Briefing Book: The Foundation Of

Scandal
SHE CREATED THIS MESS AND SHE KNOWS IT
Clintons Top Aide Huma Abedin Lamented That Conflicts With The Foundation Are Clintons
Mess And She Knows It. And then, in what appears to be a rare venting of frustration by Abedin
toward Hillary Clinton (at least in the thousands of hacked Podesta emails), she wrote this about her
boss: She created this mess and she knows it. Ultimately, Clintons aides prevailed upon her, and she
sent Bill and Chelsea Clinton in her place. But this exchange about Morocco, first reported by The New
York Post, is the clearest example yet in the emails posted by WikiLeaks of the type of arrangement that
people find most, well, icky about the Clintons. Bill and Hillary wanted a deep-pocketed donor to make a
large contribution and foot the bill for a ritzy conference, and the king of Morocco wanted access to the
woman who, then as now, was the leading candidate to be the next president of the United States. The
Clintons didnt apparently care that, as the Post noted, Morocco had a spotty record on human rights. The
State Department has cited the Moroccan government for widespread corruption, and the governmentowned mining company that paid for the CGI meeting has been cited for its own human-rights abuses.
(Russel Berman, She Created This Mess And She Knows It, The Atlantic, 10/22/16)

From The Beginning, Hillary Clinton Has Been Deeply Involved With The Foundation
The Foundation Was A Joint Enterprise From The Start Between Bill And Hillary Clinton. But
Mrs. Clintons effort to distance herself understates the extent to which the foundation was a joint
enterprise from the start. Shortly after the Clintons left the White House, close advisers convened
meetings at the couples Washington home to map out Mr. Clintons future as a philanthropist. (Don Van Natta
Jr., Jo Becker, and Mike McIntire, In Charity And Politics, Clinton Donors Overlap, The New York Times, 12/20/07)

The Clinton Foundations First Chief Of Staff, Karen A. Tramontano: Mrs. Clinton Played An
Important Role In Shaping Both The Foundations Organization And The Scope Of Its Work. Mrs.
Clinton played an important role in shaping both the foundations organization and the scope of its work,
said Karen A. Tramontano, a senior adviser in the Clinton White House and the foundations first chief of
staff. (Don Van Natta Jr., Jo Becker, and Mike McIntire, In Charity And Politics, Clinton Donors Overlap, The New York Times, 12/20/07)

Political Careers. (Bill And Hillary Inc. The Economist, 10/1/16)

Clinton Hasnt Answered Questions About The Foundation Head On

The Atlantic Headline: Clinton Still Hasnt Faced Questions About Pay-To-Play Head On (David Graham,
Clinton Still Hasnt Faced Questions About Pay-To-Play Head On, The Atlantic, 10/20/16)

When Asked About Pay To Play At The Foundation In The Final 2016 Debate, Clinton More Or
Less Avoided The Question. Moderator Chris Wallace pointed out that Clinton had pledged to avoid
appearances of conflict of interest between the Clinton Foundation and her work as secretary of state.
But emails show that donors got special access to you. Those seeking grants for Haiti relief were
considered separately from non-donors, and some of those donors got contracts, government contracts,
taxpayer money, Wallace said. Can you really say that you kept your pledge to that Senate committee?
And why isnt what happened and what went on between you and the Clinton Foundation, why isnt it
what Mr. Trump calls pay-to-play? Clinton more or less avoided the question. She said that everything I
did as secretary of state was in furtherance of our countrys interests and our values. The State
1

Department has said that. Then she moved into a defense of the Clinton Foundations work. Wallace tried
to get her back to the question at hand: The specific question went to pay for play. Do you want to talk
about that? Clinton, for the most part, did not, saying theres no evidence. (David Graham, Clinton Still Hasnt Faced
Questions About Pay-To-Play Head On, The Atlantic, 10/20/16)

Chelsea Clinton Will Remain On The Board Should Clinton Be Elected. Conflicts of interest are as
much about appearance as they are about concrete examples of malfeasance. The point of ethics
guidelines is to avoid even the impression that there might be shady business, and in the case of the
Clinton Foundation, that did not work. Even if donors to the Clinton Foundation were not getting access
from the State Department, its easy to imagine some giving was inspired by the hope of access. And even
if there were no concrete favors doled out, the Band messages suggest some access. Trumps failure to
press his advantage politically, and Clintons success in dodging the question, make for interesting debate
analysis. But if, as polls suggest, Clinton wins the presidency, the question will become more important.
The Clinton Foundation reportedly plans to stop accepting foreign and corporate donations if Hillary
Clinton is elected, and to discontinue the annual Clinton Global Initiative events. Bill Clinton would step
down from the foundation, but Chelsea Clinton, their daughter, would apparently remain on the board.
(David Graham, Clinton Still Hasnt Faced Questions About Pay-To-Play Head On, The Atlantic, 10/20/16)

The Clintons Seem To Know That What They Are Doing Will Look Bad And Raise Questions Of
Ethics And Corruption, And Yet Convinced Of Their Own Righteousness, They Do It Anyway. That
is why the Moroccan episode is such a quintessentially Clinton controversy. Its not as if they are tonedeaf politicians. Like so many other scandalsfrom the alleged renting out of the Lincoln bedroom in
1990s, to the pardon of Marc Rich, to Hillarys use of a private email serverthe Clintons seem to know
that what they are doing will look bad and raise questions of ethics and corruption, and yet convinced of
their own righteousness, they do it anyway. And the fact that these lapses continue to repeat themselves
so long into their time in the public arena offers little hope that the next four years of a possible Clinton
White House would be any different. (Russel Berman, She Created This Mess And She Knows It, The Atlantic, 10/22/16)

