Section 307:- Attempt to murder


Whoever does any act with such intention or knowledge, and under such circumstances that,
if he by that act caused death, he would be guilty of murder, shall be punished with
imprisonment of either description for a term which may extend to ten years, and shall also
be liable to fine; and, if hurt is caused to any person by such act, the offender shall be liable
either to imprisonment for life, or to such punishment as is hereinbefore mentioned.
Attempts by life-convicts When any person offending under this section is under sentence
of imprisonment for life, he may, if hurt is caused, be punished with death.
Illustrations
A shoots at Z with intention to kill him, under such circumstances that, if death
ensued A would be guilty of murder. A is liable to punishment under this section
A, with the intention of causing the death of a child of tender years, exposes it in a
desert place A has committed the offence defined by this section, though the death of the
child does not ensue.
A, intending to murder Z, buys a gun and loads it. A has not yet committed the
offence. A fires the gun at Z. He has committed the offence defined in this section, and, if by
such firing he wounds Z, he is liable to the punishment provided by the latter part of the first
paragraph of this section.
A, intending to murder Z by poison, purchases poison and mixes the same with food
which remains in A keeping; A has not yet committed the offence in this section. A places the
food on Z table or delivers it to Z servants to place it on Z table. A has committed the
offence defined in this section.

ABSTRACT: The investigating authorities often make heinous offences like u/s Section 307
IPC, without taking into consideration the medical evidence, by taking advantage of the legal
loop-holes, causing undue harassment to the alleged accused while the medical evidence
plays a pivotal role in establishing such cases in a court of law. The authenticity of medical
opinion is discussed in this case wherein the offence u/s 307 IPC against the alleged accused
was ordered to be cancelled by the court keeping in view the simple nature of injuries from
medical evidence. KEY WORDS: Dangerous to life, Medical evidence.

Section 324 in The Indian Penal Code


324. Voluntarily causing hurt by dangerous weapons or means.Whoever, except in the case
provided for by section 334, voluntarily causes hurt by means of any instrument for shooting,
stabbing or cutting, or any instrument which, used as weapon of offence, is likely to cause
death, or by means of fire or any heated substance, or by means of any poison or any
corrosive substance, or by means of any explosive substance or by means of any substance
which it is deleterious to the human body to inhale, to swallow, or to receive into the blood,
or by means of any animal, shall be punished with imprisonment of either description for a
term which may extend to three years, or with fine, or with both.
Section 20 in The Narcotic Drugs and Psychotropic Substances Act, 1985
20. Punishment for contravention in relation to cannabis plant and cannabis. Whoever, in
contravention of any provisions of this Act or any rule or order made or condition of licence
granted there under,
(a) cultivates any cannabis plant; or
(b) produces, manufactures, possesses, sells, purchases, transports, imports inter-State,
exports inter-State or uses cannabis, shall be punishable 1[(i) where such contravention
relates to clause (a) with rigorous imprisonment for a term which may extend to ten years and
shall also be liable to fine which may extend to one lakh rupees; and
(ii) where such contravention relates to sub-clause (b),
(A) and involves small quantity, with rigorous imprisonment for a term which may extend to
six months, or with fine, which may extend to ten thousand rupees, or with both;
(B) and involves quantity lesser than commercial quantity but greater than small quantity,
with rigorous imprisonment for a term which may extend to ten years and with fine which
may extend to one lakh rupees;
(C) and involves commercial quantity, with rigorous imprisonment for a term which shall not
be less than ten years but which may extend to twenty years and shall also be liable to fine
which shall not be less than one lakh rupees but which may extend to two lakh rupees:
Provided that the court may, for reasons to be recorded in the judgment, impose a fine
exceeding two lakh rupees.]
Cannabis is illegal in India by law except in govt. authorized shops that sell Bhang (Bhang).
Bhang can refer either to the actual ground cannabis balls, or to the drink made by mixing it
in milk. All production and selling of Bhang has to be through govt. authorized shops.
The cannabis that is sold as Bhang but belongs to the Cannabis indica variety than Cannabis
sativa variety that is commonly used in cases where cannabis is smoked up. The indica
variety has lower THC content, and also Bhang is usually seen as a sleep inducer, or even
appetizer rather than a recreational drug.
Used during observance of certain Hindu rituals. Government-owned shops in holy cities
like Varanasi sell cannabis in the form of bhang. Despite the high prevalent usage, the law
makes it illegal to possess any form of the psychoactive. However, this law is rarely enforced
and treated as a low priority across India. Further, large tracts of cannabis grow unchecked
in the wild in many parts of northern and southern India in many states such as West Bengal,
Tripura, Andhra Pradesh, Karnataka, Kerala, and Tamilnadu. Many states such as West

Bengal, Tripura, and the North East have their own laws allowing cannabis, locally known as
ganja.
Legality of cannabis by country
Coming to the punishment for the crime, for use of Cannabis it is 6 months of imprisonment
or/and Rs. 10,000 in fine, jail time may be waived if the offender opts for de-addiction
treatment.
