MICROSOFT SOFTWARE LICENSE TERMS

MICROSOFT PLAYREADY PC RUNTIME


These license terms are an agreement between you and

the device manufqweqweqeqwwqeqweqweqeqacturer that distributes the software with


the device; or

the software installer that distributes the software with the device.
Please read them. They apply to the software named above, which includes the med
ia on which you received it, if any. Printed paper license terms, which may come
with the software, take the place of any on-screen license terms. The terms als
o apply to any Microsoft

updates,

supplements,

Internet-based services, and

support services
for this software, unless other terms accompany those items. If so, those terms
apply. If you obtain updates or supplements directly from Microsoft, Microsoft,
and not the manufacturer or installer, licenses those to you.
By using the software, you accept these terms. If you do not accept them, do not
use the software. Instead, contact the manufacturer or installer to determine i
ts return policy for a refund or credit.
As described below, using the software also operates as your consent to the tran
smission of certain computer information for Internet-based services.
If you comply with these license terms, you have the rights below for each licen
se you acquire.
1.
OVERVIEW. These license terms permit installation and use of one copy of
the software on one device, along with other rights, all as described below.
2.
INSTALLATION AND USE RIGHTS. The software license is permanently assigne
d to the device with which you acquired the software. That device is the licensed
device. A hardware partition or blade is considered to be a separate device.
a.
Licensed Device. You may install and use one copy of the software on the
licensed device.
3.
ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS.
a.
Remote Access. The single primary user of the licensed device may access
and use the software installed on the licensed device remotely from any other d
evice. You may allow other users to access the software to provide you with supp
ort services. You do not need additional licenses for this access. No other pers
on may use the software under the same license at the same time for any other pu
rpose.
b.
Font Components. While the software is running, you may use its fonts to
display and print content. You may only

embed fonts in content as permitted by the embedding restrictions in the fonts;


and

temporarily download them to a printer or other output device to help print cont
ent.
4.
INTERNET-BASED SERVICES. Microsoft provides Internet-based services with
the software. Except as otherwise noted in materials accompanying a service, it
may change or cancel them at any time.
a.
Consent for Internet-Based Services. The software feature described belo
w connects to Microsoft or service provider computer systems over the Internet.
In some cases, you will not receive a separate notice when they connect. By usin
g this feature, you consent to the transmission of this information. Microsoft d
oes not use the information to identify or contact you.
Computer Information. The following feature uses Internet protocols, which send
to the appropriate systems computer information, such as your Internet protocol
address, the type of operating system, browser and name and version of the softw
are you are using, and the language code of the device where you installed the s
oftware. Microsoft uses this information to make the Internet-based service avai
lable to you.

Microsoft PlayReady Content Access Technology.

Revocation. Content owners use Microsoft PlayReady content access technology to

protect their intellectual property, including copyrighted content. If the PlayR


eady software fails to protect the content, content owners may ask Microsoft to
revoke the softwares ability to use PlayReady to play, subscribe, purchase, rent,
stream, sideload or copy protected content. Revocation does not affect unprotec
ted content. You agree that by using PlayReady software, software applications u
sing PlayReady may automatically download and install revocation lists from Micr
osoft.

DRM Updates. Updates to PlayReady may be required in order to access content tha
t is protected by PlayReady. When you attempt to play content that requires a DR
M update or if the security of your version of PlayReady is compromised, PlayRea
dy will (a) connect to the Microsoft or service provider computer systems over t
he Internet, and (b) use Internet protocols to send the appropriate systems stan
dard computer information, troubleshooting data, and a unique identifier for you
r PlayReady version and information about your PlayReady version, such as revisi
ons, security levels and certificates. If you decline an update, you will not be
able to access content that requires the update.
b.
Use of Information. We may use the computer information, to improve our
software and services. We may also share it with others, such as hardware and so
ftware vendors. They may use the information to improve how their products run w
ith Microsoft software.
5.
SCOPE OF LICENSE. The software is licensed, not sold. This agreement onl
y gives you some rights to use the software. The manufacturer or installer and M
icrosoft reserves all other rights. Unless applicable law gives you more rights
despite this limitation, you may use the software only as expressly permitted in
this agreement. In doing so, you must comply with any technical limitations in
the software that only allow you to use it in certain ways. For more information
, see the software documentation. You may not

work around any technical limitations in the software;

reverse engineer, decompile or disassemble the software, except and only to the
extent that applicable law expressly permits, despite this limitation;

make more copies of the software than specified in this agreement or allowed by
applicable law, despite this limitation;

publish the software for others to copy;

rent, lease or lend the software; or

use the software for commercial software hosting services.


