REQUEST FOR EMPANELMENT (RfE) NOTICE


1.0 Power Grid Corporation of India Limited (A Government of India
Enterprise) incorporated under the Companies Act, 1956, having its
Registered Office at B-9, Qutab Institutional Area, Katwaria Sarai, New
Delhi 110 016 (hereinafter referred to as POWERGRID) have been
entrusted to empanel the manufacturers for procurement of various
Equipment/Items for different States/Discoms under Deen Dayal
Upadhyay Gram Jyoti Yojana (DDUGJY) and Integrated Power
Development Scheme (IPDS) on behalf of Ministry of Power, Government
of India.
1.1 Under the above said schemes, the procurement has been envisaged to
be carried out in three tranches with total quantity splitted in the ratio of
4:3:3 through a process of Request for Empanelment followed by
Request for Proposal which inter-alia includes e-Reverse Auction. The
Notice Inviting Request for Empanelment under the schemes were
earlier invited vide notification dated 12.10.2015 and thereafter Request
for Proposal under tranche-1 were also invited from the empaneled firms
vide invitation dated 28.01.2016. This invitation is intended for
empanelment of manufacturers as per the provisions of this RfE
documents for remaining tranches.
2.0 Accordingly, POWERGRID hereby solicits Request for Empanelment (RfE)
from Applicants (Manufacturers) from within India, fulfilling the
Qualifying Requirements (QR) and meeting the minimum criteria
stipulated for empanelment as brought-out in Section 4 of the RfE
Document for the following equipments:

3.0 The RfE, alternatively referred to as Applications, to be submitted by


the Applicants shall include qualification data in compliance to the
stipulated
QR
and
other
information/details/data/documentary
evidences as sought through this RfE Document. The Applicants must
meet the QR, which is a pass/fail criteria to be considered for
empanelment. In addition to the QR, the empanelment also includes
criteria for evaluating the Applications (referred to as Marking Criteria)
on different attributes on a total score of 100 out of which an Applicant
must score minimum 60 marks to be considered for empanelment. The
Applicants who meet the stipulated Qualification Requirements and
obtain the minimum score against the Marking Criteria shall be
empaneled for different equipments. Thereafter, the Request for
Proposal (RfP) which inter-alia includes e-Reverse Auction shall be
invited from the empaneled parties to finalize one or several Rate
Contract(s) for procurement of the equipment/items, against which
various States/Discoms may place orders for procurement of the

equipment/items as per their requirements from time to time. However,


prior to empanelment, POWERGRID reserves the right to carry out the
assessment of Applicants as per the provisions of Section-4 of the RfE
document.
3.1 POWERGRID, also, reserves the right to invite RfE from time to time and
to undertake RfP in one or more than one tranches, as per requirement
in due course of time.
4.0 Against this notice, the process of submission of Applications shall be
conducted on electronic platform with portal address https://www.tcil-indiaelectronictender.com and the Applicants shall not be permitted to submit
their Applications by any other mode. The Intergrity Pact, which shall be
applicable for empanelement, bidding as well as contract execution,
shall however, be submitted in Hard copy in Original.
5.0 The RfE Document has also been uploaded on POWERGRIDs website
www.powergridindia.com for the purpose of reference. Interested
Applicants can download the RfE Documents and commence
preparation to gain time. However, in case of any contradiction between
the RfE Documents at POWERGRIDs website and those at the portal
https://www.tcil-india-electronictender.com, the later shall prevail.
6.0 Interested Applicants have to necessarily register themselves on the
portal
https://www.tcil-india-electronictender.com
through
M/s.
Telecommunications Consultants India Limited, New Delhi to participate
in the empanelment process under this RfE notice. It shall be the sole
responsibility of the interested Applicants to get themselves registered
at the aforesaid portal for which they are required to contact M/s.

