The following Ordinance promulgated by the Governor of the Punjab is hereby published for
general information:-

PUNJAB ORDINANCE NO. II OF 1978

AN
ORDINANCE

to repeal and, with certain modifications, re-enact the Punjab Public Service Commission Act, 1974.

Preamble -

WHEREAS it is expedient to repeal and, with certain modifications, re-enact the Punjab Public
Service Commission Act, 1974;

AND WHEREAS the Governor of the Punjab is satisfied that circumstances exist which render it
necessary to take immediate action;

NOW, THEREFORE, in pursuance of the proclamation of the fifth day of July, 1977, read with the
Laws (Continuance in force) Order, 1977 (CMLA Order NO. 1 of 1977), the Governor of the Punjab is
pleased to make and promulgate the following Ordinance:-

Short Title and Commencement --

1. This Ordinance may be called the Punjab Public Service Commission Ordinance, 1978.

(2) It shall come into force at once.

Definitions --

2. In this Ordinance, unless there is anything repugnant in the subject or context:-

(a) "Commission" means the Punjab Public Service Commission;

(b) "Member" means a member of the Commission and includes the Chairman thereof; and

(c) "Service of Pakistan" means the Service of Pakistan as defined in the Constitution of Islamic
Republic of Pakistan.

Composition of Commission etc. --

3. (1) There shall be a Commission consisting of such number of members as may be determined
by the Governor.

(2) The members of the Commission shall be appointed by the Governor.

(3) The terms and conditions of service of the members shall be determined by the Governor:
Provided that the salary, allowances and privileges of a member shall not be varied to his
disadvantage during his term of office.

(4) Not less than one half of the members shall be persons who have held office in the Service
of Pakistan for not less than 20 years.

(5) No proceeding or act of the Commission shall be invalid merely on the ground of existence of any
vacancy in, or any defect in the constitution of the Commission.

(6) The Governor shall nominate one of the members to be the Chairman of the Commission.

(7) A person appointed as member on or after 19the day of December, 1977 and holding office
as such immediately before the commencement of this Ordinance shall be deemed to have been appointed
as member under this Ordinance.

(8) A person appointed as member at any time before 19th day of December, 1977 and holding
office as such immediately before the commencement of this Ordinance shall cease to hold office on such
date as the Governor may direct.

Terms of Office of a Member --

4. (1) The term of office of a member shall not exceed 5 years:

Provided that a member may be reappointed for another term not exceeding three years.

(2) A member may resign his office by writing under his hand addressed to the Governor.

Removal from Office --

5. (1) A member shall not be removed from office during the term of his office except in the
manner hereinafter provided.

(2) If, the Governor is of the opinion that a member:-

(a) may have been guilty of misconduct; or

(b) may be incapable of properly performing the duties of his office by reason for
physical or mental incapacity;

the Governor shall appoint a Judge of the High Court to inquire into the matter.

(3) If, after inquiring into the matter the Judge reports to the Governor that he is of the opinion
that the member has been guilty of misconduct or is incapable of performing the duties of his office, the
Governor may remove the member from office.

Ineligibility for further employment --

6. (1) On ceasing to hold office a member shall not be eligible for further employment in the
service of Pakistan.

(2) Nothing contained in sub-section (1) shall be deemed --

(i) to prevent a member, other than the Chairman, from being appointed as
Chairman; and

(ii) to apply to a person who, at the time of the commencement of this Ordinance,
was holding the office of the member and immediately before his
appointment as member, was holding an office in service of Pakistan.

Functions of Commission.

*7. The functions of the Commission shall be:-

(a) to conduct tests and examinations for recruitment to --

(i) such Provincial Services and posts connected with the affairs of the Province, as may
be prescribed; and

(ii) such posts in or under a Corporation or other body or organisation set up by


Government under any law, as may be prescribed;

(b) to advise the Government on such matters as may be prescribed relating to the terms and
conditions of service of persons who are members of a Provincial Service or hold posts in
connection with the affairs of the Province; and

(c) such other functions as may be prescribed.

Commission to be informed when its advice is not accepted --

8. Where the Governor does not accept the advice of the Commission he shall inform the Commission
accordingly.

9. (1) The Commission shall, not later than 15th day of February in each year, prepare report as to
the work done by it during the preceding year ending on the 31st day of December and submit the report to
the Governor.

(2) The report shall be accompanied by a statement setting out, so far as known to the
Commission:-

(a) The cases, if any, in which the advice of the Commission was not accepted and the
reasons therefore; and

(b) The matters, if any, on which the Commission ought to have been consulted but was
not consulted and the reasons therefore.

(3) The Governor shall cause a copy of the report to be laid before the Provincial Assembly.

Rules * (and Regulations)

10. (1) The Government may, by notification in the official gazette, make rules for carrying out the
purpose of this Ordinance.

and the rules the Commission may make regulations for carrying out the purposes of this Ordinance and the
rules.

Repeal --

11. The Public Service Commission Act, 1974 (1 of 1974) is hereby repealed.
ORIGINAL VERSION OF AMENDED SECTIONS OF THE PPSC
ORDINANCE, 1978

Original version of Section 6(2) and Section 7 which were substituted vide Law Department notification
No. Legis. 3(18)/78 dated 22nd August, 1978.

6.(2) Nothing contained in sub-section (1) shall debar a member who, immediately before his
appointment as member, was holding a post in the Service of Pakistan and has not attained the age of
superannuation prescribed by law applicable to him as a civil servant at the time of his ceasing to hold
office as member, to hold a post as civil servant till he superannuates or retires or otherwise ceases to hold
post as civil servant.

7. The functions of the Commission shall be:-

Functions of Commission

(a) to conduct tests, examinations or interviews for selection of suitable persons for
appointments to Civil Services of the Punjab and posts connected with the affairs of the Province in
Grade-16 and above or equivalent posts and such other posts as may be prescribed;

Explanation: In this clause, "appointment" means initial appointment otherwise than by


transfer or promotion.

