Section1.ItisherebydeclaredapolicyoftheGovernmenttopromoteandencouragethedevelopmentofeconomicandsocializedhousingprojects,primarilyby
theprivatesector,inordertomakeavailableadequateeconomicandsocializedhousingunitsforaverageandlowincomeearnersinurbanandruralareas.
Sec.2.As used in this Act, economic and socialized housing refers to housing units which are within the affordability level of the average and lowincome
earnerswhichisthirtypercent(30%)ofthegrossfamilyincomeasdeterminedbytheNationalEconomicandDevelopmentAuthorityfromtimetotime.Itshall
alsorefertothegovernmentinitiatedsitesandservicesdevelopmentandconstructionofeconomicandsocializedhousingprojectsindepressedareas.
Sec.3.Tocarryouttheforegoingpolicy,theMinistryofHumanSettlementsisauthorizedtoestablishandpromulgatedifferentlevelsofstandardsandtechnical
requirementsforthedevelopmentofeconomicandsocializedhousingprojectsandeconomicandsocializedhousingunitsinurbanandruralareasfromthose
provided in Presidential Decree Numbered Nine hundred fiftyseven, otherwise known as the "Subdivision and Condominium Buyers' Protective Decree,"
PresidentialDecreeNumberedTwelvehundredandsixteen,"DefiningOpenSpaceinResidentialSubdivision"PresidentialDecreeNumberedTenHundredand
ninetysix,otherwiseknownasthe"NationalBuildingCodeofthePhilippines"andPresidentialDecreeNumberedElevenhundredandeightyfive,otherwise
known as the "Fire Code of the Philippines" and the rules and regulations promulgated thereunder, in consultation with the Ministry of Public Works and
Highways,theIntegratedNationalPolice,andotherappropriategovernmentunitsandinstrumentalitiesandprivateassociations.
Sec.4.ThestandardsandtechnicalrequirementstobeestablishedunderSectionthreehereofshallprovideforenvironmentalecology,hygieneandcleanliness,
physical,culturalandspiritualdevelopmentandpublicsafetyandmayvaryineachregion,provinceorcitydependingontheavailabilityofindigenousmaterials

forbuildingconstructionandotherrelevantfactors.
Sec.5.ThedifferentlevelsofstandardsandtechnicalrequirementsthatshallbeestablishedandpromulgatedbytheMinistryofHumanSettlementsonlyafter
publichearingandshallbepublishedintwonewspapersofgeneralcirculationinthePhilippinesforatleastonceaweekfortwoconsecutiveweeksandshalltake
effectthirtydaysafterthelastpublication.
Sec.6.ThisActshalltakeeffectuponitsapproval.

ANNEXARULESANDSTANDARDSFORECONOMICANDSOCIALIZEDHOUSINGPROJECTSTOIMPLEMENTBATASPAMBANSA
PursuanttoSec.3ofBatasPambansaBlg.220andbyvirtueofSec.4(f)ofPresidentialDecree1396,thefollowingrulesandlevelsofstandardsarehereby
promulgated.
RULEI
GENERALPROVISIONS
Section1.ScopeofApplication.Theserulesandstandardsshallapplytothedevelopmentofeconomicandsocializedhousingprojectsinurbanandruralareas
asdefinedinSec.2ofBPBlg.220.Theyshallapplytothedevelopmentofeitherahouseandlotorahouseorlotonly.
TheserulesandstandardsshallalsoapplyinthecaseofindividuallotownerwhobelongtothecategoryofaverageoflowincomeearnersasdefinedinBPBlg.
220andwhoshallcausetheconstructionoftheirhousesaftertheeffectivityoftheseRules.
Sec.2.Declaration of Policies. It is a policy of the government to promote and encourage the development of economic and socialized housing projects,
primarilybytheprivatesectorinordertomakeavailableadequateeconomicandsocializedhousingunitsforaveragedandlowincomeearnersinurbanandrural
areas.

