AFFIDAVIT
I, EDNA B. BACULI, Filipino, of legal age, married and presently residing at
107 Lealtad St., Balayan, Batangas, hereby depose and state under oath that:
1.

That in 1998, I purchased on loan from Honda Cars San Pablo,

through an agent named Tessie, one unit Honda City A/T with
SN: 1640000208
EN: P200163
CN: 1004511612
PN: DTF142;

2.

That the loan was subsequently refinanced by ABN-AMRO Bank;

3.

That all post-dated checks issued to cover up the payments were

made payable in the name of car dealer and not ABN-AMRO Bank;

4.

That upon full settlement of the account, I was advised to secure the
cancellation of chattel mortgage from ABN-AMRO, then located at
Ayala Avenue, Makati City;

5.

That the mortgage was cancelled at the Register of Deeds-Nasugbu,

Batangas after I have paid all the necessary expenses;

6.

That prior to my departure to the United States on 2003, the car was
sold to a buyer whose name I can no longer recall because the sales
transaction was facilitated by then Barangay Chairman Bimboy
Inciong;

7.

That the proceeds of sale was handed to me in cash and papers for
the transfer of ownership with LTO was signed by me;

8.

That my copy of cancellation of mortgage was given to the new owner

for LTO registration, whom despite diligent efforts I can no longer
locate;

9.

That all efforts were exerted to get a copy of the document from RDNasugbu but to no avail because according to them said document is

now housed in a new office and all old documents were boxed in their
old office and already disposed;
10.

That I was surprised to have been informed that according to records

of the Bangko Sentral ng Pilipinas, my credit status yielded that a civil
case involving the abovementioned vehicle was apparently filed
against me;

11.

That the case was also verified with MTC-Manila and Makati but with
negative results because no such case is pending or was filed thereat;

12.

That I execute this Affidavit to attest to the truth of the foregoing facts
and for whatever legal purpose it may serve.
