Do hereby submit as under,
I am conversant with the facts of the case in the earlier
application filled concerning farmers and agricultural produce of
debt waiver scheme in this connection certain orders have been
passed by the commissioner which is presently in review before
honourable minister and the review petition is pending disposal.
It is now imperative that the auditor MR. T. N. Kawade
(District Spl. Auditor Class-1) be made a party to the review
petition is as much as certain subsequent action and/or purported
orders requires to be looked into to examine the entire issue in its
totality.
In the other words it will only meet the ends of justice if the
above auditor is made a party and notice has been send if
necessary so that he could make representation, if at all,This
would also be of assistance to the honourable minister in
disposing off review petition.
The facts of the case are simple where an order dated 12 th
April 2012 was passed by Mr. T.N. Kawade (District Spl. Auditor
Class-1) stating that the disbursement of loan is proper however
the very same auditor appears to have differed from his own
decision which according to us is incorrect.(Annexed is the order,
deffered)
Based on this report it appears, the commissioner is
influence or bound to pass an order in review.
Hence both the findings of the auditor and the
commissioner requires to be set aside and the order of the auditor
along with other connected orders be held to be valid and legal .