DEFINITIONOFTERMS
Sec.3.Asusedinthisrules,thefollowingwordsandphrasesaredefinedandunderstoodtohavethemeaningcorrespondinglyindicatedtherein.
ALLEY:Apublicwayintendedto
servebothpedestrianand
emergencyvehicles,andalso
accesstolots,bothendalways
connectingtostreets.
BLOCK:Aparceloflandboundedon
thesidesbystreetsoralleysor
pathwaysorothernaturalor

RULEIII
MINIMUMDESIGNSTANDARDSANDREQUIREMENTSFORECONOMICANDSOCIALIZEDHOUSING
Sec. 4. Compliance with standards required. Development of economic and socialized housing project shall be in accordance with the minimum design
standardshereinsetforth.
Sec.5.Basisandobjectivesoftheminimumdesignstandards.Theminimumdesignstandardssetforthhereinareintendedtoprovideminimumrequirements
within the generally accepted levels of safety, health and ecological considerations. Variations, however are also possible, as may be based on some specific
regional,culturalandeconomicsetting,e.g.,buildingmaterials,spacerequirementsandusage.TheparametersusedinformulatingtheseDesignStandardsare:
A.Protectionandsafetyoflife,limb,propertyandgeneralpublicwelfare.
B.Basicneedsofhumansettlements,enumeratedindescendingorderasfollows:
1)Water
2)MovementandCirculation
3)Stormdrainage
4)SolidandLiquidWasteDisposal
5)Power
6)Park/Playground
Theprovisionofthesebasicneedsshallbebasedontheactualsettingwithinwhichtheprojectsiteislocated.
C.Affordabilitylevelsoftargetmarket
D.Location
The Actual setting of project site shall determine the type and degree of development to be required in a subdivision/housing project regardless of political
boundaries.Withrespecttothis,thedegreeonlevelofdevelopmentshallbedefinedasfollows:
1)UnderdevelopedAreacharacterizedbythepredominantabsenceofutilitysystemsornetworks,especiallywatersupply,roadsandpower.
2)DevelopedAreacharacterizedbythepredominantpresenceofutilitysystemsornetwork,especiallywatersupply,roadsandpower.
Sec.6.TechnicalGuidelines.Indeterminingwhetheraneconomicandsocializedhousingshallbeallowed,thefollowingguidelinesshallbeconsidered.
A.SuitabilityofSite
1.PhysicalSuitability
Apotentialsitemusthavecharacteristicsassuringhealthful,safeandenvironmentallysoundcommunitylife.Itshallbestableenoughtoaccommodatefoundation
loadwithoutexcessivesiteworks.Criticalareas(e.g.,areassubjecttoflooding,landsslidesandstreet)mustbeavoided.
2.Slope
Flattorollingterrain(0to5%)arepreferablebuthousingdevelopmentmaytakeplaceupto15%slopes,withflatlands(below5%)forhighdensitydevelopment
andslopingarea(515%)forlowtomediumdensitydevelopment.Thelatterslopes,however,shouldbecapableofbeingdevelopedforhabitationatreasonable
costwithassuranceofstabilityforverticalconstruction.
3.Availabilityofbasicneeds
Theprioritizedbasicneedscitedearliershallpreferablybeavailablewithinreasonabledistancefromtheprojectsite,butwherethesearenotavailable,thesame
shallbeprovidedforbythedeveloper.
4.ConformitywiththeZoningOrdinanceorLandUsePlanoftheCity/Municipality
Generally, housing projects should conform with the Zoning Ordinance of the city/municipality where they are located. However, where there is no Zoning
OrdinanceorLandUsePlan,thedominantlanduseprincipleandsitesuitabilityfactorscitedhereinshallbeusedindeterminingsuitabilityofaprojecttoasite.
Furthermore,iftheprojectisundoubtedlysupportiveofotherlandusesandactivities,(e.g.,housingforindustrialworkers)saidprojectshallbeallowed.
B.Allowanceforfuturedevelopment
Projectdesignshouldconsidernotonlythereductionofcostofdevelopmenttoaminimumbutalsoprovisionforpossiblefutureimprovementorexpansion,as
intheprescriptionoflotsizes,rightsofwayofroads,openspace,allocationofareasforcommonusesandfacilities.

