SUPPORTING AFFIDAVIT FOR REQUEST TO ISSUE ARREST w ARR~I'IT

INSTRUCTIONS: A person seeking an arrest warrant shall appear personally before any justice. or justice of the peace and shall give an affidavit in substantially the form hereinafter prescribed. The affidavit shall contain facts. information and circumstance upon which such person relies to establish probable cause for the issuance of the warrant and the affidavit may be supplemented by oral statements under oath for the establishment of probable cause. I, Captain Francis T. Moran, being duly sworn, depose and say:

1. I am a police officer in the Town of Hanover, New Hampshire. I herewith make application for the issuance of an Arrest Warrant against the defendant:

CHARLES CLARK WARTHEN, D.O.B.: 06/2211987 of2304 MONUMENT AVE, RICHMOND VA 23220

2. I have information that a crime (or offense) has been committed by the defendant as follows:

On May 13th at approximately 2:20am Officer Matthew Ufford of the Hanover PD was dispatched to meet with Dartmouth Safety and Security (DSS) Sgt. Wayne Agan at 38 College Street, Sigma Alpha Epsilon fraternity, (SAE). Officer Ufford learned that DSS had been called to the fraternity by Philip Aubart. Mr. Aubart is member of the Sigma Alpha Epsilon fraternity. He reported that he had witnessed several people in one of the common rooms on the first floor of his fraternity using cocaine. DSS Sgt. Agan said he was invited into the house to view the area, and at that point saw cocaine residue on one of the composites that was laying on the pool table.

Officer Ufford met with Mr. Aubart. He pointed to the pool table, where Officer Ufford saw two fraternity photo composites laying. Mr. Aubart advised he had witnessed four (4) people standing over the composites, apparently about to snort cocaine. Two of the suspects there were males, two were females. Officer Ufford viewed the photo composites and saw that on one of them was a small amount of a white powdery residue. Officer Ufford noted several smudges on the composite, as ifit had been wiped or smeared. Officer Ufford took photographs of the composite and the suspected cocaine and then collected the white powder as evidence.

The two male suspects in this matter were identified as Brian Shea and Andrew Lohse. One of the females was identified as Bernadette Reyes. Reportedly, Miss Reyes had told Philip Aubart that she had not used the cocaine but had simply been present in the room. The fourth party, the other female was not known to Mr. Aubart. It is suspected that this woman is Sarah Koo, is the girlfriend of Andrew Lohse.

Mr. Aubart went on to say that this is not the first time this sort of thing has occurred in the house. He said that Mr. Shea and Mr. Lohse are both suspected cocaine users, and although they are house members, SAE does not condone that behavior. He said that in a similar incident last term, he discovered a composite with smudges and

a small amount of white powder residue. He reacted by sending an email to all Sigma Alpha Epsilon members

advising them not to engage in that sort of activity in the common rooms, and that failure to comply with this request would result in a report to DSS.

Later, Mr. Aubart provided a written statement to support his complaint.

"Around 2:15am this morning (my phone has 2:16am as the the time I called S&S) May, 13th, I was in the Foyer when I saw Bernadette Reyes trying to open the Pool Room door. Figuring she had left her jacket inside I let her in the door and was holding the door waiting for her to come back from retrieving her coat. However, I saw her walk over to the far end of the pool table in the room where Brian Shea, Andrew Lohse and a college aged Asian femaile with dark brown/black hair were standing over a composite laid face up on the corner of the pool table. It was then that I noticed the lines of what I suspected to be cocaine on the glass of the composite. All four people at that time were standing very close t%r over the composite with cocaine. Their legs were close enough to be touching the edge of the composite and they were all leaning towards it. At that point they told me to close the door, and as I had realized that they were doing cocaine I did so, told the people . sitting in the foyer that people were doing coke in the pool room and that I was calling S&S. I immediately stepped outside and called S&S. Once I was told officers were on their

I way, I stepped back inside, and waited for them. Bernedette Reyes was already out of the

pool room when I came back inside and quickly told me that she had not done any coke. Soon thereafter, the other three individuals in the pool room came out and Brian Shea got in my face and said "Really?! You called S&S! Are you serious?!" Then S&S arrived and I identified myself as the person who called and took them into the pool room. At this point no composites were on the pool table, so I took the two leaning against the wall that I suspected had been used and laid them on the pool table and pointed to the smear marks on them. S&S looked closer with their flashlights, found residue and immediately contacted Hanover Police. While waiting for Hanover Police, I was escorted by an S&S officer to my room to secure it and my posessions. When Hanover Police arrived I was told I could let them in or wait for a warrant, so after attempting to contact the President of the house, I allowed Hanover Police and officer Matt Ufford and his partner to enter. The police were present for the rest of the evening.n

In furtherance of this investigation officers met with Brian Shea and Andrew Lohse and conducted separate interviews. Both males denied involvement in the possession/use of cocaine as witnessed by fellow fraternity member Philip Aubart. During Mr. Lohse' interview at the offices ofDSS, Sarah Koo made several telephone calls in an attempt to reach him. Reportedly, Miss Koo wanted to know what Mr. Lohse was talking about with the authorities, and insisted that she had to speak with him immediately. Miss Koo was offered emergency assistance by DSS but she declined. As the evening went on, the police were unable to meet with Bernadette Reyes or Sarah Koo.

