Honorable Brian C. Walsh
The plaintiffs' very broad Motion in Limine 1 seeks to eliminate in one fell swoop all
22
evidence concerning Audrie Pott's discovery with respect to her biological father and its
23
psychological impact on her. Purposefully or not, the plaintiffs' motion misses the point as to the
24
probative value of this particular evidence. Specifically, the evidence will point out Audrie
25
Pott's anger and mistrust, as well as her fractured relationship with SHEILA and LAWRENCE
26
POTT at the time that she decided to take her own life. The evidence goes directly to her state of
27
mind and explains, in part at least, her apparent sense of hopelessness. This parentage issue was
28
umesolved in Audrie Pott's life less than two weeks before she committed suicide.

Deborah Black, who was an older friend of Audrie's with whom she studied the Bible,
testified as follows:
"Q. Okay. Were you aware at one time that Audrie had been in
therapy?
A. Yes.
Q. Okay. How did you become aware of that?
A. When Audrie found out about her real dad in eight grade,
it became evident that she was having a hard time, so my mom,
in talking with Larry, we had said that we thought it would be
a good idea.
Q. Okay. What do you mean by, 'When Audrie found out about
her real dad?'
A. She never knew that Larry was not her real father until
eight grade when her real dad contacted her through
Facebook.
Q. We're talking about a guy named Michael Lazaren (sic)?
DEFENDANT JOHN B. 'S OPPOSITION TO PLAINTIFFS' MOTION IN LI MINE NO. 1 SEEKING TO PRECLUDE

A. Yes.
2
A. No.
4
5
Q. Okay. Were you present when your mother and Larry are
talking about, you know, 'What are we going to do because
Michael Lazaren (sic) has contacted Audrie?"
A. Yes.
A. Yes.
9
Q. Did you talk to Audrie about her feelings about this disclosure?
10
A. Yes. She was really upset and had said that she had
11
something to tell me and, um, it was news to her. She hadn't - was completely blindsided. I had speculated from Lisa's side
comments that that was not her biological father. So I had
already - - had some idea.
12
13
15
16
17
Q. Right.
18
A. - -what the particular issue was. Um, so that was new. But
when Audrie had told me that that was not her biological
father, it was not news to me.

20
21
A. Yes.

Audrie's best friend, Emily Penuen, also testified about Audrie's anger issue with respect
25

"Q
quote, her natural father or biological father?
DEFENDANT JOHN B. 'S OPPOSITION TO PLAINTIFFS' MOTION IN LIMINE NO. 1 SEEKING TO PRECLUDE
EVIDENCE OF LAWRENCE POIT'S PARENTAGE
Yes.
Q
And if you can recall, what was her reaction to trying trying to be contacted by this person saying he was her biological
father?
-
5
6
A
She was confused and angry. Very angry at her mother
because she was unaware.
Q
Did Audrie ever tell you at any point in time that her
mother or Larry and Lisa had told her that, in fact, Larry was not
her biological father?
8
9
10
11
Q
So as far as you know, it was still a mystery to Audrie at the
point in time that she died?
12
13
14
15
16
A
Yes. From the Facebook messages she believed that that
was her biological father.
17
18
Yes.
19
20
No.
21
22
Yes.
23
Q
And roughly how long before her death was it that, you
know, she told you that, gee, this guy's my biological father.
24
25
Q
Okay. Did you have any conversations with her about that
issue after that or was that just sort of a dead-end issue with you?
26
27
28
III
A
She was just angry at her parents." (Deposition of Emily

I know your intentions are just to let her know you love he1. Your contact with her has effects