C.LandAllocation
1.Saleableandnonsaleableare
Thereshallbenofixedratiobetweensaleableportionandnonsaleableportionofasubdivisionproject.
2.AreaallocatedforCirculationSystem
Theareaallocatedforthecirculationsystemshallnotbefixed,aslongastheprescribeddimensionandrequirementsforaccess(toboththeprojectsiteandto
dwellingunits)specifiedintheseDesignStandardsarecompliedwith.
3.Areaallocatedforcommunityfacilities
Sitesforcommunityfacilitiesshallbereservedorallocatedbythedeveloper,wheresuchfacilitiesmaybeconstructed/putuptheHomeownersAssociationasthe
needarises.SaidsitesshallbeusedexclusivelyforthesefacilitiesasdefinedinRuleII,andtheareashallbeexclusiveofthatareaintendedforpark/playground.
Theareaallocatedforcommunityfacilitiesshallvarywiththedensityofthesubdivision,i.e.,numberoflotsand/orlivingunitswhicheverisapplicable,asshown
inTableI.

Sec.7.DesignStandardsandPlanningConsiderations.Thefollowingdesignstandardsandplanningconsiderationsshallbeobservedbyallprojectscovered

A.WaterSupply
1.UnderdevelopedArea
Minimumrequirementshallbeprovisionofcommunalwells.
Watersupplymustbepotableandadequateatleast43literspercapitaperday.Supplysourceshallbeidentifiedanddevelopedbytheprojectdeveloper/owner.
Whenever a body of water shall be utilized for community waters supply, permits from the National Water Resource Council (NMRC) shall be obtained.
StandardssetbytheRegionalWaterResourceCouncil(RWRC)onwatersourcedevelopmentshallbecompliedwith.Eachwellshallbeallocatedapproximately
four(4)squaremetersareawhichshallformpartoftheareaforcommunityfacilities(asdefinedinRuleII)andshallnotencroachonanysaleablylotorrightof
way.
2.DevelopedArea
Wheneverapublicwatersupplysystemexists,connectiontoitbythesubdivisionismandatory.Eachlotand/orlivingunitshallbeservedwithwaterconnection
(regardlessofthetypeofdistributionsystem).Watersupplyprovidedbythelocalwaterdistrictshallbecomplemented/supplementedbyothersources,when
necessary,suchascommunalwellwhichmaybelocatedstrategicallyforeaseandconvenienceinfetchingwaterbyresidentsandatthesametimenotcloserthan
300metersfromeachother.
If public water supply system is not available, the developer shall provide for an independent water supply system within the subdivision project. Minimum
quantityrequirementshallbe75literspercapitaperday.
Likewise,requiredpermitsfromtheNWRCshallbeobtainedandstandardsoftheLocalWaterUtilitiesAdministrationshallbecompliedwith.
Ifgroundreservoiristobeputup,andareashallbeallocatedforthispurpose(partofallocationforcommunityfacilities).Thesizeshalldependonvolumeof
waterintendedtobestored.Provideforprotectionfrompollutionnamely,bufferofatleast25metersfromsourcesofpollution/contamination.
Forelevatedreservoir,structuraldesignshallcomplywithacceptedstructuralstandards.
B.CirculationSystem
1.CirculationsystemshallbethesameinbothUnderdevelopedAreaandaDevelopedAreaprojectsexceptfortypeofpavementwhichisadoptedonregionalor
locationalpeculiaritiesoftheprojectsite.

2.PlanningConsiderationsorCirculationLayout

areincontinuationofexistingones.Streetnamesshallberecognizableandreadable.
Thedevelopershallbearthecostofpurchaseandinstallationofstreetnames/signscoincidentwiththeconstructionofstreetsandutilities.
f)Sidewalksshallnotberequiredwhendrainagesystemisthroughopencanalswhendrainagecanalsarecoveredorunderground,thespaceabovethecanals
shallbeutilizedassidewalk.
C.DrainageSystem
Drainagesystemshallberequiredinallprojects.
Anopencanaloneachsideofthecirculationnetworkshallbeprovided.Saidcanalshallhaveappropriateslopetoeffectgooddrainage.Moreover,thesidesof
theopencanalshallbelinedwithgrassorstonestopreventerosion.Seeillustrationbelow.
Incaseofnonexistenceofdrainagesysteminthelocality,catchmentareafordrainagedischargesshallbeprovidedforanddevelopedbythedeveloper/ownerin
consultationwithlocalauthoritiesorprivateentitiesconcerned,topreventfloodingofadjacentproperty.Moreover,saidcatchmentareshallbemadesafeand
maintainedandshallformpartofthepark/playgroundrequirement.
D.SewageDisposalSystem
Theminimumrequirementforsewagedisposalshallbetheuseofseptictank.
Forsingledetachedunitsandmultiunitbuildings,communalseptictanksmaybeallowed.
Drainfieldareaofaffluentshallbe25.00metersminimumdistancefromanysourcesofwater(well,spring,etc.).
E.ElectricalPowerSupply
1.UnderdevelopedArea
Electricalpowersupplyisoptional.However,thedevelopershallallocatesufficientlandareaforeasementsforpowersupplyfacilitiesbasedonexistinglawsand

