Defendant, x----------------------------------------x MANIFESTATION AND MOTION TO RECONCIDER THE COURT ORDER ON JUDGMENT BASED ON THE PLAINTIFFS PLEADING ALONE Defendants, thru counsel, most respectfully begs for the indulgence of this honorable Court manifest and pray that the order (Annex A) issued by this Honorable Court be reconsidered based on the following grounds: 1. Defendants Counsel timely and personally filed on May 19, 2015 (Tuesday) with this Honorable Court a Motion to Reset (Annex B) the May 22, 2015 (Friday) Preliminary Conference (Annex C) as evidenced by the marking stamped Received May 19, 2015 by this Honorable Court. The reason for the prayer for the resetting was that both the Plaintiffs Counsel and the Defendants Counsel had a previous hearing earlier set at the same date and time at the Cabanatuan City MTCC Branch III (Annex D). As evidenced by said court order dated May 22, 2015, the names of both Counsels appeared. 2. It will be an injustice to the Defendants if their side of the issues will not be heard as they timely filed their answer (Annex E) simply because of an alleged technicality. Basing the decision, soly based on one side when the other side has timely filed an answered will wok injustice to the other side. Very respectfully manifested.