THE FOUNDATION IS RIFE WITH CONFLICTS OF INTEREST

The Clinton Foundation Is Increasingly Seen As A Distraction By Supporters Of Hillary Clintons
Presidential Bid The Bill, Hillary and Chelsea Clinton Foundation increasingly seen as a distraction
by supporters of Hillary Clinton's presidential bid is considering dialing back its activity during the
campaign and a potential Clinton presidency, according to interviews and documents obtained by
POLITICO. (Ken Vogel, Clinton Foundation Of Collision Course With Campaign, Politico, 1/28/16)
The Foundation Has Put Wealthy Donors Into Clintons OrbitAnd Allowed Them To Buy A Rare
Chance To Shape Her Perspective That Few Average Americans Will Ever Get. But while those
claims are overblown, the story still illustrates how the foundation helped put wealthy donors into
Clintons orbit and allowed them to buy a rare chance to shape her perspective that few average
Americans will ever get. (Jeff Stein, The Hillary Clinton Scandal Involving Morocco, Explained, Vox, 10/24/16)
[Y]ou Cant Pretend That Theres A Bright Line Separating Clinton The Philanthropist And Clinton
The Would-Be President. Clinton is not officially a candidate for the presidency, so there arent any
rules or ethical boundaries for her to officially cross. But you cant pretend that theres a bright line
separating Clinton the philanthropist and Clinton the would-be president. (Simon Maloy, Clintons Donor Mess: The
Clinton Foundations Fundraising Is A Big Problem For Hillary, Salon, 2/20/15)

The Foundation Has Given Contributors Entree, Outside The Traditional Political Arena, To A
Possible President. The financial success of the foundation, which funds charitable work around the
world, underscores the highly unusual nature of another Clinton candidacy. The organization has given
contributors entree, outside the traditional political arena, to a possible president. Foreign donors and
countries that are likely to have interests before a potential Clinton administration and yet are

ineligible to give to U.S. political campaigns have affirmed their support for the familys work through
the charitable giving. (Rosalind S. Helderman, Tom Hamburger and Steven Rich, Clintons Foundation Has Raised Nearly $2 Billion And Some
Key Questions, The Washington Post, 2/18/15)

Bill Allison Of The Sunlight Foundation: The Clinton Foundation Is A Unique Non-Profit That Cant
Be Separated From The American Political System. Bill Allison, senior policy analyst at the Sunlight
Foundation, a campaign finance watchdog group, says the Clinton foundation is a unique non-profit that
cant be separated from the US political system. If there is foreign money coming into the Clinton
Foundation, it will raise the question of - is the president going to be doing favors for a foreign business, a
foreign government, a foreign individual? And you just cannot have that in the American system of
government, where the president is supposed to represent the American people, Allison said. (Julianna
Goldman, Chinese Company Pledged $2 Million To Clinton Foundation In 2013, CBS News, 3/16/15)
Donors Appear to Hope To Gain Access To The Corridors Of Political Power With Their Gifts.
One of the reasons that the Clinton Foundation has become such a formidable fund-raising machine is
that donors appear to hope to gain access to the corridors of political power with their gifts. (Why The Clinton
Foundation Is So Controversial, The Economist, 2/7/16)

The Problem With The Clinton Foundation Is That Appears Vulnerable To Conflicts Of
Interest. The problem is that a foundation, which is led by an ex-president and someone who
hopes to be elected president by the end of the year, can appear vulnerable to conflicts of interest.
(Why The Clinton Foundation Is So Controversial, The Economist, 2/7/16)

The Washington Post: Contributions May Spur Questions About The Independence Of A Potential
Commander In Chief Who Has Solicited Money From Foreign Donors With A Stake In The Actions
Of The U.S. Government. The role of interests located in countries such as Saudi Arabia, Qatar and
Argentina may spur questions about the independence of a potential commander in chief who has
solicited money from foreign donors with a stake in the actions of the U.S. government. (Rosalind S. Helderman,
Tom Hamburger and Steven Rich, Clinton Foundations Global Network Overlaps With Familys Political Base, The Washington Post, 2/19/15)

BILL CLINTON HAS MADE OVER $65 MILLION IN PERSONAL PROFITS FROM THE
FOUNDATION
In A Leaked Memo, Clinton Aide Doug Band Detailed A Circle Of Enrichment In Which He Raised
Money For The Clinton FoundationWhile Pressing Many Of Those Same Donors To Provide
Personal Income To The Former President. In doing so, Band also detailed a circle of enrichment in
which he raised money for the Clinton Foundation from top-tier corporations such as Dow Chemical and
Coca-Cola that were clients of his firm, Teneo, while pressing many of those same donors to provide
personal income to the former president. (Rosalind Helderman and Tom Hamburger, Inside Bill Clinton Inc,: Hacked Memo Reveals
Intersection Of Charity And Personal Income, The Washington Post, 10/26/16)

Bands Memo Lays Out The Aggressive Strategy Behind Lining Up The Consulting Contracts And
Paid Speaking Engagements For Bill Clinton That Added Tens Of Millions Of Dollars To The
Familys Fortune, Including During The Years That Hillary Clinton Led The State Department.
The memo, made public Wednesday by the anti-secrecy group WikiLeaks, lays out the aggressive
strategy behind lining up the consulting contracts and paid speaking engagements for Bill Clinton that
added tens of millions of dollars to the familys fortune, including during the years that Hillary Clinton led
the State Department. It describes how Band helped run what he called Bill Clinton Inc., obtaining inkind services for the President and his family for personal travel, hospitality, vacation and the like.
(Rosalind Helderman and Tom Hamburger, Inside Bill Clinton Inc,: Hacked Memo Reveals Intersection Of Charity And Personal Income, The Washington
Post, 10/26/16)