4.DistancetoExits.Nopointinabuildingshallbemorethan45.00metersfromanexteriorexitdoor,ahorizontalexit,exitpassageway,oranenclosed
stairway, measured along the line of travel. In a building equipped with the complete, automotive fire extinguishing system the distance from exits may be
increasedto60.00meters.
5.AutomaticSmokeDetectionAlarmInitiatingDevice.Automaticsmokedetectionalarminitiatingdevicesshallbeinstalledineveryfamilydwellingunit
locatedandadjustedtooperatereliablyincaseofabnormalaccumulationofsmokeinanypartoftheprotectedarea.Installationofsmokedetectionalarminitiating
deviceshallbeapprovedfortheparticularapplication,locationandspacing.
c. Corridors and Exterior Exit Balconies. The provisions herein shall apply to every corridor and exterior exit balcony serving as a required exit for an
occupantloadofmorethanfifty(50).
1.Width.Everycorridororexitbalconyshallnotbelessthan1.20metersinwidth.
2. Projections. The required width of corridors and exit balconies shall be unobstructed. Doors in any position shall not reduce the required width of the
corridorbymorethanonehalf.
3.AccesstoExits.Whenmorethanoneexitisrequired,theyshallbesoarrangedtoallowgoingtoeitherdirectionfromanydeadendpoint.
4.DeadEnds.Corridorsandexteriorexitbalconieswithdeadendsarepermittedwhenthedeadendnotexceed12.00metersinlength.
5.Construction.Wallsofcorridorsabovethefirststoreyshallbeofmasonry(e.g.CHB,bricks,titles,etc.).CeilingsshalllikewisebefireresistiveProvided,

6. Openings. Where corridor walls are required to be fireresistive, every interior door opening shall be protected as set forth in generally recognized and
acceptedrequirementsfordualpurposefireexitdoors.Thetotalareofallopeningsotherthandoors,inanyportionofaninteriorcorridorwallshallnotexceed
twentyfive(25)percentoftheareaofthecorridorwalloftheroombeingseparatedfromthecorridor.
7.Ramps.Changesinfloorelevationoflessthan300metersalonganyexitservingatributaryoccupantloadof10ormoreshallbebymeansoframps.The
maximumallowableslopeforrampsisfifteen(15)percent.
d.CommonStairways.Exceptforstairsorladdersusedonlytoserveasaccesstoequipment,everystairwayinsideamultifamilydwellingservingtwoor

3.DrainageSystem.Surfacerunoffsshallbechanneledtoappropriaterepositories.
4.SewageDisposalSystem.Sewagedisposalmaybeaccomplishedbyanyofthefollowingmeans:
a.Dischargetoanexistingpublicseweragesystem.
b.Treatmentinacommunitydisposal,plant,orcommunalseptictank.

C.GeneralConstructionRequirements
1.StructuralRequirements
AllconstructionshallconformwiththeprovisionsofthelatesteditionofthePhilippineStructuralCode.
2.ElectricalRequirements
Allelectricalsystems,equipmentandinstallationshallconformwiththeprovisionsofthelatesteditionofthePhilippineElectricalCodeandtherequirementsof
theelectricutilitythatservesthelocality.
3.SanitaryRequirements
Allsanitarysystems,equipmentandinstallationshallconformwiththeprovisionsofthelatesteditionoftheNationalPlumbingCode.
4.ConstructionMaterials
Theuseofindigenousmaterialsforsitedevelopmentandconstructionofdwellingsshallbeencouraged,aslongastheseareinconformitywiththerequirements
oftheseRulesandensuresabuildinglifespanofatleast25years,orinacorrespondencetoloantermsofpayment.
Sec. 9. Variances/Exemptions. Variances from these standards and requirements may be granted when strict observance hereof will cause unnecessary
hardshiptotheowner/developerorprejudiceintendedbeneficiariessuchasinthecaseofregionalconsiderations/characteristics,peculiaritiesofthelocationand