6.
BACKUP COPY. You may make one backup copy of the media. You may use it o
nly to reinstall the software.
7.
DOCUMENTATION. Any person that has valid access to your computer or inte
rnal network may copy and use the documentation for your internal, reference pur
poses.
8.
EXPORT RESTRICTIONS. The software is subject to United States export law
s and regulations. You must comply with all domestic and international export la
ws and regulations that apply to the software. These laws include restrictions o
n destinations, end users and end use. For additional information, see www.micro
soft.com/exporting.
9.
SUPPORT SERVICES. For the software generally, contact the manufacturer o
r installer for support options. Refer to the support number provided with the s
oftware. For updates and supplements obtained directly from Microsoft, Microsoft
provides support as described at www.support.microsoft.com/common/international
.aspx.
10.
ENTIRE AGREEMENT. This agreement (including the warranty below), any add
endum or amendment included with the software, and the terms for supplements, up
dates, Internet-based services and support services that you use, are the entire
agreement for the software and support services.
11.
APPLICABLE LAW.
a.
United States. If you acquired the software in the United States, Washin
gton state law governs the interpretation of this agreement and applies to claim
s for breach of it, regardless of conflict of laws principles. The laws of the s
tate where you live govern all other claims, including claims under state consum
er protection laws, unfair competition laws, and in tort.

b.
Outside the United States. If you acquired the software in any other cou
ntry, the laws of that country apply.
12.
LEGAL EFFECT. This agreement describes certain legal rights. You may hav
e other rights under the laws of your state or country. You may also have rights
with respect to the party from whom you acquired the software. This agreement d
oes not change your rights under the laws of your state or country if the laws o
f your state or country do not permit it to do so.
13.
LIMITATION ON AND EXCLUSION OF DAMAGES. Except for any refund the manufa
cturer or installer may provide, you cannot recover any other damages, including
consequential, lost profits, special, indirect or incidental damages.
This limitation applies to

anything related to the software, services, content (including code) on third pa


rty Internet sites, or third party programs; and

claims for breach of contract, breach of warranty, guarantee or condition, stric


t liability, negligence, or other tort to the extent permitted by applicable law
.
It also applies even if

repair, replacement or a refund for the software does not fully compensate you f
or any losses; or

the manufacturer or installer, or Microsoft knew or should have known about the
possibility of the damages.
Some states do not allow the exclusion or limitation of incidental or consequent
ial damages, so the above limitation or exclusion may not apply to you. They als
o may not apply to you because your country may not allow the exclusion or limit
ation of incidental, consequential or other damages.

LIMITED WARRANTY
A.
LIMITED WARRANTY. If you follow the instructions, the software will perf
orm substantially as described in the Microsoft materials that you receive in or
with the software.
B.
TERM OF WARRANTY; WARRANTY RECIPIENT; LENGTH OF ANY IMPLIED WARRANTIES.
The limited warranty covers the software for 90 days after acquired by the first
user. If you receive supplements, updates, or replacement software during those
90 days, they will be covered for the remainder of the warranty or 30 days, whi
chever is longer. If you transfer the software, the remainder of the warranty wi
ll apply to the recipient.
To the extent permitted by law, any implied warranties, guarantees or conditions
last only during the term of the limited warranty. Some states do not allow lim
itations on how long an implied warranty lasts, so these limitations may not app
ly to you. They also might not apply to you because some countries may not allow
limitations on how long an implied warranty, guarantee or condition lasts.
C.
EXCLUSIONS FROM WARRANTY. This warranty does not cover problems caused b
y your acts (or failures to act), the acts of others, or events beyond the reaso
nable control of the manufacturer or installer, or Microsoft.
D.
REMEDY FOR BREACH OF WARRANTY. The manufacturer or installer will, at it
s election, either (i) repair or replace the software at no charge, or (ii) acce
pt return of the product(s) for a refund of the amount paid, if any. The manufac
turer or installer may also repair or replace supplements, updates and replaceme
nt software or provide a refund of the amount you paid for them, if any. Contact
the manufacturer or installer about its policy. These are your only remedies fo
r breach of the limited warranty.
E.
CONSUMER RIGHTS NOT AFFECTED. You may have additional consumer rights un
der your local laws, which this agreement cannot change.
F.
WARRANTY PROCEDURES. Contact the manufacturer or installer to find out h
ow to obtain warranty service for the software. For a refund, you must comply wi
th the manufacturers or installers return policies.
G.
NO OTHER WARRANTIES. The limited warranty is the only direct warranty fr
om the manufacturer or installer, or Microsoft. The manufacturer, or installer a
nd Microsoft give no other express warranties, guarantees or conditions. Where a
llowed by your local laws, the manufacturer or installer and Microsoft exclude i
mplied warranties of merchantability, fitness for a particular purpose and non-i
nfringement. If your local laws give you any implied warranties, guarantees or c
onditions, despite this exclusion, your remedies are described in the Remedy for
Breach of Warranty clause above, to the extent permitted by your local laws.
H.
LIMITATION ON AND EXCLUSION OF DAMAGES FOR BREACH OF WARRANTY. The Limit
ation on and Exclusion of Damages clause above applies to breaches of this limit
ed warranty.
This warranty gives you specific legal rights, and you may also have other right
s which vary from state to state. You may also have other rights which vary from
country to country.

