EXTRA-JUDICIAL SETTLEMENT OF THE ESTATE OF A

DECEASED PERSON

KNOW ALL MEN BY THESE PRESENTS:

This extra-judicial settlement of the estate of Juan de la Cruz
Sr. made and executed this 21st of August 2010 by and between the
following persons:

1 JUAN DE LA CRUZ, Filipino, of legal age, single and a resident

of Dipolog City;
2 MAIRA DE LA CRUZ, Filipino, of legal age, single and a
resident of Dipolog;
3 PEDRO DE LA CRUZ, Filipino, of legal age, single and a
resident of Dipolog City
WITNESSETH:

That the above-named persons are the only surviving heirs of

the late Juan de la Cruz sr. who died in Dipolog City on January 24, 2015
without any will and leaving no indebtedness;

That at the time of his death, said Juan de la Cruz Sr. left the
following described properties:
PARCEL 1

A parcel of land otherwise known as Lot No. 437,

covered by Original Certificate of Title No. O-43647 of the Registry of
Deeds of Dipolog City, the exact description of which is indicated on the
face of the aforesaid title.

PARCEL II

A parcel of land otherwise known as Lot No. 542 covered

by Original Certificate of Title No. O-43645 of the Registry of Deeds of
Dipolog City, the exact description of which is indicated on the face of the
aforesaid title.

PARCEL III

A parcel of land otherwise known as Lot No 643 covered

by Original Certificate of Title No. O-43650 if the Registry of Deeds of
Dipolog City , the exact description of which is indicated on the face of the
aforesaid title.

That the above-named persons hereby decreed and adjudicate

among themselves the above-described properties in the following manner:

1 To Juan de la Cruz, Jr.: PARCEL I;

2 To Maira de la Cruz: PARCEL 2;

3 To Pedro de la Cruz: PARCEL 3;

That this extra-judicial settlement does not include any personal

property.

That in compliance with the provision of the Rules of Court, the

above-named persons agree to have this document published in the
Mindanao Observer for three (3) consecutive weeks.

de la Cruz exhibiting his Community Tax Certificate No. 5867910 issued in
Dipolog City, known to me to be the same persons who executed the
foregoing Deed of Extra-judicial Settlement and they acknowledged that the
same are their free and voluntary act and deed.

AFFIDAVIT OF SELF-ADJUDICATION

I, MARIA B. DELA CRUZ, of legal age, Filipino, single and a

resident of 6789 Washington Street, Pio del Pilar, Makati City, after having
been duly sworn to in accordance with law, depose and state:

1. That I am the only daughter of JUAN B. DELA CRUZ who died

without any last will and testament on July 20, 2013 in Makati City as
evidenced by his Death Certificate issued by the City of Makati hereto
attached as Annex A and made an integral part of this Affidavit;

2. That at the time his death, my father had no debts, liabilities or

obligations to any persons, agency or institution;

3. That the only property he left is a parcel of land consisting of 60

square meters located in J.B. Roxas Street, Makati City more particularly
described in TCT No. 112233 hereto attached as Annex B and made an
integral part of this Affidavit;
4. That pursuant to Rule 74, Sec. 1 of the Rules of Court, I hereby
adjudicate unto myself the above-described real estate by means of this
Affidavit and hereby files the same with the Register of Deed of Makati City
with the request that the said adjudication be made effective without judicial
proceeding as prescribed by the aforementioned provision of the Rules of
Court.
