(No. 5) Order 2015
IN exercise of the powers conferred upon it by section 44 of the Commerce Commission
Decree 2010, the Fiji Commerce Commission, with the approval of the Minister, makes
the following Order
Short title and commencement
1.(1) This Order may be cited as the Commerce (Price Control) (Petroleum Prices)
(No. 5) Order 2015.
(2) This Order shall come into force on 1 January 2016.
Maximum prices
2.(1) Subject to subparagraph (2), the prices set out in Schedule 1 to Schedule 6
shall be the maximum retail or wholesale prices, as the case may be, at which the goods
mentioned therein may be sold in the areas so specified in the schedules.
(2) Where the maximum price of an item listed in the schedules is required to be
rounded up to the nearest whole number by reason of the cessation of the 1 cent and 2
cents denominations, the consequential increase or decrease in the price of that item does
not constitute a contravention of this Order.
Schedule 1
3. The prices set out in Schedule 1 are the maximum retail or wholesale prices, as the
case may be, at which the goods specified in it may be sold in any area on the island of Viti
Levu located within 3 kilometres from any public road.
Schedule 2
Levu located beyond 3 kilometres from any public road.
Schedule 3
case may be, at which the goods specified in it may be sold in any area on the islands of
Vanua Levu, Taveuni and Ovalau located within 3 kilometres from any public road.
Schedule 4
6. The prices set out in Schedule 4 are the maximum retail or wholesale prices, as
the case may be, at which the goods specified in it may be sold in any area on the islands
of Vanua Levu, Taveuni and Ovalau located beyond 3 kilometres from any public road.

case may be, at which the goods specified in it may be sold in any area within the Republic
of Fiji other than the islands mentioned in schedules 1, 2, 3, 4 and 6.
Schedule 6
the case may be, at which the goods specified in it may be sold in any area on the island
of Rotuma.
Packaging
9. Except where otherwise stated, prices referred to in paragraph 2 includes the cost
of packaging.
Prices to be marked or displayed
10.(1) Any person having for sale by retail any of the goods specified in any schedule
to this Order must cause the same to be legibly and conspicuously marked with the maximum
retail price for the information of the public.
(2) If goods specified in any of the schedules are not displayed for sale in an individual
packet or container, a retailer complies with this Order if he or she displays in a prominent
position a legible and conspicuous notice clearly indicating those goods to which the notice
relates and the maximum retail price of the goods.
Calculation of price
11. If the maximum price ascertained in any of the schedules includes a fraction of a
cent, an amount of or in excess of one half () cent is to be reckoned as one cent, and an
amount of less than one half () cent is to be ignored.
Value Added Tax (VAT)
12. Wholesalers must state the Value Added Tax (VAT) separately in the invoice
provided at the time of sale.
Revocation
13. The Commerce (Price Control) (Petroleum Prices) (No. 4) Order 2015 is hereby
revoked.

Ex-factory) Order 2015
IN exercise of the powers conferred upon me and on the recommendation of the Fiji
Commerce Commission in accordance with section 39 of the Commerce Commission
Decree 2010, I hereby declare the following
1.(1) This Order may be cited as the Commerce (Price Control) (Wheat Products
Ex-factory) Order 2015.
Maximum prices schedules
2.(1) Subject to subparagraph (2) below, the prices set out in Part 1 of the Schedule
are the maximum prices at which the goods mentioned in that Part may be sold ex-factory.
(2) Where the maximum price of an item listed in Part 1 of the Schedule is required
to be rounded up to the nearest whole number by reason of the cessation of the 1 cent and
2 cents denominations, the consequential increase in the price of that does not constitute
a contravention of this Order.
(3) Ex-factory wholesale prices shall apply from the factory to the areas designated
in Part 2 of the Schedule.
(4) Part 3 of the Schedule applies in respect of areas not designated in Part 2.
3. Manufacturers must state the Value Added Tax (VAT) separately in the invoice

PART 2
Ex-factory wholesale and delivery price shall apply to the following areas
(a) the cities of Suva and Lautoka;
(b) the towns of Ba, Lami, Nadi, Sigatoka, Tavua, Nausori and Nasinu;
(c) an area from the prescribed boundary of the city of Suva at Nabua on the
Kings Road to the prescribed boundary of the town of Nausori at Davuilevu
on the Kings Road to a width of 3 kilometres on either side from the centre
point of that road; and
(d) the areas on the island of Viti Levu within a radius of 5 kilometres from any
of the post offices situated at Korovou, Navua or Rakiraki.
PART 3
(a) a reasonable delivery cost may be charged to any area on the island of Viti
Levu not designated in Part 2;
(b) a delivery cost must relate only to the cost of delivery beyond the areas
designated in Part 2; and
(c) a freight subsidy of $20 per tonne for any place outside Viti Levu shall be
paid by the Manufacturer of goods specified in Part 1.

Wholesale and Retail) Order 2015
Short title commencement
1.(1) This Order may be cited as the Commerce (Price Control) (Wheat Products
Wholesale and Retail) Order 2015.
Maximum prices
2.(1) Subject to subparagraph (2) below, the prices set out in Schedule 1 to Schedule
8 shall be the maximum retail or wholesale price, as the case may be, at which the goods

rounded up to the nearest whole number by reason of the cessation of the 1 cent and 2 cents
denominations, the consequential increase in the price of that item does not constitute a
contravention of this Order.
Schedule 1
case may be, at which the goods specified in it may be sold within the cities of Suva and
Lautoka, the towns of Ba, Lami, Nadi, Sigatoka, Tavua, Nausori and Nasinu and the areas

the case may be, at which the goods specified in it may be sold in all areas on the island of
Taveuni not mentioned in Schedule 4.
Schedule 6
Vanua Levu and Ovalau located within 1 kilometre from any public road except the towns
of Labasa, Savusavu and Levuka.
Schedule 7
case may be, at which the goods specified in it may be sold in any area on the island of
Vanua Levu and Ovalau not mentioned in Schedule 4 or Schedule 6.
Schedule 8
the case may be, at which the goods specified in it may be sold in any areas in Fiji except
the islands of Ovalau, Taveuni, Vanua Levu and Viti Levu.

