Concerning minimal requirements on safety and health related to medical assistance
onboard vessels
On the basis of article 108 in the Romanian Constitution, republished,
The Government of Romania has adopted this decision:
CHAPTER I
General Provisions
Art.1 - The present decision establishes the minimal requirements on safety and health
related to medical assistance onboard vessels.
Art.2 - The present decision uses the following denominations and definitions:
a) vessel: any vessel flying the Romanian flag seagoing or estuary-fishing, publicly or
privately owned, excluding:
- inland navigation vessels;
- pleasure boats used for non-commercial purpose and not manned by professional crews;
- tugs operating in harbor areas.
b) worker: any person carrying out an occupation on board a vessel, including trainees
and apprentices, but excluding port pilots and shore personnel carrying out work on board
a vessel at the quayside;
c) owner: the registered owner of a vessel unless that vessel has been chartered by
demise or is managed, either wholly or in part, by a natural or legal person other than the
registered owner under the terms of a management agreement; in that case the owner
shall be construed as the demise chartered or natural or legal person managing the vessel
as appropriate;
d) medical supplies: medicines, medical equipment and antidotes, a non-exhaustive list of
which is given in Annex 2;
e) antidote: substance used to prevent or treat a harmful effect or effects, direct or indirect,
of one or more substances included on the list of dangerous substances in Annex 3.
Art.3 - Vessels are categorized in three categories, according to provisions of Annex no. 1.
CHAPTER II
Medicines and sanitary materials - Sick bay Doctor
Art.4 - Any vessel flying the Romanian flag must permanently have onboard medical
endowment, in terms of quality, according to provisions of pct. I and II in Annex no. 2,
corresponding to vessel category it belongs.
Art.5 - The quantities of medicinal products and medical equipment to be carried onboard
depend on the nature of the voyage in particular ports of call, destination, duration the
type or types of work to be carried out during the voyage, the nature of the cargo and the
number of workers.
Art.6 - The content of medical supplies, regarding the medicines and medical equipment,
shall be detailed on a checklist corresponding at least to the general framework laid down
in Annex 4, sections 1, 2 and 3, pct. II.
Art.7 - (1) Any vessel flying the Romanian flag in category C vessels, shall carry for each
of its life-rafts or life- boats a watertight medicine chest containing at least the medical
supplies specified in Annex 2, pct. I and II.
(2) The check of the pharmacy chest shall be also registered in the control document
provided at art. 6 of the present chapter.
Art.8 - (1) Any vessel flying the Romanian flag of more than 500 gross registered tones
with a crew of 15 or more workers and engaged in a voyage of more than three days shall
have a sick-bay in which medical treatment can be administrated under satisfactory
material and hygienic conditions.
(2) Any vessel flying the Romanian flag with a crew of 100 or more workers and engaged
in a voyage of more than three days outside national waters shall have a doctor onboard
vessel, responsible with health care of workers.
CHAPTER III
Antidotes
Art.9 - Any vessel flying the Romanian flag and carrying one or more of the dangerous
substances listed in Annex 3 shall provide on board medical supplies including at least the
antidotes listed in Annex no. 2 at pct. III.
Art.10 - (1) Any ferry-type vessels flying the Romanian flag whose conditions of operation
do not always allow knowing well in advance the nature of the dangerous substances
transported must have on board medical supplies including at least the antidotes listed in
Annex no. 2 at pct. III.
(2) However, on a regular where the crossing is due to last less than two hours, the
antidotes may be limited to those which have to be administrated in cases of extreme
emergency within a period of time not exceeding the normal duration of the crossing.
Art.11 - The contents of the medical supplies regarding the antidotes shall be detailed on a
checklist corresponding at least to the general framework laid down in Annex no. 4
sections 1, 2 and 3.
CHAPTER IV
Allocation of responsibilities
Art.12 The procurement and replenishment of the medical supplies of any vessel flying
the Romanian flag are undertaken on the solely responsibility of the owner, without any
expense to the workers.
Art. 13 - (1) The management of the medical supplies is placed under the responsibility of
the captain of the vessel.
(2) Without prejudice to this responsibility laid down at para. (1), the captain of the vessel
may delegate the use and maintenance of the medical supplies to one or more workers
specially designated by reason of their competence.
Art. 14 - The medical supplies must maintained in good condition, completed and
replenished and/or replace as soon as possible, and in any case as priority part of normal
revictualling procedures.
Art. 15 - In a medical emergency ascertained by the captain after having obtained a