(b) to advise the Governor on matters relating to qualifications for and method of recruitment to
the civil services of the Province and posts connected with the affairs of the Province; and

(c) such other functions as may be prescribed.

NOTIFICATION
The 26th October, 1978

No. SORIII-1-49/73. In exercise of the powers conferred by Section 10 of the Punjab Public Service
Commission Ordinance, 1978, the Governor of the Punjab is pleased to make the following rules:-

1. (1) These rules may be called the Punjab Public Service Commission (Functions) Rules,
1978.

(2) They shall come into force at once.

2. In these rules, unless there is anything repugnant in the subject or context --

(1) "Grade" means the National Scale of Pay in which a post or group of posts is placed:

Provided that in the case of a post or group of posts which have not been placed in any National
Scale of Pay, Grade means the "National Scale of Pay", corresponding to the "existing scale of pay", in
which a post or group of posts would have been placed; and

(2) "Test" includes written examination, psychological test, appraisal of record, interview and
viva voce.

3. (1) The Commission shall conduct tests and examinations and take all steps ancillary thereto
for recruitment to:-

(i) the Provincial services and civil posts connected with the affairs of the Province
falling in Grade *(16 to 22) except those specified in Schedule-I;

(ii) such posts in or under a Corporation or other body or Organization set up by


Government under any law carrying a scale of pay the maximum of which is Rs.
2,750 per mensem or above as may be referred to the Commission; and

(iii) any other posts which may be referred to the Commission for recruitment by the * *
(Governor Chief Minister).

(2) the Government may associate the Commission in the framing of rules regulating
appointments to Provincial Services or such posts connected with the affairs of the Province, as may be
prescribed, in such manner as it may determine.

4. Notwithstanding anything contained in rule 3, the Commission shall not conduct test for recruitment
to posts which are filled --

i) on contract for a specified period; or

ii) for a period of # (one year) or less pending selection of a candidate on the basis of test
conducted by the Commission;

Provided that the above period may be extended:-

(a) for a further period of six months with the approval of the Commission if a
requisition for filling the post was sent to the Commission before filling of the post
on ad hoc basis and the Commission had failed to nominate a candidate; or

(b) in any other case, by order of the *(Governor Chief Minister); or

iii) by transfer of an officer of the Armed Forces of Pakistan or an officer already holding a post
on regular basis in equivalent grade under the Federal or a Provincial Government.

Explanation:- For the purpose of clause (iii), "regular basis" means other than ad hoc, contract or
temporary basis for a specified period.

5. Notwithstanding anything contained in rule 3, the * (Governor Chief Minister) may, in the public
interest, specify posts which may be filled, without reference to the Commission, by persons possessing
such qualifications and experience and in such manner as he may determine.

NOTIFICATION

Dated Lahore, the 17th January, 1979.

No.S.O. Cab-I (S&GAD) 7-7/78 -- In exercise of the powers conferred by Section 10 of the Punjab Public
Service Commission Ordinance, 1978, the Governor of the Punjab is pleased to make the following rules;
namely:--

PART-I - GENERAL

1. Short title and commencement -- (1) These rules may be called the Punjab Public Service
Commission (Conditions of Service) Rules, 1978.

(2) They shall come into force at once.

2. Definition -- (1) In these Rules unless there is anything repugnant in the subject or context:-

"All Pakistan grade" shall have the meaning assigned to it in the All Pakistan Services
(Change in Nomenclature) Rules, 1973.

(2) Words and expressions used but not defined shall bear the same meaning as they bear in the
Punjab Public Service Commission Ordinance, 1978.

3. Seniority -- The inter se seniority of the members shall be determined in accordance with the
respective dates of their entering upon the office as a member:

Provided that when a member is appointed for a second or subsequent term, his seniority shall be

reckoned from the date when he enters upon the second or subsequent term of office, as the case may be:

Provided further that the inter se seniority of members appointed from the Service of Pakistan shall
be reckoned from the date of their continuous officiation in their respective grades of pay (immediately
before appointment as member) in the service of Pakistan. In case more than one member received their
last grade of pay on the same day their inter se seniority would be determined on the basis of seniority in
age.

4. Pay –The Chairman shall receive pay in BS-22 and a member in BS-20 provided that

(a) if on the date of his appointment he was in the service of Pakistan and was drawing a pay
higher than BS 22 or 20, as the case may be, he shall continue to draw such pay; and

(b) if he was re-employed, after retirement from the service of Pakistan, his pay shall be
regulated according to the Civil Service (Pension) Rules applicable to him:

Provided further that in case of a member, if before his appointment as member he was drawing pay
in the pay scale below BS-20 he shall receive a special pay of Rs. 440/- per mensem subject
to the condition that his maximum pay shall not exceed the minimum of BS-20 at the time of
such appointment.

5. Staff Car -- The Chairman and a Member of the Commission shall be entitled to the use of official
car maintained at Government expenses at the scale prescribed by Government.

6. Pension -- The Service as Chairman or Member shall not qualify for pension but if on the date of
his appointment as Chairman or Member, he was in the Service of Pakistan, the service shall count for
pension under the rules applicable to the service to which he belonged, and unless he was a member of the
All Pakistan Unified Grade or he was entitled to pension under the Army Regulations, his service in the
Commission shall also qualify for the lower grade or upper grade of special additional pension under the
rules applicable to him before appointment to the Commission.

7. Provident Fund -- (1) It shall be permissible for the Chairman or a Member, if he so selects, to
subscribe to the General Provident Fund in accordance with the rules relating to the Fund.

(2) The Chairman or a Member who, on the date of his appointment, was in the service of
Pakistan and had been admitted to the benefits of any Provident Fund maintained by Government shall be
eligible, after appointment to the Commission to continue to subscribe to the said Fund upon the same
terms and conditions and subject to the rules of the Fund:

Provided that he shall cease to subscribe to the Fund on attaining the age of superannuation in his
previous service and the amount standing to his credit in the said Fund after such deductions as are
authorised under the rules applicable to him shall become payable to him.

