Mosthumblybeseechyourmostexcellentmajesty,yourfaithfulandobedient
subjects,theLordsspiritualandtemporal,andtheCommons,inthisyour
presentParliamentassembled,thatwhereintimeofthereignofyourmostdear
father,ofworthymemory,KingHenryVIII,diversgoodlawsandstatuteswere
madeandestablished,aswellfortheutterextinguishmentandputtingawayof
allusurpedandforeignpowersandauthoritiesoutofthisyourrealm,andother
yourhighness'sdominionsandcountries,asalsofortherestoringandunitingto
theimperialcrownofthisrealmtheancientjurisdictions,authorities,
superiorities,andpreeminencestothesameofrightbelongingand
appertaining,byreasonwhereofwe,yourmosthumbleandobedientsubjects,
fromthefiveandtwentiethyearofthereignofyoursaiddearfather,were
continuallykeptingoodorder,andweredisburdenedofdiversgreatand
intolerablechargesandexactionsbeforethattimeunlawfullytakenandexacted
bysuchforeignpowerandauthorityasbefore[Page443]thatwasusurped,
untilsuchtimeasallthesaidgoodlawsandstatutes,byoneActofParliament
madeinthefirstandsecondyearsofthereignsofthelateKingPhilipand
QueenMary,yourhighness'ssister,intituledanActrepealingallstatutes,
articles,andprovisionsmadeagainsttheSeeApostolicofRomesincethe
twentiethyearofKingHenryVIII,andalsofortheestablishmentofall
spiritualandecclesiasticalpossessionsandhereditamentsconveyedtothelaity,
wereallclearlyrepealedandmadevoid,asbythesameActofrepealmoreat
largedoesandmayappear;byreasonofwhichActofrepeal,yoursaidhumble
subjectswereeftsoonsbroughtunderanusurpedforeignpowerandauthority,
anddoyetremaininthatbondage,totheintolerablechargesofyourloving
subjects,ifsomeredress,bytheauthorityofthisyourHighCourtof
Parliament,withtheassentofyourhighness,benothadandprovided:
Mayitthereforepleaseyourhighness,fortherepressingofthesaidusurped

foreignpowerandtherestoringoftherites,jurisdictions,andpreeminences
appertainingtotheimperialcrownofthisyourrealm,thatitmaybeenactedby
theauthorityofthispresentParliament,thatthesaidActmadeinthesaidfirst
andsecondyearsofthereignsofthesaidlateKingPhilipandQueenMary,and
allandeverybranch,clauses,andarticlesthereincontained(otherthansuch
branches,clauses,andsentencesashereaftershallbeexcepted)may,fromthe
lastdayofthissessionofParliament,byauthorityofthispresentParliament,be
repealed,andshallfromthenceforthbeutterlyvoidandofnoneeffect.
Andthatalsofortherevivingofdiversofthesaidgoodlawsandstatutesmade
inthetimeofyoursaiddearfather,itmayalsopleaseyourhighness,thatone
ActandstatutemadeinthetwentythirdyearofthereignofthesaidlateKing
HenryVIII,intituled,AnActthatnopersonshallbe[Page444]citedoutofthe
diocesewhereinheorshedwells,exceptincertaincases;
AndoneotherActmadeinthetwentyfourthyearofthereignofthesaidlate
King,intituled,AnActthatappealsinsuchcasesashavebeenusedtobe
pursuedtotheseeofRomeshallnotbefromhenceforthhadnorused,but
withinthisrealm;
AndoneotherActmadeinthetwentyfifth[1]yearofthesaidlateKing,
concerningrestraintofpaymentofannatesandfirstfruitsofarchbishopricsand
bishopricstotheseeofRome;
AndoneotherActinthesaidtwentyfifthyear,intituled,AnActconcerning
thesubmissionoftheclergytotheking'smajesty;
AndalsooneActmadeinthesaidtwentyfifthyear,intituled,AnAct
restrainingthepaymentofannatesorfirstfruitstotheBishopofRome,andof
theelectingandconsecratingofarchbishopsandbishopswithinthisrealm;
AndoneotherActmadeinthesaidtwentyfifthyear,intituled,AnAct
concerningtheexonerationoftheking'ssubjectsfromexactionsand
impositionsheretoforepaidtotheseeofRome,andforhavinglicencesand
dispensationswithinthisrealm,withoutsuingfurtherforthesame;
AndoneotherActmadeinthetwentysixthyearofthesaidlateking,intituled,
AnActfornominationandconsecrationofsuffraganswithinthisrealm;