APPLICATIONANDAPPROVALOFPLANSANDBUILDINGDESIGNS
Sec.10.ApprovalRequired.Nodevelopmentofeconomicandsocializedhousingprojectsshallbeallowedwithouthavingcompliedwiththestandardsand
approvalproceduressetforthintheseRules.
Sec.11.ApprovalofProposedResidentialHousesofAverageandLowIncomeEarners.Individuallotownerswhoareaverageandlowincomeearnersas
definedbyBP220mayconstructtheirindividualresidentialhousesinthemannerprovidedbytheserules,providedthat:
1.TheysecureprojectapprovalfromtheMinistryofHumanSettlementspriortotheirconstructionand
2.TheyutilizeMHSapprovedstockplansortheysubmittheirproposedbuildingplanstotheMinistryforapproval.
Wheneverapplicable,theproceduresanddocumentsrequiredunderthisRuleinthecaseofotherhousingprojectsshallalsobeobservedincaseofindividual
residentialprojects.
Sec.12.EstablishmentofanIntegratedApprovalSystem.ThereisherebyestablishedandINTEGRATEDAPPROVALSYSTEMwhichshallbeapplicable
exclusivelytotheevaluationandapprovalofallproposedeconomicandsocializedhousingprojectswhetherthedevelopmentisforahouseandlotorforahouse
orlotonly.
UpontheeffectivityoftheseRules,allproposedeconomicandsocializedhousingprojectsshallberequiredtosecureonlytheINTEGRATEDAPPROVALset
forthhereinwhichshalltaketheplaceofpermitsandclearancesrequiredunderPresidentialDecreeNumbers957,1216,1096and1185andtheirimplementing
rulesandregulations.
Sec.13. Where Application for Integrated Approval Made. Applications for integrated approval shall be made with the Ministry of Human Settlements
through its regulatory arm, the Human Settlements Regulatory Commission which is hereby authorized to prescribe application requirements and impose the
necessaryconditionsonapprovalsandapplications.
Sec.14.HowApplicationMade.ApplicationforIntegratedApprovalshallbemadebyaccomplishinginduplicatecopiesanapplicationformdulyprescribed
bytheCommission.
Theapplicationformshallbeaccompaniedbythefollowingdocuments:
a)Developmentcostestimateandpaymentschemeforamortization
b)Statementofpotentialandfundingsources,preferablyattestedtobyanaccountant
c)Programofdevelopment,indicatingphasingandschedule
d)LocationalClearanceissuedbytheCommission
e)Certifiedxeroxcopyofownerscertificateoftitleorothersufficientevidenceofownershipifapplicantisnottheowner,authoritytodevelopandsell
f)Atleasttwo(2)setsofsketchplanandsitedevelopmentplan,showinggeneralpatternandlayoutofdevelopment,includinglocationofstreetsandproposed
accessroads,powerandotherutilitylines,residentialareasandopenspacesforparks,playgroundsandcommunityfacilities
g)Locationandvicinitymap,drawntoarequiredscale,indicatinglocation,intensityandnatureofsurroundinglanduseswithinone(1)kilometersradius
h)WrittenoptionstoavailoftheMHSStockPlans,indicatingspecificmodel(s)desired,orintheabsencethereof,atleasttwo(2)setseachofthefollowing:
1.Architecturaldrawing
2.Detailedstructuralplansandspecificationincludingcostestimates
3.Detailedengineeringdrawing
i)CertificationfromtheMinistryofAgrarianReformthattheLandisnottenantedand/orisnotcoveredbyoperationlandtransfer
j)Swornstatementastonature,numberandincomelevelofbeneficiaries.
Sec.15.EvaluationofLandDevelopmentandStructuralDesignComponentsofProject.Shouldtheprojectbefoundlocationallyviable,theCommissionshall
proceedtodeterminewhetherthelanddevelopmentschemeandbuildingdesignisinaccordancewiththestandardssetforthintheseRules.
WherethedeveloperorapplicanthasoptedtoavailofthepreapprovedplansoftheCommission,thereshallbenonecessityforevaluatingbuildingdesignexcept
with respect to the suitability thereof to project site and its harmony/compatibility with the land development scheme. Should the design be found
unsuitable/incompatible,thedevelopermaybeaskedtoalter/revisehischoice.TheCommissionmayextendtechnicalassistanceinthechoiceoftheappropriate
model.