On the afternoon of May 13th Detective Eric Bates and I went to the Sigma Alpha Epsilon fraternity (SAE) to execute a search warrant in the room of Brian Shea. There we met with Brian Shea and his roommate Charles "Clark" Warthen. I asked Brian Shea to meet with me in private to discuss this matter. He agreed to this and brought me down the hall to the SAE "library". I asked him to take me through the events of last evening leading up to his involvement with the Hanover Police this morning. Mr. Shea stated that he attended the SAE house meeting from 22:00 - 23:20. He admitted that he drank a bottle of wine and 5-10 cups of beer during this meeting. He advised that he walked over to Tabard alone at approximately 23:25. He explained that he was invited there by a female friend named Bernadette Reyes. He advised that he did not drink anything at Tabard

r-during the show and returned to SAE with Miss Reyes "possibly a little before 02:00AM." He reported that he -----drank an estimated 5-10 shots of Jim Beam-in his bedroom and throughout the SAE house upon his return to his fraternity. He acknowledged that this caused his memory to be hazy.

Mr. Shea reported that they entered SAE via the front door and spent time "poking their heads into rooms" at SAE. He explained that they drank shots of Jim Beam in his room and in other rooms throughout SAE. He confirmed that they went "in and out" of the "Pool Room" in SAE several times. He advised that he was in the presence of Bernadette Reyes, Andrew Lohse and probably his girlfriend Sarah Koo, as well as Alex Villar in the "Pool Room".

He reported that he was at SAE for about an hour before DSS was called by Mr. Aubart. Mr. Shea denied recalling any encounter with Phil Aubart prior to this call. He stated that "someone" had told him that Phil had call "S&S" on him. Mr. Shea stated that he was in the basement when this other person made him aware of this. He advised that he did not recall who told him this information. I advised Mr. Shea that DSS was called because cocaine was being used in the "Pool Room". Mr. Shea advised that he had no memory of anything involving cocaine last night. He stated that he only recalled walking around with a bottle of Jim Beam.

Mr. Shea admitted that he has used cocaine in the past, but denied that he used it recently. According to Mr.

. Shea, there was a time when cocaine was a problem at SAE, but that things changed after some SAE members from the classes of 2008 and 2009 graduated. Mr. Shea stated that he "could imagine a situation could occur, when drinking, being offered (cocaine) while drunk." He reported that under such a situation he may likely use cocaine again. However he denied being the source of any cocaine used at SAE this morning, or recalling using it with others in the "Pool Room" as reported.

I advised Mr. Shea that this matter was still under investigation and that it was too soon to determine an outcome. I cautioned him about threatening, harassing or otherwise causing issues for Phi Aubart. I explained that Mr. Aubart is a witness and any inappropriate action on his part, (Shea's), could result in serious criminal charges for Witness Tampering. He confirmed that he understood and would not be communicating with Mr. Aubart in any manner. I told Mr. Shea that there were several other parties that were witnesses and/or suspects in this matter. I cautioned him about colluding or otherwise engaging in a conspiracy to prevent the police from gathering evidence and/or determining the truth in this matter. He confirmed that he understood.

I asked Mr. Shea about his relationship with Bernadette Reyes. He stated that she is a girl that wants to "hook up" with him. He denied that he has any interest in her and attributed the attraction to being primarily one way. I told him that I had some further work to do with Bernadette Reyes and that I did not want him to communicate with her until it was completed. He agreed not to be in contact with Miss Reyes.

On May 14th, 2010 Detective Eric Bates went to the Hitchcock Dormitory to locate Bernadette Reyes in hopes of conducting an interview. Miss Reyes was located in her room, (#206). Detective Bates asked Miss Reyes to detail her activities last night leading up to DSS being called to SAE. Miss Reyes advised that her primary reason for being at SAE was to hang out with Brian Shea. She said that she had a couple of "drinks" before going to a show at Tabard, where she is a house member. Miss Reyes told us that she met up with Brian Shea at Tabard sometime around midnight. Reyes could not say how much alcohol Mr. Shea had consumed prior to showing up at Tabard, but she did take notice that he was "looser than usual", which gave her the impression that· he had been drinking.

