Civil Code Volume II (Property)

Comments and Cases on Property

Justice Edgardo L. Paras

Hector S. De Leon
Hector M. De Leon, Jr.

About the Author:

Associate Justice, Supreme Court of the
Philippines (1986-1992)
Recipient of the Centenary Book Award for his
book Civil Code of the Philippines, Volumes I-IV

Salient Features:
The authors have tried to discuss all aspects
of every legal provision. Where appropriate,
examples and illustrative cases are given,
but always after the reader is provided with
sufficient background of the concepts, rules,
and/or principles involved. To acquaint the
student with the method of judicial reasoning,
selected decisions of the Supreme Court, with
the facts reduced to the bare essentials, are
presented in nearly complete form especially
where the Court makes an analysis of related
cases and compares them with the case under
consideration. The result is an extensive volume
which the authors hope will be found adequate
to serve the purpose for which it was prepared.

Gil Marvel P. Tabucanon

Salient Features:
Equips students with outright skills in
questioning, analysis and the ability to look at
the facts and law from different viewpoints.

This work recognizes what has been implicit in

the Philippine legal system

That our hybrid legal system adheres to both the

traditions of the civil law and the common law
systems; and although our system recognizes the
primacy of statutory provisions, it also places
practically the same value to policy considerations
as they evolve in actual settlement of disputes in our
society as expressed in decisions of the Supreme
Court. Necessarily, the complexion of various legal
principles and doctrines continue to evolve, if not
altered or discarded, as policy considerations are
made to adjust to evolving contemporary settings.

Hector S. De Leon
Hector M. De Leon, Jr.

Salient Features:
The author attempts to present the basic laws,
jurisprudence and principles on three major
topics of Taxation I, namely, municipal taxes,
realty taxes and tariff and customs laws.
Chapters 1 to 7 cover the laws on municipal
taxes, Chapters 8 to 12 on realty taxes, and
Chapters 13 to 20 on tariff and customs laws.

thinks are important for that Chapter.

Salient Features:
The authors adopt the same approach employed
in their other works. Concepts, principles,

explained, followed by examples whenever
appropriate, and then, by selected Supreme
Court decisions that illustrate their application
in actual situations. In addition, numerous brief
rulings are given for the convenience of the
researcher who desires to refer to other cases
pertinent to certain points of law that concern
him. Analogous or related cases are cited in
the proper places with the same end in view.
Furthermore, the topics are so organized and
presented, generally with headings and subheadings, that any interested reader by reference
to them and the Table of Contents may see the
full extent of what is included in the book and
quickly locate it

Professor of Law for 35 years, Bar Reviewer for

and Lecturer for 40 years,

Salient Features:
This book attempts to enrich the compilation by
Adding some explanatory comments and court
rulings. This is particularly true of three laws,
namely those on thirteenth month pay, sexual
harassment, and social security. These three
special laws have become favorite subjects of bar
exam questions.
This compilation aims also to systematically
group the special laws. The laws are arranged
according to the grouping and sequence of
subjects in the Labor Code. Thus, special laws
about pre-employment, which is Book One of the
Code, are clustered ahead of TESDA law which
relates to Book Two of the Code, and so on up to
Labor Relations of Book Five.

Environmental Ethics and Law

Business Law and Ethics

Atty. Emmanuel Q. Fernando

Atty. Emmanuel Q. Fernando

Salient Features:
This is a course on environmental law and
ethics. As such, various cases in Philippine
environmental law will be examined and
explored in light of the ethical theories taken
up. It is not sufficient that the law regarding the
environment be known. The law provides only
one set of standards with which to guide and
monitor ecological and environmental activities
of man. Moreover, environmental activities may
involve unethical practices which may be legally
permissible. A more stringent standard must be
set which concern morally permissible behavior
regarding the environment.
The law by means of which business practice
is to be examined is Philippine environmental
law. Statutes as well as actual cases will be
studied when relevant to assess the morality of
environmental activity.

Bensaudi I. Arabani, Sr.

Edgardo m. Villareal II
Salient Features:
In this revised edition, he has included relevant
decisions on the Supreme Court up to 2010
and some board regulations of the Dangerous
Drugs Board. This book is not just for lawyers
and law students, but more importantly for law
enforcement offi cers, particularly agents and
operatives of the Philippine Drug Enforcement
Agency (PDEA), the lead agency in the national
anti-drug campaign. He reminds drug law
enforcers to follow rules and procedures
governing the custody, control and handling of
seized drugs, stressing on the Supreme Courts
pronouncement that in not a few instances,
cases involving prosecution for illegal drugs
were dismissed and the accused acquitted due to
technical grounds.

Salient Features:
This book compiles the laws, rules and
regulations that apply to Filipinos overseas
seafarers, and the judicial interpretations of
them, with the POEA Standard Employment
Contract at its center
It endeavors to impart them in simple and
understandable manner and terms, by way
of short questions and answers, followed
by Supreme Court rulings. The judicial
interpretations are grouped into how they stand
on certain issues, as the stand can vary at times,
depending on the particular facts and laws
involved.