Wherethedeveloperdoesnotavailofsaidplansandpresentshisowndesignandspecifications,theCommissionshallevaluatethebuildingcomponentofthe
projectastostructural,firesafetyandfunctionality.Thereviewofsuchbuildingplansandspecificationsshallbeinaccordancewiththestandardssetforthin
theseRules.
Sec.16.PreApprovalofBuildingPlans.TheCommissionshallformulatemodelbuildingplansanddesignormayapproveplanssubmittedbydulyqualified
professionalswhichplansshallbeconsideredpreapprovedandmaybeutilizedbythedeveloper/proponent.
Sec.17.ValidityofDevelopmentApproval.Developmentpermitsshallbevalidforaperiodofone(1)yearandshouldactivitybenotcommencedwithinsaid
period,thegranteeofthepermitmayapplyforitsrevalidationwithinthenextsucceedingyear.
Thereafter,nodevelopmentshallbeallowedunlessanewapplicationforapprovalisfiled.
Sec.18.SurveyandApprovalofSubdivisionPlan.UpontheissuanceofIntegratedApprovaltoaneconomicandsocializedhousingproject,thedeveloper
shallreferthefinalsubdivisionplantogetherwiththeparcellarymaptotheBureauofLandsfortheconductofverificationsurveyandapprovalofthesubdivision
scheme.Uponaccomplishmentthereof,theBureaushallsubmititsfindingtotheCommission.
RULEV
REGISTRATIONANDLICENSINGOFECONOMICANDSOCIALIZEDHOUSINGPROJECTS
Sec.19.RegistrationofProject.Nosubdivisionorcondominiumintendedforeconomicandsocializedhousingshallbesoldunlessithasbeenregisteredand
issuedalicensetosellinaccordancewiththeseRules.
UponreceiptoftheSurveyReturnsandApprovalofSubdivisionPlanfromtheBureauofLands,theCommissionshallnotifythedeveloperofeconomicand
socializedhousingproject,whichhavebeengrantedIntegratedApprovaltosubmitthefollowingdocumentstohavehisprojectregisteredundertheseRules.
1.CertificateofTitleorothersufficientevidenceofownership
2.AffidavitattestingthatthedatasubmittedintheOriginalApplicationFormsandattachmentstheretohaveremainedthesame,oriftherehavebeenanychanges,
incorporatingthereinthenatureandsurroundingcircumstancesthereof
3. Articles of incorporation or partnership or association, with all amendments thereto, and existing bylaws, if developer is a corporation, partnership or
association
4.Ifpropertyismortgaged,mortgagecontractandstatusofloancertifiedbymortgageeinadditionanundertakingbymortgageetoreleasethemortgageonany
subdivisionlotsorcondominiumunitsassoonasfullpurchasepriceispaid
5.Submitcertificationofavailabilityofwatersupply,ifproponent/developerintendstoutilizeexistingwatersystemorpermitfromtheNationalWaterResources
Council,ifheintendstoputupacentralizeddeepwelldistributionsystemorcertificateofwaterpotability,ifheintendstoleavetheestablishmentofindividual
wellstolot/unitownersfromtheappropriategovernmentagency.
Sec.20.NoticeofPublication.Uponevaluationofthecompletenessandveracityofthedocumentssubmitted,thisOfficeshallcausethepublicationatthe
expenseoftheapplicantaNoticeofPendingApplicationforRegistrationandLicensetoSellinonenewspaperofgeneralcirculationinEnglishorinPilipino
recitingthereinthatanapplicationforregistrationandLicensetoSellforthesaleofsubdivisionlotsandcondominiumunitshasbeenfiledwiththeCommission
andthattheaforesaidapplicationpapersaswellasthedocumentsattachedtheretoareopentoinspectionduringbusinesshoursbyinterestedparties.Inaddition,a
3x6billboardnoticeoftheprojectshallbepostedontheprojectsiteuntiltheissuanceoftheLicensetoSell.
Uponcompletionofthepublication,theproponentshallsubmitProofofPublicationexecutedbythePublisherandanaffidavitattestingtothepostingofthe
BillboardNoticeonthesite.
Sec.21.RegistrationofProject.Tendaysfromthecompletionofthepublicationandsubmissionoftheproofofpublication,theCommissionshall,inthe
absenceofanoppositiontotheRegistrationoftheProject,issueaCertificateofRegistration.Nooppositionshallbeentertainedaftertheaboveperiod.
Sec.22.OppositiontoRegistration.ComplaintsandoppositiontotheregistrationshallbefiledwiththeCommissionwithinten(10)daysfromthedateof
publication.Proceedingsforregistrationandlicensetosellshallbe,inthemeantime,suspendeduponaninitialfindingthatthesameismeritorious.
Sec.23.LicensetoSell.Noownerordevelopershallsellanydisposablesubdivisionlotorcondominiumunitinaregisteredpropertywithoutalicensetosell
issuedbytheCommission.
UponsubmissionofaPerformanceBondintheformsofaSuretyBondtotheamountofTenPercent(10%)ofthetotalestimateddevelopmentcostoftheproject
issued by a duly accredited bonding company and acceptable to the Commission, or a certificate of guarantee from any bank or financing institution of good
standingaddressedtotheCommissionforthetotaldevelopmentcost,theCommissionshallcausetheissuanceofaLicensetoSellfortheproject.
WheneveritshallappearthatthePerformanceBondis,orforanycausehasbecomeworthless,inadequateorinsufficientaftertheLicensetoSellhasbeenissued,
theowner/developershall,afterduenotice,berequiredtogiveanadditionalperformancebondorreplacetheworthlessbondwithintendaysfromreceiptofsuch
notice.Meanwhile,theLicensetoSellshallbedeemedsuspendorrevoked.
Sec.24.MonitoringofProject.TheCommissionshallhavethepowertomonitorprojectsgrantedIntegratedApprovalandLicensetoSellundertheseRules
toensurefaithfulcompliancewiththeterms,standardsandconditionsthereof.Itmayexercisevisitatorialpowersandincaseofviolationornoncomplianceof
the terms, standards and conditions set forth in the approval and the license issued, it may institute revocation proceedings and impose appropriate fines and

