SOCIAL RESPONSIBILITY PLAN

PLAN DE RESPONSABILIDAD SOCIAL

All YANACOCHA Contractors shall submit a Social

Responsibility Plan, to be approved by the SOCIAL
RESPONSIBILITY DEPARTMENT. This department shall
offer the necessary support for the development of said
plan, in coordination with the Agreement sponsor area. THE
APPROVAL OF THE SOCIAL RESPONSIBILITY PLAN IS
A VITAL REQUIREMENT FOR ALL CONTRACTORS,
WITHOUT WHICH THEY WILL NOT HAVE ACCESS TO
THE WORK AND/OR SERVICE FRONT THEY ARE
RESPONSIBLE FOR.

Es obligacin de todo Contratista de YANACOCHA,

presentar un Plan de Responsabilidad Social, que deber
ser
aprobado
por
EL
DEPARTAMENTO
DE
RESPONSABILIDAD SOCIAL, el cual le brindar el soporte
necesario para el desarrollo del mismo, en coordinacin con
el rea sponsor del Contrato. LA APROBACIN DEL PLAN
DE RESPONSABILIDAD SOCIAL ES UN REQUISITO
INDISPENSABLE DE TODO CONTRATISTA, SIN EL CUAL
NO PODR ACCEDER AL FRENTE DE LAS OBRAS Y/O
SERVICIOS A SU CARGO.

I. CONTENTS

well as the integration with the neighbors in urban and

Entrenamiento y concientizacin de trabajadores en el

respeto de la cultura y costumbres locales, urbanas y
rurales, a travs de charlas y/o dramatizaciones, que
impliquen el fomento de conductas de respeto a las
personas y a las costumbres locales as como la
integracin con los vecinos en contextos urbanos y
rurales.

With regard to transportation, generate a route plan to

transport the necessary number of units between
Cajamarca and the mine, training the drivers in good
driving habits, adequate use of lights, turning off back
up alarm, use of the horn, etc.

En cuanto al transporte, generar un plan de ruta con el

fin de movilizar la cantidad indispensable de unidades
entre Cajamarca y Mina, capacitando a sus
conductores en hbitos de manejo, uso adecuado de
luces, apagado de alarmas de retroceso, uso del
claxon, etc..

2. Purchase of Local Goods and Services:

Favor local purchase of materials and services, in
equivalent commercial situations, establishing this
commitment with a Commitment Declaration.
3. Hiring Local Personnel
The Contractor shall take up its social responsibility
contributing to the wellbeing of the inhabitants in
YANACOCHA area of direct influence. For this
purpose, the Contractor shall try to hire local personnel
from the villages and/or populated centers adjacent to
the area of influence where they are performing the
Work and/or Services under their responsibility (be it
skilled or unskilled labor), considering for this matter the
existing skills, the support to the development of
communities through training, considering the
responsibility and performance shown by this kind of
personnel. For such purpose, YANACOCHA Social
Responsibility Department will provide support and
advice
through
their

2. Adquisicin de Bienes y Servicios Locales:

Favorecer las compras locales de materiales y
servicios, ante situaciones comerciales equivalentes o
similares, estableciendo este compromiso mediante
una Declaracin de Compromiso.
3. Contratacin de Personal Local
EL CONTRATISTA debe asumir su responsabilidad
social contribuyendo al bienestar de los pobladores del
mbito de influencia directa de YANACOCHA. Para
ello, el Contratista procurar dar prioridad a la
contratacin de personal local de los caseros y/o
centros poblados adyacente del mbito de influencia de
la zona en la que se encuentre el rea en la que
desarrollar las Obras y/o Servicios bajo su cargo (sea
que se trate de mano de obra calificada o no calificada),
considerando para ello las capacidades existentes, el
apoyo al desarrollo de las comunidades mediante la
capacitacin; considerando la responsabilidad y
desempeo que muestre este tipo de personal. Para
tales fines, contar con el apoyo y asesoramiento del

4. Projects
YANACOCHA Social Responsibility Department,
through its COMITE, in accordance with the type and
term of the agreement, shall facilitate a project matrix,
among which the Contractor may choose the one they
are interested in developing, as a contribution to the
development of local capabilities. Such is the case of
professional internships for new graduates and
technical training for their workers, work plans with
educational institutions in the area that include topics
such as road education, environmental education,
community work, among others. The Plan is an Exhibit
to the Agreement.
5. Human Rights and the World Pact
Peru is member of the United Nations Organization
(UN) and therefore the compliance and respect for the
fundamental rights consecrated by the Universal
Declaration of Human Rights are binding for Peru.
Therefore, Peruvian legislation include or is in process
of including these fundamental rights and all of us living
and working here have the same obligation of
respecting these fundamental rights, establishing for
this purpose a Commitment Declaration.

