4.1 ''And Their Name Was Treason''
4.1.1
Background
A Day to Remember formed when guitarist Tom Denney asked Jeremy McKinnon if he would like to join the
band as a vocalist.[2] The pair hung out with drummer
Bobby Scruggs, who later joined the band.[2] During this
period, both Denney and Scruggs were already in a band;
Denney was in 2 Days 2 Late, while McKinnon played
in All for Nothing.[3] The trio wrote a song which McKinnon said was better than everything our other bands
had come up with.[2] Shortly afterwards the trio decided
to form a band which was called End of An Era in its
rst week of existence.[2] The name was inspired by a
movie listing in a TV guide found in Denneys home.[2]
One day at rehearsal, a friend of Scruggs showed up with
his girlfriend, who came up with the bands name A Day
to Remember.[2]
Scruggs friend stayed in the band for a short period. He
was red after several instances of walking o stage midperformance.[2] According to Denney, the groups original bassist and rhythm guitarist didn't work out.[3] They
were subsequently replaced by guitarist Neil Westfall and
According to McKinnon, And Their Name Was Treason was recorded probably within 3 days,[7] in Andrew
Wade's bedroom at his parents house[8] (credited in the
album booklet as The Wade Studio).[9] The members
later said they had no idea what were they doing when
they were recording the album.[10] The album features
samples from various lms throughout; Intro features
a sample from the lm Donnie Darko, 1958 features a
sample from the lm The Boondock Saints and Sound
the Alarm features audio from Shaun of the Dead.[11]
Speaking about the lyrical themes on the record, guitarist Tom Denney said that they were all experiences
that [singer] Jeremy has had, its all based on life.[3]
A few of the songs were written by the band when they
were teenagers, such as 1958, Heartless, and You
Should Have Killed Me When You Had the Chance,
the latter being one of the rst songs that the band ever
wrote.[12] 1958 was written about a temporary drummer, who threatened to go McKinnons parents house
with a baseball bat; the numbers 1958 being the last
four digits of his phone number.[13] Denney added that
the song talks about family and us sticking together no
matter what.[3]

Jeremy McKinnon, about Victory making the band do
things they didn't want to do, 2013
On December 6, 2010, two colored vinyl editions of Old
Record were released.[34] In an interview with USA Today in 2011, McKinnon said that the band had a bunch
of people tell us we'd sold out and that was our rst
album when they had released And Their Name Was
Treason.[35] On July 2, 2013, Victory announced that Old
Record was to be reissued again on vinyl, in 3 dierent colors, from July 9:[36][37] standard black, and limited edition copies of both pink and clear with black
smoke.[38][39] In an October 2013 interview, McKinnon
revealed the band had to re-record the whole album in a
couple of days due to pressure from Victory-owner Tony
Brummel.[30] McKinnon was absolutely [...] ashamed
it was released as he thought the band had butchered it.

In the early hours of one morning,[7] McKinnon was driving to Ocala, Florida when the chorus guitar ri to The

it within 2 days.[nb 3][7] The songs lyrics are about pressure when it comes to songwriting and the attempt to

Initial releases and line-up changes
In 2008, both Homesick and the re-release of the bands
rst album, as Old Record, were announced,[36] with a further announcement claiming Homesick's release as February 17, 2009.[37] After being moved up the schedule,[38]
the albums release date became February 3 for the
U.S.[nb 6][41] In January 6, 2009,[42] the track list of the
album was revealed.[43] In mid-January, the song Welcome to the Family was put on the bands Myspace
prole,[nb 7][44][45] with The Downfall of Us All being
added on 26 January.[46] The following day, the song NJ
Legion Iced Tea was released as the rst single.[47][48]
Homesick was released on February 3 in the U.S.[nb 8][50]
The cover art, designed by Dan Mumford based on an
idea by McKinnon,[28] is an interpretation of dierent
paths in life, and how one road can change a persons
life.[51] The second single was The Downfall of Us All
and the music video was released on March 3.[52] For
tours in promotion of Homesick, the band had a line-up
change[10] adding Four Letter Lie guitarist Kevin Ska
and dropping Tom Denney, the latter of whom wanted to
settle down,[53] but was still working with the band behind
the scenes.[54][55][56]