Miss Reyes reported that following the show at Tabard, she and Mr. Shea went to the SAE fraternity. She advised that it was her impression that they-were doing this so that they could continue drinking. Once back at i SAE, Miss Reyes stated that she drank two shots of whiskey. She advised that Mr. Shea had drunk more than she had and was carrying a whiskey bottle around the SAE house with him.

Miss Reyes reported that she and Mr. Shea eventually made their way in to the SAE pool room. According to Miss Reyes, she excused herself from the room, possibly to use the bathroom, or to socialize. She estimated that she absent from the room for roughly 15-30 minutes. Reportedly, when she returned to the pool room. she discovered that she could not get in. She advised that it was around this time that she saw Phil Aubart and spoke with him briefly before he let her back into the pool room.

According to Reyes, she had no prior knowledge of what was happening in the pool room while she was gone. Reyes claimed that she had expected to be returning to people drinking in the pool room, but found herself walking blindly in to a drug scene. Miss Reyes confirmed that Brian Shea was definitely in the pool room when she returned, and claimed she did not know who the other male and female were that were also present. Miss Reyes described the female as being "Asian", but did not know her name. Miss Reyes said that the last name of "Lohse" sounded familiar to her, and that it may have been the other male's name that was in the room.

Miss Reyes advised that she recognized that there was cocaine present in the pool room, but denied that she participated using it. Reyes also claimed that she has "never" used cocaine in her life.

When asked about the use of the cocaine by the three people in the room, (Brian Shea, Andrew Lohse and Sarah Koo), Miss Reyes responded, "I think I saw one of them using." When asked for additional information about this, Reyes claimed that she could not say for sure which of the two people that were unknown to her was actually using the cocaine, only that she believes someone was snorting the cocaine while she was in the room. She advised that she did not pay attention to what was happening with the cocaine and that Brian Shea did not use any of the cocaine in her presence. She stated that she was only in the pool room for about five minutes. Miss Reyes advised that she did not know who supplied the cocaine, and did not recall any conversation in the pool room that would suggest who the cocaine belonged to.

On May 15th Officer Rolf Schemmel dispatched to the Office of Dartmouth Safety and Security to meet DSS Sgt. Greg Timmons regarding a student who felt he was being threatened by his fraternity house brothers. There Officer Schemmel met with Phil Aubart. Mr. Aubart informed Officer Schemmel that this all started after he

reported some illegal drug activity which had occurred at his fraternity (SAE) on Thursday, May 13th.

Mr. Aubart detailed the circumstances of concern to Officer Schemmel. Later, Mr. Aubart provided email that contained the following:

«Since Wednessday night, after I reported the cocaine incident at SAE fraternity a number of things have occured.

Thursday, during the daytime Andrew Lohse spit on me as he walked past me, sitting on the front stoop.

Thursday during the daytime Clark Warthen sent an e-mail to a group of mutual friends saying "Grievance to Phil For maliciously calling S&S and H-Po on his own fraternity brothers last night. Watch you backs, guys, who knows what he'll pull next. "

Thursday during the daytime Clark Warthen confronted me in the Hop asking "Now do you understand why we all truly hate you so much?"

Thursday night Clark Warthen confronted me in the bathroom and asked "Are you going to

! destroy any more brother's lives tonight?" And said "I hope you enjoy not coming back to reunions" I replied, "I'll come back for reunions." He queried "Why? So you you can sit in a corner while we all talk about how much we hated you in college?" Shortly thereafter I·left the house for the night

The next day, the President of the house (Brandon Floch) reported to me that several guys had attempted to break into my room with the intent of "pissing on all my stuff."He also said that he had stopped Max Copello 'e9 from continuing to hit the table I had built for the fraternity with a fire poker. He relayed the general feelings of the house as "a number of guys want to kill you, most want you out of the house (as in depledged)" I don't see the statment about killing as a threat, but rather an expression of feeling. He also informed me that there had been a number of blitzes sent out to the entire house (minus me) talking badly about me.

Friday, while talking to the President, Andrew Lohse dumped a beer on the door of my room.

This morning around 11:3e am I received a call from the President saying "I just wanted to let you know so you don't freak out when you get to the house. Guys broke your table last night." He said it was broken into many pieces, completely destroyed.

When I returned to the house I looked for the pieces in the living room, where the table is normally kept, but it wasn't there. I texted the President asking where the pieces were and he said by the grill.

At 4pm today I left the house witht the intent of walking down to the grill area and taking a picture of the pieces and taking one with me. However, there were 3 or 4 guys standing down there two of whome were Greg Hart 'le and Alex Vespoli 'e9. I am unsure of who the third person was and whether there was a fourth person because I was keeping my head down and just moving through at that point.

