1. This bidding will be conducted in accordance with open international tendering procedures and it
is open to all bidders from eligible source countries.
2. Interested eligible bidders may obtain further information from AWWCEs office at the address
given below and inspect a complete set of bidding documents in English language which is
available on the AWWCEs web site.
3. Local Bidders should present renewed trade license, Tax payer registration certificate and Vat
registration certificate when submitting their offer.
4. A bidder could participate for the offer for a lot shall not be partial.
5. Bidding documents shall be sealed and delivered to Amhara Water Works Construction
Enterprises office at Bahir Dar. Electronic bidding is not allowed.
6. Bids shall be valid for Ninety (90) days after the bid opening date.
7. All bids must be accompanied by a bid security of USD 18,000.00 (Eighteen Thousand) or
Ethiopian Birr 378,000.00 (Three Hundred Seventy Eight Thousand) in the form of bank
guarantee. The bank guarantee issued by a foreign bank shall be indorsed by indigenous bank.

8. Bid closing and opening date shall be on August 31/2016 at 4:00 PM in the presence of
bidders or their legal representatives who choose to attend at AWWCEs office at Bahir Dar.
Late bids after 4:00 PM of the bid closing and opening date will not be accepted.
9. The Amhara Water Works Construction Enterprise reserves the right to accept or reject all or
parts of the bid, and to annul the bidding process.

2. INSTRUCTION TO BIDDERS
2.1.

No verbal agreement or conversation made or had at any time with the


enterprise employee shall affect or modify the terms or obligations here in
attached.

2.3The name and address of the bidder, the invitation number, the lot number and

2.5All requests for clarification of these document by the bidder shall be made in
writing and sent by registered international air mail, or by fax and or delivered by
hand to the address indicated on article 2.2.
2.6If clarification or changes and deemed necessary, they shall be made in writing by
Amhara Water Works Construction Enterprise (AWWCE) in the form of an
addendum to the bid documents and shall be made available at our website.
2.7Bidders shall examine the invitation to bid, as well as all the attached
specifications, instructions and bid schedules.

2.8Each bidder shall furnish the information required by the bid schedule. The
bidder

2.9

2.9.1 The bidder shall submit together with his bid detail schedule showing particulars for all
goods offered by him; Country of origin and standard of manufactured material. In
addition, the bidder shall furnish illustrated literature complete specification of the
Goods and facts substantiate that the make, model and type of the Goods and part
thereof offered has been regularly sold for such use. The literature specifications and
illustrations shall be sufficient to permit complete technical specifications of his
invitation to bid. The statement Comply with your specification in full will not meet
the requirement of this invitation to bid.
Therefore, original manufactures brusher has to be attached.
2.10

All of the above documents shall be in English language, and all measures and

weights given in specifications or other bid documents, if not otherwise defined, are in
recognized metric units.
2.11

The changing of standard model, substituting new components not shown in the

literature or specifications of the goods thereof to meet the requirement of the


invitation, may result in rejection of the bid.
2.12

Bids and modifications or withdrawals thereof received after the time set for bid

opening will not be considered Telephoned and/or cabled bids shall not be considered.
2.13

Bids shall be sealed and delivered to AWWCEs office at Bahir Dar. Bid

closing date shall be on August 31, 2016 G.C at 4:00pm and opened on the
same day at 4:00pm in Bahir Dar in the presence of interested bidders or their legal
representatives on the Third floor office no. 23. If the bid opening date is holiday,
closing and opening of the bid will be the next working day at the same time and the
same venue.
2.14

Bidders are responsible for assuring that bids actually received on time at the place

and office designated in this invitation. A late bid shall not be considered even though

it becomes late because of factors beyond the bidders control such as delay in mail
handing telephone transmission, or custom clearance, etc.
2.15

Bidders must ensure that any changes or deletion in their bid must be initialed.

Bids received with changes and/or deletion and without initial shall be rejected. All
original supporting certificates and manufacturers date must be submitted with the
bid. Bid received without the completed set of literature shall be rejected. No supporting
literature what so ever shall be accepted after the time of bid opening unless required
by the AWWCE.
2.16

Failure filling the price and VAT on the bid form and price schedule sheet shall be

sufficient causes for rejection. The bidder shall also submit price in this standard
Performa invoice.
2.17

Local bidders shall be submitted their price schedule both in DDP and FOB price,

whereas, bidders not submitted their price schedule in both DDP and FOB price will be
rejected.
2.18

In the event no bid is submitted, there is no need to return the invitation unless

otherwise specified.
2.19

In case conflicts are found b/n the general conditions and the technical

specification in this tender the statements in the technical specification shall govern.
2.20

Technical documents and commercial invoice should be in the same

folder but original & copy documents will be submitted separately by one
copy.
2.21