on MTV on March 16.[68][69] The music video was based
on an idea from a friend Kyle Crawford, as McKinnon
said: He was like, 'Hey, you should totally make a video
where you guys are playing kickball and you play a bunch
of kids and just kick the s*** out of them?" I was like,
That is a great idea. Lets look into it.'"[nb 11][10] Asked
why it was the bands next music video, Westfall said it
stands out compared to the other songs as its a harder
song.[55]
The band had performed acoustic versions of both
Homesick and Have Faith in Me before a show in
early April, for 98 Rock,[70] and again, for KROQ, a few
months later.[71][72] The band also played Have Faith in
Me acoustically for MTV, which was posted online midApril.[73][74] At the beginning of May 2010, the band
asked fans to name their next tour,[75] which was shortly
afterwards named as Toursick.[76] The band started the
rst of The AP Sessions for Alternative Press on June 30,
performing Homesick and Have Faith in Me.[77] The
music video for Have Faith in Me, directed by Mark
Staubach,[78] was released on July 14, receiving its world
premiere on MTV.[79][80] The song was also released as a
single.[81]

the genre.[2] Monger called the backing vocals exciting at rst, but felt that they eventually dissolve into
the waves of distortion mid-album, becoming an audio
equivalent of an energy drink crash.[2] The nal track,
If It Means a Lot to You, as Monger noted, was different from the preceding tracks, as they were deafening, ultimately forgettable, over-compressed slabs of
twentysomething angst.[2] Sputnikmusic's John Hanson
said the album was an incredibly derivative and plodding record that was lled with laughable moments.[1]
He also noted the band haven't seemed to progress that
basic combination of ideas in combining pop-punk and
metalcore, and that the intro to The Downfall of Us All
is just one example of embarrassing decisions.[1]

4.4.1 Background
While the band was touring Homesick (2009), a line-up
change occurred[2] when guitarist Tom Denney wanted
to settle down.[3] Four Letter Lie guitarist Kevin Ska
was added in his place;[3] Denney, however, was retained
to work with the band behind the scenes.[4] All of the
songs for What Separates Me from You were written while
the band were touring in 2009 and 2010,[5] and as early
as March 2010, vocalist Jeremy McKinnon stated that A
Day to Remember already had all of the pop/punk song
ideas written [...] And we're then going to write ve heavier songs.[6]