7.0 For proper uploading of the Applications on the portal namely
https://www.tcil-india-electronictender.com. (hereinafter referred to as
the portal), it shall be the sole responsibility of the Applicants to
apprise themselves adequately regarding all the relevant procedures

and provisions as detailed at the portal as well as by contacting from


M/s Telecommunications Consultants India Limited, New Delhi directly,
as and when required, for which contact details are mentioned above.
POWERGRID in no case shall be responsible for any issues related to
timely or properly uploading/submission of the Applications in
accordance with the relevant provisions of the RfE Documents.
8.0 Interested Applicants are requested to download the document and
submit their RfE as per the following schedule:

10.0 Notwithstanding anything stated herein above, POWERGRID reserves


the right to annul the aforesaid RfE process any time and may, at its

SECTION 1: INTRODUCTION
1.1 Background
1.1.1 Government of India has launched two ambitious schemes, namely
Deen Dayal Upadhayay Gram Jyoti Yogna (DDUGJY) and Integrated
Power Development Scheme (IPDS) to augment and strengthen subtransmission and distribution infrastructure of the country. The primary
objective of DDUGJY is strengthening and augmentation of infrastructure
in rural areas including metering of distribution transformers, feeders
and consumers; separation of agriculture and non-agriculture feeders
facilitating judicious rostering of supply to agricultural and nonagricultural consumers in rural areas; and rural electrification. The
components of IPDS are strengthening of sub-transmission and
distribution networks in urban areas; metering of distribution
transformers, feeders and consumers in urban areas; and IT enablement
of distribution sector and strengthening of distribution network. The
combined outlay of these two schemes is over Rs.72,000/- crores. In
order to implement projects of such magnitude, large quantity of
equipment and materials for power distribution system shall be
required. Therefore, a need has been felt to streamline procurement of
key equipment and materials to ensure quality and timely supply. For
this purpose, Power Grid Corporation of India Limited (A Government of
India Enterprise) incorporated under the Companies Act, 1956, having
its Registered Office at B-9, Qutab Institutional Area, Katwaria Sarai,
New Delhi 110 016 (hereinafter referred to as POWERGRID) have
been entrusted to empanel the manufacturers for procurement of
various equipment/items for different States/Discoms under aforesaid
schemes.
1.2 Purpose of this RfE
1.2.1 POWERGRID, therefore, intends to empanel the manufacturers for
procurement of various equipment/items under DDUGJY/IPDS Schemes.
The objective of this empanelment is to obtain most competitive prices
from the empaneled parties to enable POWERGRID to finalize one or
several Rate Contract(s) with them for supply of various
equipments/items.
Against
the
Rate
Contract(s),
different
States/DISCOMs may choose to place orders for procurement based on
their requirement of equipments/items from time to time, as per their
choice.
1.2.1.1
Under the above said schemes, the procurement has been
envisaged to be carried out in three tranches with total quantity splitted
in the ratio of 4:3:3 through a process of Request for Empanelment
followed by Request for Proposal which inter-alia includes e-Reverse

1.2.2 The Applications to this RfE shall, inter-alia, include qualification data
to the stipulated QR and evaluation of Applications against Marking
criteria related to Applicants Organizational Structure, Product
Manufacturing System, Testing Set-up, Quality System and other aspects
as contained in Section 4: Evaluation Criteria for the following
equipment/items:

Power Transformer;
Distribution Transformer;
Conductor;
Aerial Bunched Cables.

Application shall be submitted as per Section 2: Instructions to


Applicants. For ascertaining compliance to the stipulated Qualification
requirements of the Applicants as well as evaluation of Applications
against Marking Criteria mentioned at above para, as per Section - 4,
the Applicants are required to furnish all the requisite information/
details/data/ documentary evidences in support of the stipulated
requirements.
1.2.3 Notwithstanding above, POWERGRID reserves the right to carry out the
assessment of the capacity and capability of the Applicants prior to
empanelment. This assessment shall inter-alia include (i) document
verification; (ii) Applicants work/manufacturing facilities visit; (iii)
Manufacturing Capacity, details of works executed, works in hand,
anticipated in future & the balance capacity available for the present
scope of work; (iv) details of plant & machinery, manufacturing and
testing facilities, manpower and financial resources; (v) details of quality
systems in place; (vi) past experience and performance; (vii) customer
feedback; (viii) bankers feedback etc.
1.2.4 The Applicants for each equipment/item Category meeting the
stipulated Qualification Requirements and scoring the minimum marks
i.e. 60 out of 100 against the Marking Criteria shall be considered for
empanelment subject to the condition that they are found suitable on
assessment, if carried out as per para 1.2.3 above.
1.2.4.1
The empanelled Parties shall be intimated the outcome of the
empanelmenet through