The bidders shall be entirely responsible for all taxes, duties, license fees,

commissioning costs, etc incurred until delivery of the contracted Goods to the
purchaser.
2.22

The bidders shall bear all costs associated with the preparation and submission of

its bid, and one purchaser will in no case be responsible or liable for those costs,
regardless of the conduct or outcome the bidding process.
2.23

The bidders have the option to bid for a lots. However, bids received for incomplete

lots will be treated as incomplete bids and shall be sufficient causes for rejection.
3. GENERAL CONDITION OF CONTRACT
3.1
3.1.01

APPOINTMENT OF AN AGENT
Bid submitted by persons other than the manufacturer shall be accompanied by
certified letter from the manufacturer stating that the bidder is an authorized
agent of the said manufacturer

3.1.2 All successful bidders shall have, or undertake to appoint, an authorized agent,
resident in Ethiopia who has employed persons trained in providing the necessary
back-up services, to the manufacturers products.
3.1.3

If bids do not accompanied by the manufacturers letter of authorization to the


supplier and subsequently to the suppliers local agent, their bids will be
subjected to rejection.

3.1.4 Any bid that does not submitted in accordance with these requirements will be
resulted in automatic rejection.
3.2

SUPPLIERS NAME AND SIGNING OF DOCUMENTS


3.2.1 Each Bid shall bear legal name of the manufacturer or supplier and shall be
signed either by an authorized officer of the bidder and/or shall be accompanied
by a power of Attorney giving Authority to the person signing the documents.
3.2.2 Each bid shall be submitted in two copies one original and one copy. The
bidders name and signature shall be shown on each sheet on which he makes
an entry. Any changes shall be initialed by the person signing the bid.

PRICE AND TERMS OF PAYMENT

The Bidders shall indicate in the bid form and price schedule attached to these documents
the unit price and the total price of the goods it proposes to supply under the contract
Pursuant to article (3.3.01) above bidders shall provide price for FOB & or DDP at
Bahir dar, as per bid form the price schedule attached with this tender.
The bidders separation of price components in accordance with 3.3.02 above will not in
any way limit the purchasers right to contract on any of the terms offered
The Bidder shall quote firm prices, for all the above costs. Bid with estimated quotation
for the items shall be rejected. The AWWCE shall pay the actual cost up to the amount
quoted. No amount in excess of the quoted price shall be paid by AWWCE.
In addition to the price schedule bidders shall submit their quotations, in an official proforma invoice containing details identical to the bid schedule attached to this tender.
The prices quoted shall be firm for at least for a period of 90 days after the date of the
bid opening.
The unit prices shall be shown for each item bid upon unless otherwise specified. In case
of error in the extension of price, the unit price shall govern.
Alternate bids, unless supported by the detailed specification, it shall not be considered.
Conversion from Foreign currency to Ethiopian Birr, for the purpose of price comparison
selling rate established by National Bank of Ethiopia/Commercial Bank of Ethiopia/ on
the date of bid opening shall be used and shall be binding on both parties and no
subsequent adjustment shall be made due to fluctuations in rates.

For goods and services that the bidder will supply from outside the purchasers
country; Price shall be quoted in any freely convertible currency acceptable by
the National bank of Ethiopia for goods & service the bidder supplies from the
purchasers country; Prices shall be quoted in Birr.

3.4

TERMS OF PAYMENT

3.4.1. If FOB is chosen


The preferable payment term is 90% upon document at discharge port and 10% after final
acceptance at purchasers warehouse.
3.4.2. If DDP Bahir Dar is chosen.
A maximum of 30% of the contract price shall be paid in advance against submission of an
equivalent amount of advance payment guarantee in the form of CPO or unconditional Bank
guarantee.
a) The remaining 70% of the contract price shall be paid upon final acceptance.

DELIVERY OF GOODS
The counting of the delivery time of equipment to AWWCEs warehouse at Bahir Dar
shall commence from the day the bidder sign the contract agreement. The equipments
covered under this invitation are required to be delivered in short time credit will be given
to earlier deliveries.
The delivery time to be given shall be the calendar days, that is, including Sundays and
holidays.

SECURITY BONDS
3.6.1 BID GUARANTEE

Each bid shall be accompanied by a bid guarantee of USD 18,000.00 (Eighteen Thousand) for
foreign suppliers and ETB 378,000 (Three Hundred Seventy Eight Thousand) for local suppliers in
the form of bank guarantee price payable to the AWWCE. The guarantee instrument shall have a
validity of at least 90 days from date of bid opening, shall be in the form of C.P.O, certified check,
or unconditional Bank guarantee. The unsuccessful bidders shall be released from their bid
guarantee after signing of the contract agreement from the successful bidder. The successful
bidder shall be released from the bid guarantee only upon submitting of the performance
guarantee to AWWCE referred in 3.6.2 below.

