ThebillrequiresthattheDepartmentofCommerceandBoardofPharmacytake
allactionsnecessarytoensurethattheProgramisfullyoperationalnotlaterthantwo
yearsafterthebill'seffectivedate
Qualifyingmedicalconditions
AIDS,amyotrophiclateralsclerosis,Alzheimer'sdisease,cancer,chronictraumatic
encephalopathy,Crohn'sdisease,epilepsyoranotherseizuredisorder,fibromyalgia,
glaucoma,hepatitisC,inflammatoryboweldisease,multiplesclerosis,painthatiseither
chronicandsevereorintractable,Parkinson'sdisease,positivestatusforHIV,
posttraumaticstressdisorder,sicklecellanemia,spinalcorddiseaseorinjury,
Tourette'ssyndrome,traumaticbraininjury,andulcerativecolitis.
ThebillalsoauthorizesanindividualtopetitiontheMedicalBoardtoaddadiseaseor
conditiontothelistofqualifyingmedicalconditions.
Permissibleformsandmethodsofmedicalmarijuana
Thebillpermitsonlythefollowingformsofmedicalmarijuana:oils,tinctures,
plantmaterial,edibles,patches,andanyotherformapprovedbytheBoardof
Pharmacy.Thebillprohibitsanyformormethodconsideredattractivetochildren,as
specifiedinrulesadoptedbytheBoard.
Underthebill,anindividualmaypetitiontheBoardofPharmacytoapproveanadditional
formormethodofusingmedicalmarijuana.
Tetrahydrocannabinolcontent
Thebillspecifiesthatplantmaterialhaveatetrahydrocannabinol(THC)contentofnot
morethan35%,whileextractshaveaTHCcontentofnotmorethan70%.
Smokingprohibition
Thebillexpresslyprohibitstheuseofmedicalmarijuanabysmokingorcombustion,but
allowsforvaporization.However,thebilldoesnotstatehowthiswouldbeenforced.

PatientRegistration/Applyingformedicalmarijuana
Anapplicationmustinclude:
Thatabonafidephysicianpatientrelationshipexistsbetweenthephysicianand
patient
Thatthepatienthasbeendiagnosedwithaqualifyingmedicalcondition
Thatthephysicianorphysician'sdelegatehasrequestedfromtheBoardof
Pharmacy'sOhioAutomatedRxReportingSystem(OARRS)areportof
informationrelatedtothepatientthatcoversatleastthe12monthsimmediately
precedingthedateofthereport
Thatthephysicianhasinformedthepatientoftherisksandbenefitsofmedical
marijuanaasitpertainstothepatient'squalifyingmedicalconditionandmedical
history
Thatthephysicianhasinformedthepatientthatitisthephysician'sopinionthat
thebenefitsofmedicalmarijuanaoutweighitsrisks.
Authoritytouse,possess,oradministermedicalmarijuana
Thebillauthorizesaregisteredpatienttouseorpossessmedicalmarijuanaorpossess
anyparaphernaliaoraccessoriesspecifiedinBoardofPharmacyrules.
Underthebill,theamountofmedicalmarijuanapossessedbyaregisteredpatientor
caregivermustnotexceeda90daysupply
Thebillprovidesthataregisteredpatientorcaregiverisnotsubjecttoarrestforthe
followingactions:
Inthecaseofaregisteredpatient,usingmedicalmarijuana
Obtainingorpossessingmedicalmarijuana
Possessingspecifiedparaphernaliaoraccessories
Inthecaseofaregisteredcaregiver,assistingaregisteredpatientintheuseor
administrationofmedicalmarijuana.
Tenantprotection
Thebillprovidesthataperson'sstatusasaregisteredpatientorcaregiverisnottobe
usedasthesoleorprimarybasisforrejectingthepersonasatenant