Band Detailed How He Combined His Private Sector Teneo Work With CGI Work, Saying He
Would Use A Hotel Room Above The CGI Meeting To Meet With Business Clients. Band
3

described in the memo how he combined his work for CGI and Teneo. He wrote that he had used a
hotel room upstairs from the 2011 CGI gathering to meet with Teneo clients. He also
acknowledged giving free CGI memberships to target Teneo clients being cultivated as potential
foundation donors. Memberships generally cost $20,000 a year. (Rosalind Helderman and Tom Hamburger,
Inside Bill Clinton Inc,: Hacked Memo Reveals Intersection Of Charity And Personal Income, The Washington Post, 10/26/16)

Doug Band Bragged About Secured Contracts For The Former President That Would Pay Up $66
Million Over The Subsequent Nine Years Band wrote that Teneo partners had raised in excess of $8
million for the foundation and $3 million in paid speaking fees for Bill Clinton. He said he had secured
contracts for the former president that would pay out $66 million over the subsequent nine years if the
deals remained in place. (Rosalind Helderman and Tom Hamburger, Inside Bill Clinton Inc,: Hacked Memo Reveals Intersection Of Charity And
Personal Income, The Washington Post, 10/26/16)

Bill Clinton Never Signed The Required Conflict Of Interest Statement As A Board Member Of
CGI
In Another Email, Band Revealed That Bill Clinton Had Never Signed The Required Conflict Of
Interest Statement As A Board Member Of The Clinton Global Initiative. A top official at the Clinton
Foundation said he could name 500 different examples of conflicts of interest, including some involving
former President Bill Clinton, according to more of the e-mails purportedly hacked from the account of
Hillary Clintons campaign chairman. The official, Doug Band, allegedly wrote on Nov. 17, 2011, that he
had been required to sign a conflict-of-interest statement as a board member of the foundations Clinton
Global Initiative, but that the former president oddly didnt have to sign one even though he is
personally paid by 3 cgi sponsors, gets many expensive gifts from them, some that are at home etc. (Ben
Brody, Clinton Foundation Aide Said To Have Cited Conflicts Of Interest, Bloomberg, 10/20/16)

THESE ETHICAL CONCERNS ARE NOT NEW, CLINTON FACED SCRUTINY FOR HER
FOUNDATION DURING HER 2008 RUN AS WELL
The Disclosure Of The Foundations Donors Became An Ethics Issue During Clintons 2008
Run For President
In 2007, Bill Clinton Pledged To Make Public Future Donors If Mrs. Clinton Was Elected
President. Mr. Clinton himself echoed those concerns this fall when he pledged to make public future
donors if Mrs. Clinton was elected president. (Don Van Natta Jr., Jo Becker, And Mike McIntire, In Charity And Politics, Clinton Donors
Overlap, The New York Times, 12/20/07)

Bill Clinton Said Failure To Disclose Donors Would Raise All These Questions About
Whether People Would Try To Win Favor With [Hillary] While disclosure is not legally
required, failure to do so, Mr. Clinton said, would raise all these questions about whether people
would try to win favor with her by giving money to me. (Don Van Natta Jr., Jo Becker, And Mike McIntire, In Charity
And Politics, Clinton Donors Overlap, The New York Times, 12/20/07)

But Bill Insisted That Past Donors Should Remain Private. Even so, past donors should
remain private, he insisted, unless there is some conflict of which I am aware, and there is
not. (Don Van Natta Jr., Jo Becker, And Mike McIntire, In Charity And Politics, Clinton Donors Overlap, The New York Times, 12/20/07)

During The 2008 Campaign, Clinton Repeatedly Dodged The Question Of Whether Or Not The
Foundation Should Disclose Its Donors
During A 2007 Democrat Primary Debate, Clinton Was Asked About Disclosing Donations To The
Foundation, And Clinton Touted A Bill She Co-Sponsored Requiring Sitting Presidents To Disclose
Donations To Their Presidential Library, Saying It Was A Good Policy. RUSSERT: I want to turn to
politics and money. Senator Clinton, as you all know, you had to turn back $850,000 in contributions from
4