II. SUPPORT AND COORDINATION

and advisory for preparing and implementing the Social
Responsibility Plan for each Contractors company,
making office and field coordination visits.

Responsibility report on the month they will be carried
out, skating the topic dealt with, duration of the activities
and the amount of workers that participated. These
activities do not exclude the activities the Contractors
may organize by themselves.

4. Proyectos
El Departamento de Responsabilidad Social de
YANACOCHA, a travs del COMITE, de acuerdo con el
tipo y duracin del contrato, facilitar una matriz de
proyectos, entre los cuales el contratista elegir el que
le interesa desarrollar, como contribucin al desarrollo
de capacidades locales; tal es el caso de prcticas
profesionales para recin egresados y capacitacin
tcnica a sus trabajadores; planes de trabajo con
instituciones educativas de la zona que incluyan temas
de educacin vial, educacin ambiental, labores
comunitarias, entre otros. El Plan constituye un anexo
del Contrato.
5. Derechos Humanos y Pacto Mundial
El Per es miembro de la Organizacin de las Naciones
Unidas (ONU) y por ello el cumplimiento y respeto de
los derechos fundamentales consagrados en la
Declaracin Universal de los Derechos Humanos son
de carcter vinculante para el Per. Por ello las normas
peruanas ya recogen o estn en proceso de incorporar
estos derechos fundamentales y todos los que vivimos
y trabajamos aqu, tenemos esta misma obligacin de
respetar
estos
derechos
fundamentales,
establecindose ste mediante una Declaracin de
Compromiso.
II. SOPORTE Y COORDINACION
EL DEPARTAMENTO
DE
RESPONSABILIDAD
SOCIAL de YANACOCHA, a travs del COMIT,
brindar el apoyo y asesoramiento para la formulacin
e implementacin del plan de Responsabilidad Social
de cada empresa contratista, efectuando visitas de
coordinacin en oficinas y en campo.
III. CUMPLIMIENTO DEL PLAN DE RESPONSABILIDAD
SOCIAL
La implementacin y cumplimiento del Plan de
Responsabilidad Social constituir un elemento
importante en la continuidad de la relacin contractual y
calificacin para futuros procesos de contratacin y
asignaciones de nuevos contratos.
Como parte del cumplimiento del Plan de
Responsabilidad Social, cada contratista har llegar
informacin mensual sobre los avances que tenga el
desarrollo del mismo, mediante los siguientes
entregables:
1. Promocin de actitudes y conductas socialmente
aceptadas y valoradas en Cajamarca, entre su
personal:
De acuerdo a la duracin del contrato, el Departamento
de Responsabilidad Social, a travs del COMIT,
facilitar informacin segn el formato de Actividades
Propuestas (ANEXO H-1) para precisar la cantidad de
actividades anuales, que se informarn en el reporte de
Responsabilidad Social del mes en que se realicen,
consignado tema tratado, duracin de la actividad y
cantidad de trabajadores que participaron. Estas
actividades no excluyen las propias que pueda ser
generada por el contratista.

2. Purchase of Local Goods and Services
According to the type and term of the agreement, the
Contractor shall put forward a local purchase plan.
The Contractor shall include in its monthly Social
Responsibility plan, information about the percentage of
local purchases carried out in the month, taking into
account the total monthly purchases according to the
Goods and Services Purchase form (EXHIBIT H-2)
establishing this in a Commitment Statement.
3. Hiring of Local Personnel
All contractors shall have a Local Hiring Plan
approved by the COMITE, before beginning the
services. The Contractor shall give priority to the
former owners and from adjacent villages and
populated centers. In the second place, the priority will
fall in personnel from the city of Cajamarca, and the
third priority shall fall on people from the region of
Cajamarca according to the agreement degree of
specialization and the local existing capabilities, trying
to hire the largest proportion of local (villages and/or
populated centers).
The Social Responsibility Department shall provide
information through the COMIT to the Contractors
about the existing local capabilities among the former
owners, the inhabitants of adjacent villages and from
the city of Cajamarca, before the Contractor hires the
necessary personnel.
YANACOCHA values and acknowledges hiring local
personnel because of the direct positive impact on the
development of capabilities and the generation of
income for the population in the area, something that
fully responds to the concept of Entrepreneurial Social
Responsibility.
4. Projects
According to the plan established with the support of the
COMIT, these activities shall be reported every month
as it may correspond, specifying the project and/or
activity performed, the amount of participating members
of the institutions that were involved in the activity as
per the Social Action form (EXHIBIT H-4)

5. Human Rights and the Social Pact

In the topic of Human Rights, eradication of child labor,
according to Peruvian current legislation, and the
children attendance to school, are a critical interest.
Contractors shall make sure that no child labor exist in
any of their processes or their suppliers, Contractors, or
subcontractors process, and additionally, they will
promote responsibility in the children education among
the employees.
Contractor, before starting the Service shall submit their
Human Rights Commitment Statement.