PART-II - LEAVE

8. Leave -- The Chairman or a Member who on the date of his appointment was in the service of
Pakistan may be granted leave by the Governor under the rules applicable to him immediately before his
appointment and his service as Chairman or Member shall count for such leave.

9. The Chairman or a Member who, on the date of his appointment, was not in the service of Pakistan
may be granted leave by the Governor as follows:-

(i) On leave salary equivalent to full pay up to one eleventh of the period spent on duty as
Chairman or a Member, subject to a maximum of four months at any one time;
(ii) On medical certificate on leave salary equivalent to half pay up to two elevenths of the
period spent on duty as Chairman or a Member, subject to a maximum of three months at
any one time; and
(iii) Extraordinary leave without salary.

Explanation -- A person who is appointed as Chairman/ Member after his retirement from the
service of Pakistan, or who attains the age of superannuation while serving in the Commission as
Chairman/Member shall be governed by the provisions of this rule.

PART-III - TRAVELLING ALLOWANCE AND MEDICAL ALLOWANCE

10. Traveling Allowance -- For the purposes of Traveling Allowance:--

(a) the Chairman shall be entitled to the allowance admissible to a judge of the Supreme Court
of Pakistan if he be a retired Judge of the Supreme Court, and to a Judge of a High Court in
any other case; and
(b) a member shall be entitled to allowance admissible to a Secretary to Government.

11. Medical Allowance -- A Member shall be entitled to the medical facilities admissible in terms of the
West Pakistan Government Servants (Medical Attendance) Rules, 1959 as amended from time to time:
Provided that a Member who on the date of his appointment to the Commission was in the service
of Pakistan may elect to be governed by the rules applicable to him immediately before the said date.

12. Where a person appointed as a Member was immediately before his appointment as such, in the
service of Pakistan, his rights as a person in the service shall not be affected by his appointment as
Member.

PART-IV – MODE OF SELECTION OF MEMBEERS OF THE COMMISSION

13. (a) Subject to the Ordinance, a Member may be selected from amongst eminent persons
representing Liberal Arts and Sciences and Professionals in the private sector.
(b) All proposals regarding appointments of Members shall be initiated by the S&GAD. These
shall be sent to the Chairman of the Commission who may give his views or these
recommendations and incorporated the names of any recommendees of his own. He shall
thereafter send the case to the S&GAD for obtaining the approval of the Governor.

REGULATIONS, 2000
ANCILLARY INSTRUCTIONS
NO. SOIV(S&GAD)16-14/64
Dated 7th October, 1967

Subject:- APPOINTMENT THROUGH PUBLIC SERVICE COMMISSION -


DELAY, CAUSES AND REMEDIES

I am directed to state that the Government of West Pakistan have had under consideration the
causes of delay and their remedies, in appointments to posts filled through the Public Service Commission.
After careful examination it has been decided that Administrative Departments and Heads of Attached
Departments and the West Pakistan Public Service Commission should strictly observe in future the
instructions given in this letter in supersession of existing instructions, if any.

2. Delay in making requisitions -- It was emphasized in this department's circular letter


No.SOVIII-3-1/64, dated the 24th December 1964, that delay in the filling up of vacancies should be
strictly avoided. The vacancies for the next financial year should be worked out in the month of March and
a requisition sent to the Public Service Commission. It is now directed that --

(a) each department should work out vacancies for one financial year and send the requisition to
the Commission in the preceding March;

(b) Departmental Secretary should send a certificate to Services and General Administration
Department in April that this has been done; and

(c) The present restriction on ad hoc appointments should continue.

3. Incomplete Requisition -- It has been noticed that requisitions to the Commission are not sent in
complete form which delays recruitment. In order to avoid such delays, it is directed that --

(a) Administrative Secretary and Head of Attached Department must give a certificate with
each requisition that he has personally examined the requisition, that it is complete in all
respects and that all necessary papers are being sent with the requisition.

(b) If the Commission still finds some defect in requisitions, it should give the Administrative
Department/Head of Attached Department a fortnight for rectification.

(c) In case the defects are not rectified in time, the Commission should return the requisition to
the concerned department, and close the case under intimation to Services and General
Administration Department.

4. Postponement of requisitions -- The Administrative Department after sending requisitions,


postpone or suspend them. This causes confusion, delay and injustice. In future this power will be exercised
only through Services and General Administration Department, which will exercise strict control and
demand full justification.

5. Incomplete Character Rolls -- One cause which delays the decision of cases by the Commission is
the submission of incomplete character rolls. It is directed that --

(a) The Administrative Departments, should examine each Character Roll to ensure that it is
complete before submission to Public Service Commission.

(b) If it is not complete, Administrative Department, should adopt practical ad hoc methods for
getting it completed within a month.

(c) If it is not so completed, the Administrative Department should give a certificate that the
Character Roll is as complete as it can be within reasonable time. This certificate may be
given only as a last resort.
(d) The Public Service Commission may then assess the candidate on the available record.

6. Marking System -- In cases to be decided without written examination the Commission should
themselves evolve a uniform and workable system of evaluation for each service within the general frame
work that 30 per cent marks may be allocated for interview and 70 per cent for academic record and
experience. The formula when finalised may be communicated to the Services and General Administration
Department and should be followed strictly.

7. Zonal and Regional Representation -- The responsibility for correct zonal and regional
representation in promotions and recruitments will be that of the Administrative Department/Attached
Department concerned. The Department, should, however, when sending a requisition, invariably supply
necessary information regarding Regional/Zonal allocation to the Commission so as to enable them to see
whether proposals made by the department are correct and in keeping with rules. In case of difference of
opinion the matter should be referred to the Services and General Administration Department for final
decision.

