Thirteenth(13th)monthpayisthemandatorybenefitgiventoarank
andfileemployeeasanadditionalcompensationfromhis/her

employee.Itisequivalenttoonetwelfth(1/12)ofthebasicsalaryofanemployeewithina
calendaryear(PresidentialDecree851asamendedbyMemorandumOrderNo.28Series
of1986).
Todeterminewhetheroneisarankandfileemployeeornot,theRevisedGuidelineson
theImplementationofthe13thMonthPayLawprovides:
TheLaborCodedistinguishesarankandfileemployeefromamanagerialemployee.It
providesthatamanagerialemployeeisonewhoisvestedwithpowersofprerogativesto
laydownandexecutemanagementpoliciesand/ortohire,transfer,suspend,layoff,recall
discharge,assignordisciplineemployees,ortoeffectivelyrecommendsuchmanagerial
actions.Allemployeesnotfallingwithinthisdefinitionareconsideredrankandfile
employees.
Theabovedistinctionshallbeusedasguideforthepurposeofdeterminingwhoarerank
andfileemployeesentitledtothemandated13thmonthpay.
Itisclearfromtheabovementionedlawthatyouarequalifiedtoreceive13thmonthpay,
beingarankandfileemployeeduringyourstintasacashierpriortoyourresignation.
Likewise,accordingtothesaidguidelines,aresignedemployeemayreceivehisprorated
13thmonthpay,towit:
Anemployeewhohasresignedorwhoseserviceswereterminatedatanytimebeforethe
timeforpaymentofthe13thmonthpayisentitledtothismonetarybenefitinproportionto
thelengthoftimeheworkedduringtheyear,reckonedfromthetimehestartedworking
duringthecalendaryearuptothetimeofhisresignationorterminationfromtheservice.

Thus,ifheworkedonlyfromJanuaryuptoSeptemberhisproportionate13thmonthpay
shouldbeequivalentof1/12histotalbasicsalaryheearnedduringthatperiod.
Thepaymentofthe13thmonthpaymaybedemandedbytheemployeeuponthe
cessationofemployeremployeerelationship.Thisisconsistentwiththeprincipleofequity
thatastheemployercanrequiretheemployeetoclearhimselfofallliabilitiesandproperty
accountability,socantheemployeedemandthepaymentofallbenefitsduehimuponthe
terminationoftherelationship.
Sinceaccordingtoyou,youhaveservedyouremployerforatotaloffivemonthspriorto
yourresignation,youareentitledtoreceiveaprorated13thmonthpayfromyouremployer
whichisequivalenttoonetwelfthofyourtotalbasicsalaryforthefivemonthsthatyouwere
employed.
Again,wefinditnecessarytomentionthatthisopinionissolelybasedonthefactsyou
havenarratedandourappreciationofthesame.Theopinionmayvarywhenthefactsare