Norman Hsu because of his rather checkered past. Again, President Clinton said this, Now, we don't have
to publish all our donors for the Clinton Foundation, but if Hillary became president, I think there would
questions about whether people would try to win favor by giving money to me. In light of that, do you
believe that the Clinton Foundation and the Clinton library should publish all the donors who give
contributions to those two entities? CLINTON: Well, Tim, I actually co-sponsored legislation that would
have sitting presidents reveal any donation to their presidential library, and I think that's a good policy.
RUSSERT: And the foundation? CLINTON: Well, it would be the same, because thats where the library
comes from. (Senator Hillary Clinton, Democratic Presidential Candidates Debate At Dartmouth College, Hanover, NH, 9/26/07)
When Asked During The Same Debate If The Clinton Foundation Should Make Its Donors Public,
Clinton Responded, Well, I Dont Talk About My Private Conversations With My Husband, But Im
Sure Hed Be Happy To Consider That. RUSSERT: Until such legislation, would they voluntarily, the
Clinton library and Clinton Foundation, make their donors public? CLINTON: Well, you'll have to ask
them. RUSSERT: What's your recommendation? CLINTON: Well, I don't talk about my private
conversations with my husband, but I'm sure he'd be happy to consider that. (Senator Hillary Clinton, Democratic
Presidential Candidates Debate At Dartmouth College, Hanover, NH, 9/26/07)
When Asked Later About The Transparency Of Clinton Foundation Donations, Hillary Clintons
Spokesman Phil Singer Said Senator Clinton Is Not Involved In The Fund-Raising Or Operations Of
The Clinton Foundation. As the scope of the foundation expanded from the Clinton library into issues
like treating AIDS in the developing world and addressing global poverty and climate change and as
Clinton moved closer to announcing her candidacy, the pace of giving quickened. Last year, contributions
reached $135 million, a 70 percent increase over the previous year. Two-thirds came from just 11
donors. The $31.3 million donation, which was previously undisclosed, came from the Radcliffe
Foundation run by Frank Giustra, a Canadian who has made millions financing mining deals around the
world. Giustra has become a member of Bill Clinton's inner circle, joining him on global trips and letting
him use his private MD-87 jet. For weeks, Clinton Foundation officials had suggested that the $31.3
million contribution listed on its tax return did not come from a single donor. They then said it came from
a single source, but declined to identify it. On Wednesday afternoon, a representative of Giustra contacted
The Times and acknowledged the Radcliffe contribution. In a statement, the foundation said, Donors did
not seek, nor did President Clinton give, favors from the federal government, adding that most of the
contributions came after Clinton left office. In a separate written response from Hillary Clinton's
campaign, a spokesman, Phil Singer, said, Senator Clinton is not involved in the fund-raising or
operations of the Clinton Foundation. (Don Van Natta Jr., Jo Becker and Mike McIntire, Bill Clinton's Foundation Haunts Campaign, The
International Herald Tribune, 12/21/07)

Until Clintons Run For President In 2008, Donors To The Foundation Had Not Been Disclosed
Donors To The Clinton Foundation Had Been A Closely Guarded Secret. Over the last decade,
former President Bill Clinton has raised more than $500 million for his foundation, allowing him to build
a glass-and-steel presidential library in Little Rock, Ark., and burnish his image as an impresario of global
philanthropy. The foundation has closely guarded the identities of its donors including one who gave
$31.3 million last year. Now, the secrecy surrounding the William J. Clinton Foundation has become a
campaign issue as Senator Hillary Rodham Clinton seeks the Democratic presidential nomination with
her husband as a prime source of strategy and star power. Some of her rivals argue that donors could use
presidential foundations to circumvent campaign finance laws intended to limit political influence. (Don
Van Natta Jr., Jo Becker, and Mike McIntire, In Charity And Politics, Clinton Donors Overlap, The New York Times, 12/20/07)

Early On, Donations To The [Clinton] Library Caused Perception Problems. (Don Van Natta Jr., Jo
Becker, and Mike McIntire, In Charity And Politics, Clinton Donors Overlap, The New York Times, 12/20/07)

CLINTON PROMISED A FIREWALL BETWEEN THE FOUNDATION AND THE STATE

DEPARTMENT IN ORDER TO BE SWORN IN
To Pave The Way For Clinton To Become Secretary Of State, Clintons Team Agreed To
Certain Rules With The Foundation
Clinton Promised A Firewall Between The Foundation And The State Department Given
Clintons promise of a firewall between the foundation and the state department, was that exchange
really appropriate? Keilar asked Granholm. (Linda Qiu, Clinton Surrogate Spins Clinton Foundation Defense, Politifact, 9/24/16)
The Agreements Were Intended To Minimize Conflicts Of Interest. What's clear is that both
agreements were intended to minimize conflicts of interest. (Linda Qiu, Clinton Surrogate Spins Clinton Foundation Defense,
Politifact, 9/24/16)

In November 2008, The Clinton Foundation Agreed To Publicly Disclose Clinton Foundation
Donors As Part Of An Agreement With Obamas Transition Team That Cleared That Way For
Hillary Clinton To Become Secretary Of State. Former President Bill Clinton has agreed to disclose
publicly the names of more than 200,000 donors to his foundation as part of an accord with Presidentelect Barack Obama that clears the way for Senator Hillary Rodham Clinton to become secretary of state,
Democrats close to both sides said on Saturday. (Peter Baker, Clinton To Name Donors As Part Of Obama Deal, The New York Times,
11/30/08)

According To The Agreement, If Any Country Increased Its Commitment Or A New Country
Decided To Contribute, The Foundation Was Obliged To Notify State Department Ethics Officials.
Four other initiatives under the umbrella of the Clinton foundation -- focused on H.I.V./AIDS, climate
change, development and sustainable growth -- will continue to do work under agreements with foreign
governments that provide financing, including Britain, France, Norway and Sweden. But if any of those
countries increases its commitment or a new country decides to contribute, the foundation will notify
State Department ethics officials. (Peter Baker, Clinton To Name Donors As Part Of Obama Deal, The New York Times, 11/30/08)
Additionally, Bill Clinton Agreed To Submit His Future Personal Speeches And Business Activities
For Review By State Department Ethics Officials, And If Necessary, By The White House Counsels
Office. The disclosure of contributors is among nine conditions that Mr. Clinton signed off on during
discussions with representatives of Mr. Obama; all go beyond the requirements of law. Among other
issues, he agreed to incorporate his Clinton Global Initiative separately from his foundation so that he has
less direct involvement. The initiative, which promotes efforts to fight disease, poverty and climate
change, would no longer hold annual meetings outside of the United States or accept new contributions
from foreign governments. Mr. Clinton also agreed to submit his future personal speeches and business
activities for review by State Department ethics officials and, if necessary, by the White House counsel's
office. (Peter Baker, Clinton To Name Donors As Part Of Obama Deal, The New York Times, 11/30/08)

