The undersignedprosecutorstateson information and belief that the defendant,

eitherdirectly or as a party, at County of Davis, Stateof Utah, committedthe crimesof:

COUNT 1

CRIMINAL HOMICIDE, AGGRAVATED MURDER, (2627) 76-5-202 UCA,

first degreefelony, as follows: That betweenApril 29, 2010 and May 8, 2010 at the place

aforesaidthe defendantintentionally or knowingly causedthe deathof anotherunderany of the

following circumstances

(a) the homicide was committed incident to an act, scheme,course of conduct, or criminal

episodeduring which the actor committedor attemptedto commit aggravatedsexualabuseof a

child or child abuseasdefinedin Subsection76-5-109(2Xa);

(b) the homicide was committed incident to one act, scheme~course of conduct~or criminal

episodeduring which the actor committed the crime of abuseor desecrationof a dead human

body asdefinedin Subsection76-9-704(2)(e);


(c) the homicide was committed for the purpose of avoiding or preventing an arrest of the

defendantor anotherby a peaceofficer acting undercolor of legal authority;

(d) the homicidewas committedby meansof the administrationof any lethal substanceor of any

substanceadministeredin a lethal amount,dosage,or quantity;

(e) the homicide was committed in an especially heinous, atrocious, cruel, or exceptionally

depravedmanner, any of which must be demonstratedby physical torture, serious physical

abuse,or seriousbodily injury of the victim beforedeath;

(t) the actor dismembers,mutilates,or disfiguresthe victim's body, whetherbeforeor after death,

in a mannerdemonstratingthe actor'sdepravityof mind; or

(g) the victim was youngerthan 14 yearsof age.

OR

With reckless indifference to human life, did causethe death of another incident to an act,

scheme,courseof conduct,or criminal episodeduring which the actor is a major participant in

the commissionor attemptedcommissionof child abuseasper Subsection76-5-109(2)(a).

CHILD ABUSE, (156) 76-5-109(2)(a)UCA, seconddegreefelony, as follows:

That between April 29, 2010 and May 8, 2010 at the place aforesaid the defendant did

intentionally Of knowingly inflict upon a child serious physical injury Of, having the care Of

custodyof such child, intentionally or knowingly causedor pennitted anotherto inflict serious

physicalinjury upon saidchild.

follows: That betweenMay 6, 2010 and May 11, 2010 at the placeaforesaidthe defendantdid,

with intent to hinder, delay, or preventthe investigation,apprehension,prosecution,conviction,

or punishmentof any personregardingconductthat constitutesa criminal offense:

(a) prevent,by deception,any personfrom perfonning any act that might aid in the discovery,

apprehension,prosecution,conviction,or punishmentof any person;

(b) alter, destroy,conceal,or removeany item or otherthing; or

(c) provide false infonnation regardinga suspect,a witness,the conductconstitutingan offense,

or any other materialaspectof the investigation.

COUNT 4

ABUSE OR DESECRAllON OF A HUMAN BODY, (603) 76-9-704 UCA,

third degreefelony, as follows: That betweenMay 6, 2010 and May 11, 2010 beginning in

Davis and continuing into WeberCounty. the defendantdid disturb. move. remove.conceal.or

destroy a dead human body or any part of it; or damageany part or portion of a deadhuman

body-

PROBABLE CAUSE STATEMENT: The undersignedprosecutoris a Deputy

Davis County Attorney and has received information from the investigating officer, Brooke

Plotnick of the Layton Police Department,and the information herein is based upon such

personalobservationsand investigationof saidofficer.

1 BetweenApril 29, 2010 and May 8, 2010 in Davis County,the defendant,as a

party, engagedin multiple acts inflicting seriousinjuries upon a four-rear-old male victim. The

severe abuse resulted in the child's death. The criminal acts included beatings, burning,

drugging, isolating, malnourishing,leaving the child alone and unattendedwhile suffering, and

refusingto seekvital life-sustainingmedicalattention.

2. After causing the child's death, the defendant,as a party, desecratedand

buried the child's body,

3. The defendant and a co-defendant then falsely reported to the police that the

child had wandered away from their apartment.
