JUDICIAL AFFIDAVIT
Offer of Testimony:
The testimony of the witness is being offered to
prove the following:
1. That she is one of the grandchildren of Marco
SINUTO, the legitimate and biological brother of
the registered owner of a parcel of land covered by
Declaration of Real Property with Tax Declaration
No. 29407;
2. That Franciso SINUTO had seven (7) children;
3. That she personally knows Francisco SINUTO, his
children and has stayed in their house for more
than four (4) years;
4. That Victoria Lily N. Ragadio who claims to be
Victoria SINUTO is not their relative;
5. That there is no legal basis for the Affidavit of
Self-Adjudication and Sale executed by Victoria SINUTO;
6. That she will likewise identify certain
documents relative to this case.
That I, TERESITA S. NAIBULSA, of legal age, married,
Filipino Citizen, a resident of Barangay Buneg, Pozorrubio, Pangasinan,
after having been sworn in accordance with law, hereby depose and
say:
PRELIMINARY STATEMENT
The person examining me is Atty. Kim Medina, with office
address at the 2nd Floor Security Bank Building, Abanao cor. Shagem

Streets, Baguio City. The examination is being held at the same

address. I am answering his questions fully conscious that I do so
under oath and may face criminal liability for false testimony and
perjury.

(They are all my cousins. My grandfather, Marco SINUTO,
and their grandfather, Francisco SINUTO, are siblisngs.)

by a Declaration of Real Property with Tax Declaration Number
29407 consisting of 2,166 square meters, located at Barangay
Buneg, Puzorrubio, Pangasinan. Do you know and have you met
Francisco SINUTO?)

He is our neighbor in Pangasinan when I was young and I
stayed with them for eight (8) years, because I worked for them.

APOLONIO, MODESTO, CATALINA, RUFO, URBANO, PABLO and
VENANCIO, all surnamed SINUTO.)

(Do you know the whereabouts of these people you just
mentioned?)

(They are all deceased, sir.)

you know if your cousins got married?)
A: Amok nga nangasawa jay daduma sir ngem ni uncle
Venancio ket haan pay nakaasawa napanen Borneo edi 1960,
isunga hanko lang amo nu adda inasawa na ejay.( I know that
they all got married except for Venenciano, who left for Borneo
together with my uncle Urbano and Rufo to work in the year
1960. I just dont know if he got married there.

(So Venenciano does not yet have a wife when he left for

(From what I know he does not have a child before he left
for Borneo and when he returned he did not say if he had any in
Borneo)

(How old were you in the year 1960 when your Uncles
Venancio and Urbano migrated to Borneo?)

(I was 18 years old, sir.)
16. Q: Kasatnu kabayag nga nagtrabaho ni Uncle mu nga
Venancio idiay Borneo.
(How long did your Uncle Venancio stay in Borneo?)
A: Nabayag ta nagawid lang isuna dituy Pilipinas iddi 2005
nga agsaksakit pay.

(Quite long because he only came back to the Philippines

on 2005 and he was very ill.)

have previously stated, my Uncle Urbano left for Borneo
sometime in 1960 and VICTORIA LILY B. RAGADIO/ VICTORIA
SINUTO was born on November 8, 1962 and my Uncle did not
come back here in the Philippines until sometime 2005 when he
was already sick.)

(On January 19, 2009, Victoria Ragadio executed an
AFFIDAVIT OF SELF-ADJUDICATION AND SALE stating therein that
Francisco SINUTO died without any issue and adjudicated unto
herself
the area of 200 square meters of the land and selling the
same to
Spouses Danilo Ronquillo ken Marcelina Nimer. What can
you say
about that?)

(What she did was utterly false because Victoria SINUTO is
not our relative. She lied when she said that Francisco SINUTO
had no children because he had seven (7) children and even has
grandchildren. It is as if she killed us all.)