which they have been empanelled, their Manufacturing Capacity and


Average Annual Turnover for best 3 years out of last 5 Financial Years.
Thereafter they shall be invited to submit response to Request for
Proposal (RfP) which shall be followed by e-Reverse Auction as detailed
in Section 5 of this RfE Document.
1.2.4.2
The eligibility to bid against the Request for Proposal (RfP) for
subject procurement shall be governed as per the Details of
Empanelment at per para 1.2.4.1 above and as per the terms and
conditions of the RfP documents and shall be further subject to
following:
a) Number of Provisionally allocated units in all the three tranches x
rating of equipment being supplied 3 x per annum manufacturing
capacity in MVA/km of the Bidder.
b) Number of provisionally allocated units in all the three tranches x
rate per unit (excluding differential prices) quoted by bidder
3.33 x Average Annual Turnover of the bidder.
1.2.5 The Applicants who have submitted their Applications against the
Notice Inviting RfE under the said schemes which appeared in National
and Regional Newspapers on 12/10/2015, are not required to submit
their Applications afresh. These firms shall be eligible to participate in
the RfP process as per the Details of Empanelment communicated to
them against the said RfE dated 12.10.2015 and shall be subject to
para
1.2.4.2
above.
These
firms,
if
however,
are interested in getting the capacity, rating, turnover etc. of the
Details of Empanelment reviewed, they are also required to submit
online Applications as per the provisions of this RfE documents.

SECTION 2: INSTRUCTIONS TO APPLICANTS


1.

There is no Application fee for this RfE process. Applicants shall submit
the Application to this RfE in the prescribed Forms and Formats as
contained in Section - 6.

1.1

The RfE Documents are available at POWERGRIDs website


http://www.powergridindia.com as well as on portal https://www.tcilindia-electronictender.com. Interested Applicants can download the
RfE Documents and commence preparation to gain time. However, in
case of any contradiction between the RfE Documents at POWERGRIDs
website and those at the portal, the later shall prevail.

1.2

The Applications shall be submitted on electronic platform with portal


address https://www.tcil-india-electronictender.com, details of which are
provided in Annexure-I and the Applicants shall not be permitted to
submit the same by any other mode. In such case, even if the
Applicant has submitted the Hard copy part of the document in original
i.e. Integrity Pact within the stipulated deadline, its Application shall be
considered as Non-responsive and shall not be considered further.

The amendment/clarification, if any, to the RfE documents will be


notified
only
through
the
portal
https://www.tcil-indiaelectronictender.com.

1.4

Applicants are requested to provide complete and precise information


in the space provided along with supporting documentary evidences,
as applicable. The Applicants should attach separate sheet(s) in case
the space provided is not sufficient. POWERGRID will consider the
Applications
solely
on
the
basis
of
information/details/data/documentary evidences etc. provided by the
Applicants in the Applications only without seeking further clarifications
from the Applicants in normal circumstances. Accordingly, the
Applicants are required to furnish complete and precise information
along with supporting documentary evidences as applicable in the
Applications as the same shall be treated as final and no further
clarifications may be asked by POWERGRID from the Applicants for
qualification or evaluation purposes.
Incomplete, partially complete, not clearly filled forms giving incorrect
information are liable to be rejected without any consideration.
Where the answer is a statement of fact it must be accurate and
supported by documentary evidence wherever required. It is the
Applicants responsibility to respond with such clarity that will ensure
POWERGRID not to misinterpret any of the Applications.

1.5

The Application to be submitted alongwith relevant supporting


documentary evidences etc. must be signed and stamped with
company seal by a person duly authorized to sign on behalf of the
Applicant. This authorization shall consist of a written power of
attorney accompanying the Application. The name and position held
by each person signing the authorization must be typed or printed
below the signature in the power of attorney document.

1.6

Separate Applications shall be submitted for each Equipment/Item


alongwith necessary documents and details, if the Applications by one
Applicant are made for more than one Equipment/Item.

The RfE Document is meant for the exclusive purpose of facilitating


POWERGRID for empanelment of vendors for different equipments
under DDUGJY/IPDS Schemes and shall not be transferred to any other
party or reproduced or used otherwise for any purpose other than for
which they are specifically provided.
Further, all the costs associated with preparation of Applications,
submission of the same to POWERGRID etc. shall be borne by the
Applicants only.

