LONG ISLAND UNIVERSITY

MEMORANDUM
TO:

The Long Island University Community

FROM:

Pamela Duffy, Executive Director for Human Resources

SUBJECT:

Drug-Free Schools & Communities Act

DATE:

November 30, 2016

________________________________________________________________________
The U.S. Department of Education has issued regulations implementing the provisions of the
Drug-Free Schools and Communities Act of 1989. These regulations require Long Island
University as a recipient of federal financial aid, grants and contracts, to adopt and implement
programs to prevent the use of illicit drugs and the abuse of alcohol by employees and students.
In response to these laws, the University has promulgated a policy statement that is reiterated
here for information and appropriate compliance:
1

All employees, students, and members of the Long Island University community are
advised that the unlawful manufacture, distribution, dispensation, possession or use of
a controlled substance; and the unlawful possession or use of alcoholic beverages on
the campuses of Long Island University is prohibited. Only those of a legal drinking
age (21 or older) may be permitted to possess or drink alcoholic beverages at
authorized events; or as authorized in the LIU Brooklyn Campus, LIU Post Campus,
and regional campus Student Handbooks.

The Act also requires that employees and students are apprised of the applicable laws
concerning these offenses. Accordingly, attached is a copy of the New York Alcohol
Beverage Control Laws (Appendix A) and the relevant New York Penal Law
provisions and penalties for controlled substance offenses (Appendix B). If it is
determined that a violation of these policies has occurred, appropriate disciplinary
action will be taken in accordance with the student disciplinary procedures described
in the campus student handbooks which may include immediate suspension or
expulsion from the University. With respect to employees, disciplinary action will be
taken in accordance with the terms of the relevant employee collective bargaining
agreements, if applicable; and/or with other policies and practices of the University.
Sanctions may include suspension or termination. Students and employees who

violate the University Drug and Alcohol policies may also be referred to counseling
or rehabilitation services. The matter may also be referred to government agencies for
prosecution.
3

All employees must abide by this policy statement. Employees must also notify the
employer in writing, of any criminal drug statute conviction for a violation occurring
in the workplace, no later than five calendar days after such conviction. Failure to do
so may subject the employee to disciplinary action up to and including dismissal.

The University recognizes alcohol and drug dependency as an illness and a major
health problem, and will assist those directly affected by it, and their families.
Employees who need help with substance abuse problems, or co-workers/family
members of substance abusers are encouraged to use the Employee Assistance
Programs located at the LIU Post Campus; and at the LIU Brooklyn Campus.
Services include assessment, referral to professional treatment and self-help
programs, an early recovery group and extensive follow-up. All contacts are
confidential and conscientious efforts to seek help will not jeopardize an employees
job. Questions concerning student counseling services and programs should be
directed to the Student Health and Counseling Center at the LIU Post Campus; and to
University Health Medical Services at the LIU Brooklyn Campus.

Questions regarding this policy or violations of its provision should be addressed to the Office of
the University Counsel, University Center, Brookville, NY 11548.