It was important to the band that Sticks & Bricks
opened the album, as it was an in-your-face song.[14]
McKinnon said in an interview with USAToday that the
opening lyric ("I am fueled by all forms of failure")
was 100% directed at everyone who ever doubted our
band.[4] He stated that it is one of the meaner, heavier
songs that we've ever done as a band.[10] "All I Want" is
about being in a band,[4] according to McKinnon, and
was one of the nal songs written for the album.[14] The
song came about from an idea by McKinnon that he expanded on guitar in the middle of recording for the album,
and wrote most of it in one night.[14] A rough version was
31
recorded between McKinnon and producer Chad Gilbert
before the band had arrived at the studio.[14] McKinnon
said the song was more of a singing version of the bands
song I'm Made of Wax, Larry, What Are You Made
Of?".[14]
"Its Complicated" was written while the band were
abroad in Amsterdam; the original version diered signicantly from the nal version.[14] Andrew Wade ew
out to the band in an attempt to work on the song
immediately.[14] This Is the House That Doubt Built
was among one of the rst to be written for the album, written almost in one sitting while McKinnon had
his acoustic guitar with him,[15] while the band was
abroad.[14] 2nd Sucks was about people who viewed being in a band as being a sort of competition.[14]
Tracks 610
Better O This Way was one of the rst written for
the album, and re-written at least 3 dierent times.[14]
The song was the nal one nished for the album.[14] The
title for "All Signs Point to Lauderdale" came from an
occasion when McKinnon and bassist Joshua Woodard
were in a rough neighborhood in West Palm Beach,
Florida.[14] A piece of the song came from a recording
session for Homesick when Gilbert said he had an idea
for the melody, which McKinnon took a while to write
over: Chad had a cool idea, vocally, for something.[14]
In an interview with PopCrush in 2011, McKinnon said
the song was when you get the feeling like you're stuck
in a place thats leading you nowhere and standing up
for yourself and taking charge of your life.[16] You Be
Tails, I'll Be Sonic was written with the bands former
guitarist, Tom Denney;[14] the song was made up of several separate pieces from dierent song ideas, with a chorus McKinnon had re-written 4 times.[14]
Referring to You Be Tails, I'll Be Sonic, Ska said that
the songs titlea reference to Tails and Sonic from the
video game serieshad really came out of nowhere.[13]
McKinnon said the song is a more personal song [...]
It discusses how the choices I've made to put my best
foot forward in my career, in a sense, have really done
damage to my personal life.[10] Both You Be Tails, I'll
Be Sonic and Out of Time talk about how I feel
like I'm doing what I want with my life, but I think,
Wow, I just did something that really aected me.""[10]
Out of Time was also one of the rst songs written
for the album, and was written while the band was in
Australia.[14] McKinnon said the song was the most personal on the record.[14] Ska had a major hand in writing
If I Leave.[14] The song describes dierent things you
got through being on the road and a relationship ending when you're not really around enough to actually take
care of it in person.[17] On being asked whether he knew
it would be the nal song on the album, McKinnon said
It just felt right [...] seemed like a good ending.[17]

Neil Westfall, on pre-production, 2010
Before showing the songs to the band, McKinnon and
Ska worked on them alone.[10] When the pair had
all of the song ideas, they worked on them as a fullband,[10] with pre-production being undertaken in, as
Ska commented, a makeshift studio[7] by Andrew
Wade.[18] Woodard commented that the band had been
going in from 11am until 9pm and all we do is sit
around and play.[18] Between demoing the songs, and
their nal forms on the album, Woodard said crazy
things were happening verses became choruses, with
Chad Gilbert assisting the band with arrangements and
writing.[18] As the band thought they were getting better
as songwriters, Woodard stated, its getting more heavy
and more pop.[18] One song that the band recorded was
screwed up really bad and it didn't make the record, as
Ska comments, as the group recorded it at a fast pace

What Separates Me from You was recorded from May to
July 23, 2010,[20] in three locations, per the album booklet: The Wade Studios in Ocala, Florida, The Back of
a Bus with No AC in Germany and A Closet in New
Jersey,[21] the latter of which being where the backing vocals for All Signs Point to Lauderdale were recorded.[22]
The album was mixed by David Bendeth and Dan Korne, and produced by Gilbert with assistance by Wade
and McKinnon.[21] Wade also produced the bands previous album, Homesick.[23] It was the rst album featuring
Ska on guitar, following Tom Denneys departue after
Homesick.[24] All I Want, Its Complicated, This Is
the House That Doubt Built and If I Leave were mixed
by Bendeth, while the rest of the album tracks were mixed
by Korne.[21] Mastering for the album had taken place
at Sterling Sound by Ted Jensen.[21]

AbsolutePunk reviewer Thomas Nassi summarizes that
McKinnon chronicle[d] the last three years of his bands
collective life, from the opening track to the last song
often reminisc[ing] on the bands beginnings. Another
recurring matter was demanding respect, and that the
band doesn't stray from their combination of pop punk
and metalcore.[1] Writing for Alternative Press, Brendan
Manley called the album a classic ADTR record in every sense, with Manley favoring the pop punk songs:
"[pop punk] wins, providing the most memorable moments on the record. Manley noted the listener would
hear constant touches of the unmistakable chug-a-chug
algorithm ADTR that the band had previously used
on their other albums.[2] Tamsyn Wilce, for Alter the
Press!, wrote that the albums opening track throw[s]
you right into the whirlpool of pop-mosh goodness proving that that the band returned with a massive bunch of
solid anthems. Wilce also wrote that the songs make
up for the amount of in-studio chatter included on the
album.[3] Rock Sound's Andy Ritchie called Right Back
at It Again unmistakably the 'All I Want' of 'Common
Courtesy'" and suggesting that lines in Sometimes You're
the Hammer, Sometimes You're the Nail, and The Document Speaks for Itself, were digs at Victory. Ritchie
also wrote that the pace is broken up by I'm Already
Gone which was well-aligned slotted before Violence
(Enough Is Enough)".[128]