During Clintons 2009 Confirmation She Repeatedly Promised To Abide By The Ethics
Agreement In Order To Become Could Become Secretary Of State
Clinton: [T]he Foundation And The President-Elect Decided To Go Beyond What The Law And The
Ethics Rules Call For To Address Even The Appearance Of Conflict And That Is Why They Signed A
Memorandum Of Understanding, Which Outlines The Voluntary Steps That The Foundation Is
Taking To Address Potential Concerns That Might Come Up Down The Road. CLINTON: I am very
proud to be the president-elects nominee for secretary of state, and I am very proud of what my husband
and the Clinton Foundation and the associated efforts hes undertaken have accomplished, as well. It is
not unique, however, for spouses of government officials to work and there are very well established
rules for what is expected when that occurs. In this particular case, the Office of Government Ethics and

the career ethics officials at the State Department have looked at the rules and concluded there is not an
inherent conflict of interest in any of my husbands work at all. However, the foundation and the
president-elect decided to go beyond what the law and the ethics rules call for to address even the
appearance of conflict and that is why they signed a memorandum of understanding, which outlines the
voluntary steps that the foundation is taking to address potential concerns that might come up down the
road. (Committee On Foreign Relations, U.S. Senate, Hillary Clinton Confirmation Hearing, 1/13/09)

Clinton: [Obamas] Transition Team Began Working With The Foundation To Try To Craft An
Agreement That Would Avoid The Appearance Of A Conflict But Would Also Ensure That The
Foundation Can Continue Its Work. KERRY: And this is going to take a very significant hands-on
effort, as I think you know. Weve been, obviously, reading about or hearing about the potential of special
envoys, as series of them. Do you want to address that at all today? CLINTON: Well, no final decisions
have been made. That is a tool that I think you will see more use of. I believe that special envoys,
particularly, vis a vis military commands, have a lot to recommend in order to make sure that weve got
the civilian presence well represented. . because all of the independent professionals who do this for
our government said there was no conflict. So its a kind of a catch-as-catch-can problem. I mean, when it
was all submitted to the Office of Government Ethics, they said there was no inherent conflict. My
husband doesnt take a salary. He has no financial interests in any of this. I dont take a salary. I have no
financial interests. So out of that abundance of caution and a desire to avoid even the appearance, the
president-elects transition team began working with the foundation to try to craft an agreement that
would avoid the appearance of a conflict but would also ensure that the foundation can continue its
work. (Committee On Foreign Relations, U.S. Senate, Hillary Clinton Confirmation Hearing, 1/13/09)
Clinton: The Work Of The Foundation And Its Record Of Transparency Were Very Persuasive To
The Transition Team That We Had To Work Out Something To Keep The Foundation In Business
While I Did What I Needed To Do To Be As Transparent As Possible. CLINTON: So the work of the
foundation, the confidence that it has created with donors who know that it has an extremely low
percentage that goes to any overhead. It has a very transparent way that it uses the money. Were very
persuasive to the transition team that we had to work out something to keep the foundation in business
while I did what I needed to do to be as transparent as possible. (Committee On Foreign Relations, U.S. Senate, Hillary Clinton
Confirmation Hearing, 1/13/09)
Clinton: All Contributors Will Be Disclosed And All Contributors To The Clinton Global Initiative
Are Disclosed And Public As Of Now Anyway. Vitter: OK, But That Changes Under The MOU.
Clinton: No. VITTER: OK. Well, if you could consider that suggestion, I think thats a big gap in the
MOU that moving forward, the Clinton Global Initiative is separated from the foundation and then theres
7

no disclosure whatsoever about contributors to the Clinton Global Initiative. The other big gap, it seems
to me, is that the disclosure in the MOU is for new contributors. And so old contributors who re-give or
who even substantially increase their contributions, if its to certain initiatives, arent disclosed. Would
you consider amending that so that all contributions, whether from new contributors or old contributors,
would be disclosed? CLINTON: All contributors will be disclosed and all contributors to the Clinton
Global Initiative are disclosed and public as of now anyway. VITTER: OK, but that changes under the
MOU. CLINTON: No. (Committee On Foreign Relations, U.S. Senate, Hillary Clinton Confirmation Hearing, 1/13/09)
Clinton: There Is No Intention To Amend The MOU. It Has Been Worked Out Between The
Transition And The Foundation. VITTER: OK. Im very happy to hear that. Thats not whats in the
MOU. So if I could simply request, before our vote, a document or an amendment from the transition and
the foundation that clarify that, because under the MOU, moving forward, the Clinton Global Initiative is
separated from the foundation and then theres disclosure under the foundation. CLINTON: Well,
Senator, I believe that all the answers that are relevant to these inquiries are in the record. There is no
intention to amend the MOU. It has been worked out between the transition and the foundation. But the
Clinton Global Initiative is a pass-through. The money of any donors to put on the Clinton Global Initiative
are public and there is no ongoing -- you know, the foundation is a yearly event. Its unlike the foundation.
So we will clarify it. We will definitely clarify that for you. (Committee On Foreign Relations, U.S. Senate, Hillary Clinton
Confirmation Hearing, 1/13/09)
Clinton: [T]his Is An Agreement That Has Been Worked Out Between All Of The Parties And The
Fact Is That The Concerns That Were Raised In The Discussions Between The Foundation And The
President-Elects Team Were Thoroughly Discussed And They Believe, And I Agree, That The
Transparency And Disclosure That Is Needed, Which, As You Said Yourself, It Goes Beyond Any
Kind Of Legal Or Ethical Consideration. VITTER: Theres also been the suggestion from a lot of folks
to disclose the date and amount or at least amount within ranges of new contributions and to do that at
least quarterly rather than annually. Would you be open to that? CLINTON: Well, again, this is an
agreement that has been worked out between all of the parties and the fact is that the concerns that were
raised in the discussions between the foundation and the president-elects team were thoroughly
discussed and they believe, and I agree, that the transparency and disclosure that is needed, which, as you
said yourself, it goes beyond any kind of legal or ethical consideration. And not only that, there will be
ongoing -- there will be ongoing reviews by anything that is brought to the attention of the career
professionals. But I just have to go back, Senator, and try to set the record straight. CGI is not in the
memorandum of understanding because they already have a practice of disclosing all of their
contributions. There is no need to require it. I will certainly state here that theyre going to continue the
practice which theyve already done. No president has ever disclosed the contributions to his foundation.
So when my husband agreed to disclose the contributions to his foundation, that was a very
unprecedented event, which he was happy to do. But the Clinton Global Initiative, which is separate from
the foundation, has always disclosed the contributions. (Committee On Foreign Relations, U.S. Senate, Hillary Clinton
Confirmation Hearing, 1/13/09)

