ORDINANCE PROMOTING THE USE OF BICYCLE AS A FORM OF HEALTHFUL EXERCISE AND

AS AN ENVIRONMENTALLY SOUND MODE OF TRANSPORTATION IN THE MUNICIPLAITY OF


BACLAYON, BOHOL BY PROVIDING INSTITUTIONAL MECHANISMS, INCENTIVES, PEOPLES
PARTICIPATION, PENALTIES FOR VIOLATIONS THEREOF AND FOR OTHER PURPOSES.

BE IT ORDAINED by the Sangguniang Bayan of Baclayon, Bohol in session duly assembled that:
Section 1: TITLE - This Ordinance shall be known as the Bicycle Transportation Promotion
Ordinance of 2012.
Section 2: DECLARATION OF POLICIES
1. Consistent with the constitutional provisions and with that of RA 7160, otherwise known as the
Local Government Code of 1991, specifically Section 16 (General Welfare Clause), the Local
Government Unit of Baclayon, Bohol shall have the health of its constituents among the top most
priorities and concerns;
2. The LGU shall initiate creative and appropriate ways to halt further deterioration of environment
and air pollution which would cause harmful effects on health and productivity of its people; and is
detrimental to natural resources and precursor of climate change;
3. It shall promote the use of bicycles as a healthful exercise and as an environmentally sound mode
of transportation in the territorial jurisdiction of the town; and
4. At the same time, provide institutionalized mechanisms, peoples participation and incentive
schemes, and establish rules and regulations therefore for the safety and maintenance of order in
the municipality.
Section 3: SCOPE This Ordinance shall take effect within the territorial jurisdiction of Baclayon,
Bohol.
Section 4: INSTITUTIONAL MECHANISMS
A. Designated Bicycle Routes All municipal and barangay roads in the territorial jurisdiction of the
municipality of Baclayon, Bohol shall be designated as bicycle routes. All motorists shall give way to
the bicycle riding commuters at all times, except, when there would be established and designated
bike lanes which shall be for exclusive use of the bicycle riding commuters;

B. Bicycle Lanes Bicycle Lanes shall be designated in future opening and/or improvements of
municipal and barangay roads, which lanes shall be for the exclusive use of bicycle riding
commuters, after evaluation jointly conducted by the Municipal Planning and Development Office and
the Municipal Engineering Office;
C. Prohibition in the National Highway At the national highway, bicycle riding commuters shall only
be allowed to cross safely. They shall not be allowed to ply along the national highway within the
territorial jurisdiction of the municipality of Baclayon, Bohol, except in the following cases:
1. When a bike lane would be duly established along the national highway by the national, provincial
or municipal government; and
2. During special events or occasions duly approved by the municipal mayor.
D. Protection of Bicycle Riders Bicycle Riders must always use head protective gears and use at
night rear and tail lighting;
E. Registration of Bicycles For monitoring and regulation purposes, all bicycle owners/holders must
register their units in the LGU. The Office of the Mayor, in cooperation with the Treasurers Office and
the PNP, shall formulate scheme and control measures for the registration and inventory of bicycles
within the municipality;
F. Bicycle Parking Racks The Municipal Engineering Office shall construct Bicycle Parking Racks
and install it at all public schools and LGU owned facilities, while private establishments such as
business centers, malls, universities and schools among others, shall also be required to install such
within their premises;
G. Bicycles For Rent The LGU through the Municipal Tourism Office or through the cooperation of
NGOs and the private sector, shall procure bicycles to promote not only non-motorized transportation
but also for recreational and cultural activities, which it shall rent it out in strategic locations such as
the Baluarte area, among others;
H. Bike Patrol - The LGU shall set up Bike Patrols In Tandem within the municipality thru the PNP
and the barangay tanods using bicycles to regularly patrol alleys and narrow streets in the different
barangays;
I. Budget The Budget to support the implementation of this Ordinance shall be sourced out from
unprogrammed budget of the LGU or the Municipal Mayor may suspend non-priority items in the said
budget;
J. Impact Evaluation Every two (2) years after the approval of this Ordinance, the Office of the
Municipal Mayor, or its duly created committee for this purpose, shall conduct an impact evaluation