COMPLAINTS,HEARINGSANDPENALTIES
Sec.25.AuthoritytoIssueRulesandProcedures.TheCommissionisherebyauthorizedtoissueRulesofProceduretogoverntheconductofHearingsbefore
itoncomplaintsorproceedingsagainstowners,developers,dealers,brokersandsalesmenarisingundertheseRules.UntiltheissuanceofsuchRules,thepresent
RulesofProceduretogoverntheconductofHearingsbeforetheHumanSettlementsRegulatoryCommissionshallapply.
Sec.26.Mediation/ConciliationofComplaints.ItshallbemandatoryonthepartoftheCommissiontoconductmediationorconciliationoncomplaintsor
oppositionfiledwithitbeforethesamecouldbesubjectedtoaformalhearing.
Sec.27.SuspensionofLicensetoSell/CeaseandDesistOrder.TheCommissionmay,initsdiscretionoruponnoticeandhearingimmediatelysuspendthe
owner'slicensetosellandissueaCeaseandDesistOrderpendinginvestigationandhearingofthecaseforthefollowingreasons:
a.Uponverifiedcomplaintfiledbyabuyerofasubdivisionstatementlot/houseoranyinterestedparty
b.Initsopinion,anyinformationintheregistrationstatementfiledbytheowner/dealerisorhasbecomemisleading,incorrect,inadequateorincompleteorthe
saleorofferingforsaleoftheprojectmayworkortendtoworkafrauduponprospectivebuyers
c.WhenitappearstotheCommissionthattheowner/dealerisengagedinanyactorpracticewhichconstituteorshallconstituteaviolationoftheprovisionsof
theseRules.
Thesuspensionorder/ceaseanddesistordermaybeliftedif,afternoticeandhearing,theCommissionisconvincedthatanydeficiencyintheswornregistration
statementhasbeencorrectedorsupplemented,orthatthesaletothepublicofthesubdivisionprojectshallneitherbefraudulentnorresultinfraud.Itshallalsobe
liftedupondismissalofthecomplaint.
Untilthefinalentryofanorderofsuspension,thesuspensionoftherighttoselltheproject,throughbindinguponallpersonsnotifiedthereof,shallbedeemed
confidentialunlessitshallappearthattheorderofsuspensionhasinthemeantimebeenviolated.
Sec.28.RevocationoftheRegistrationCertificateandLicensetoSell.TheCommissionmay,motupropio,oruponverifiedcomplaintfiledbyabuyerrevoke
theregistrationandlicensetosellofanysubdivisionprojectorsubdivisionlot/houseinsaidprojectorcondominiumunitifuponexaminationoftheaffairsofthe
ownerordealer,duringahearingconducteditshallappearthereisprimafacieevidencethatthesaidownerordealer:
a.Isinsolventor
b.Hasviolatedanyoftheprovisionsofthelawanditsrulesandregulationsoranyundertakingofhis/itsperformancebondor
c.Hasbeenorengagedinfraudulenttransaction.
Sec.29. Administrative Fines and Penalties. Violation of any of the provision of these Rules and Standards shall be subject to the Fines and Penalties as
providedforunderPD's957,1216,1096and1185.

