Focus/Challenges:
Tylenol rollback in 1982 After 7 people died due to tampering and potassium cyanide
poisoning after Tylenol reached the shelves in Chicago. Although J&J was not responsible,
conducted an immediate product recall from the entire country. Two months after the

product was removed, J&J decided to reintroduce Tylenol products containing a triple-seal
tamper resistant packaging.

Tylenol was reintroduced with a new, triple-sealed package. Tylenol became the first
product in the industry to use a tamper resistant packaging. [1] This new sealing design
made it nearly impossible for someone to tamper with the contents without being
noticed.
They also coupled this recovery effort with heavy ad campaigns and price promotions
where you could save up to $2.50 per bottle. Television and newspaper advertisements
proclaimed Tylenol as a brand you can trust. In less than a year, Johnson & Johnsons
market share had increased back up to 29%. Within several years, Tylenol had once again
become the most popular over-the-counter analgesic in the U.S.
Johnson & Johnson was able to remain in a positive light with the media and maintain
great public relations with its swift actions. They continued to make improvements in
quality control. Along with the tamper resistant packaging, J&J developed new random
inspection procedures before the shipment of Tylenol to retailers.

$72 Million Awarded in Ovarian Cancer Lawsuit

February 24, 2016 A jury in St. Louis, Missouri has awarded $72 million to the family of a
woman who died of ovarian cancer after using baby powder for decades as a feminine
hygiene product. Click here to read more.
September 14, 2016 A woman who was diagnosed with ovarian cancer after using
Shower-to-Shower for 10 years has filed a lawsuit (PDF) against Johnson & Johnson for failing
to warn about the risk. Click here to read more.
What is Shower-to-Shower?
Shower-to-Shower is marketed as an after-shower body powder with the slogan, Just a
sprinkle a day helps keep odor away. The powder primarily consists of cornstarch and
talcum powder, which help absorb moisture. It has been sold for decades by Johnson &
Johnson.
Shower to Shower and Ovarian Cancer
Talcum powder, an ingredient in Shower-to-Shower, is a powdered mineral that is commonly
found in cosmetics, baby powder, feminine hygiene products, and more. In its natural state,
talcum contains asbestos, a known human carcinogen. However, since 1973, federal law has
prohibited asbestos in consumer products containing talc.
The problem is that a number of recent studies have linked asbestos-free talcum powder
products to an increased risk of ovarian cancer. Tissue samples from women with ovarian
cancer have also detected talc fibers in the ovary, suggesting that talcum can move through
the vagina, uterus, fallopian tubes, and into the ovaries.
J&J Loses Shower-to-Shower Lawsuit in South Dakota
In October 2013, J&J lost a trial involving Deane Berg, a 56 year-old woman from South
Dakota who was diagnosed with ovarian cancer in 2006 after using Shower-to-Shower for 30
years. The jury in Sioux Falls did not award damages, but agreed that the company failed to
warn about the risk of ovarian cancer. By February 2016, over 1,200 lawsuits had been filed.
Ovarian Cancer Information
The American Cancer Society estimates that 22,000 women will be diagnosed with ovarian
cancer this year, and over 14,000 will die from the disease. Although ovarian cancer is rare,
it is one of the deadliest cancers because symptoms are mild and vague, which tends to
delay diagnosis until it is difficult or impossible to cure.
Post J&J verdicts, talcum powder norms in spotlight (May 2016)
Claim- Fox, who lived in Birmingham, Alabama, claimed she used Baby Powder and Shower
to Shower for feminine hygiene for more than 35 years before being diagnosed three years
ago with ovarian cancer. She died in October at age 62. Jurors found Johnson & Johnson
liable for fraud, negligence and conspiracy, the family's lawyers said.

two straight losses for J&J, which has to pay total compensation of $127 million in the two
cases. ($72 and $55 M)

The losses faced by J&J pertain not to the talcum powder itself, but more with its usage
for feminine hygiene, therefore, any change in norm need to take into account baby as
well as adult products.

Regulatory mechanism
Even as the government has asked the J&J for information on the safety of its products and
also asked the Bureau of Indian Standards to revise the standards for this sector, consumer
activists are talking about the lackadaisical manner the regulators work.
Consumer rights activist Bejon Mishra said that the regulatory mechanism for setting
standards is slow and the authorities need to be pushed to act quickly.
The government and standard setting authority BIS should take cognisance of the cases in
the US and react quickly to take immediate action, he said.
Scientists have found that the use of talcum powder for feminine hygiene could lead to
cancer as the minute mineral particles could enter the body and get lodged in the ovaries,
causing inflammation, tumor and cancer.

J&J is facing about 1,200 similar cases in the US.

Consumer rights activists say they are closely monitoring the situation and waiting for
the authorities to take the necessary steps. Other consumer advocacy groups believe
there should be clear instructions on the packaging of talcum powder products,
especially baby talcum powders to avoid indiscriminate use or wrong use.

Yogini Mishra, Co-ordinator, Association for Consumers Action on Safety and Health, a
Mumbai-based advocacy group set by lawyers, said that talcum powder firms should be
asked to have clear instructions and if possible even have pictorial depiction for the
correct use of talcum powder.

She said these instructions should be put in regional languages or the national language
as all strata of consumers use these products.

The last time J&J had suffered a trial loss, in February 2016, it was asked to pay $72
million (or Rs 475 crore) to a family of a US woman who died of cancer. Indian regulators
had subsequently conducted an investigation of J&J's factory in Mulund in the city's
northeast.