Clinton: And Not Only That, There Will Be Ongoing -- There Will Be Ongoing Reviews By Anything
That Is Brought To The Attention Of The Career Professionals. VITTER: Theres also been the
suggestion from a lot of folks to disclose the date and amount or at least amount within ranges of new
contributions and to do that at least quarterly rather than annually. Would you be open to that?
CLINTON: Well, again, this is an agreement that has been worked out between all of the parties and the
fact is that the concerns that were raised in the discussions between the foundation and the presidentelects team were thoroughly discussed and they believe, and I agree, that the transparency and
disclosure that is needed, which, as you said yourself, it goes beyond any kind of legal or ethical

8

record straight. CGI is not in the memorandum of understanding because they already have a practice of

Initiative, which is separate from the foundation, has always disclosed the contributions. (Committee On Foreign

CLINTON BROKE HER PROMISES MADE IN HER AGREEMENTS WITH THE OBAMA
ADMINISTRATION
PolitiFact Rated The Claim That Clinton Abided By The Ethics Agreement Mostly False.
Granholm said Clinton abided by the ethics agreement between the Clinton Foundation and the Obama
administration. That's a misleading response that ignores what occurred at Clinton's State Department.
Experts told us emails between Clinton aides and a foundation aide may not have been prohibited by the
specific terms of the ethics pledges. But they demonstrate a blurring of the lines between official
government business and Clintons personal connections breaking the firewall Clinton agreed to
preserve. The statement contains an element of truth but ignores critical facts that would give a different
impression. We rate it Mostly False. (Linda Qiu, Clinton Surrogate Spins Clinton Foundation Defense, PolitiFact, 9/24/16)

The Foundation Did Not Disclose All Of Its Donors

Reuters Found That The Foundations Flagship Health Program Stopped Making Annual Donor
Disclosures In 2010. But in a breach of the pledge, the charitys flagship health program, which spends
more than all of the other foundation initiatives put together, stopped making the annual disclosure in
2010, Reuters has found. (Jonathan Allen, Exclusive: Despite Hillary Clinton Promise, Charity Did Not Disclose Donors, Reuters, 3/19/15)

In Response To Questions From Reuters, Officials At CHAI And The Foundation Confirmed
No Complete List Of Donors To The Clintons Charities Has Been Published Since 2010.
(Jonathan Allen, Exclusive: Despite Hillary Clinton Promise, Charity Did Not Disclose Donors, Reuters, 3/19/15)

Clinton Health Access Initiative (CHAI) Released Only A Partial Donor List For The First Time In
2015 And Called Its Failure To Disclose Its Donors In The Past An Oversight. CHAI, which is best
known for helping to reduce the cost of drugs for people with HIV in the developing world, published a
partial donor list for the first time only this year. CHAI should have published the names during 20102013, when Clinton was in office, CHAI spokeswoman Maura Daley acknowledged this week. Not doing
so was an oversight which we made up for this year, she told Reuters in an email when asked why it had
not published any donor lists until a few weeks ago. (Jonathan Allen, Exclusive: Despite Hillary Clinton Promise, Charity Did Not
Disclose Donors, Reuters, 3/19/15)

A Foundation Spokesman Admitted That The Foundation Believed CHAI Was Bound By
Portions Of The Ethics Agreement. The foundation list has not included those who donated just
9

to CHAI since the initiative was spun off in 2010, foundation spokesman Craig Minassian said.
Minassian said the foundation believed CHAI continued to be bound by the agreement with the
Obama administration. (Jonathan Allen, Exclusive: Despite Hillary Clinton Promise, Charity Did Not Disclose Donors, Reuters,

CHAI Failed To Submit Any Foreign Government Donations The State Department For Vetting
While Clinton Was Secretary
The Clinton Foundation Pledged To Allow The State Department To Review Any New Or Increased
Donations From Foreign Governments. The Reuters inquiries also raised questions about a second
assurance Hillary Clinton made to the Obama administration: that the State Department would be able to
review any new or increased contributions to CHAI by foreign governments while she served as the
nation's top diplomat. The Clintons said the pledge was intended to defuse accusations that foreign
governments might use such donations to earn favors. (Jonathan Allen, "Exclusive: Despite Hillary Clinton Promise, Charity Did
Not Disclose Donors," Reuters, 3/19/15)
But The Clinton Health Access Initiative Never Submitted Information On Any Foreign Donations
To State Department Lawyers For Review During Clintons Tenure From 2009 To 2013 The
Clinton Health Access Initiative never submitted information on any foreign donations to State
Department lawyers for review during Clintons tenure from 2009 to 2013, Maura Daley, the
organizations spokeswoman, acknowledged to the Globe this week. (Annie Linskey, Clinton Charity Never Provided