2. Adquisicin de Bienes y Servicios Locales

De acuerdo al tipo y duracin de su contrato, el
contratista propondr un plan de adquisiciones locales.
El contratista incluir en su reporte mensual de
Responsabilidad
Social,
informacin
sobre
el
porcentaje de compras locales realizadas en el mes, en
funcin de su total mensual de compras segn el
formato de Adquisicin de Bienes y Servicios (ANEXO
H-2) establecindose ste mediante una Declaracin
de Compromiso.
3. Contratacin de Personal Local
Todas las empresas contratistas debern contar con un
Plan de Contratacin Local aprobado por el
COMITE, previo al inicio del servicio., El contratista
buscar priorizar personal Ex propietario y de caseros
o centros poblados aledaos. En segundo lugar
buscar priorizar personal de la ciudad de Cajamarca y,
como tercera prioridad buscar personal de la regin de
Cajamarca de acuerdo al grado de especializacin del
contrato y a las capacidades locales existentes,
procurando la mayor proporcin posible de personal
local (caseros y/o centros poblados).
El Departamento de Responsabilidad Social brindar
informacin, a travs del COMIT a las empresas
contratistas respecto a las capacidades locales
existentes entre los ex propietarios, vecinos de caseros
aledaos y de la ciudad de Cajamarca, previa a la
contratacin del personal requerido por la empresa
contratista.
La contratacin de personal local es muy valorada y
reconocida en YANACOCHA, por el impacto directo
positivo que sta genera en el desarrollo de
capacidades y la generacin de ingresos para la
poblacin de la zona, que responde plenamente al
concepto de Responsabilidad Social Empresarial.
4. Proyectos
De acuerdo al plan establecido con el apoyo del
COMIT
estas
actividades
sern
informadas
mensualmente segn corresponda, especificando el
proyecto y/o actividad realizada, la cantidad de
trabajadores que participaron, la cantidad de miembros
de la institucin participante que se involucraron y el
resultado de la actividad segn el formato de Accin
Social (ANEXO H-4)
5. Derechos Humanos y Pacto Global
En el tema de Derechos Humanos, la erradicacin del
trabajo infantil segn la normativa vigente en el Per y
la asistencia escolar de los nios, son un inters crtico.
Las empresas contratistas se asegurarn, que en
ninguno de sus procesos o los de sus proveedores y
contratistas, o subcontratistas, exista trabajo infantil y
de igual modo, promovern entre sus empleados la
responsabilidad por la educacin de sus hijos.
El contratista, previo al inicio de Servicio, presentar su
Declaracin de Compromiso con los Derechos
Humanos.

1. Local Contractor
Local Contractors are those who carry out economic
activities in Cajamarca, for more than 10 years and/or
whose partners or owners were born in Cajamarca and
whose headquarters are located in the province of
Cajamarca.
2. Local personnel
Local personnel are the former owners and those
belonging to the direct area of influence (villages and/or
populated centers) as defined by the Social
Responsibility Department, through the COMITE
V. OBLIGATIONS TOWARDS THEIR OWN PERSONNEL
The Contractor shall be responsible for providing the
following facilities and benefit to workers and
employees:

1. Transportation for the Contractor and Subcontractor

personnel, including supervision, to and from the work
area.

2. Food for all Contractor and Subcontractor workers.

3. The Contractor shall provide a snack to all their Work

Force and watch for the Subcontractor Work Force to

receive a snack as well during their shift break,
according to the nutritional needs and the climate and
altitude in which the services are rendered.

4. Safety training programs for the entire work force,

including the obligation to demand the same training

programs from the subcontractors work force.

5. Allow enough time to attend the safety and training

programs that either YANACOCHA or the Contractor
may offer.

6. All Personal Protection Equipment (PPE). Besides the

YANACOCHA Loss Prevention Manual, the Contractor
shall provide the workers with adequate working clothes
for cold and rainy weather, including at least reflecting
elements for night work.

7. All hand tools, unspecified but necessary to perform the

work and/or services.