8. Correspondence with Candidates -- It is duty of each candidate to fill the application form properly
and to send it with necessary enclosures. In practice, the form is often incomplete and enclosures are
missing. The Commission has to carry on long correspondence with the candidates. This is unnecessary. In
future each candidate may be given 3 weeks to rectify the defects, and if they are not rectified within this
period the application may be rejected straight away.

9. Delay by Public Service Commission -- After receipt of a complete requisition, the time limit for
the Commission will be nine months where a written examination is to be held, and 3 months where there
is no written examination. The Commission may however, obtain the relaxation of the limit from Services
and General Administration Department in appropriate cases.

10. Appointment Orders -- After receipt of the Commission's recommendations, Administrative


Departments sometimes do not issue appointment orders for months, which causes injustice, doubt and
confusion. The appointment orders should in future be issued within 3 months where medical examination
and antecedent verification are to be done, and within one month in other cases.

11. Review -- In order to ensure that these instructions are strictly followed, it has been decided that
there will be an annual review by the Council of Ministers of the appointments made in consultation with
the Commission. The review will be in October each year and will relate to the preceding financial year. It
is requested that the information for the financial year 1967-68 may be sent in the enclosed pro forma to
the Services and General Administration Department by all the Administrative Departments and Heads of
Attached Departments by the 15th of September 1968. The matter will be placed before the Council of
Ministers in October 1968.

Subject:- PROPORTIONAL REPRESENTATION OF ZONES IN CLASS I


AND CLASS II SERVICES ON POPULATION BASIS

I am directed to invite a reference to Services and General Administration Department's letter


No.SOR-III-10-1/70, dated 24th August, 1970 on the subject noted above and to say that Government have
decided that zonal formula of filling the direct recruitment vacancies in Class I and Class II services should
continue for the time being, but with this modification that 20 per cent of the vacancies should be filled
strictly on merit irrespective of the domicile of the candidates. If a suitably qualified candidate is not
available from the zone to which a vacancy has been allocated, it should be added to the merit quota and
filled by a suitable candidate irrespective of his domicile. A large number of Class I and Class II Rules and
other Rules in which regional representation formula applies have been amended accordingly by
Notification No.SOR-III-10-2/72(A), dated 23rd May, 1973. The Block system of 10 vacancies of the two
zones (zone I previously zone 3) and zone 2 (Previously zone 4) shall henceforth operate as under :-

The cycle will be repeated after completing a block of 10 vacancies. The zonal representation
formula will apply to initial recruitment to Class I Senior and Junior and Class II vacancies and other
unclassified posts equivalent in pay scales to these classes or any other service or post in which this
formula is specially prescribed in the Service/ Recruitment Rules and to the vacancies to be filled after the
date of S&GAD's notification No.SOR-III- 10-2/72(A) dated 23rd May, 1973 irrespective of the dates of
their occurrence. I am to request that these instructions may kindly be complied with carefully in future.

BY THE EXISTING SERVICE/RECRUITMENT RULES

I am directed to say that despite the clarification conveyed in para 2 of this Department's circular
letter No. SORI (S&GAD)16-2/71 (Policy), dated the 18th August, 1971, some Administrative
Departments have advertised posts or placed requisitions with the Punjab Public Service Commission for
the posts which are not covered by any of the existing Service/Recruitment Rules and have specified the
qualifications by themselves. This has resulted in anomalies. As already explained, a proposal for framing
the Service/Recruitment Rules or an amendment in any of the existing Rules, remains a proposal unless it
has gone through the entire process and has been formally promulgated by the orders of the Chief Minister.
Normally, therefore, no post which is not covered by any of the Service/Recruitment Rules should be
advertised nor a request in respect of such a post be placed with the Punjab Public Service Commission.
Where this may not be possible in cases of extreme urgency, the Administrative Departments are requested
to obtain clearance from this Department with regard to qualifications for a post not covered by any of the
existing rules, whether it is to be advertised by the Administrative Department itself or a requisition for it is
to be placed with Public Service Commission.

Subject: ADMINISTRATIVE REFORMS - JOB DESCRIPTION OF POSTS

I am directed to say that in the context of Administrative Reforms, Job Description of each and
every post in all Departments is the crux and corner stone of the new unified service structure, so that
scientific career planning is promoted and the objective of matching specific skills to specific needs of the
job is achieved.
2. The Committee on Administrative Reforms has approved a pro forma of Job Description for all
Government Departments to draw up their description of each post.

3. I am to request that this exercise of drawing up of job Description may be taken in hand by your
department in respect of all categories of posts under your administrative control and completed as
expeditiously as possible. The Job descriptions, when completed, may be sent to the Administrative
Reforms Wing of the Services and General Administration Department for scrutiny/vetting by the Study
Group and the Committee on Administrative Reforms. A copy of the prescribed job description proforma is
enclosed below.

4. The Administrative Reforms Committee has, in consultation with the Forestry and Wildlife
Department, drawn up Job descriptions in respect of the posts of Chief Conservator of Forests, Divisional
Forest Officer, Sub-Divisional Forest Officer and Senior Range Forest Officers to serve as model for all
Departments. A copy each of these Job Descriptions is enclosed. I am to request that the Job Descriptions
in respect of the different posts in your Department as well as in offices under your administrative control
may be prepared on the pattern of the model Job Descriptions. It will be appreciated if this work is comple-
ted within a month.

5. I am to add that in case of any difficulty in drawing up the job descriptions the Deputy Secretary
(AR) and Research Officer(AR) will be available for consultation. A short course of training in the
preparation of Job Description at the Administrative Staff College is also envisaged, as intimated in this
Dept. letter No.SO(ARC)1-6/74, 21.3.75.

