Terms and Conditions


1. The immovable assets will be sold under e-Auction through the Banks
approved service provider M/s e-Procurement Technologies Ltd (ETL) under
the supervision of the Authorised Officer of the Bank.
2. e-Auction Tender Document containing online e-Auction bid form,
declaration, general terms and conditions of online auction sale are available
in ETLs website https://sbi.abcprocure.com
3. Intending
bidders
are
advised
to
go
through
the

https://sbi.abcprocure.com for detailed terms and conditions of the auction
sale before submitting their bids and participating in the e-auction.

6. Bids in the prescribed formats given in the Tender Document shall be
submitted online through the portal of https://sbi.abcprocure.com. Bids
submitted otherwise shall not be eligible for consideration. Bid should be
along with scanned copies of Photo ID, preferably PAN Card and address
proof documents, mentioning UTR number/supportive evidence for
submitting EMD amount. In case of joint bidders, a scanned copy of the
authorization letter signed by all the bidders authorizing actual bidder (one
among them who is holding a valid Digital Signature Certificate) to submit
and participate in the bid on their behalf should be attached to the bid form.
Similarly, in case the bidder is a company, a scanned copy of the resolution
passed by the Board of Directors authorizing the actual bidder, who is holding
a valid Digital Signature Certificate, to submit and participate in the bid on
its behalf should be attached.
7. The EMD and other deposits shall be remitted through EFT / NEFT / RTGS
Transfer to the bank account as specified above.
8. Bid form without EMD or with below EMD amount shall be rejected
summarily.
9. The Bid increment / multiplier shall be at Rs.50,000/-.
10. Online auction sale will start automatically on and at the time as
mentioned above. Auction / bidding time will initially be for a period of one
hour with auto time extension of five minutes each till the sale is concluded.
11. Auction / bidding will be only online bidding through the portal provided
by ETL
12. Demo e-Auction process will be conducted by ETL for familiarization and
allocation of user name/password to eligible prospective bidders for access to
the e-Auction at the specified date and time.
13. In case of Technical defects/ holiday declared or any other reason, if the
website is not available on the last day of submission of bid or on the day of
auction, the respective events shall be postponed to the next working day /
website available day.
14. The property shall be sold to the highest bidder. The purchaser shall
deposit 25% of the sale price (including EMD) immediately on the day of sale
being confirmed in his/her favour. On receipt of said payment and verification
of KYC documents with originals (Photo ID and address proof documents),
the Authorised Officer shall issue letter of sale confirmation. The balance
amount shall be paid on or before the fifteenth day of confirmation of sale of
immovable assets or such extended period as may be agreed upon in writing
between the parties. If 25% of the sale price is not paid for any reason, EMD
will be forfeited. Likewise, if the balance 75% amount is not paid for any
reason within 15 days or such extended period as stated above, 25% of
amount already deposited by him/her will be forfeited and Bank will be at
liberty to re-auction the immovable assets.
15. The assets are being sold on As is where is and As is what is
condition. The bidders should make their own enquiries regarding any
statutory liabilities/ Taxes/ dues etc. in respect of the above mentioned
assets by themselves before participating in the auction.
16. The EMD of the unsuccessful bidders will be refunded on the closure of
the e-auction sale and intimated via their email Id. Bidders should provide
details of their Bank accounts such as Name of the Bank and Branch, IFSC
Code number, Account Number etc. for the purpose in the bid form.
17. On confirmation of sale by the Bank and if the terms of payment have
been complied with, the Authorised Officer exercising the power of sale shall
issue Sale Certificate for immovable assets in favour of the purchaser in the

form given in Appendix V of the Security Interest (Enforcement) Rules,


2002.
18. The sale certificate will be issued in the name of the purchaser(s) /
Applicant(s) only and will not be issued in any other name(s).
19. The purchaser shall bear the dues to Excise Dept, VAT, charges/fee
payable for conveyance such as registration fee, stamp duty, statutory dues
etc. as applicable as per law.
20. The Bank is not liable to pay any interest/ refund of EMD in case of any
delay in issue of confirmation of sale/ Sale Certificate by virtue of any Court
Order received after e-auction is held.
21. The Authorised Officer reserves the right to reject any or all the
offers/tenders without assigning any reason or shall have the right to
postpone or cancel e-auction. The Authorised Officer also reserves the right
to modify any terms and conditions of the advertisement/sale at his
discretion without prior notice.
22. The prospective bidders can inspect the property on the date and time
mentioned as above.
23. The Authorised Officer or the Bank shall not be responsible for any
charge, lien, encumbrances, or any other dues to the Government or any one
else in respect of immovable assets e-auctioned.
24.
This is also a notice to the borrower/guarantors of the said loan
about holding of e-auction sale on the above mentioned date if the dues are
not repaid in full before the date of e-auction.
