1. Article 7 shall be amended to E-Prior Notice published by the exporter at
the latest before the ship departs (not On date of On Board nor date
of BL)

Article 61A,

** Paragraph (1), Regulation of the Minister of Agriculture number 13 of 2016


shall be valid for 2 (two) years since its enactment (what date this regulation is
enacted?)
** Paragraph (2), concerning E- Prior Notice, COA and the web in Barantan
** Paragraph (3), After the expiration of this Permentan back to the Regulation of
the Minister of Agriculture No.04 of 2015

Article 61B,

** Paragraph (1), For countries whose FFPO (Fresh Food of Plant Origin) system
has not been recognized and countries that do not have a registered laboratory,
they must attach:
a. E-Prior Notice (E-PN)
b. COA
** Paragraph (2), the issuance of E-PN shall be in accordance with Article 7 to
Article 9 (Plus amendment of article 7)
** Paragraph (3), For countries whose FFPO system has not been recognized and
countries that do not have a registered laboratory, the FFPO testing can use
FFPO laboratories owned by other countries which have been registered.
** Paragraph (4), the parameter of FFPO testing shall be in accordance with the
Regulation of the Minsiter of Agriculture No.04 of 2015

Article 61C,

** Paragraph (1), The provisions in Article 61B shall be valid for 2 (two) years
since this Minister Regulation is enacted (Enacted since when?)
** Paragraph (2), After this Regulation of the Minsiter of Agriculture is applicable
for 2 (Two) Years, the Regulation of the Minsiter of Agriculture No.04 of 2015 shall
be reenacted along with its necessary or important amendments.

Article 61D,

** Paragraph (1) For countries whose FFPO system has not been recognized and
countries that do not have a registered laboratory, the FFPO testing of
commodities loaded to the means of conveyance per February 17, 2016 shall be
conducted at the entry point (destination Country)
** Paragraph (2), FFPO Testing in paragraph (1) above shall be applicable six (6)
months from the promulgation of this Miniter Regulation.

** After the expiration of period as referred to in paragraph (2) the place of


destination of FFPO shall be in accordance with the provisions in Article 61B.

AMENDMENTS TO THE REGULATION OF MINISTER OF AGRICULTURE No. 04 /
PERMENTAN / PP.340 / 2/2015 ON FOOD SECURITY INSPECTION OF THE IMPORT
AND EXPORT OF FRESH FOODS OF PLANT ORIGIN
BY THE GRACE OF GOD ALMIGHTY
THE MINISTER OF AGRICULTURE OF THE REPUBLIC OF INDONESIA,

Considering

: a. that by the Regulation of Minister of Agriculture Number 04 /


Permentan / PP.340 / 2 / 2015, the Food Security Inspection of
the Import and Export of Fresh Foods of Plant Origin has been
stipulated;
b. that in order to avoid obstacles to the trade, it is necessary to
amend some provisions in the Regulation of Minister of
Agriculture No. 04 / Permentan / PP.340 / 2/2015 on Food
Security Inspection of the Import and Export of Fresh Foods of
Plant Origin;
c. That based on the considerations as referred to in letters a and
b, it is necessary to stipulate the Regulation of the Minister of
Agriculture on the Amendment to Regulation of the Minister of
Agriculture Number 04 / Permentan / PP.340 / 2/2015 on Food
Security Inspection of the Import and Export of Fresh Foods of
Plant Origin;

In View of

DECIDES:
REGULATION OF THE MINISTER OF AGRICULTURE ON THE AMENDMENTS TO THE
MINISTER OF AGRICULTURE No. 04 / Permentan / PP.340 / 2/2015 ON FOOD
SECURITY INSPECTION OF THE IMPORT AND EXPORT OF FRESH FOODS OF PLANT
ORIGIN.

Article II
Several provisions in the Regulation of the Minister of Agriculture No. 04 /
Permentan / PP.340 / 2/2015 on Food Security Inspection of the Import and
Export of Fresh Foods of Plant Origin (State Gazette of the Republic of Indonesia
of 2015 No. 275) shall be amended as follows:

1. The provisions of paragraph (1) of Article 7 are amended to read as follows:

Article 7
(1) Description of FFPO (prior notice) as referred to in Article 6 shall be issued
by exporters in the country of origin at the latest before the ship is
departed from the country of origin.
2. Between the Article 61 and Article 62 four (4) Article shall be inserted,
namely Article 61A, Article 61B, Section 61C and Article 61D to read as
follows:

Article 61A
(1) The compliance with the procedures for issuing the description of FFPO (Prior
Notice) and procedures for the issuance of certificate of test results
(Certificate of Analysis) as referred to in Article 7 to Article 10 shall be given
a maximum period of 2 (two) years since this Decree of Minister of
Agriculture is promulgated ,
(2) The compliance as referred to in paragraph (1) shall be in the form of:
a. the format of description of FFPO (Prior Notice);
b. the use of official portal of Agricultural Quarantine Agency; and
c. the format of certificate of test results (Certificate of Analysis).
(3) If the period of time as referred to in paragraph (1) expires, the procedures
for issuing description of FFPO (Prior Notice) and the issuance of certificate of
test results (Certificate of Analysis) shall comply with the provisions referred
to in Article 7 to Article 10.

Article 61B
(1) If countries of origin of FPPO whose FFPO security suprevision system has not
been recognized and they do not have registered FFPO security testing
laboratories, the importation of FFPO can be conducted by attaching:
a. description of FFPO (prior notice); and
b. certificate of test results (Certificate of Analysis).
(2) Issuance of Description of FFPO (prior notice) as referred to in paragraph (1)
letter a shall be in accordance with the provisions referred to in Article 7 to
Article 9.
(3) Certificate of test results (Certificate of Analysis) referred to in paragraph (1)
letter b shall be issued by registered security testing laboratories of other
countries.
(4) Parameter test as referred to in paragraph (3) shall refer to Annex I.

Article 61C
(1) Importation of FFPO as referred to in Article 61B shall be valid for a period of
2 (two) years, commencing from the promulgation of this regulation.

(2) If the period of time as referred to in paragraph (1) expires, the provisions on
the requirements of FFPO importation as referred to in Article 4 to Article 10
shall apply mutatis mutandis to the importation of FFPO as referred to in
Article 61B.

Article 61D
(1) If the FFPO is derived from countries whose FFPO system has not been
recognized and countries that do not have a registered security testing
laboratory, it must have been loaded on the means of conveyance per
February 17, 2016 FFPO and the FFPO testing shall be conducted in the place
of importation.
(2) FFPO testing as referred to in paragraph (1) shall be valid for a period of 6
(six) months, commencing from the promulgation of this regulation.
(3) If the period of time as referred to in paragraph (2) expires, the importation
of FFPO shall be in accordance with the provisions of Article 61B.
3. Other provisions in the Regulation of the Minister of Agriculture No. 04 /
Permentan / PP.340 / 2/2015 on Food Security Inspection of the Import and
Export of Fresh Foods of Plant Origin shall be declared still valid.

Article II
This Regulation shall come into force on the date of promulgation.
For public cognizance, this Ministerial Regulation shall be promulgated in the
State Gazette of the Republic of Indonesia.