Subject:- SCRUTINY OF CHARACTER ROLLS OF IN-SERVICE


CANDIDATES

I am directed to address you on the subject noted above and to say that Section 7 of the Punjab
Public Service Commission Ordinance, 1978 (which deals with the functions of the Commission) refers to
tests, examinations and interview only for selection of suitable persons. The Commission is of the view that
scrutiny of Character Rolls of in-service candidates does not fall within the purview of its functions. Since
the Departments do not either supply complete Character Rolls or take unnecessarily long time to supply
these to the Commission confirmation of Commission's Provisional recommendation is delayed which is
not desirable.

2. It has, therefore, been decided that:-

i) Henceforth it will be the responsibility of the authority competent to forward the application
of an in-service candidate to the Public Service Commission to satisfy itself with regard to
his character and performance before forwarding the application.

ii) In all those cases where the Commission has already communicated its recommendations to
the Departments provisionally subject to the Character Rolls being found satisfactory by the
Commission, the recommendation will be no more provisional. It shall now be the
responsibility of the Appointing Authority in such cases to satisfy itself with regard to the
character and performance of the candidate before issuing the appointment letter; and

iii) If the Appointing Authority finds an in-service candidate undesirable on account of his
Character Roll being unsatisfactory it must refer back his case immediately to the
Commission with full justification, for reconsideration and further action.

Subject:- ANNUAL REPORT OF THE PUNJAB PUBLIC SERVICE COMMISSION FOR 1979 -
FAILURE OF APPOINTING AUTHORITIES TO OBSERVE CORRECT PROCEDURE
FOR FILLING POSTS THROUGH THE COMMISSION

In its Annual Report for the year 1979 the Punjab Public Service Commission has pointed out that
most of the departments did not follow the instructions contained in this department's letter * No.
SOIV(S&GAD)-16-14/64, dated 7th October, 1967 and subsequent letters issued from time to time with
regard to submission of requisitions to the Commission for filling vacancies.

2. It has been pointed out that requisitions were sent to the Commission without ensuring compliance
of Government instructions on the following points:-

(i) Merit/Zonal Allocation of posts to be advertised. Allocation was either not indicated or was
incorrectly worked out.

(ii) Indication of prescribed qualifications and age limits. Information given in requisitions was
in some cases inconsistent with the relevant Recruitment/Service Rules.

(iii) Clearance from the SGA&ID for posts for which Service Rules had not been framed or for
which the amended rules had not been notified. In many cases requisitions were sent to the
Commission without obtaining such clearance.

(iv) Clearance from SGA&ID or Finance Department to fill vacancies during ban on fresh
recruitment. Requisitions were submitted without obtaining prior clearance.

(v) Change in the number of posts after these had been advertised. Contrary to Government
instructions the Departments continued to submit piecemeal requisitions for increased
number of vacancies after the posts had been advertised. This made it difficult for the
Commission to prepare a planned
programme for processing the requisitions.

(vi) Delay in issuing letters of appointment after receipt of commission's recommendations.


According to the standing orders the Administrative Departments are required to issue
appointment orders of the Commission's recommendees within three months of their
medical examination and antecedents verification, and within one month in other cases.
Some of the Administrative Departments did not issue appointment orders to the
Commission's recommendees within the specified time, thus causing frustration among the
candidates.

3. In order to avoid repetition of administrative lapses affecting the functions of the Public Service
Commission instructions issued from time to time are reiterated and all appointing authorities in
Administrative Departments, Attached Departments and other officers in Punjab are requested to strictly
observe the following instructions in future:-

FOR ADMINISTRATIVE DEPARTMENTS.

(a) Delay in filling vacancies should be eliminated. Vacancies for the next financial year
should be worked out carefully and requisitions for filling vacant posts should be
sent to the Commission well in advance so that it can process these under a planned
programme. Concerned Administrative Secretary must furnish a certificate with each
requisition that he has personally examined the requisition to ensure that it is
complete in all respects.

(b) Deficiencies noticed and pointed out by the Commission in the requisitions should
be rectified by the Administrative Department within a fortnight. In case the defects
are not rectified within this time, the Commission will return the requisition to the
concerned department and close the case under intimation to SGA&ID.

(c) Vacancies to be filled by initial recruitment should be worked out in the light of the
Punjab Civil Service (Ratios of Recruitment) Rules, 1973 and the posts to be filled
should be clearly and finally mentioned in the requisition. The Commission should in
no case be approached subsequently for recommending candidates for additional
number of vacancies through the same selection.

(d) Only qualifications and experience prescribed in the relevant Service Rules should
be mentioned in the requisition. Unless acceptance of experience gained prior to
acquisition of prescribed qualification is specifically provided for in the Service
Rules prior experience, if any, will not be counted by the Commission.

(e) Requisitions for posts for which Service/Recruitment Rules do not exist or for which
the amended rules have not been notified, should not be submitted to the

Commission unless clearance in respect of conditions of appointment from SGA&ID
has been obtained. A requisition submitted to the Commission should be withdrawn
only after obtaining clearance from SGA&ID.

(f) The merit/zonal allocation of posts should be worked out correctly in accordance
with block-system provided in S&GAD's letter * No.SORIII-10-4/73, dated 13th
July, 1973, read with circular No.SORIII-10-2/76, dated 15th January, 1980.

(g) Where Service Rules provide for admittance of equivalent qualifications, a list of all
equivalent qualifications, should be appended to the requisitions in order of priority,
if any.

(h) Relaxation in the upper age limit provided in the Rules are mentioned in the
Commission's advertisements. Any additional relaxation allowed in particular cases
should be specifically mentioned in the requisitions. Orders of relaxation of conditions
of appointment beyond permissible limits advertised by the Commission must be sent
to the Commission well before the date of test/interview fixed by the Commission.

(i) After receipt of the Commission's recommendations, Administrative Departments


sometimes do not issue appointment orders for months, which causes injustice, doubt
and confusion. The appointment orders should in future be issued within 3 months
where medical examination and antecedent verification are to be done, and within
one month in other cases.

