AN ORDINANCE SETTING THE RATES FOR THE USE OF THE MISAMIS
OCCIDENTAL PROVINCIAL ATHLETIC COMPLEX (MOPAC)

PREFATORY STATEMENT
The Provincial Government of Misamis Occidental (PGMO) started its project of
Design and Construction of Grandstand with Classrooms and Commercial Space for the
purpose of restoring the glory and grandeur of the Misamis Occidental Provincial Athletic
Complex (MOPAC) so that it can once again serve as venue for athletic meets and other
activities, aside from boosting the economy of the Province of Misamis Occidental;
The PGMO must be sensible to raise funds in order to maintain its facilities & sustain
its operation. Towards this end, it welcomes public, private individuals and groups to use the
Sports Complex for the different activities. Consequently, it must charge rental fees to cover
expenses for lights, electricity and maintenance, provided, that the collected rental fees shall be
deposited in a Trust Fund to be used for the maintenance and upkeep of the sports complex,
hence,
BE IT ORDAINED by the Sangguniang Panlalawigan of Misamis Occidental in
Session that:
SECTION 1. TITLE - This Ordinance shall be known as An Ordinance Setting the
Rates for the Use of the Misamis Occidental Provincial Athletic Complex (MOPAC);
SECTION 2. FEES AND RENTALS. For the use of MOPAC the following fees and
rentals shall be charged:

The fees during Night time shall double the fees during Day time because of the

electricity consumption.
4. GRANDSTAND. The rates shall be based on the whole day use. Whole day means a
maximum of 8 hours from 8:00 a.m. to 5:00 p.m. An additional cost of rental as
cleaning fee of the facility shall be set by the Complex Management Committee.

6. TICKET SALES COMMISSION. The Complex Management Committee shall be


entitled to a Ticket Sales Commission of P5.00 per ticket sold for whatever event.

8. NINE (9) COMMERCIAL STALLS. a) The rental fee of each of the EIGHT (8)
Commercial stalls shall be subject to public bidding with a minimum bid price of
FIVE THOUSAND PESOS (P5,000.00); b) ONE (1) stall under the main stairs of the
main entrance is a Strategic Space shall be charged with a minimum bid price of TEN
THOUSAND PESOS (P10,000.00) exclusive of the actual electricity and water
consumption;
9. POOL SITE CAFE. The rental fee of the Pool Site Cafe shall be subject to public
bidding with a minimum bid price of FIVE THOUSAND PESOS (P5,000.00)
exclusive of the actual electricity and water consumption;
10. TEN (10) CLASSROOMS. a) the two (2) Classrooms out of Ten (10) Classrooms will
be intended for public use. b) the remaining eight (8) Classrooms shall be subject to
public bidding with a minimum bid price of FIVE THOUSAND PESOS (P5,000.00)
exclusive of the actual electricity and water consumption;

SECTION 3. GENERAL GUIDELINES. That the following Guidelines shall be


observed for the use of the services, amenities, facilities, stalls and rooms of the MOPAC;
1. The Provincial Government of Misamis Occidental (PGMO) as the sponsoring
entity to government related functions and activities is entitled to use all of the
facilities in the Complex for free. However, the PGMO shall pay for the electricity
consumption of the entire activity or function;
2. Similarly, the Department of Education shall also enjoy the same privilege as that of
the PGMO and likewise shall pay only for the electricity consumption;

3. All other Government entities are entitled to a 50% discount, provided that the
activity is government-related and is subject to assessment and evaluation of the
MOPAC Management Committee;
4. In cases wherein the event organizer will use their own sound system with high
electricity consuming equipments like sound blasters and other similar gadgets, the
Complex Management shall have the right to charge corresponding rental increase
and rehearsal charges based on the assessment of the Managements Electrical
Team;
5. All renter cannot sublease the premises without the written consent of the Complex
Management Committee.
6. The Provincial Treasurers Office or its authorized collecting officer on duty at the
MOPAC entrance shall be in- charge in the collection of fees.
SECTION 4. BOOKING FEE. A booking fee of 20% of the total rental must be paid
to the Provincial Treasurers Office upon acceptance of the booking application by the
Complex Management Committee. If the event pushes through, the booking fee shall be
deductible from the total rentals. If the event does not push through or is canceled, the
Organizers booking fee shall be forfeited in favor of the Sports Complex Management.
The payment of the Total Event Rental must be completely made two (2) days before
the event schedule wherein a corresponding Event Permit shall be issued by the Complex
Management upon receipt of the Official Receipt (O.R.) of payment;
SECTION 5. BOOKING TIME. The booking must be made at least a month before
the event and must be confirmed within 3 working days upon actual receipt of the booking
request by the requesting party from the Provincial Treasurers Office;
SECTION 6. RE-SCHEDULED EVENTS. That the organizers are given seven (7)
calendar days before the event to inform the Management of any change of the event date.
After seven (7) calendar days, the Sports Complex Management is not liable for accepting
other applications. In cases wherein the organizer changes the event date, and the venue is
already booked for another event, the Management is not liable for any cost damage as a result
of the postponement made by the organizer. Re-scheduling of events can be allowed only
twice. The booking fee shall be forfeited in favor of the Complex Management should
rescheduling is made more than two (2) times;
SECTION 7. TRUST FUND. All rental fees/income of the Complex Facilities shall be
placed in a separate account under a Trust Fund to be used for the maintenance and upkeep of
the sports complex.
SECTION 8. THE MOPAC MANAGEMENT COMMITTEE
1. Creation & Composition. There is hereby created the MOPAC Management
Committee for efficient implementation of this Ordinance.
The Management Committee shall be composed of the following:

2. Functions/Duties/Responsibilities
a) The Management Committee shall execute the policies and measures to attain
the objective of this Ordinance;
b) Formulates the design of the grandstand/bleachers and other sports facilities at
the MOPAC;
c) Acts as coordinator of funds from other agencies;

d) Recommends appropriate actions in governing the operation and management of


MOPAC; and
e) Performs other duties and functions as may be delegated from time to time in
order to attain the objectives of this Ordinance.
SECTION 9. THE MOPAC ADMINISTRATIVE COMMITTEE.
1. Composition. The MOPAC Administrative Committee shall be created to facilitate
the management and operation of the Complex.
The Administrative Committee shall be composed of the following:

2. Functions/Duties/Responsibilities
a) The MOPAC Administrative Committee shall be the over-all in-charge of
MOPAC Grandstand Facilities;
b) Maintains the building structures, swimming pool, oval and other sports
facilities and equipment; and
c) In-charge of bookings, rentals, and expenditures.
SECTION 10. AUTHORITY - That this Ordinance is pursuant to R.A. 7160, The
Local Government Code of 1991;
SECTION 11. EFFECTIVITY - That this Ordinance shall have a retroactive effect
starting _________. Nevertheless, the same shall still comply with the posting requirements of
R.A. 7160, posted in a bulletin board at the entrance of the Provincial Capitol and in at least two (2)
other conspicuous places in the local government unit of Misamis Occidental.