In addition to meeting the Qualifying Requirements, Applicants meeting


the following mandatory criteria need only to apply.
a)

The Applicant must be registered under Indian Company Act 1956


or 2013, as the case may be/ Indian Partnership Act 1932/The
Indian Factories Act 1948/Any relevant Indian Laws, whichever is
applicable.

b)

The Applicant must have Sales Tax Registration No. / Service Tax
Registration No. / Permanent Account No. (PAN)/ PF code no.,
whichever applicable.

6.

Others

6.1 Submission of Application does not automatically guarantee inclusion


of name in the list of empaneled Parties.
6.2 POWERGRID reserves the right to call for additional information and/or
check, verify all the information furnished in the Application.
POWERGRID also reserves the right to inspect all premises / facilities to
confirm the authenticity of information furnished / capabilities
mentioned in the Application.
6.3 POWERGRID reserves the right to reject Applications on the basis of
unsatisfactory performance of ongoing job or any similar job in the last
seven (7) years or for furnishing false information/declaration in the
Application.
6.4 POWERGRID reserves the right to reject any or all the Applications
without assigning any reasons whatsoever.
6.5 POWERGRIDs decision shall be final on all matters.
6.6 Applicants to note that Applications with conditions unacceptable to
POWERGRID shall be rejected.

6.7 Fraud and Corruption


It is the POWERGRIDs policy that requires the Applicants to observe
the highest standard of ethics during this RfE process. In pursuance of
this policy, POWERGRID:
(a)

defines, for the purpose of this provision, the terms set


forth below as follows:

(i)

corrupt practice is the offering, giving, receiving or


soliciting, directly or indirectly, of anything of value to
influence improperly the actions of another party;

(ii)

fraudulent practice is any act or omission, including a


misrepresentation, that knowingly or recklessly misleads or
attempts to mislead, a party to obtain a financial or other
benefit or to avoid an obligation;

(iii)

collusive practice is an arrangement between two or


more parties designed to achieve an improper purpose,
including to influence improperly the actions of another
party;

(iv)

coercive practice is impairing or harming, or threatening


to impair or harm, directly or indirectly, any party or the
property of the party to influence improperly the actions of
a party;

(v)

obstructive practice is
(aa) deliberately destroying, falsifying, altering or
concealing of evidence material to the investigation
or making false statements to investigators in order
to materially impede a POWERGRIDs investigation
into allegations of a corrupt, fraudulent, coercive or
collusive practice; and/or threatening, harassing or
intimidating any party to prevent it from disclosing
its knowledge of matters relevant to the investigation
or from pursuing the investigation;
or
(bb) acts intended to materially impede the exercise of
the POWERGRIDs inspection and audit rights.

(b)

will reject an Application if it determines that the Applicant


has, directly or through an agent, engaged in corrupt,
fraudulent, collusive, coercive or obstructive practices in
competing for the Qualification in question;

(c)

will sanction a firm or individual, including declaring


ineligible, either indefinitely or for a stated period of time,
if it at any time of this process determines that the firm
has, directly or through an agent, engaged in corrupt,
fraudulent, collusive, coercive or obstructive practices in
competing for, or in executing, in this Qualification process;
and

(d)

will have the right to require that the provision be included


in RfE Documents and in contracts, requiring Applicants,
suppliers, and contractors and their sub-contractors to
permit the POWERGRID to inspect their accounts and
records and other documents relating to Application
submission and contract performance and to have them
audited by auditors appointed by the POWERGRID.

6.8 The Applicant is also required to complete the accompanying Integrity


Pact (as per the prescribed format given in Section 6 to this RfE
Document), which shall be applicable for this empanelment process,
bidding process as well as for contract execution, duly signed on each
page by the authorised signatory(ies) signing the Application and shall
be submitted in Hard copy in Original.
The Bidder shall submit the Integrity Pact on a non judicial stamp paper
of Rs. 100/-.
The required Integrity Pact is automatically generated as Attachment 2Integrity Pact of the RfE documents. Applicants shall take print out in
two copies, shall be duly filled and shall be submitted in a separate
envelope, duly superscripted with Integrity Pact and shall be
submitted as discussed above.

