NAMING OF SPECIFIC AREAS OF SCHOOL FACILITIES

Procedures

The Superintendent’s office is the coordinating office for all naming


nominations. This regulation provides the procedure for action on the
nomination to name an area of a school building or facility. Gifts of
tangible items which may or may not have named plaques attached,
such as plants, benches, and equipment are handled under Policy 4.4,
Private Funding.

A. Nominations for Honorary Naming

Groups or individuals who wish to initiate the naming of a specific school


area or facility in honor of an individual must submit a written
nomination to the School Board Chairman and Superintendent. The
nomination should identify the area or facility to be named and provide
information regarding the connection between the individual and the
area or facility proposed to be named.

Written nominations must be submitted to the Superintendent. The


Superintendent will consult with the School Board Chair to determine
whether the School Board should consider the nomination directly or
after committee consideration. The School Board Chair and
Superintendent will consult with the principal(s) of the school(s) where
the proposed naming would occur.

1. Direct Consideration

In order to provide a deliberate process, the nomination will be


presented to the Board in the form of a resolution. The resolution will
be placed on the agenda of a regular Board meeting and a public
hearing will be held. Representatives of the group or individual who
made the nomination will have the opportunity to make a
presentation in support of the nomination. The School Board will

take a vote on the resolution at a subsequent meeting. The


Superintendent will make recommendation on the resolution to
include the name, the area or facility and the duration of the
naming.

2. Committee Consideration

If the School Board Chairman and Superintendent determine that


a committee should be convened, the matter will remain
confidential until the committee is convened. The School Board
Chairman and the Superintendent will determine the membership of
the committee, and suggest a deadline for the completion of the
committee review.

The nomination will be presented to the Board in the form of a


resolution, with the supporting information from the written
nomination and the committee’s recommendation. The
recommendation will include the name, the area/facility, and the
duration of the naming.

B. Nominations for Funded Naming

Groups or individuals may initiate a request to name a specific


area/facility of a school for individual or business sponsors who are
contributing substantially for capital improvements or to the benefit of a
school or the school division.

If preliminary discussions occur on a nomination, they should be held


with the Superintendent and the principal of the school. Such
preliminary discussions, if they occur, must be treated confidentially. If
discussions proceed beyond a preliminary stage, the Superintendent will
notify the Chairman of the School Board. School staff members who are
apprised of the potential for a donation must notify the
Superintendent’s office.

In all decisions on naming, the School Board will act in the best interest
of the school division, making decisions that are consistent with the
mission statement and values of the division.

1. Capital Improvements Exchanged for Naming Rights

Funded naming may be appropriate when private contributions


for such capital improvements are proposed to be made in exchange
for the right to name the capital improvement which is being
funded.

If the funding is provided by a donor directly to the schools, a


memorandum of understanding (MOU) or “gift agreement”) between
the donor and the School Board must be approved by the School
Board.

If the funding is raised from one to more donors through the


efforts and coordination of a school affiliated organization (SAO),
the MOU/gift agreement is between the SAO and the donor(s). School
Board prior approval for such fund raising efforts by an SAO is
required. Each proposed MOU/gift agreement must be submitted for
approval by the School Board. Final approval for proposed names
and gift agreements rests with the School Board.

It is the School Board’s intent to permit and encourage all SAO’s


to engage in fund- raising activities, and there is no intent to give
exclusive rights to naming particular areas only to certain SAO’s.
SAO’s will coordinate their efforts and work cooperatively.
Approval of one SAO’s fund raising proposal does not preclude
another SAO from making similar proposals.

In every case, the memorandum of understanding (MOU) must


include relevant matters such as the area of the school to be named,
the proposed name, the amount of funding provided, the payment
schedule, the duration of the naming, and a provision for exigent

circumstances requiring the changing or termination of an agreement.


Each MOU/gift agreement must provide that the School Board retains
full control and maintenance of the facility and all programs which
occur within the facility.

The MOU/gift agreement will provide that the School Board


reserves the right to terminate or amend a gift agreement under
exigent circumstances including corporate donor wrong-doing or
criminal conviction, changes to corporate existence in the regular
course of business, or other circumstances caused by the donor which
in the judgment of the School Board will harm the reputation or
mission of the Falls Church City Public Schools.

The Superintendent will make a recommendation to the School


Board on the proposed MOU and the naming of the capital
improvement when School Board approval of the MOU is required. If
the School Board action is the approval of the SAO fund-raising
proposal or the approval of proposed names, the Superintendent will
make a recommendation on those matters. The Superintendent will
consider the matters identified in policy in making the
recommendation.

2. Contributions Exchanged for Naming Rights for Already-


Built Facilities

a. Contributions Made Directly to the Schools

Funded naming may be appropriate when private contributions


are given in exchange for the opportunity to name an existing
school area or facility. In this case, a memorandum of understanding
(MOU) should be provided along with the nomination to include
relevant matters such as the area or facility of the school, the
proposed name, the amount of funding provided, the payment
schedule, the duration of the naming, and a provision for exigent
circumstances requiring the changing or termination of an agreement.

Each MOU/gift agreement must provide that the School Board retains
full control and maintenance of the area or facility and all
programs which occur within the facility. The parties to the MOU are the
donor and the School Board if the contribution is being made
directly to the schools.

The Superintendent will make a recommendation for action to the


School Board on the naming of the area or facility, considering the
matters identified in the policy in making the recommendation.

b. Endowment Contributions to School Affiliated


Organizations and Targeted Gifts

Funded naming of an existing school area or facility may also be


appropriate when substantial funding has been provided into the
endowment of a school affiliated organization for long-term capital
preservation and periodic income distribution for the benefit of the
Falls Church City Public Schools or when a school affiliated
organization has raised substantial targeted gifts. In these cases,
the memorandum of understanding (MOU)/ gift agreement) is
between the donor and the school affiliated organization.

If the proposed naming is a result of an approved fund-raising


campaign, the presumption is that the naming will be approved, but
final approval rests with the School Board.

The Superintendent will make a recommendation for action to the


School Board. The Superintendent’s recommendation will include
confirmation that the naming is consistent with the approved fund-
raising campaign. The Superintendent will ensure that the
MOU/gift agreement between the SAO and the donor contains all
necessary information and conditions, including the area or
facility of the school, the proposed name, the amount of funding
provided, the payment schedule, the duration of the naming, and a
provision for exigent circumstances requiring the changing or

termination of the agreement. Each MOU/gift agreement must


provide that the School Board retains full control and maintenance of
the area or facility and all programs which occur within the facility.

If the proposed naming is not a result of an approved fund-raising


campaign, the Superintendent’s recommendation will make a full
analysis of the proposal, including the matters identified in policy,
the area of the school, the proposed name, the duration of the
naming, an analysis of the short and long term benefit to the Falls
Church City Schools from the naming, and other relevant information.
Final approval of the naming rests with the School Board.

3. Memorial Gifts for Scholarships and Programs

Funded naming may also be appropriate when the funding is in


the form of a memorial on behalf of, in memory of, or in honor of an
individual. The Superintendent will make a recommendation for
action to the School Board on the acceptance of the memorial gift
which includes naming of a scholarship or program. The threshold
amounts in Policy 4.4, Private Funding, will determine whether the
naming is acted upon by the principal, the Superintendent or the
School Board. The Superintendent’s recommendation will consider
the factors identified in policy and identify the proposed name, the
amount of funding provided, the payment schedule, the duration of
the naming, distribution of the scholarship or program, as well as any
other matters the Superintendent deems relevant.