8. Insurance as required by Law and by YANACOCHA.

9. Duly supported medical examination.
10. The Contractor agrees to keep the 100% of its Workers
in all categories and levels, necessary to provide the
services required by YANACOCHA, under their full
responsibility, guaranteeing full compliance with wage
and salary obligation and other workers benefits.

1. Contratista Local
Se entender por Contratista Local a aquellos que
realizan actividades econmicas en Cajamarca, con
una antigedad mayor a diez aos y/o cuyos socios o
propietarios hayan nacido en Cajamarca y cuya sede
principal se encuentre en la provincia de Cajamarca.
2. Personal Local
Se entender por Personal Local a los ex propietarios y
a aquellos que pertenecen a la zona de influencia
directa (caseros y/ centros poblados) definida por el
departamento de Responsabilidad Social., a travs del
COMITE

OBLIGACIONES
PERSONAL

PARA

CON

SU

RESPECTIVO

Es responsabilidad de EL CONTRATISTA cumplir con

las siguientes facilidades y beneficios a los trabajadores
y empleados:

1. Transporte para los Trabajadores del Contratista y del

Subcontratista, incluyendo supervisin hacia y desde el

rea de trabajo.

2. Alimento para todos los Trabajadores del Contratista y

del Subcontratista.

3. EL CONTRATISTA deber proporcionar a toda su

Fuerza Laboral un refrigerio y velar porque la Fuerza

Laboral de su Subcontratista reciba igualmente un
refrigerio, de acuerdo con las necesidades nutricionales
y el clima y altitud en los que los servicios se llevan a
cabo, durante el descanso del turno de trabajo.

4. Programa de capacitacin en seguridad para el total de

la fuerza laboral que incluye el compromiso de exigir a

sus subcontratistas iguales programas de capacitacin
para su respectiva fuerza laboral.

5. Tiempo suficiente para asistir a los programas de

seguridad y capacitacin que pudiera ofrecer tanto

YANACOCHA como del Contratista.

6. Todos los Equipos de Proteccin Personal (EPP).

Adems de los Equipos de Proteccin Personal

requeridos de acuerdo con el Manual de Prevencin de
Prdidas de YANACOCHA, el Contratista ser
responsable de proporcionar a sus Trabajadores ropa
de trabajo adecuada para clima fro y lluvioso
incluyendo por lo menos elementos reflectores para el
trabajo nocturno.

7. Toda herramienta de mano no especificada, pero

necesaria para realizar las obras y/o servicios.

8. Seguros requeridos por Ley y por YANACOCHA.

9. Examen mdico debidamente sustentado.
10. EL CONTRATISTA se compromete a mantener al

100% de sus Trabajadores de toda categora y nivel,

que sean necesarios para la prestacin de los servicios
requeridos por YANACOCHA, bajo su plena
responsabilidad, asegurando el fiel cumplimiento de las
obligaciones salariales y dems beneficios que
correspondan a los Trabajadores.

LOCAL PURCHASE OF GOODS AND SERVICES COMMITMENT

Minera YANACOCHA SRL, supplier of goods and services, within the Framework of the Social
Responsibility that YANACOCHA promotes and with which we identify, and fully aware of the importance of
contributing to Cajamarca local development, we agree herein, to purchase at least . % of goods and
services for the present Agreement in the Province of Cajamarca.
Additionally, we commit to submitting a Purchase Plan before entering the Agreement, to present Social
Responsibility monthly reports with information on the percentage of local purchases made throughout the
month, in terms of the total monthly purchases following the Local Purchase of Goods and Services Form
(Exhibit H-2-A) and every time YANACOCHA requests it through the Social Responsibility Department.

DECLARACION DE COMPROMISO
Nosotros ., empresa contratista de Minera YANACOCHA SRL, conocemos de la adhesin
que est ha hecho al Pacto Global1, el cual les pide a las compaas abrazar, sostener y representar, en su esfera de
influencia, un grupo de valores centrales en las reas de los derechos humanos, estndares laborales2, medio
ambiente y anticorrupcin, y aceptamos este compromiso de respeto a los Derechos Humanos, expresados en la
Declaracin Universal de los Derechos Humanos3.
Tambin reconocemos que como parte de su compromiso, YANACOCHA en sus procesos de seleccin y concurso de
contratistas y proveedores otorgara un valor a quienes demuestren su compromiso e iniciativas concretas para el respeto a
estos derechos fundamentales recogidos en estos documentos.

