month shall be recovered from each interim certificate along with
recovery of each instalment. In case the interim certificate is not
sufficient to recover the interest and instalment, the statutory levies and
retention money shall be adjusted first. Out of the balance payable, the
interest due will be appropriated first and the balance towards
instalment.
34.6 The equipment against which the advance is given shall not be allowed
to be withdrawn from site until the recovery of instalment is made

LIQUIDATED DAMAGES FOR DELAY IN COMPENSATION


If the contractor fails to complete the work in all respects within the time
specified or within the extended time that may be allowed by the Engineer
as per Clause 31, the contractor shall pay or allow to the Port a sum
equivalent to % (half percent) per week or part thereof of the total value
of the contract subject to a maximum of 10% of the total value of contract
as liquidated and ascertained damages and not by way of penalty, for every
week or part thereof beyond the said period or extended period as the case
may be during which the work shall remain unfinished. Such damages will
be deducted from any moneys due or to become due to the contractor. The
payment of such damages does not relieve the contractor of his obligations
to complete the works or from any other of his obligations or liabilities
under this contract.
SITE INFORMATION AND CONDITIONS
The berth construction work has to be carried out in Southern side of the
proposed inner dock Basin. The berth structure construction has to be
carried out partly in water and remaining part in land. The Hardening work
shall be carried out in the area between CB3 diaphragm wall rear side and
existing conveyor.

immediately as directed by the Engineer without any extra cost. The
contractor is required to ascertain and allow in his cost for any rerouting of
the services that may be necessary for the due execution of the contract and
any claim resulting from his failure to do so will not be admitted The

MAINTAINING UTILITY AND SERVICES

responsibility of the contractor to conduct additional bore holes, if required
prior to starting of the pile and diaphragm wall works. No additional
payment or time extension will be entertained due to variation in
geotechnical strata during the execution of the work