SECTION 3: QUALIFYING REQUIREMENTS FOR VARIOUS


EQUIPMENTS
1.0

For the purpose of establishing a list of qualified Parties for different


Equipment/Items, the Applicants shall meet the following Qualifying
Requirements:

2.0

Following factors shall be applicable for determining compliance to the


Qualifying Requirements of an Applicant:

a)

The specified requirement of at least 2 years operation shall mean


continuous operation for any duration of at least 2 years during the
specified period of seven years.

b)

In case of Transformers, an applicant shall be considered qualified upto


& including such capacity (in MVA/KVA) of transformers in each voltage
class, for which the Applicant meets the specified Technical Experience
Requirement.

c)

All transformers having 0.433kV as LV shall be treated as Distribution


Transformers and not as Power Transformers.

d)

In case of Conductor, an applicant shall be considered qualified upto &


including such strand of Conductor in each type (viz. ACSR and/or
AAAC), for which the Applicant meets the specified Technical
Experience Requirement.

e)

The total number of strands in case of ACSR Conductor shall also


include number of steel strands.

f)

In case of AB Cable, an applicant shall be considered qualified upto &


including such size of AB Cable in each voltage class (viz. HT and/or
LT), for which the Applicant meets the specified Technical Experience
Requirement.

g)

The size of phase wire shall be taken as size of AB Cable for the
purpose of QR.

h)

SECTION 4: EVALUATION CRITERIA [EC]


1.0

POWERGRID will ascertain to its satisfaction whether Applicant is


qualified, as per the Qualification Requirement specified in Section 3 to satisfactorily perform the contract. POWERGRID shall be the
sole judge in this regard and POWERGRIDs interpretation of the
Qualification Requirement shall be final and binding.

1.1

The determination will take into account the Applicants financial,


technical capabilities including production capabilities, in particular
the Applicants contract work in hand, future commitments &
current litigation and past performance during execution of
contracts, if any. It will be based upon an examination of the
documentary evidence of the Applicants qualifications submitted
by the Applicant, as well as such other information as POWERGRID
deems necessary and appropriate. This shall, however, be subject to
assessment that may be carried out, if required, by POWERGRID as
per the provisions of Section - 3. POWERGRID shall be the sole judge
in this regard.

1.2

The determination will also take into account evaluation of


Applications against Marking Criteria related to Applicants
Organizational Structure, Product Manufacturing System, Testing
Set-up, Quality System and other aspects as detailed out in the
Attachment-5 in Section-6 of the RfE document. This evaluation
shall be carried out on a maximum score of 100 out of which an
Applicant must score 60 or more to be considered for empanelment.
For this purpose, the Applicants are required to furnish supporting
documents alongwith their Applications based on which marks shall
be assigned against each of the attributes subject to the maximum
score specified for such attributes. POWERGRID shall be the sole
judge in this regard and POWERGRIDs evaluation of the marking
shall be final and binding.

2.0

POWERGRID may waive any minor informality, nonconformity or


irregularity in any Application that does not constitute a material
deviation, affecting the capability of the Applicant to perform the
Contract.

3.0

An affirmative determination will be a prerequisite for POWERGRID


to consider the Applicant short-listed for invitation of offer against
Request for Proposal process as mentioned in Section 5. A
negative determination will result in rejection of the Applicants
Application.

4.0

Subject to Clause 3 of the Evaluation Criteria, Section-3,


POWERGRID will empanel the Applicants for different category of
Equipment(s) in which they are interested and for which the
Applicant meets the appropriate requirements.

5.0

POWERGRID reserves the right to empanel the Applicants for


different category of equipments based on financial position of the
Applicants e.g. Turnover and other aspects as deemed appropriate.

SECTION - 5: PROCESS OF REQUEST FOR PROPOSAL (RfP)


1.

As mentioned in Section 3, Applicants meeting the QRs as well as the


Marking Criteria for respective Equipment(s), shall be considered shortlisted for invitation of offers from them against Request for Proposal
process which inter-alia includes e-Reverse Auction for such
Equipment(s).

2.

POWERGRID will invite offers from short-listed Parties for Equipment(s)


mentioned in this RfE against Request for Proposal (RfP) process
followed by e-Reverse Auction for which RfP Documents will be issued
to short-listed Parties.

3.

The RfP Document shall contain Price Schedules for the scope of work
indicated in Section-7 as well as Commercial Terms and Conditions for
execution of the contracts for respective Equipment(s) under different
States/DISCOMs. The Bill of Quantity (BoQ) indicated in the this RfE is
tentative one.