medical opinion, the required medicines, medical equipment and antidotes which are not
available on board must be procured as soon as possible.
CHAPTER V
Information and training
Art. 16 - Medical supplies are accompanied by one or more guides to their use, including
instructions for use of antidotes required in Annex no. 2 at pct. III.
Art. 17 - All persons having competence certificates and other employee categories
working on board of a vessel flying the Romanian flag must provide a medical assistance
and first aid course graduation proof in the event of an accident or serious medical
emergency;
Art. 18 - The captain and worker or workers who, pursuant art. 13, were designated to use
the medical supplies must follow special training at least every five years, taking into
account the specific risks and needs connected with the different categories of vessel and
in accordance with the general guidelines set out in Annex no. 5.
CHAPTER VI
Medical consultations by radio
Art. 19 - To ensure better emergency treatment for workers on board vessels, the Ministry
of Public Health assures free of charge medical consultation by radio throughout the
National Vessel Radio Communication Company "RADIONAV" - S.A.
Art. 20 - The Ministry of Public Health assures the training of doctors appointed for the
centre of consultation by radio, taking into account the special conditions prevailing on
board vessel.
Art. 21 - (1) Radio consultation centres may keep medical personal data, on the approval
of respective employees, in order to optimize the assistance given through radio
consultation.
(2) Medical personal data are confidential.
CHAPTER VII
Control of medical supply on board vessel
Art. 22 - (1) The Ministry of Public Health carries out an annual control of medical supplies
on board all vessels flying the Romanian flag.
(2) The periodical control mentioned at para. (1) provides a check on:
a) the medical supplies meet the minimum requirements of this Decision;
b) the checklist provided for in Art. 6 confirms that the medical supplies comply with this
Decisions minimum requirements;
c) the medical supplies are correctly stored;
d) any expiry dates have been respected.
Art. 23 - (1) Inspections of the medical supplies stored on life-rafts shall carried out in the
course of those life-rafts annual maintenance.
(2) Inspections as laid down at para. (1) can not be postponed for more than five months.

CHAPTER VIII
Final provisions
Art. 24 Annexes no. 1 - 5 are inner part of the present Decision.
Art. 25 - This Decision enters in force at 1st September 2006.

ANNEX no.1
CATEGORIES OF VESSELS (Article 114 (a))
A. Sea-going or sea-fishing vessels, with no limitation on length of trips.
B. (1) Sea-going or sea-fishing vessels making trips of less than 150 nautical miles from
the nearest port with adequate medical equipment.
(2) Category B shall be extended to sea-going or sea-fishing vessels which make trips of
less than 175 nautical miles from the nearest port with adequate medical equipment and
which remain continuously within range of helicopter rescue services.
(3) To this end, the Ministry of Transports forward up-to-date information on the areas in
which routine helicopter rescue services are provided, and the circumstances in which they
operate to the Member States to the captains of vessels flying Romanian flag who are
concerned by application of the subparagraph (2). The information shall be forwarded in
the most appropriate way, for example through radio-consultation centers, rescue
coordination centers or coastal radio stations.
C. Harbour vessels, boats and craft staying very close to shore or with no cabin
accommodation other than a wheelhouse.

ANNEX no.3
DANGEROUS SUBSTANCES (Article 114 (e) and Article 116 (1))
The substances listed in this Annex are to be taken into account in whatever form they are
carried on board, including the form of waste or cargo residues.
- explosive substances and objects,
- gases: compressed, liquefied or dissolved under pressure,
- inflammable liquids,
- inflammable solids,
- substances liable to spontaneous combustion,
- Substances which, on contact with water, give off inflammable gases,
- combustible substances,
- organic peroxides,
- toxic substances,
- infectious substances,
- radioactive substances,
- corrosive substances,
- various dangerous substances, i.e. any other substances which experience has shown, or may show, to
be dangerous, so that the provisions of Article 116 need to be applied.

I.
1. Basic understanding of physiology, symptomatology and therapeutics.
2. Elements of preventive medicine, notably individual and collective hygiene, and elements of possible
prophylactic measures.
3. Ability to perform basic types of treatment and supervise emergency disembarkation at sea.
Person responsible for treatment aboard category A vessels should if possible receive their practical
training in hospitals
4. Detailed knowledge of how to use the various remote medical consultation facilities.
II. This training should take account of the programmes of instruction detailed in relevant recent
international documents.
