Municipal Ordinance. Further, it shall not be used as dwelt place or sleeping quarters by of the LESSEE or histher employees, guests customers; ‘That the LESSEE shall not directly or indirectly sublease, assign, tansfer or conv hishher rights of lease over the stall under ease or any portion thereof without the pri ‘written consent of the LESSOR; “That the LESSOR reserves the right to change the amount of rentals over the sta under the Lease Contract. But in no case shall the same be changed more than oncs year, ‘Any damage or injury on the stall herein leased due to the fault ofthe LESSEE or t ther helpers and/or other third persons who may have gained aocess to the leased sti shall be repaired promptly at the expense of the LESSEE under the supervision of LESSOR and that the LESSOR shall not be held responsible for any loss or dame which the LESSEE may sustain in the premises during the repair, “The LESSEE shall comply with all the conditions, sanitary rules and regulations wh have been or may hereunder be promulgated by duly constituted authorities and me tain the leased stall and its premises in a clean and sanitary condition and dispose of fubbish or trash thereat only thru the means and places indicated by the LESSOR or duly authorized representatives; ‘That any violation direct or indirect, on any of the conditions of this contract ané any existing rule, law, regulations or ordinance promulgated by duly constituted thotities shall automatically terminate this Contract of Lease Crom the time s vilation occurs without prejudice to the imposition of the fines and/or penalties Vided for under such rule, law, regulation or ordinance so violated and the LESS may re-let the premises without notice to the LESSEE upon the latter's disqualil tion; “The LESSEE shall pay and defray ail the expenses of his/her consumption of ele current and such other utility services that may be connected to the lease stalls, an ‘she shall likewise bear the expenses for the repair of such facilities; be i 13, The LESSEE shall not claim any loss or damage on account of ordinary repairs that the LESSOR may order to be done on the building that may interrupt the use of the leased stall; 14, ‘The LESSEE shall be responsible tall times for acts done by his/her employees, agents, ‘guests of other persons entering the leased stall; eB) 15, ‘The LESSOR shall not be responsible for any loss or damage which tae LESSEE may | sustain on the leased stall due to any fortuitous event or foree majeure, 16. Upon termination or expiration ofthis contract, the LESSEE shall promptly surrender to the LESSOR the leased stall, Failure to surrender the same, said LESSEE shall be responsible to the LESSOR for all damages that they might occur by reason of said failure and/or refusal; 17. Upon expiration or earlier termination of this Contract, the LESSOR hereby authorizes the LESSEE to remove from the stall, improvements of any nature introduced by the ‘LESSEE on the leased premises if such could not produce any damage to the property, and to deposit all personal belongings of said LESSEE in a Bodega where the latter shall bear all costs of transfer and storage; 18. The LESSOR andior his/her duly authorized representative shall have the right to enter and inspect the leased stall at any reasonable time ‘of the day to ensure compliance with ‘the terms of this Contract; 19, The LESSEE hereby acknowledges and confirms that he has seen and inspected the premises herein leased and that it is in good condition and is suitable for the purpose for which it is leased, and he/she agrees to surrender it peacefully, also in good condi tion upon the expiration or termination of this Contract; 20, The failure of the LESSOR to insist upon a strict compliance with any of the terms anc condition herein stipulated shall not be deemed a relinquishment or waiver of an: rights or remedy he may have, nor shall it be construed as a waiver of any subsequen breach or default of the terms, conditions and covenants herein contained which shal be deemed to be in full force and effect. No waiver by the LESSOR shall be deemed t have been made, unless expressed in writing and signed by the latter; 21. Incase of litigation for the collection of any unpaid rentals or fees or the enforcemer ofany of the conditions of this contract, the LESSEE shall be liable for damage: and attorneys fees apart from the costs and other expenses incidental to the suit. Applicant is not delinquent in the payment of taxes, fees and other charges du to the Municipal Government, Applicant must secure a clearance from th Municipal Treasurer’s Office. b). Bidding for stall shail be conducted by the Market Committee, Notice of public biddin shall be posted in three (3) conspicuous places, in the Municipal Hall compound. The Municip: Market Committee, may, at its option, cause the publication of the notice in a newspaper « general circulation in the Municipality of Binmaley. Inthis notice shall be specified th number of stall or booth, the section where located, and the last day of filing said applicatic for occupancy thereof. The same notice shall remain where itis posted for a period not less the ten (10) days immediately preceding the date of the bidding, k.Bids shall be written in the bid forms numbered and prescribed by the Municip Market Committee, It shall decide which stall(s) shall be open for bidding first. The winnir bidder and the corresponding stall number shall be announced after every bidding. 