Please note: As this software is distributed in Quebec, Canada, some of the clau
ses in this agreement are provided below in French.

GARANTIE LIMITE
A.
GARANTIE LIMITE. Si vous suivez les instructions, le logiciel fonctionner

B.
DURE DE LA GARANTIE; BNFICIAIRE DE LA GARANTIE; DURE DE TOUTE GARANTIE IMPLICI
TE. La garantie limite couvre le logiciel pendant une dure de quatre-vingt-dix (90
)jours compter de son acquisition par le premier utilisateur. Si vous recevez des
supplments, des mises jour ou un logiciel de remplacement au cours de ces quatre
-vingt-dix (90)jours, ils seront couverts soit pendant la dure de la garantie rest
ant courir, soit pendant trente (30)jours, la priode la plus longue tant applicable
. Si vous transfrez le logiciel, la dure de la garantie restant courir sapplique au
destinataire.
Dans toute la mesure permise par la rglementation applicable, toute garantie impl
icite sera applicable uniquement pendant la dure de la garantie limite. Certains ta

i)accepter le retour du ou des produits contre remboursement du montant pay, le ca
s chant. Le fabricant ou linstallateur peut galement rparer ou remplacer les supplment
s, les mises jour et le logiciel de remplacement ou rembourser le montant que vo
us avez pay pour ces lments, le cas chant. Veuillez contacter le fabricant ou linstall
ateur pour connatre les modalits. Ces recours sont les seuls dont vous disposez en
cas de violation de garantie limite.
E.
DROITS DES CONSOMMATEURS NON AFFECTS. Vous pouvez bnficier de droits supplme
ntaires relatifs aux consommateurs en vertu du droit de votre pays, que ce contr
at ne peut modifier.
F.
PROCDURES RELATIVES AUX RCLAMATIONS ENTRANT DANS LE CADRE DE LA GARANTIE.

trant dans le cadre de la garantie du logiciel. Pour obtenir un remboursement, v
ous devez vous conformer aux modalits de retour des marchandises du fabricant ou

AUCUNE AUTRE GARANTIE. La garantie limite est la seule garantie directe f
ournie par le fabricant ou linstallateur et Microsoft. Le fabricant ou linstallate
ur et Microsoft naccordent aucune autre garantie expresse. Dans la mesure autorise
par le droit de votre pays, le fabricant ou linstallateur et Microsoft excluent
les garanties implicites de qualit, dadquation un usage particulier et dabsence de c
ontrefaon. Si les lois de votre pays vous accordent des garanties implicites, non
obstant la prsente exclusion, les recours dont vous disposez sont ceux exposs dans
larticle ci-dessus relatif aux recours en cas de violation de garantie, dans la

H.
LIMITATION ET EXCLUSION DE RESPONSABILIT EN CAS DE VIOLATION DE GARANTIE.

dommages sapplique en cas de violation de la prsente garantie limite.
La prsente garantie vous confre des droits lgaux spcifiques et vous pouvez galement bn
icier dautres droits qui varient dun tat lautre ou dun pays lautre.
LIMITATION ET EXCLUSION DE RESPONSABILIT EN CAS DE DOMMAGES. Hormis le remboursem
ent pouvant tre obtenu du fabricant ou de linstallateur, vous ne pouvez prtendre au
cune indemnisation pour les autres dommages, y compris les dommages spciaux, indi
rects ou accessoires et les pertes de bnfices.
Cette limitation concerne:


toute affaire lie au logiciel, aux services ou au contenu (y compris tout code) f
igurant sur des sites Internet tiers ou dans des programmes tiers; et

les rclamations pour rupture de contrat ou violation de garantie, les rclamations


en cas de responsabilit sans faute, de ngligence ou autre dlit dans la limite autor
ise par la loi en vigueur.
Elle sapplique galement, mme si:

la rparation, le remplacement ou le remboursement du logiciel ne compense pas intg


ralement tout prjudice subi; ou

le fabricant ou linstallateur; ou Microsoft avait ou aurait d avoir connaissance d


lventualit de tels dommages.
Certains tats nautorisent pas lexclusion de garanties ou la limitation de responsab
ilit pour les dommages indirects ou accessoires, de sorte que la limitation ou lex
clusion ci-dessus peut ne pas vous tre applicable. Elles peuvent galement ne pas v