Packaging
11. Except where otherwise stated, prices referred to in paragraph 2 include the cost
of packaging.
Weights and measurements
12. The weights or measurements stated in all columns headed Quantity in any
schedule to this Order are the net weights or measurements of the goods referred to and do
not include the weight or measurement of any packaging.
13. Any person having for sale by retail any of the goods specified in any schedule to
this Order must cause the same to be legibly and conspicuously marked with the maximum

1.(1) This Order may be cited as the Commerce (Price Control) (Breakfast and
Cabin Crackers Prices) (No. 2) Order 2015.
Maximum Prices
2.(1) Subject to subparagraph (2) below, the prices set out in Schedule 1 to Schedule
9 herein shall be the maximum retail or wholesale price, as the case may be, at which the
goods mentioned therein may be sold in the areas so specified in the schedules.

Commerce (Price Control) (Foodstuffs) Order 2015

1.(1) This Order may be cited as the Commerce (Price Control) (Foodstuffs) Order
2015.
Maximum Prices
2.(1) Subject to subparagraph (2) below, the prices set out in schedules 1 to 8 herein
shall be the maximum retail or wholesale price, as the case may be, at which the goods
rounded up to the nearest whole number the nearest whole number at the point of sale by
reason of the cessation of the 1 cent and 2 cents denominations. The consequential increase
in the price of that item does not constitute a contravention of the Order.
Maximum prices schedules
Schedule 1
3.(1) The prices set out in Schedule 1 are the maximum retail or wholesale prices,
as the case may be, at which the goods specified in it may be sold within the cities of Suva
and Lautoka, the towns of Ba, Lami, Nadi, Sigatoka, Tavua, Nausori and Nasinu and the
areas on the island of Viti Levu within a radius of 5 kilometres from any of the post offices
situated at Korovou, Navua and Rakiraki.

Commerce (Control of Prices for Reinforcement

Steel Rods) Order 2015
IN exercise of powers conferred upon me and on the recommendation of the Fiji Commerce
Commission in accordance with section 39 of the Commerce Commission Decree 2010, I
hereby make this Order
1.(1) This Order may be cited as the Commerce (Control of Prices for Reinforcement
Steel Rods) Order 2015.
(2) This Order shall be deemed to have come into force on 13 November 2015.
Interpretation
2. In this Order, unless the context otherwise requires, market means the sale and
purchase of reinforcement steel rods through wholesale in Fiji.
Control of prices for steel rods
3. For the purpose of section 39 of the Commerce Commission Decree 2010, the
prices for reinforcement steel rods (in all qualities and classes) that are sold in the market
are controlled including, but not limited to the following grades
(a) grade 300 deformed;
(b) grade 300 plain;
(c) grade 430 deformed;
(d) grade 430 plain;
(e) grade 500 deformed; and
(f)
grade 500 plain.

Expiration of Order
4. This Order expires three years from the date of commencement unless it is extended
or earlier revoked.

Commerce (Control of Prices for Interconnection

Services Rates) Order 2015
IN exercise of powers conferred upon me and on the recommendation of the Fiji Commerce
Commission in accordance with section 39 of the Commerce Commission Decree 2010, I
hereby make this Order
1.(1) This Order may be cited as the Commerce (Control of Prices of Interconnection
Services Rates) Order 2015.
(2) This Order shall be deemed to have come into force on 21 November 2015.
Interpretation
2. In this Order, unless the context otherwise requires

Interconnection means a specific type of access to facilities involving the
physical or logical linking of two networks for communication between
consumers of one with the other or for transit of communications from the
consumers of one network across the network of the other, irrespective of
the type of signals or information conveyed; and
Interconnection Services means any wholesale services provided or offered
by any person in relation to Interconnection and this includes the off-net
services.
Price Control
3. For the purposes of section 39 of the Commerce Commission Decree 2010, the
prices or rates for the supply of Interconnection Services in all quantities and qualities,
grades or classes are controlled.
Expiration of Order
4. This Order expires three years from the date of commencement unless it is extended
or earlier revoked.

Commerce (Rent Increase Restriction on

Residential and Ground Rent) Order 2015
IN exercise of the powers conferred upon it by section 45 of the Commerce Commission
Decree 2010, the Fiji Commerce Commission with the approval of the Minister, hereby
makes the following Order
1.(1) This Order may be cited as Commerce (Rent Increase Restriction on Residential
and Ground Rent) Order 2015.
Rent increase on residential premises and ground rent
2. Between the period of 1 January 2016 and 31 December 2016, a person must not
charge a rent in respect of the letting or continued letting of any premises under residential
tenancy including ground rentals to which the Commerce Commission Decree 2010 applies,
exceeds the rental applicable to those premises as at 31 December 2015.
Records
3. Any person or class of persons (including the State) shall keep to the satisfaction
of the Commission such letting agreements and receipts as are customary and proper in
respect of the letting or continued letting of premises under any residential tenancy, including
ground rent to which the Commerce Commission Decree 2010 applies.
