The undersigned accuses PEDRO SATRA PASCUAL for THEFT
committed as follows:
That on or about the 17th of April 2016, in the City of Baguio,
Philippines and within the jurisdiction of this Honorable Court, the abovenamed accused with intent to gain did there wilfully, unlawfully, and
feloniously take steal and carry away two (2) cans of PEDIASURE PLUS
MILK with a total price of Php 3,689.00 without the knowledge and consent
of SM Supermarket herein represented by Harold Samuel to his damage in
the total amount of THREE THOUSAND SIX HUNDRED EIGHTY NINE
PESOS (Php 3,689.00), Philippine Currency.

INQUEST RESOLUTION
Referred for inquest proceedings this is the above entitled case. Complainant
avers that on April 17, 2016, the respondent was caught carting away two
cans of Pediasure milk worth P3,689.00 by putting the same in his bag and
saving SM Supermarket without paying the items.
With intent to gain, the respondent took away the property belonging to
another without the persons knowledge or consent probable cause therefore
for the crime of theft has been sufficiently established.
THEREFORE, premises considered, the undersigned respectfully
recommends the indictment and prosecution of Respondent PEDRO SATRA
PASCUAL for the crime of theft.

RECORDED IN ITS ENGLISH EQUIVALENT BY THE SAME
INVESTIGATOR WITH HIS CONFORMITY IN THE PRESENCE OF
PO3 JAIME BRAINE, PO3 MAE FLOR, PO2 ADRIAN PETER AND
OTHERS.
QUESTION 1: Good evening sir, you came here to our office of your own
will?
ANSWER 1: Yes Sir.
Q2: Are you aware that if you do not tell the truth you will be charged of
Perjury?
A2: Yes sir.
Q3: Can you give us your name and other important personal circumstances.
A3: I am Mark Adriano, 29 years old, currently residing at No. 35 DPS
Compound, Marcoville, Baguio City, College graduate, I am employed as
Security guard of SM Supermarket SM City Baguio, Luneta Hill, Baguio
City under Black Cat Security Agency.
Q4: Why are you here inside our office?
A4: I came here to give my statement regarding the incident that I have
witnessed and to support the complaint of Harold Samuel against (Declarant
pointing to a male person who identified Pedro Satra Pascua, 27, years old,
single, jobless, a native Sabangan, Mountain Province and a resident of 34
City Camp Central, Baguio City.)
Q5: What is that incident you are referring to?
A5: Its the incident wherein I saw this Pedro Pascua sneaked out two (2)
pieces of PediasurePlus Preschool Milk worth Three Thousand Six Hundred
Eighty Nine Pesos (Php 3,689.00) without paying it to the cashier.
Q6: Where did that incident happen?
A6: it happened inside the SM Supermarket SM City Baguio Luneta Hill,
Baguio City.

Q7: When did that incident happen?

A7: At around 9:10 PM of April 17, 2016.
Q8: Can you please elaborate what happened?
A8: It was like this, while I was observing customers coming in and out of
the Supermarket, Pedro Pascua together with his companions, a male and a
female came and they went directly at the Milk shelves.
Q9: What did you do next?
A9: I discreetly followed them and I noticed the other male took two (2)
cans of Pediasure Milk plus at the Milk Shelves and he went directly at the
cloth shelves followed by his companions.
Q10: What else happened?
A10: Pedro Pascua took the two (2) cans of Pediasure Milk Plus and kept
them inside his blue bag pack and he walk directly towards the exit of the
Supermarket.
Q11: What else did you do?
A11: I immediately followed him and when he was outside the Supermarket,
I accosted him and asked him to show me the receipt of the items he placed
inside his bag but he cannot show me any.
Q12: Then?
A12: I then informed our stock clerk that I apprehend a Shoplifter and our
Store Manager Phillip Amilsoc instructed us to bring Pedro Pascua at the
Police Station.
Q13: What did you do then?
A13: After documentation, we proceed at COMPAQ 4 after which we were
brought at the Police Station 7 for proper disposition.

want to retract on your given statement?

A9: I came here to file a case against that person (Declarant pointing to a
male person who identified himself as Pedro SatraPacua, 27 years old,
single, jobless, a native Sabangan, Mountain Province and a resident of 34
City Camp Central, Baguio City.) who sneaked out two (2) pieces of
Pediasure Plus Preschool Milk worth Three Thousand Six Hundred Eighty
Nine Pesos (Php 3,689.00) without paying it to the cashier.

A11: At around 9:10 PM of April 17, 2016.
Q12: How did that incident happen?
A12: It was like this, while I was having my break, one of the Security
Guard in the person of Mark Adriano approached and informed me that he
apprehend a male person for sneaking out Two pieces of Pediasure Plus Milk
without paying them to the cashier.
Q13: What did you do at that instance?
A13: I reported the incident to SM Supermarket Management and our Store
Manager Phillip Amilsoc instructed me to bring the arrested male person to
the Police and to file necessary case against him in their behalf.
Q14: Do you have any Authorization letter?
A14: Yes sir. Here it is (Declarant submitted a copy of Authorization letter
dated April 17, 2016 duly signed by Phillip Amilsoc.

AFFIDAVIT OF ARREST
I, SPO3 CARDO ANG DALISAY, of legal age, married, Filipino
citizen, bonafide member of the Philippine National Police, PRO-COR and

presently assigned at COMPAQ 4, Station 7, Baguio City Police Office

located at Session Road, Baguio City after having been sworn to in
accordance with law, hereby disposed and state the following:
1. That I am designated as COMPAQ 4, 2nd Shift Supervisor with tour of
duty commencing from 7:00 PM to 7:00 AM daily;
2. That at around 10:00 PM of April 17, 2016 while I was inside our
Office, two male personnel of SM came in together with one male
person whom the two claimed the said male person is a suspect for
Theft committed at their work place;
3. That upon informed I immediately effect the arrest of the suspect, I
informed him of his constitutional rights and the nature of it in a
dialect he fully understood;
4. That after taking the details I called our Police Mobile and turned over
the case at Station 7 Main for proper disposition;
5. That I came to know the identity of the suspect as PEDRO SATRA
PASCUA, 27 years old, single, jobless, a native Sabangan, Mountain
Province and a resident of 34 City Camp Central, Baguio City, while
the complainant is HAROLD SAMUEL, 29 years old, married, native
of Pangasinan and a resident of No. 49 Cabinet Hill, Baguio City; and
6. That I am executing this affidavit to attest the truthfulness of the
foregoing facts and to support the complaint of Mr. Samuel against the
suspect Mr. Pascua be filed in court if there be any.