(j) As required in this department's circular ** No.SORII (SGA&ID)2-43/78, dated 27th


June, 1978 it will be the responsibility of the authority competent to forward
applications of in-service candidates to the Public Service Commission to satisfy
itself with regard to the conduct and performance of candidates before forwarding
the applications.

(k) Where the Commission has already communicated its recommendations to the
departments provisionally subject to the Character Rolls being found satisfactory by
the Commission, it shall be the responsibility of the appointing authority to satisfy
itself about the conduct and performance of an in-service candidate before issuing
the appointment letter. In such cases if an in-service candidate recommended by the
Commission is found to be undesirable due to unsatisfactory record, the appointing
authority must refer back his case to the Commission for reconsideration.

(l) After receipt of a complete requisition, the time limit for the Commission will be
nine months where a written examination is to be held, and 3 months where there is
no written examination. The Commission may, however, obtain relaxation of the
limit from Services, General Administration and Information Department in
appropriate cases.

(m) where selection is to be made without written examination it is presumed that the
Commission follows a uniform system of evaluation of candidates for each service.
The formula adopted in this respect may be communicated to SGA&ID.

(n) It is duty of each candidate to fill the application form properly and to send it with
necessary enclosures. In practice, the form is often incomplete and enclosures are
missing. The Commission has to carry on long correspondence with the candidates.
This is unnecessary. In future candidates may be given 3 weeks time to rectify the

defects, and if they are not rectified within this period the application may be
rejected straight away.

Subject:- ANNUAL REPORT OF THE PUNJAB PUBLIC SERVICE COMMISSION FOR 1980 -
FAILURE OF APPOINTING AUTHORITIES TO OBSERVE CORRECT PROCEDURE
FOR
FILLING POSTS THROUGH THE COMMISSION

Kindly refer to this Department's circular of even * number dated 29th May, 1980 on the subject
noted above.

2. In their Annual Report for 1980 the Punjab Public Service Commission have again pointed out
following irregularities on the part of Administrative Departments which have been the main cause of
unnecessary delay in the finalization of selections by the Commission:-

(1) The Government have imposed a ban on all fresh recruitments excepting the posts in
Education/Health Department. No vacancy can be filled until a clearance is obtained from
the SGA&ID and Finance Departments. During the year under report most of the
requisitions were received without the prior clearance obtained from the S&GAD and the
Finance Department with the result that it caused unnecessary delay as incomplete
requisitions had to be returned to the Administrative Departments for rectification.

(2) Almost all the Services/Posts under the Provincial Government are covered by the
recruitment/Service Rules. In certain cases requisitions received were not in conformity with
the provisions of the Service/Recruitment Rules with regard to qualifications/experience and
age limit.

(3) Piecemeal requisitions have continued to be sent to the Commission even after
advertisement of vacancies. This is contrary to Government instructions contained in
S&GAD circular letter NO. SO-IV(S&GAD)-16-14/64 dated 7th October 1967 and it
created difficulties for the Commission to prepare a planned programme for processing the
requisitions and arranging interviews.

(4) To give due representations to all areas the Government have introduced the scheme of
Zonal Allocation of vacancies to be filled by initial recruitment. This formula is not
properly followed by the Administrative Departments and the Commission have to work out
the Zonal Allocation of vacancies themselves and to get these confirmed from the respective
departments. A lot of un-necessary delay can be avoided if the departments take greater care
in working out the correct Zonal Allocation.

(5) The in-service candidates are required to send the Departmental permission from the
appointing authority, but such Departmental Permissions are not sent to the Commission
well in time and are usually incomplete. Consequently a number of candidates lose their
chance on account of delayed or defective departmental permission.

(6) Secretaries to Government are empowered to relax upper age limit by 5 years to avoid
hardship to the deserving candidates. Relaxation in upper age limit beyond 5 years is granted
by the Government. Such relaxation orders are received very late and some times on the
dates fixed for the interview. This makes it difficult for the Commission to proceed with the
scheduled programme.

(7) Temporary posts are created for a specified period, i.e. for one or two years. In such cases
the Administrative Departments should place requisitions with the Commission immediately
after the posts are sanctioned, but in many cases the requisitions are placed when half of the
period for which the posts are sanctioned is over.

(8) Under rule 4(ii)(a) of the Punjab Public Service Commission (Functions) Rules, 1978 the
Commission is required to extend the ad hoc appointment for a further period of 6 months
provided a requisition for recruitment to the post has been placed and the Commission fails
to nominate suitable candidates. The Commission have prescribed pro forma for submitting
proposal to them, but in most of the cases proposals regarding extension of ad hoc
appointments are not sent on the prescribed pro forma within time.

(9) In certain cases overage/unqualified persons have been appointed on ad hoc basis without
obtaining proper relaxation orders by the competent authorities.

3. All appointing authorities in Administrative Departments, Attached Departments and other Offices
in the Punjab are requested to strictly observe the guidelines given in this Department circular dated * 29th
May, 1980 and ensure that irregularities listed above are not repeated.

Subject:- REVIEW OF THE WORKING OF THE PUNJAB PUBLIC SERVICE


COMMISSION-ELIMINATION OF UNNECESSARY DELAYS IN SELECTION OF
SUITABLE CANDIDATES

I am directed to refer to the instructions issued, vide this Department circular *


NO.SORIII(S&GAD)10-2/80, dated the 21st June, 1981 on the subject cited above and to say that the
Governor has expressed his serious concern over the continuing incidence of unnecessary delays in
selection of suitable candidates for various posts by the Punjab Public Service Commission. The
Commission have reported that the responsibility in the matter rests upon the Administrative Departments
who have failed to act in accordance with the instructions issued by the Government which inter-alia
specifically prescribe that the requirements of direct recruits should be assessed in a planned manner and
communicated to the Commission in March every year.

2. I am, therefore, directed to request you once again to look personally into the matter and ensure
that:-

(i) Requirements of direct recruitment for the ensuing year should be assessed and
communicated to the Punjab Public Service Commission in the March every year. No
Objection Certificate from SGA&I Deptt./- Finance Department, where so required, must be
obtained in advance and should accompany the requisition placed with the Commission.