Sec.30.ConformancetotheRequirementsofotherpertinentlaws,rulesandregulations.Unlessotherwiseamendedorexpresslyprovided,theprovisionsof
PresidentialDecree957anditsImplementingRulesonthefollowingSectionsareherebyadoptedintheseRules:
a.SubmissionofSemestralReportsonOperations
b.Advertisement
c.TimeofCompletion
d.ExtensionofTimeforCompletion
e.AlterationofPlans
f.NonForfeitureofPayments
g.RegistrationofConveyances
h.Mortgages
i.Takeoverdevelopment
j.PhasesofSubdivision

Sec.31.NonDevelopment.Failureonthepartoftheownerordevelopertodeveloptheprojectinaccordancewiththeapprovedprojectplansandwithinthe
timehereinspecifiedshallsubjecttheowner/developertoadministrativesanctionsandpenalties.
Sec.32.OrganizationandRegistrationofHomeowners.Theownerordeveloperofasocializedandeconomichousingprojectshallinitiatetheorganizationof
ahomeownersassociationamongthebuyersandresidentsoftheprojectforthepurposeofpromotingandprotectingtheirmutualinterest.Saidhomeowners
associationshallregisterwiththeCommissionandthelatterisherebyauthorizedtoaccreditanddeterminethelegitimatehomeownersassociationofthehousing
projectforpurposesofapplyingthepertinentprovisionsoftheseRules.

Sec.33.DonationsofRoads,OpenSpacesandWaterSupply.Theownerorprojectdevelopershalldonatetheroadsandopenspacesfoundintheprojectto
thelocalgovernmentoftheareaaftertheircompletionhadbeencertifiedtobytheCommissionanditshallbemandatoryforthesaidlocalgovernmenttoaccept
suchdonations.ParksandplaygroundsmaybedonatedtothedulyaccreditedHomeownersAssociationoftheprojectwiththeconsentofthecityormunicipality
concernedunderPD1216.
The water supply system of the project may likewise be donated to the duly accredited homeowners association after certification by the Commission of its
completionandofitsbeingoperational.Shouldthehomeownersnotacceptthedonation,theownerordeveloperoftheprojectshallcollectreasonableratestobe
determinedbytheCommissioninconsultationwiththeNationalWaterResourcesCouncilortheLocalUtilitiesAdministration.Theproceedsthereofshallbe
usedexclusivelyforthemaintenanceandoperationofthewatersystembythedeveloper.
Sec.34.Fees.UntilsuchtimethattheCommissionshallhaveadoptednewscheduleoffeesforeconomicandsocialhousingprojects,itshallapplyandcollect
thefeesprovidedforundertheimplementingRulesofPD's957,1096and1185.
Sec.35.AuthoritytoIssueSupplementalRules,DirectivesandInterpretativeMemorandumandCircular.IntheimplementationofBatasPambansaBlg.220
and these Rules and Standards, the Commission, through its Chief Executive Officer, is hereby authorized to issue supplemental rules, directives and
interpretativememorandumandcirculars.
Sec.36.SeparabilityClause.TheprovisionoftheseRulesareherebydeclaredseparable,andintheeventanyofsuchprovisionsaredeclarednullandvoid,
thevalidityofallotherprovisionsshallnotbeaffectedthereby.
Sec.37.Effectivity.TheseRulesshalltakeeffectthirtydaysafteritslastpublicationintwonewspapersofgeneralcirculationinthePhilippinesforatleast
onceaweekfortwoconsecutiveweeks.
