A change to headings 2705 through 2709 from any other chapter.
Critical Materials any material classified in chapter 27
Example #2
A change to heading 2716 from any other heading.
Critical Materials- any material classified in heading 2716
Example #3
A change to headings 2802 through 2803 from any other heading, including another heading
within that group.
Critical Materials- If the good is classified in heading 2802 the critical material is any material
classified in heading 2802; if the good is classified in heading 2803 the critical material is any
material classified in heading 2803.
Example #4
A change to subheading 4009.21 from any other heading, except from headings 4010 through
4017.
Critical Materials- any material classified in heading 4009 and in headings 4010 through 4017.
Example #5
A change to subheading 2806.20 from any other subheading.
Critical Materials- any material classified in subheading 2806.20
Example #6
A change to subheadings 3923.30 through 3923.90 from any other heading, provided there is a
regional value content of not less than:
(A) 60 percent where the transaction value method is used, or
(B) 50 percent where the net cost method is used.
Critical Materials-any material classified in heading 3923; the good must also satisfy a RVC
requirement.
Example #7
A change to subheading 3923.29 from any other heading, except from subheadings 3920.20 or
3920.71. In addition, the regional value content must be not less than:
(A) 60 percent where the transaction value method is used, or
(B) 50 percent where the net cost method is used.
Critical Materials- any material classified in heading 3923 and subheadings 3920.20 and 3920.71;
the good must also satisfy a RVC requirement.

A change to tariff item 7321.90.10 from any other tariff item.
Critical Materials- any material classified in tariff item 7321.90.10
Example #9
(A) A change to subheadings 7324.10 through 7324.29 from any other heading; or
(B) A change to subheadings 7324.10 through 7324.29 from subheading 7324.90, whether or
not there is also a change from any other heading, provided there is a regional value content of
not less than:
(1) 60 percent where the transaction value method is used, or
(2) 50 percent where the net cost method is used.
Critical Materials-any material classified in heading 7324. If the only non-originating material
classified in heading 7324 is classified in subheading 7324.90 then the producer is allowed to try
to satisfy the RVC requirement specified in the B Part of the rule of origin..

NOTE: If a critical material is not covered by a valid NAFTA Certificate of Origin the good does
not qualify as a NAFTA originating good unless the value of the critical material is de mimimis.
