Thanks for the meeting time.

Fortunately, I have been to Metro previously.

The topic is attached, more or less. I can supply much more, of course. But the "moral" questions are here
displayed.

Proposal was that Metro should cooperate with the needs of the new, clean WTE facility, ZESC, that accepts
MSWand converts it into energy and clean building materials without a smokestack. Further, that inasmuch as
the facility itself did not require the tipping fee, that Metro should continue to administrate the MSW hauling and
continue to use the money for Metro uses up to and including using a portion of the hauling revenues to allow
MSW to be dis-entrained (remediated) and treated at the ZESC. Alternately, Metro could allow us to arrange
that financing separately while still receiving the tipping fees.

Our basis for asking for the decision was:

1) that HB 3744 is the law of the land, and obligates Metro's cooperation and encouragement for recycling of
waste in feasible ways.

2) that allowing Metro to continue to receive the tipping fees meant that Metro had a ..---.
feasible (zero cost)
proposal to rec cle, which is well below the contract $-limit that allows the Deputy Chief Operating Officer to
execute.

Scott Robinson's objections included

- that we had not arranged financing through the utility (pilot plant, avoided cost power purchase agreement).
Instead, we had arranged all financing through other means and through the FERC Exempt Wholesale
Generator procedure (allowing new energy providers to receive wholesale prices rather than the avoided-cost
prices that utilities usually bargain for).

- that we had not arranged financing utilizing the full faith and credit of Metro or the municipalities. The
transaction does not utilize any municipal bonds, is financed through federal cooperation with commercial lender.

Scott Robinson overrode his staff who clearly stated that recycling for the purposes of energy in this proposal
are feasible and in fact already Metro-procedure (t1hey cited another wrE transaction).

In my opinion, neither of those objections constitutes a platform to withhold Metro's cooperation with the law and
undermines the intent of HR 3744, which does not in any way stipulate that financial agreements of renewable
energy facilities must benefit current energy and landfill monopolies. Further, I do oot believe it was proper for
Metro's officers to defer their erformance in favor of requiri the ZESC to operate through lobb ists, as was
t case.