Clintons Ethics Agreement Allowed Foreign Governments To Continue Supporting Existing

Programs, But New Or Increased Donations Had To Be Vetted By The State Department. Under the
deal, those four entities could continue to accept funds from foreign governments already supporting
those programs, but any material increases in donations and any donations from new countries were

supposed to be submitted for review by State Department ethics officials. (Josh Gerstein, Foreign Donation Slipped

received as much as $26.4 million in previously undisclosed payments from major corporations,
universities, foreign sources and other groups The money was paid as fees for speeches by Bill, Hillary
and Chelsea Clinton. Foundation officials said the funds were tallied internally as revenue rather than
donations, which is why they had not been included in the public listings of its contributors published as
part of the 2008 agreement. (Rosalind Helderman and Tom Hamburger, Clinton Foundation Reveals Up To $26 Million In Additional

The Clinton Foundation Accepted Millions From Foreign Governments

An Estimated $181 Million Has Come From Foreign Governments To The Foundation. But an
estimated $181m, or 9%, of its cumulative revenues has come from foreign governments and $54m of
that, or 3% of the total, from autocratic states such as Saudi Arabia and Kuwait. (Bill And Hillary Inc. The Economist,

Rarely, If Ever, Has A Potential Commander In Chief Been So Closely Associated With An

Hillary Clinton Now Finds Herself Under Attack For Her Family Foundations Acceptance Of
Millions Of Dollars In Donations From Middle Eastern Countries Known For Violence Against
Women And For Denying Them Many Basic Freedoms. It was supposed to be a carefully planned
anniversary to mark one of the most important and widely praised moments in Hillary Rodham Clintons
political career and to remind the country, ahead of a likely 2016 presidential campaign, about her
long record as a champion for the rights of women and girls. Instead, as Mrs. Clinton commemorates her

13

1995 womens rights speech in Beijing in back-to-back events in New York, she finds herself under attack
for her family foundations acceptance of millions of dollars in donations from Middle Eastern countries
known for violence against women and for denying them many basic freedoms. This was not how she
intended to reintroduce herself to American voters. (Amy Chozick, Hillary Clinton Faces Test Of Record As Womens Advocate,
The New York Times, 3/8/15)

While Advancing Women Has Been Her Central Lifes Work, Even Clintons Most Strident
Critics Could Not Have Predicted She Would Prove Vulnerable On The Subject. Mrs.
Clintons glide path to a likely April announcement that she will seek the presidency was built
around womens issues. Advancing women has been her central lifes work, as she and her
admirers say proudly; she made it a priority as secretary of state and focused on it as a
philanthropist. But that focus also allowed Mrs. Clinton, who played down her gender in 2008, to
frame her second attempt at the White House in what could be one way to make it special and
new: as a shot at history for her and for all women. And for someone who has so long been
lampooned, and demonized on the right, as overly calculating, playing up her gender as a strength
would also allow her to demonstrate her nurturing, maternal and newly grandmotherly side
to voters whom she may have left cold in the past. Even her most strident critics could not have
predicted that Mrs. Clinton would prove vulnerable on the subject. (Amy Chozick, Hillary Clinton Faces Test Of

The State Department Has Highlighted Human Rights Abuses, Including Sex Discrimination, In
Countries That Have Given The Foundation Tens Of Millions Of Dollars. But the Bill, Hillary &
Chelsea Clinton Foundation has accepted tens of millions of dollars in donations from Saudi Arabia, the
United Arab Emirates, Kuwait, Oman, Qatar, Algeria and Brunei all of which the State Department has
faulted over their records on sex discrimination and other human-rights issues. (Amy Chozick, Hillary Clinton Faces
Test Of Record As Womens Advocate, The New York Times, 3/8/15)

Saudi Arabia, A Particularly Generous Benefactor To The Clinton Foundation, Was

Tersely Faulted By Clintons State Department For Gender Discrimination. The
departments 2011 human rights report on Saudi Arabia, the last such yearly review prepared
during Mrs. Clintons tenure, tersely faulted the kingdom for a lack of equal rights for women and
children, and said violence against women, human trafficking and gender discrimination, among
other abuses, were all common there. Saudi Arabia has been a particularly generous benefactor
to the Clinton Foundation, giving at least $10 million since 2001, according to foundation
disclosures. At least $1 million more was donated by Friends of Saudi Arabia, co-founded by a
Saudi prince. (Amy Chozick, Hillary Clinton Faces Test Of Record As Womens Advocate, The New York Times, 3/8/15)

Clinton Has Dodged When Asked About Foundation Donor Countries With Poor Human
Rights Records
At A March 2015 Press Conference, Clinton Dodged On The Clinton Foundations Acceptance Of
Donations From Countries With Poor Womens Rights Records. QUESTION: Could you answer the
questions that have been raised about foreign contributions from Middle Eastern countries like Saudi
Arabia, that abuse women, or permit violence against women to the family foundation, and whether that
disturbs you, as you are rightly celebrating 20 years of leadership on this issue. CLINTON: Well, those

14

are two very different questions, let me see if I can take them in order With respect to the Foundation, I
am very proud of the work that the Foundation does, very proud of the hundreds of thousands of people
who support the work of the Foundation and of the results that have been achieved for people, here at
home and around the world. And, I think that we are very clear about where we stand, certainly where I
stand, on all of these issues, there cant be any mistake about my passion concerning womens rights here
at home and around the world, um, so I think that people who want to support the Foundation, know full
well what it is we stand for and what were working on. (Hillary Clinton, Remarks At The United Nations, 3/10/15)