The foreign bank guaranty presented from the foreign suppliers, must be integrated in the local
bank from Ethiopia. The foreign bank guaranty is not acceptable if it is separately presented from
the foreign suppliers.

3.6.2

PERFORMANCE GUARANTEE

i) Within 10 days from receipt of notification that his bid is accepted, the successful bidder shall
furnish a guarantee for satisfactory performance of contract equal to 10% of the total contract
price payable to the AWWCE.
ii) The performance bond shall only be in the form of unconditional Bank Guarantee through the
illegible local bank.
iii) The AWWCE reserves the right to forfeit the performance guarantee of successful bidder and
cancel the award if the successful bidder fails to submit the performance guarantee within 10
days from receipt of notification.
iv) The supplier shall faithfully and properly performs this contract according to all the terms
thereof.
His obligation here in under shall remain in full force and effect.
a) The initial performance bond shall be valid for the period of complete delivery of the goods .
b) The supplier shall make the performance bond continuously active and workable up to the
end of delivery.
c) The performance bond shall not be released without AWWCE consent and written permit
letter to the relevant bank.
d) The supplier shall automatically update the validity of performance bond until all the items are
delivered to the final destination and inspection testing is performed by both parties and
further until the end of delivery.
3.6.3. EVALUATION OF BIDS AND AWARD OF CONTRACT

3.6.3.1. Bids will be verified for completeness, formal correctness and technical compliance. Bids
which are incomplete, conditional, illegible, or obscure or that contain additions not called for
reservations, erasures, alterations or irregularities of any kind, May be rejected.
3.6.3.2 The contract award shall be made to the responsible bidder who complies with
requirement in the invitation to bid and the technical specifications and whose bid is the most
advantageous to the AWWCE price and other factors considered.
3.6.3.3 Prior to the expiration of the period of the bid validity, the AWWCE shall issue an official
letter, denoting Purchase Order, to the evaluated winner who must then acknowledge receipt of
same by his letter of acceptance addressed to the AWWCE to confiscate the Bid bond.
3.6.3.4 The notification of award and a written acknowledgement thereto shall constitute a
binding contract between the AWWCE and the winner without further action by both parties.
3.6.3.5 Conditions that there not stipulated in the offer shall not be accepted by the AWWCE if
stated in the Winners letter of acknowledgement. There shall be no adjustment in respect of
increase in the cost of labor and/or materials or any other matter affecting the cost of the provision
of the item bid upon.

3.7 INSPECTION
3.7.01

The supplier shall furnish for items supplied, a manufacturers inspection certificate,
certifying that the item supplied complies with the specifications set out in the technical
specification of the bid documents and that the supplied items are for the respective item
to be supplied.

3.7.02

The supplier shall give notice to the AWWCE by cable that items are ready for shipment,
at least 15 days prior to the intended date of shipment.
3.7.03. If the supply term is DDP Final inspection of the item shall be made by the AWWCE and the
suppliers representative at the final destination. The final destination shall be the
AWWCE, Central warehouse, at Bahir Dar.
3.8

WARRANTY

3.8.01

The supplier warrants all items furnished, are in accordance with the requirements set
out in the technical specification including spare parts of whatever manufacture against
defective materials workmanship. The supplier and/or his agent shall at his own expense
and within 15 up to 60 days (depends on the nature of items ) after receipt of notification
from the AWWCE provide replacements or replacement parts for items which prove
defective from negligent poor workmanship of faulty material, or short shipment.

3.8.02

The supplier and/or his agent shall at his own expense (Including all installation and
labor charges) and within 60 days after receipt of notification from the AWWCE provide
replacements or replacement parts for items, which prove defective from negligent
workmanship or faulty material during the warranty period, delivered to the final
destination by the quickest means.
Failure to do so will result in remedial action being under taken by AWWCE at the
risk & expense of the bidder/supplier. AWWCE reserves the right to further claim for
down time of the delivered equipment due to failures or malfunctioning of equipment
that may be happened during the warranty period. Whenever such failures or short
shipment is not rectified within the specified time, AWWCE shall request compensation
for construction damage that may be caused to the envisaged projects due to
unavailability of the equipment under consideration.

3.9

VARIATION OF ORDERS
The AWWCE reserves the right to increase or decrease any item of goods by 25% of the
total quantity within the price validity without a change in the unit price.

3.10

FINAL ACCEPTANCE

3.10.01 Notification of shipment by cable shall be made to the AWWCE at the time of shipment
and copies of bill of loading and invoice directly sent to the buyer by air not less than
15 days in advance of the arrival of the equipment at the said location.