(ii) Qualifications/experience and age limit to be specified in requisitions should be in strict


conformity with the provisions of the relevant Service/Recruitment Rules.

(iii) Allocation of vacancies on zonal basis should be correctly worked out and communicated to
the Commission along with the requisition to avoid back references.

(iv) Departmental permission from the Appointing Authority in respect of in-service candidates
should be decided expeditiously and forwarded to the Commission well in time.

(v) Secretaries to Government are empowered to relax upper age limit by five years, while
relaxation up to 10 years is allowed by the Additional Chief Secretary, Punjab. Cases
involving relaxation beyond 10 years require approval of the Governor. Approval of
appropriate authority in individual cases should be obtained and conveyed to the
Commission well in time.

(vi) The requisitions for newly created temporary posts every year should be placed immediately
with the Commission after the posts are sanctioned and the tendency of allowing almost half
of the period of sanction to run out in this process should be curbed.

(vii) Where the Commission fails to nominate suitable candidates for recruitment, approval of the
Commission for extension of the ad hoc appointments should be obtained by submitting
proposals on the prescribed pro forma within the specified time limit.

3. The above guidelines should be strictly observed by the Administrative Departments, Attached
Departments and other offices.

Subject:- STREAMLINING OF PROCEDURES AND SYSTEMS FOR SELECTION OF
CANDIDATES THROUGH PUNJAB PUBLIC SERVICE COMMISSION

With a view to streamlining procedures and systems in the Punjab Public Service Commission
responsible for delays in the selection of candidates for posts referred to the Commission for initial
recruitment, the following decisions have been taken with the approval of the Governor/MLA:-

I. DEFICIENCY MEMO.

At present deficiency memos are issued to the candidates enabling them to rectify the mistakes in
their original applications. This is main source of delay in processing the applications. A candidate
who is not careful enough to even ensure completion of his application deserves to be rejected
out-right. It has, therefore, been decided that incomplete applications shall be rejected straight away.
The aggrieved candidates may, however, appeal to the member In-charge/ Chairman of the
Commission with reasonable grounds for reconsideration of rejection order.

II. DEPARTMENTAL PERMISSION

Difficulties are being faced by the in-service candidates in getting Departmental Permission from
the competent authorities for applying to the Commission for various posts. To overcome such
difficulties, the serving candidates may submit their applications to the Head of office or department
in which they are employed and forward advance copy to the Commission. If the Commission does
not receive the Departmental Permission within a period of 30 days from the last date fixed in the
press note, it shall be deemed to have been granted.

III. NUMBER OF CHANCES

Under * Rule 3 of the West Pakistan Civil Services (Applications for Posts) Rules, 1957, two
chances are allowed to in-service candidates to appear in competitive examinations and there is no
limit on the number of chances for which candidates other than serving persons can apply for
appearing in the competitive examination. It has now been decided that all candidates (private or
in-service) appearing in competitive examinations to be held by the Commission shall be allowed to
avail of three chances only subject to the condition that candidates fulfill all other requirements of
the rules. In case age relaxation has been allowed only one chance shall be given.

With regard to one paper test, the number of chances shall also be restricted to three with the
following exceptions:-

(a) One more chance may be given to a candidate who has acquired either an additional relevant
qualification or experience and the gap between the 3rd and the 4th appearance is not less
than one year;

(b) For the posts of Lecturers in Education Department or for a candidate who is applicant for
more than one job he shall have three chances in each subject for which he is a candidate or
for each job;

(c) Where the candidates do not appear in a competitive examination or a test they would be
given only three chances to appear for interview unless they have acquired a higher
qualification in the same subject in which case one additional chance may be given.

IV. REQUISITIONS

* These rules have been substituted by the “Punjab Civil Services (Application for Posts) Rules, 1987”.
At present each Department has to work out vacancies for one financial year and send the
requisitions to the Commission in the preceding March. In order to facilitate planning and avoid
accumulation of work, it has been decided that:-

(a) Requisitions for competitive examinations should be sent by 1st September of each year so
as to enable the Commission to invite applications by December and hold examination in
February;

(b) All Administrative Departments should forward their requisitions for filling vacant posts
other than those filled through competitive examination from 1st July to 31st December each
year so that the Commission may process them in a planned programme;

(c) The Administrative Departments may, in exceptional circumstances, forward their


requisitions between 1st January to 1st May after obtaining approval of the Chief
Secretary/Addl. Chief Secretary;

(d) No requisition should be sent to the Commission during the period from 1st May to 1st July
so that this period is utilized by the Commission to clear the back log and plan for the
future.

It would be the responsibility of the Head of Department concerned to ensure that the above time
schedule for sending requisitions to the Commission is adhered to strictly.

V. AGE RELAXATION

Under the West Pakistan Delegation of Powers (Relaxation of Age) Rules, 1961 all Administrative
Secretaries, Heads of Attached Departments and Divisional Commissioners are empowered to relax
upper age limit by five years and the A.C.S. upto 10 years to avoid hardship to the deserving
candidates. It has now been decided that the candidate concerned shall be responsible to obtain
orders of relaxation from the competent authority and send it to the Commission along with his
application before the closing date prescribed in the Press Note. If relaxation in age limit is not
received by the Commission within the prescribed closing date, the application shall be rejected.

2. Necessary amendments in the West Pakistan Civil Services (Application for Posts) Rules, 1957
wherever required are being made separately.

3. Various instructions on the subject issued from time to time are deemed to have been modified to
the extent stated above.

