COMPLAINT - AFFIDAVIT
I, AMANDA RUGISTA, of legal age, Filipino Citizen, married and
resident of Davao, Philippines, after being sworn to in accordance with law,
hereby depose and state that:
1. I am married to Atty.Rod Rugista, a prominent lawyer and
managing partner of Batas Law Firm, on May 2011 which was
held at San Pedro Church in Davao, as evidenced by a marriage
certificate issued by the office of solemnizing officer of the said
church herein attached as Annex A,
2. After our wedding, we happily lived together as husband and wife
in our conjugal dwelling in Davao City.
3. As result of our loving relationship, Rod Rugista and I was given a
3 year old son.
4. On June 2014, while going to the school where I teach, I am
suddenly stop when I saw my husband on the newspaper. At first, I
thought that the reason was that my husband did great from his
work because he is a prominent lawyer. Then suddenly, I was
shocked, while reading the newspaper, discovering that Rod
Rugista, my husband, was has a previous marriage
5. I was unaware that my husband was still married to his first wife.
In fact, that Rod Rugista showed a divorce papers as a proof that
he was single at the moment we met, that divorce papers were
obtained from Havana in 2010.
6. I was both surprised and insulted by this revelation since it appears
that I am merely a second wife. All the while, I thought that I was
the one and only wife.
7. The act of contracting second marriage of my husband to me
constitutes the crime of bigamy which punishable under Article
349 of the Revised Penal Code.

8. I executed the foregoing complaint affidavit to attest to the truth

of the facts stated and for the purpose of charging respondent with
the crime of bigamy.
PRAYER
WHEREFORE, premises considered, it is most respectfully prayed
of this Honorable Court that judgment be rendered in favour of the
complainant and that after judgment;
a. The respondent, Rod Rugista, shall be ordered to pay the
amount of PHP 200,000.00 for moral damages, plus cost of suit.
b. The respondent be convicted in violation of the crime bigamy
which is punishable under Article 349 of the Revised Penal
Code.
Such other reliefs and remedies under the premises are likewise
prayed for.

correct of my personal knowledge and/or on the basis of copies of
documents and records in my possession.
4. I have not commenced any other action or proceeding involving the
same issues in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;
5. To the best of my knowledge and belief, no such action or proceeding
is pending in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;
6. If I should thereafter learn that a similar action or proceeding has been
filed or is pending before the Supreme Court, the Court of Appeals, or
any other tribunal or agency, I undertake to report that fact within five
(5) days therefrom to this Honorable Court.
TO THE TRUTH OF THE FOREGOING, I have signed this
Complaint Affidavit with a prayer on September 25, 2016.