1. Applicant shall pay a bidder’s bond to be imposed by the Municipal Treasurer. m. Adjudication of the stalls in the new Public Market be made through the following proc duinhee 2). Adjudication of stalls shall be by module and then by stalls, which hall be undertaken by the Municipal Market Committee through public bid- ding b). Applicants shall be prioritized as follows PHiority 1: Actual vendors doing business in Binmaley who are residents in Binmaley Priority 2; Actual vendors residing outside Binmaley and doing business in Binmaley Priority 3: Other interested parties. rn, Awards and Contract, - The Municipal Market Committee shall make the corresponding awards of the different market stalls herein mentioned within one (1) month from the approval of this ordinance and shall enter a contract with the winning applicants immediately thereafter. 0, Disqualification: The following are disqualified from being a stallhotder in the ‘Municipal Public Market; 1. Delinquent Staltholder; 2. Those convicted of a crime involving moral turpitude; and 3. Those convicted for any acts prohibited or made unlawful by any ordinance affecting local merket ordinance, rules and regulations. p.Grounds for Revocation of Contract. - The following are grounds for the revocation of tht Contract of Lease: 1. Failure to pay the corresponding market stall fees; 2, Failure to comply with other requirements provided under existing ordinance, rules regulation affecting the administration and management of the Municipal Publie Mas ket; 3, Failure to comply with the terms and conditions of the contract herein mentioned,an 4. Violation of the provisions against Subleasing and other prohibited acts defined an covered by this ordinance. q, Pedaling and Hawking. - Except during big market days (MONDAYS), no person sha peddle, hawk, sell, offer for sale ot expose forsale any article on the road, alley, bridge, park, plas Square, sidewalk/roadside or other places unless authorized by Sangguniang Bayan. To avoid unjuu competitions, peddlers or hawkers shall not be permitted to offer forsale, in the Municipal Marke and their surroundings within a radius of 200 meters from their confines in the stalls or booths of sa ‘Markets, neither shall they be permitted to expose or sell merchandise on sidewalk, courts (parties): places designed andior intended as aisles or passageways (pasilyo) in the public market. Market of Cials and employees and policemen detailed in the vieinity of the public market shall exercise str vigilance on this matter and are enjoined strict compliance with this provisions. 1. Weight and Measures, ~The privilege to engage in business on the public market granted any vendor who is found violating the provision of the National intemal Revenue Code, regardi weight and measures, shal] be immediately withdrawn, his lease cancelled, and the stall declar vacant and open for application, in addition to the penalties imposed by said Code. s. Maintenance of Order in the Public Market. - No person within the premises of the pub market of this Municipality shall commit any nuisance, or shall be guilty of any disorderly conduct, make any loud o boisterous noises, or use any profane, vulgar languages and obstruct the passat ‘ways (pasilyo) in the public market, ot do any act which is calculated to lead to a breach of the pee and disturb the good order and decorum therein +. Appeal from the decision of the Market Committee. ~ Any person, entity, stalthotder direc affected or aggrieved by the decision of the Market Committee may appeal the same to the Munici Mayor, whose decision or action thercon_ shall be final, except if deereed otherwise by compet legal authorities.” Section 5AJ.09, 8) of Ordinance No.3, Series of 1998 is further amended to read as follows: g) Business hours in the publie market 1. Big Market Days (MONDAYS) - Opening - 4:00 A.M.; Closing - 2:00 PM. This applies only for market premises intended for ambulant, transient or itinerant vendors. 2, Ordinary Market Day (MONDAY-SUNDAY)-Opening-4:00 A.M; Closing-8:00 PN “This applies to stallholders and other business establishments in the Binmaley Public Market : 3, Holidays including eve of Christmas and New Year's Day ‘Opening - 4:00 A.M. Closing - 2:00 PM.” Section 2. Separability Clause. - If any clause, sentence, paragraph, section, or part of th | Ordinance shall be adjudged by any authority or court of competent jurisdiction to be invalid, sue judgment shall not affect, impair or invalidate the remainder of said ordinance, but shall be confine in its operation to the clause, seatence, paragraph, seotion or part thereof directly in the controvers, Seetion 3. Repealing Clause. — All ordinances, rules and regulations or parts in conflict inconsistent with the provisions of this ordinance are hereby repealed, amended, or modified accor ingly. Section 4. Effect ‘This Ordinance shall take effect after ten (10) days from the la date of publication in a newspaper of general circulation in the province of Pangasinan.