En 1999 la ONU lanza la iniciativa del Pacto Global, que pide a las compaas abrazar, sostener y
representar, en su esfera de influencia, un grupo de valores centrales en las reas de los derechos
humanos, estndares laborales, medio ambiente y anticorrupcin, como consecuencia de su visin de ser
una empresa socialmente responsable, YANACOCHA y Newmont han suscrito el 2004 la iniciativa, por ello
la implementacin y el reporte de nuestros avances son nuestro compromiso. YANACOCHA tiene dentro
de sus grupos de inters adems de sus socios y empleados, a sus contratistas y proveedores, y
esperamos y valoramos de quienes se hacen nuestros socios de negocios, que colaboren de forma
comprometida en su propio entorno de influencia con el cumplimiento de estos 10 principios.

El Per ha ratificado muchas de las convenciones de la Organizacin Internacional del Trabajo (OIT), entre
las que se encuentran las 8 que han sido sealadas por la misma OIT en 1998, como La Declaracin de
Principios y Derechos Fundamentales en el Trabajo y que al ser parte del marco legal y compromisos del
Per, deben respetarse. YANACOCHA desde su visin de empresa socialmente responsable cumple y
respeta estas convenciones y espera y valora que quienes se hacen nuestros socios de negocio, cumplan
estas 8 convenciones en sus relaciones laborales y dentro de su propia zona de influencia que son sus
propios proveedores y contratistas.

El Per es miembro de la Organizacin de las Naciones Unidas (ONU) y por ello el cumplimiento y respeto
de los derechos fundamentales consagrados en la Declaracin Universal de los Derechos Humanos son de
carcter vinculante para el Per. Por ello las normas peruanas ya recogen o estn en proceso de incorporar
estos derechos fundamentales y todos los que vivimos y trabajamos aqu, tenemos esta misma obligacin
de respetar estos derechos fundamentales.

Como parte de los temas crticos, las empresas contratistas y/o proveedoras, se asegurarn que en ninguno
de sus procesos o los de sus proveedores y/o contratistas o subcontratistas, exista trabajo infantil y de igual
modo, promovern entre sus empleados la responsabilidad por la educacin de sus hijos.
En un tem del informe mensual, se mantendr una declaracin que asegure la no inclusin de trabajo infantil
en la contratista o en sus subcontratistas y si la empresa efectuara alguna actividad para promover la
educacin de nios, ser incluida en el reporte mensual.

COMMITMENT STATEMENT
We ., Contractors of Minera YANACOCHA SRL, are aware of its adherence to the Global
Pact4, which request companies to embrace, support and represent, within their scope of influence, a group of core
values in the areas of human rights, labor5, environmental and anti corruption standards, and accept this commitment
to respect Human Rights, expressed in the Universal Declaration of Human Rights6.
We also acknowledge, that YANACOCHA, as part of its commitment, in contractors and suppliers selection processes
and biddings will grant an additional value to those who show their concrete commitment and initiatives to respect
these fundamental rights as gathered in these documents.

In 1999, the UN launches the Global Pact initiative requesting companies to embrace, support and
represent, within their scope of influence, a group of core values in the areas of human rights, labor,
environmental and anti corruption standards. As a consequence of their vision of being a socially
responsible company, YANACOCHA and Newmont entered this initiative in 2004. Therefore, implementing
and report of our advances is our commitment. Within YANACOCHA stakeholders we can find not only their
Partners and employees, but also their contractors and suppliers, and we expect and value that our
business Partners, collaborate and commit with their own area of influence with the compliance of these 10
principles.

Peru has ratified many of the International Labor Organization (ILO) conventions, among which those that
have been pointed out by ILO itself in 1998, such as the Declaration on Fundamental Principles and Rights
at Work, as they are part of Peruvian legal framework and commitments, they must be adhered to.
YANACOCHA has a socially responsible corporate vision and from that point of view they comply with and
respect these conventions and expect and value that those who become our business Partners comply with
these 8 conventions in their work relations and within their own area of influence: their own suppliers and
contractors.

Peru is member of the United Nations Organization (UN) and therefore the compliance and respect for the
fundamental rights consecrated by the Universal Declaration of Human Rights are binding for Peru.
Therefore, Peruvian legislation include or is in process of including these fundamental rights and all of us
living and working here have the same obligation of respecting these fundamental rights.

As part of their critical topics, contractors and/or suppliers shall ensure that none of their processes or their
suppliers and/or contractors or subcontractors includes child labor, and in the same manner, they will
promote among their employees responsibility for the education of their own children.
One of the items of the monthly report will include a statement guaranteeing that neither the contractor nor the
subcontractor includes child labor. If the company carried out any activity to promote children education, this
shall be included in the monthly report.