On my way past, Alex Vespoli, holding a sledgehammer standing over a piece of the table asked "How's it going, Phil?" I kept walking, but truned around as I neared Novack, noticed that they were all leaving and went back for a piece of the table that I showed to Officer Schemmel. When I went back for the piece I noticed that the majority of the table had been burnt on the grill.

At this point I was in contact with 5&5 and Hanover Police."

Mr. Aubart provided copies of additional e-mails from the account of Charles "Clark" Warthen that he had received from one of his fraternity brothers. One stated: "I cannot believe you were stupid enough to do that last night". Another stated: "For maliciously calling S&S and H-Po on his own fraternity brothers last night .' Watch you backs, guys, who knows what he'll pull next." (See the attached emails.)

On Sunday, April 16th Mr. Aubart sent Officer Schemmel another email stating:

"Sometime between 4pm when I left the house yesterday and 9pm tonight someone peed on the door to myoId room and it went into the room and soiled a pair of socks that were lying on the floor.

I w~s in my room at 9pm tonight to grab some clothes for tomorrow.»

I Due to this apparent harassment/witness tampering, the Dartmouth College Dean's office has arranged for

i substitute housing for Phil Aubart. He is no longer residing at his fraternity house and has instead been placed : in a dormitory.

On May 18th I met with Charles "Clark" Warthen at the Hopkins Center. In the course of this discussion I asked Mr. Warthen about communication with his roommate Brian Shea regarding his alleged cocaine use on

May 13th at the SAE fraternity as well as the apparent witness tampering/retaliation against Phil Aubart. I asked Mr. Warthen about any emails that he may have sent out attacking or otherwise targeting Phil Aubart -

! following his complaint to Dartmouth Safety & Security on May 13th, 2010, (regarding the alleged cocaine use by Brian Shea and others at their fraternity). Mr. Warthen admitted that he had sent out an email that expressed his frustration about Mr. Aubart's actions but stated that he did not threaten him and wouldn't harass him. He

reported that his last email regarding Mr. Aubart was sent out on Thursday, May 13th, 2010.

I asked Mr. Warthen about his involvement in the damage to any of Phil Aubart's property following the May, 13th report to Dartmouth Safety & Security. Mr. Warthen stated that he had no role in any damages to Mr. Aubart's property. He advised that he was not present at the SAE fraternity when others damaged a table built by Mr. Aubart. He went on to say that the table had been donated to the SAE house by Mr. Aubart and was kept in the living room of the house. Mr. Warthen claimed that he did not see the table destroyed and did not know who did it.

On May j gth I met with Attorney George Ostler and his client Greg Hart. In the course of this interview Mr. Hart reported that he was solicited by Clark Warthen on Friday, May 14th to destroy Mr. Aubart's table at the SAE house as an act of retaliation. Mr. Hart confirmed that he still had the email atissue.Mr. Hart advised that Mr. Warthen's criminal solicitation was also sent to two other SAE members, Tanner Mathison and Alexander Villar. He reported that he declined to participate in the retaliation against Phil Aubart, and that he sent Mr. Warthen a text message advising him of this position. It was agreed that Attorney Ostler would forward Mr. Warthen's email to me later that day.

That afternoon, I received an email from Attorney Ostler that contained the following email from Mr. Warthen to Mr. Hart:

can you seriuosly smash-bros the shit out of phil's table? It would really mean a lot to Brian,' and would be a great signal to Phil that it's not just a small contingent of people in the house that despise him, it's truly a widespread sentiment that he's the most abhorrent thing to ever happen to this house and this campus.

At this time I am seeking an arrest warrant-for Charles Clark Warthen for the crime of Tampering with Witnesses and Informants, RSA 641:5 and Criminal Liability for the Conduct of Another, RSA 626:8.

Tampering with Witnesses. RSA 641 :5:

"A person is guilty of a class B felony if:

II. He commits any unlawful act in retaliation for anything done by another is his capacity as witness or informant."

Criminal Liability for Conduct of Another. RSA 626:8:

"III. A person is an accomplice of another person in the commission of an offenses if:

(a) With the purpose of promoting or facilitating the commission of the offense, he solicits such other person in committing it... "

I am alledging that Mr. Warthen committed criminal act of Tampering with Witness and Criminal Liability for the Conduction of Another on May 14th, 2010 when he sent an email to SAE members Gregory Hart, Tanner Mathison and Alexander Villar advocating that they vandalize a table built by Phil Aubart and owned in part by Phil Aubart as a member of the Sigma Alpha Epsilon fraternity, an act of retaliation for him cooperating with

. authorities in an investigatin of cocaine use at the Sigma Alpha Epsilon fraternity on May 13th, 2010.

3. Based upon the foregoing information (and upon my personal knowledge) there is probable cause to believe that the defendant did commit a crime (or offense) as above stated.

Wherefore, I request that the court issue an arrest warrant and order a duly authorized ~/ to take the