on the said Ordinance and submit a corresponding report and recommendations for executive and
legislative actions.
Section 5. INCENTIVES
A. FREE BICYCLES - The LGU shall, in cooperation with NGOs and POs, promote the use of
bicycles, especially among school children by procuring bicycle units to be distributed to deserving
recipients in accordance with the guidelines to be promulgated by the Office of the Mayor or any
committee or council that it would create for this purpose;
B. PROMOTION The LGU shall offer to sale bicycles to members of accredited cooperatives and
POs thorough its Board of Directors and to public elementary and high school students, who will not
qualify for free bicycles, through the Parents Teachers Associations of their respective schools at
cost price, the mechanics to be provided by the Office of the Municipal Mayor, or a Committee that
may be created for this purpose, subject to the approval of the Municipal Mayor and the usual
accounting and auditing rules and regulations;
Section 6. PEOPLES PARTICIPATION To succeed in promoting bicycle as an alternative mode of
transportation, peoples participation must be secured through information, education and
communication (IEC) activities. Additionally, the LGU shall support the setting up and strengthening
of biking/cycling clubs in the municipality.
Section 7. PENALTIES - The following penalties shall be imposed on the violations of the following,
to wit:
A. Obstruction of Bicycle Lanes and Designated Routes First Offense - A fine of Two Hundred Pesos (PhP100.00);
Second Offense - A fine of Three Hundred Pesos (PhP200.00);
Third Offense - A fine of Five Hundred Pesos (PhP300.00) and community service of two hundred
forty (240) hours under the supervision of the Office of the Municipal Engineer;
B. Non-use of Protective Gear First Offense - Warning with issuance of Citation Ticket;
Second Offense - A fine of One Hundred Fifty Pesos (P100.00);
Third Offense - A fine of Three Hundred Pesos (P200.00);
C. Non-use of Rear and/or Tail Lights at Night Time -

First Offense - A fine of Two Hundred Pesos (P100.00);


Second Offense - A fine of Three Hundred Fifty Pesos (P200.00);
Third Offense - A fine of Five Hundred Pesos (P300.00) and community service of two hundred forty
(240) hours under the supervision of the Office of the Municipal Engineer.
D. Failure of Private Establishments to Provide Bicycle Parking Racks :
First Offense - A fine of two thousand pesos (P1,000.00);
Second Offense - A three thousand pesos (P2,000.00);
Third and subsequent Offense A fine of five thousand pesos (P2,500.00).
Section 8: INTERFERENCE - Any person who shall interfere, hinder or oppose any official or
member of the PNP, barangay tanod or any other duly deputized person in the performance of their
duties in the implementation of this Ordinance, or shall tear down, mutilate, deface or alter any
billboard, tarpaulin, streamer, poster or similar notices affixed in any premises in the enforcement of
this Ordinance shall be penalized with fifteen (15) days imprisonment.
Section 9: CITIZENS SUITS - For the purpose of enforcing the provisions of this Ordinance, any
bona fide Baclayon resident may file an appropriate civil, criminal or administrative action in proper
courts/bodies against :
1. Any person who violates or fails to comply with any of the provisions of this Ordinance;
2. Any LGU Official, Employee or deputized person, who willfully or grossly neglects the performance
of an act specially enjoined as a duty by this Ordinance or abuses his/her authority in the
performance of his/her duties; or in any manner, improperly performs his/her duties under this
Ordinance. Provided, however, that no suit can be filed until after thirty day (30) notice has been
given to the said public officer and the alleged violator concerned and no appropriate action has
been taken thereon.
The Court shall exempt such action from the payment of filing fees and shall likewise, upon prima
facie showing of non-enforcement or violation complained of, exempt the plaintiff from the filing of an
injunction bond for the issuance of a preliminary injunction.
In the event the said bona fide Pasig City resident should prevail, the Court shall award reasonable
attorneys fees, moral damages and litigation costs as appropriate.
Section 10 : Miscellaneous Provisions

1. Separability Clause If, for any reason or reasons, any part or provision of this ordinance shall be
held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby
shall continue to be in full force and effect.
2. Repealing Clause all previous ordinances and executive orders inconsistent with this Ordinance
shall be deemed repealed or modified accordingly;
3. Effectivity Clause it shall be effective immediately after publication in a generally circulated
publication in a newspaper of general circulation, subject however to the review of the Sangguniang
Panlalawigan.