National Security Advisor Susan Rice Singled Out Brunei As One Of The Worlds Worst
Transgressors Against Gay Rights. On Tuesday, President Barack Obama's national security advisor
singled out Brunei as one of the world's worst transgressors against gay rights. Unfortunately, in too
many places, being gay or transgender is enough to make someone the target of slurs, torments, and
violence, Susan Rice told a gathering of LGBT activists at the White House. "We all know the names of
Harvey Milk, Eric Lembembe, David Kato, and too many other brave advocates who refused to hide or be
silenced, and who have been ostracized or killed for their work. In many places, allies and supporters of
the LGBT community are also penalized, Rice continued. New laws in Uganda and Nigeria incite the fear
of arrest and detention for those who provide health services or defend basic legal rights in court. In
addition to the pernicious so-called 'propaganda/ law already on the books, proposed legislation in
Russia would allow the government to take children away from their gay parents. There are almost 80
countries eight-zero countries in this world where discrimination against LGBT citizens is

16

enshrined in law, and that number threatens to grow. In seven countries eight, if Brunei continues on
its path same-sex acts are punishable by death. (Tina Daunt, Activists Set Worldwide Day of Protest Against Sultan of Brunei,

fresh questions about whether the State Department showed favoritism to Clinton Foundation donors --
an issue that has continued to dog the Democratic nominee during the 2016 presidential contest. Newly
released documents, obtained by the conservative watchdog group Citizens United and provided to CNN,
show the State Department was interested in purchasing land for a new US consulate in a development
called Eko Atlantic on the coast of Lagos in 2013, in a story first reported on by Fox News. The
development is managed by Ronald Chagoury and funded by an umbrella company owned by him and his
brother Gilbert Chagoury. (Laura Koran, Questions About Clinton Ties To Foreign Businessmen Brothers, CNN, 8/17/16)

While Clinton Was Secretary Of State, The Eko Project Was Identified As A Potential Property For
The State Department To Purchase. Clinton had left the State Department before it sent a letter three

years ago expressing interest in possibly buying the property. While the letter was sent after she had left
office, the State Department had identified the Eko project as a potential location when Clinton was still
secretary of state in 2012. Asked if Clinton was cognizant of that, a department spokeswoman said earlier
this week, I'm not aware she was. (Laura Koran, Questions About Clinton Ties To Foreign Businessmen Brothers, CNN, 8/17/16)

Clinton Made Time For Private Meetings With Foundation Donor Daniel Abraham While She
Was Secretary Of State Where They Discussed Foreign Policy
Daniel Abraham Has Given Between $5 And $10 Million To The Clinton Foundation. Abraham has
given $5 million to $10 million to the Clinton Foundation and donated $1.2 million in 2012 to Priorities
USA Action, a super PAC supporting Clinton in 2016. Abraham told the AP that he assumed that he and
Clinton discussed Mideast policy during their contacts. (Stephen Braun, Clinton Opened State Department Office To Dozens Of
Corporate Donors, Dem Fundraisers, The Associated Press, 11/30/15)

Abraham Secured At Least Three Meetings With Clinton When She Was Secretary Of State, And
Was Slated To Meet Three Other Times With The Billionaire. Clinton favored a select group of
visitors at least two dozen for repeated meetings. Abraham, the billionaire behind SlimFast diet
products and chairman of the S. Daniel Abraham Center for Middle East Peace, met with Clinton at least
three times and was slated to meet her three other times, according to her calendars and schedules.
Clinton's calendars showed they met at her office in May 2009 and October 2010. Clinton also spoke at an
Abraham Center event in April 2010. (Stephen Braun, Clinton Opened State Department Office To Dozens Of Corporate Donors, Dem
Fundraisers, The Associated Press, 11/30/15)

Abraham And Clinton Typically Discussed Mideast Policy. Four meetings with S. Daniel Abraham, a
multimillionaire who founded the Center for Mideast Peace, were noted in Clinton's calendar. But in four
other sessions including two listed only as private meeting Abraham's name was omitted.
Abraham, a prolific fundraiser for Clinton's 2008 campaign who has donated $3 million to a super PAC
backing Clinton in 2016, told the AP last year that he and Clinton typically discussed Mideast policy.

The Power To Sign Off On The Uranium Deal Rests With The Committee On Foreign Investment In
The United States. When a company controlled by the Chinese government sought a 51 percent stake
in a tiny Nevada gold mining operation in 2009, it set off a secretive review process in Washington, where
officials raised concerns primarily about the mines proximity to a military installation, but also about the
potential for minerals at the site, including uranium, to come under Chinese control. The officials killed

Clinton Placed Foundation Donor On A Government International Security Board With No

Board. "Today, the International Security Advisory Board (ISAB) met with Under Secretary Bill Burns,

Assistant Secretary Andrew Shapiro and Acting Assistant Secretary Vann Van Diepen. The meeting

Fernando Was Appointed To The State Departments International Security Advisory Board By
Clintons Chief Of Staff Cheryl Mills At Her Insistence. The newly released emails reveal that after
ABC News started asking questions in August 2011, a State Department official who worked with the
advisory board couldnt immediately come up with a justification for Fernando serving on the panel. His
and other emails make repeated references to S; ABC News has been told this is a common way to refer
to the Secretary of State. The true answer is simply that S staff (Cheryl Mills) added him, wrote Wade
Boese, who was Chief of Staff for the Office of the Under Secretary of State for Arms Control and
International Security, in an email to Mannina, the press aide. Raj was not on the list sent to S; he was

government intelligence advisory board even though he had no obvious experience in the field, a

dozen of the president's top fundraisers received ambassadorships during his first term, and dozens
more have been placed in various key posts in his administration. Fernando's appointment stands out,
