Voting in elections is a civic duty as stipulated by the Constitution in Article 52.

1, paragraph
c Chapter III, dealing with "duties of the citizen.
The act of voting is a crucial piece in implementing and maintaining democracy. Elections
and or Voting put citizens in direct contact with the political process. By this gesture, the
citizen chooses his representatives to exercise power, legislate and administer local
authorities.
Through voting, the citizens participate in fact in the political life of his country by
contributing to the development of government and institutionalization of democracy.
The periodic organization of elections and voter turnout remains two main areas of
democratic change and Haiti has been suffering from this periodic change and the violation
of its citizens constitutional rights.
At stake is the very survival of the democratic system, which the international community
and the friends of Haiti have tirelessly pretend that they support and to some extent trying
to uphold in Haiti.
If this article in the Haitian Constitution constitutes the basis by which the concept of one
man one vote is implemented, this very election was marred with irregularities at the very
core.
As Haitians living outside of Haiti who still kept their Haitian citizenship were deprived of
their fundamental right as stipulated in the Haitian Constitution in article 52 that of choosing
their elected representative. In addition, those living in Haiti, although still at proximity were
not able to exercise that fundamental right and some have paid dearly with their life in an
attempt to exercise a right guarantee by their constitution.
The level of participation in the so called election organized on August 9, 2015 was a
shamed and anyone be it the CEP, Friends of Haiti or the International Community trying to
portray this day as something less than a shame is guilty of aiding and abetting an illegal
act perpetrated by the current administration of Martelly/Paul in further pushing Haiti to the
brink of collapse.

A mere level of participation of 18% as reported by the CEP and we all know from what we
have seen on that day that le level of participation is far worst or below the numbers
reported due to intimidation on the part of candidate connected to the party in power and
that of its allies.
The electoral laws clearly states the duties of the CEP, candidates and law enforcements and
yet violations have occurred and no remedies provided to address the inconsistencies
experienced from the beginning to the end of the process.
The table above illustrate the numbers and the level of participation of the Haitian
electorate as a whole, one odd irregularity to ponder on is the fact that based on numbers
provided by the CEP 1,046,516 people voted in the election for representative and and
1,555,419 plus an additional 88,428 being rejected for various reasons from voting for no
candidates/unacceptable ballots for a whopping 1,643,827 people casting a ballot in the
senate race or 57% more people participated in the senate race as opposed to the
representative race.
E. - SECTION OF HOLDING OF VOTES
Article 153. - The voting takes place without interruption, from six (6) am to 4 in the
afternoon.
Article 154.- The President of the polling station or electoral supervisor may require the
assistance of the agent
electoral security or, if necessary, to an officer of the National Police of Haiti to restore order
inside the polling station. Minutes is drawn up.
Article 154.1. - No individual is allowed to enter the grounds of the Polling Station with a
firearm,
weapons, blunt object, or any other object or substance likely to threat or to present a
danger to the lives of those present.

Article 121.1. - No hardware, no property, no government vehicle can be used in the election
campaign of a
or more candidates of one or more political parties or groups
Article 121.2. - Every voter, candidate, political party or group having observed the facts
mentioned in
sections 121 and 121.1 , may terminate or enter the CEP on simple memory addressed to
him
Article 125. - On the occasion of electoral contests, the State grants to political parties,
groupings
policies approved election candidates, grants to help them conduct their
election campaign.

Article 159.2. - If the voter does not choose any candidate, he checks the box reserved for
this purpose in accordance with Article 147.
G.- SECTION OF TAB CENTER AND PUBLICATION OF RESULTS
Article 171. It is established in the Electoral Council a direction called computation center ",
intended
the entry and processing of minutes.
The tabulation center is headed by a frame bearing the title of Director of the Centre.
Political parties and blocs of political parties and candidates participating in the elections
access as observers to tabulation center and according to the procedures of the Centre for
the duration of data processing. Any verification shall be subject to a decision of
BCEN accordance with Article 187 of this Decree.
Article 195.1. - A penalty of imprisonment for six (6) months to one (1 ) year and a fine of
ten thousand ( 10,000)
twenty-five thousand ( 25,000) gourdes, the fact by any election officer to facilitate a person
to vote fraudulently.
Article 196. A penalty of imprisonment from one (1) to three ( 3) years and a fine of twentyfive (25) percent
thousand ( 100,000.00 ) water bottles, the fact by any person to disturb the voting, to wear
affect the exercise of electoral law or the freedom of voting.
Article 199. - be punished with a fine of five thousand (5,000) to twenty-five thousand
(25,000) gourds, the fact by any
person to enter a Polling with firearms, sharp weapons, blunt
and others.
Article 200. - If the weapon or substance was concealed in the fine incurred is tripled, to add
a sentence
imprisonment of six (6) months.
Article 201. A penalty of imprisonment for six (6) months to three (3) years and a fine of ten
thousand
(10,000) to one hundred thousand (100,000) gourdes, the fact by any person:
a) prevent or attempt to prevent the operation of a polling station;
b) disturb the order by assault or violence, or any other maneuver with
affect the electoral process.
Article 201.1. - is punished by imprisonment of six (6) months to three (3) years, the fact by
any person to divert
the vote of an elector by theft, threat, deceit, abuse of power or by any other means
reprehensible.
Article 201.2. - is punished by imprisonment of six (6) months to three (3) years and a fine of
thirty thousand
(30,000) to one hundred thousand (100,000) gourdes, the fact by any person, to influence or
attempt
influence or haggle the vote of one or more constituents.
Article 201.3. - is punished by imprisonment of six (6) months to three (3) years and a fine of
thirty thousand
(30,000) to one hundred thousand (100,000) gourdes, the fact by any person attempting to
influence or
to influence the vote of one or more constituents, by force or threat.
Article 202. - be punished with a fine of twenty-five (25,000) one thousand fifty (50,000)
thousand and gourds
by imprisonment of six (6) months to three (3) years, the fact by any person to induce
voter error or bring it to refrain from voting by the use of false news, expression

libelous or other corrupt practice, either directly or through a


third.
Article 203. A penalty of imprisonment of one (1) to five (5) years and a fine of fifty thousand
(50,000)
one hundred fifty thousand (150,000) gourdes, the fact by any person to burst violently
in a Polling Station.
Article 204. - Is punished with imprisonment of three (3) to five (5) years and a fine of fifty
thousand
(50,000) to one hundred fifty thousand (150,000) gourdes, the fact by any agent of the
public authority, there
including election officials:
a) Engaging in electoral propaganda activity in favor of one or more
candidates, one or more political parties or groups;
b) To facilitate the use of equipment, property or government vehicle to serve in the country
Election of one or more candidates, one or more parties or groupings
policies.