3.10.02 If the supply term is DDP Final acceptance, of all equipments and accessories shall be
subject to final inspection during the goods are delivered to the AWWCE Central
Warehouse in Bahir Dar. Items delivered but not meeting the specification, shall not be
accepted. Any cost incurred by AWWCE for subsequent inspection, storage or
assistance to the supplier shall be billed to the supplier or his local agent for
settlement.
3.10.03
If any equipment amount of items and/or accessories are delivered in damaged
condition or is short shipped, the supplier and/or his agent at his own expense shall
provide replacement in accordance with the following conditions: a) Replacement for parts, accessories and tools shall be delivered and installed within
30 days of the sending of notice of nonconformance by the AWWCE.
b) Replacement for any complete bid item (equipment) shall be delivered within 60
(sixty) days of the sending of notice of non-conformance by the AWWCE.
3.10.04 under the above circumstances, AWWCEs right to impose the Penalty stipulated under
respective provisions of this general condition is reserved.
3.10.05

All units shall be supplied with the manufacturers standard and shall be listed with
quantity and price.
3.10.06 All equipment and field kit shall be new, un-used and of current manufacture.
3.11

INCIDENTAL SERVICES

3.11.1 The supplier, as part of the supply, shall furnish the following incidental services
- All relevant manufacturers manuals and catalogues as per the details of technical
specifications,
- Electrical wiring diagrams.
3.12 DELAYS IN THE SUPPLIERS PERFORMANCE
Delivery of the goods and provision of services shall be performed by the supplier in
accordance with the delivery. An unexecuted delay by the supplier in the performance of its
delivery obligation shall render the supplier liable to forfeiture of the performance security,
imposition of the liquidated damage and other subsequent measures.
3.13 LIQUIDATED DAMAGES
For each day of delay in the delivery of the items, beyond the delivery date agreed upon by
both parties, the supplier or his local agent shall pay liquidated damage in the amount 0.1%
(zero point one percent per day) of the contract value or equipment for a maximum of
10% (ten percent) after which time AWWCE shall have the right of terminating the
contract. Upon termination AWWCE has the right to claim damages incurred as the result
of termination.

3.14 FORCE MAJEURE


Neither the Supplier/supplier agent/ nor AWWCE shall be responsible for delays arising
from unforeseeable circumstances such as natural catastrophe, civil and/or external war,
strikes, lockouts, etc.
3.15 DISPUTE SETTLEMENT
Any dispute, which may arise between the contracting parties, shall be settled amicably. In
case the parties fail to resolve the dispute amicably, the case shall be submitted to any
Ethiopian court having competent jurisdiction.
3.16 INTERPRETATION
The contents of this contract shall constitute the terms, conditions and specification for the
sale and purchase agreement between the AWWCE and the supplier and shall be deemed
for all-purpose to have been executed in Ethiopia and all respects shall be subject to and be
construed in accordance with the Laws of Ethiopia.
3.17

TERMINATION OF CONTRACT

3.17.01

The AWWCE shall send written notice of default to the supplier or his agent and
terminate the whole or any part of the contract under in any one of the following
circumstances.
a)
When the supplier and/or his local agent fails to deliver the equipment to provide
any service within the delivery time.
b)
When the supplier fails to perform any obligations of this contract in accordance
with the terms and conditions,
c)
In either of these circumstances, if the supplier will not rectify the failures within a
period or 10(ten) days

3.17.02 In the event that the AWWCE terminates this contract in whole or in part as provided in
paragraph 3.17.01 a and b, the AWWCE may procure upon such terms and in such a
manner as the AWWCE may deem appropriate, equipment item same to those so
terminated and the supplier shall be liable to the AWWCE for any excess costs. The
supplier and/or the agent shall continue the performance of this contract to the extent not
terminated.
3.18 RIGHTS AND REMEDIES OF AWWCE
The right and remedies of the AWWCE provided in this invitation to bid shall not be
excusive and are in addition to any other rights and remedies provided by law.
3.19 APPLICABLE LAW
The contents of this invitation to bid (part one through three) shall constitute the terms,
conditions and specification for the sale and purchase contract between the AWWCE and

the supplier and/or his agent and shall be deemed for all purpose to have been executed in
Ethiopia and all respects shall be subject to construed in accordance with the laws of
Ethiopia.

We undertake, if our bid is accepted, to have all items delivered with in--------- calendar days at

We understand that the Purchaser is not bound to accept the lowest or any other bid it may

In the event of litigation between the Purchaser and us we agree that Ethiopian courts shall have

All equipment shall be supplied and delivered, designed, construction assembled and equipped in
accordance with the operation conditions specified.

The desire generating sets shall consist of diesel engines and alternators mounted together on common
base plates (skid mounted). It shall be rated for continues duty for operation under the climate conditions
and altitude as specified and shall be rated at speed of 1500 rpm.

Technical information
Certified engine and alternator data showing at least, net power frequent performance curves for engine
and alternator, at specified site altitude above sea level shall be submitted with the bid.
