ORDINANCE NO. 12135-2011


AN ORDINANCE AMENDING CERTAIN SECTIONS OF ORDINANCE NO. 11075-2008, OTHERWISE
KNOWN AS THE CCTV INSTALLATION ORDINANCE OF 2008, IN THE MANNER PROVIDED FOR
HEREIN
BE IT ORDAINED by the City Council (Sangguniang Panlungsod) of the City of Cagayan de Oro in
session assembled that:
SECTION 1. - Section 2 (Definition of Terms) of Ordinance No. 11075-2008, otherwise known as the
CCTV Installation Ordinance of 2008, is hereby amended by adding therein paragraph (G) to read as follows:

High-Risk Establishments shall refer to establishments such as but not limited to


banks, lending institutions, pawnshops, money changer shops, internet cafes,
gasoline stations, lotto outlets, convenience/grocery stores, restaurants and shopping
malls, which are prone or susceptible to incidence of robbery and theft per
documentation by the Cagayan de Oro City Police Office.

SECTION 2. - Section 13 (Enforcement; Civil Penalties) of the same ordinance is also hereby amended
so as to add therein paragraph (D) to read as follows:

In relation to Paragraph (A) of this Section, the City Mayor is hereby authorized to
cancel the business permits of High-Risk Establishments found not complying with
the provision/s of this Ordinance, or implement a No CCTV, No Business Permit
Policy for the such establishments.

SECTION 3. - Section 6 (Access to Recordings) of the said Ordinance is likewise hereby amended, to
read in full as follows:

SECTION 6. - ACCESS TO RECORDINGS. - If a crime occurs or an employee believes a
crime has occurred, the business establishment shall contact the Cagayan de Oro City Police
Office immediately and it shall provide immediate access to the media or CCTV/video
recordings containing the recorded event to the police and investigators. Only the
investigators and those authorized by the City Police Director, however, shall be allowed to
view the video footages.
Upon written request of police and other law enforcement investigators, it shall be
the duty of the business establishment in-charge to immediately provide the police with a
copy of the segment or part the media or CCTV/video recordings containing the recorded
crime incident.

SECTION 4. -This Ordinance shall take effect upon its approval.