4. These instructions may kindly be brought to the notice of all concerned for strict compliance.

Subject:- PROPORTIONAL REPRESENTATION OF ZONES IN CLASS-I


AND CLASS-II SERVICES ON POPULATION BASIS

I am directed to refer to this Department's circular letter * No.SOR-III-10-4/73, dated the 13th July,
1973 on the above subject and to say that Zonal formula for filling vacancies in posts of BPS-16 and above
reserved for initial recruitment, requires that 20% of the vacancies should be filled strictly on merit
irrespective of the domicile of the candidates and 80% of the vacancies should be allocated to the two

Zones in the prescribed ratio. Under the existing instructions, in case suitably qualified candidates are not
available from the Zone to which a vacancy has been allocated, it should be added to the merit quota and
filled strictly on merit.

2. According to the scheme of things there are two Zones in the Punjab. A question has arisen as to
what should be done in a situation where ** (any) vacancy is advertised for only persons domiciled in one
Zone and no candidate is found suitable for the vacancy from that Zone. According to the existing policy
such vacancy is required to be diverted to merit quota, but this is not practicable because due to the absence
of applications from candidates of the other Zone there is no one to be considered on merit. Addition of
such vacancy to the merit quota of the next selection for the same category of posts would tantamount to a
presumption that no suitable person would become available from the concerned Zone even against the
next requisition. In order to safeguard the interests of the particular Zone, it has been decided that the
unfilled vacancies, in these circumstances, should be added to the quota of the concerned Zone against the
next requisition/advertisement of the Department for filling similar posts and this process should continue
till candidates from that Zone become available. Stop gap arrangement may be made to carry on work till
the vacancies are filled on regular basis.

I am directed to say that length of experience, besides academic qualifications, has been prescribed
for recruitment to some of the posts in various departments. A question has arisen as to whether only
experience acquired after qualifications has to be taken into consideration for eligibility or
pre-qualifications experience could be counted to fulfill the condition of experience as prescribed in the
rules. The matter has been examined in consultation with the Law and P.A. Department. It has been advised
by the Law and P.A. Department that in cases where no condition has been prescribed in the rules about the
nature of requisite experience, the experience gained before as well as after acquisition of qualifications
shall be counted as the requisite experience.

2. It is, therefore, requested that service/recruitment rules in respect of posts where a condition of
experience has been prescribed may kindly be examined and requisite proposals may be furnished, if
necessary, for consideration by the Service Rules Committee to make provisions in the light of Law
Department's advice.

IN PROVINCIAL SERVICE

Sir,

I am directed to refer to policy letters No. SOR-III-10-4/73 dated 13.7.1973, No. SOR-III-
10-2/84 dated 4.11.1985 and No. SOR-III-10-2/84 dated 24.4.1989 on the subject noted above and to say
that the scheme of zonal allocation of vacancies has been re-considered in the light of some judicial
pronouncements and it is clarified that the allocation of initial recruitment posts in BS-16 and above, shall
henceforth be made on the following basis:

a) 20% of vacancies shall be allocated to merit quota; and


b) remaining 80% shall be allocated to Zone-I and Zone-II in accordance with
the ratio of their population. The areas comprising Zone-I and Zone-II are indicated
at Annexure-A.

2. Considering the ratio of population of both the zones i.e. 69.66% of Zone-I and 30.34% of
Zone-II, a block of 10 vacancies shall be rotated as under:

3. It has further been decided that vacancies in BS-16 and BS-17 remaining un-filled after
advertisement due to non-availability of suitable candidates shall not be shifted to merit quota or the other
zone and shall remain reserved for the candidates of the zone to which the vacancies belong and shall be
included in the vacancies to be filled through the succeeding selection by the Punjab Public Service
Commission, irrespective of the fact whether such vacancies previously, were advertised separately or
through a combined advertisement of he Commission.

4. In the case of posts in BS-18 and above which remain un-filled for two years due to non-
availability or suitable candidates from the respective Zone despite repeated advertisements, the same may
be shifted to merit quota subject to the condition that equal number of vacancies out of merit quota in
subsequent requisitions shall be diverted to the quota of concerned zone to make up the deficiencies caused
due tot shifting of vacancies of its share to the merit quota.

Subject:- ALLOCATION OF POSTS ON THE BASIS OF ZONAL QUOTA

Sir,

I am directed to say that Supreme Court of Pakistan in Constitutional Petition No. 2 of 1996
held that the existing system of reservation of vacancies on zonal basis which are within the purview of the
Punjab Public Service Commission, is ultra vires of Article 27 of Constitution of Islamic Republic of
Pakistan. The system of zonal allocation of vacancies was based on first proviso below Article 27 of the
Constitution, which provided for reservation of vacancies for a period not exceeding twenty years from the
commencing day on the basis of class or area to secure their adequate representation in provincial services.
The period of twenty years has since expired.

2. It has been decided in consultation with Law and Parliamentary Affairs Department that all
recruitment to the post reserved for initial recruitment should be made in accordance with the verdict of the
Supreme Court of Pakistan referred to above pronounced on 31.3.1997. The requisitions placed with the
Commission should not indicate any zonal allocation till further instructions. Therefore, all the existing
Instructions/Notifications on the subject may be deemed to have been amended to the extent indicated
above.

3. I am to request you that contents of this letter may kindly be brought to the notice of all
concerned under your administrative control for strict compliance.

I am directed to refer to this Department’s letter of even No. dated 7th November, 1997, on
the subject noted above, and to state that it has been reported by Administrative Departments that the
Punjab Public Service Commission is sending its recommendations for appointment of candidates on the
basis of requisitions which had been placed with it on the basis of zonal allocation.

2. In compliance with the orders of Supreme Court of Pakistan dated 31.3.1997, Government
have decided that such recommendations of the Punjab Public Service Commission may be referred back to
the Commission with the approval of the Governor, obtained through Cabinet Wing of S&GAD, with the
request to re-arrange their selection on “ALL PUNJAB BASIS” instead of “ZONAL ALLOCATION
SYSTEM”. The requisitions already placed with the Punjab Public Service Commission on zonal basis
should be deemed to have been modified to this extent.