Reception
Thrash Hits reviewer Tom Doyle said that the rst track,
Right Where You Want Me to Be, started things o
in pleasant enough fashion with its bouncing, superinfectious chorus. [1] Doyle called the bands cover of
Kelly Clarkson's "Since U Been Gone" a pretty sedate
plod through a song which wasnt really that good to begin with, and that their cover of The Fray's "Over My
Head (Cable Car)" suited better to the bands style.[1]

Background
The music video for Since U Been Gone was directed
by Alex De Rako in early November 2004.[61] Clarkson
told MTV that she conceived the idea of the video after
assuming that revenge is what every girl wants to do when
their boyfriend cheats on them. She added, You know,
'Why don't I just go trash her house? [...] And so I do it
in the video. All I do is break stu. Its a cool job. I could
get used to this.[7] Clarkson expressed that in the music
video, viewers would get to see her act out of character.
She explained, In the beginning, I'm like tipping things
over and smearing mud all over the walls and it seems
like my apartment, but it ends up being the other girls
that hes with, so its a humorous video.[7] The music
video premiered on Total Request Live on November 16,
2004.[7]
Synopsis
The music video begins with Clarkson sitting on a couch
in an apartments living room, holding a heart-shaped
locket in her hand. The next scene shows Clarkson in
the bathroom where she xes her face in the mirror, she
opens the medicine cabinet and tossing all the pills in the
medicine cabinet over her shoulder and messing all the
bathroom items on the oor, squirting the toothpaste into
the sink. When she gets to a container of birth control
pills, she turns on the water in the sink, snaps the pills
out, and drops them down the drain. Clarkson then starts
to take other items; she throws a container of makeup
powder spray in the air and smears a container of facial
mud mask on the wall. During the chorus, Clarkson and
her band perform the song for a dancing crowd in a club.
After the rst chorus, Clarkson walks into a room full of
closets. She cuts up dresses, riing through the closets

number 135 on its list of the 150 Best Tracks of the Past

American schlock power-pop turned into a brilliant kisso, in any genre.[106] The A.V. Club sta rated the song
as one of their favorite gleeful breakup songs, writing
The minute that bass and drum machine start, this song

Stone ranked Since U Been Gone at number 482 of the
500 Greatest Songs of All Time in 2010,[1] whose readers
listed it as the ninth-ranked single of the last decade.[108]
The AOL Radio Sta put the song at number 10 on their
list of 10 Best Break Up Songs.[109] The song also appeared at number one in Sarah Muller of MTVs Valentines Day Playlist: Top 10 Breakup Songs.[110] On March

Legacy
As of 2014, the song has appeared in more than 40 different albums either remixed or in its original format.[100]
The song propelled Clarkson to success in mainstream
pop music and was regarded as a pop rock milestone in
the 2000s.[101] Entertainment Weekly put it on its end-ofthe-decade best-of list, saying, Can anyone do bitter
better? Nothing packs more romantic rage than the original Idols 2004 kiss-o to a coldhearted ex.[102] The song
was ranked by Pitchfork Media as the 21st best track of
the 2000s; they wrote that "'Since U Been Gone' gave
us one of the most blunt rallying cries of the last ten
years, a perfectly realized sing-along chorus that will be
a karaoke staple for years.[103] Bill Lamb of About.com
ranked the song as the 13th best pop song of all time,
expressing that Kelly Clarkson has stated that she insisted on adding the rock feel to the recording. The result