AndalsooneotherActmadeinthetwentyeighthyearofthereignofthesaid
lateking,intituled,AnActforthereleaseofsuchashaveobtainedpretended
licencesanddispensationsfromtheseeofRome;
Andallandeverybranches,words,andsentencesinthesaidseveralActsand
statutescontained,byauthorityofthispresentParliament,fromandatalltimes
afterthe[Page445]lastdayofthissessionofParliament,shallberevived,and
shallstandandbeinfullforceandstrength,toallintents,constructions,and
purposes.
Andthatthebranches,sentences,andwordsofthesaidseveralActs,andevery
ofthem,fromthenceforthshallandmaybejudged,deemed,andtakento
extendtoyourhighness,yourheirsandsuccessors,asfullyandlargelyasever
thesameActs,oranyofthem,didextendtothesaidlateKingHenryVIII,
yourhighness'sfather.
Andthatitmayalsopleaseyourhighness,thatitmaybeenactedbythe
authorityofthispresentParliament,thatsomuchofoneActorstatutemadein
thethirtysecondyearofthereignofyoursaiddearfatherKingHenryVIII,
intituled,AnActconcerningprecontractsofmarriages,andtouchingdegreesof
consanguinity,asinthetimeofthelateKingEdwardVI,yourhighness'smost
dearbrother,byoneotherActorstatute,wasnotrepealed;andalsooneAct
madeinthethirtyseventhyearofthereignofthesaidlateKingHenryVIII,
intituled,AnActthatdoctorsofthecivillaw,beingmarried,mayexercise
ecclesiasticaljurisdiction;andallandeverybranchesandarticlesinthesaid
twoActslastmentioned,andnotrepealedinthetimeofthesaidlateKing
EdwardVI,mayfromhenceforthlikewisestandandberevived,andremainin
theirfullforceandstrength,toallintentsandpurposes;anythingcontainedin
thesaidActofrepealbeforementioned,oranyothermatterorcausetothe
contrarynotwithstanding.
Andthatitmayalsopleaseyourhighness,thatitmaybefurtherenactedbythe
authorityaforesaid,thatallotherlawsandstatutes,andthebranchesand
clausesofanyActorstatute,repealedandmadevoidbythesaidActofrepeal,
madeinthetimeofthesaidlateKingPhilipandQueenMary,andnotinthis
presentActspeciallymentionedandrevived,shallstand,remain,andbe
repealedandvoid,insuchlikemannerandformastheywerebefore[Page
446]themakingofthisAct;anythinghereincontainedtothecontrary
notwithstanding.

Andthatitmayalsopleaseyourhighness,thatitmaybeenactedbythe
authorityaforesaid,thatoneActandstatutemadeinthefirstyearofthereign
ofthelateKingEdwardVI,yourmajesty'smostdearbrother,intituled,AnAct
againstsuchpersonsasshallunreverentlyspeakagainsttheSacramentofthe
BodyandBloodofChrist,commonlycalledtheSacramentofthealtar,andfor
thereceivingthereofunderbothkinds,andallandeverybranches,clauses,and
sentencesthereincontained,shallandmaylikewise,fromthelastdayofthis
sessionofParliament,berevived,andfromthenceforthshallandmaystand,
remain,andbeinfullforce,strength,andeffect,toallintents,constructions,
andpurposes,insuchlikemannerandformasthesamewasatanytimeinthe
firstyearofthereignofthesaidlateKingEdwardVI;anylaw,statute,orother
mattertothecontraryinanywisenotwithstanding.
Andthatalsoitmaypleaseyourhighness,thatitmaybefurtherestablished
andenactedbytheauthorityaforesaid,thatoneActandstatutemadeinthefirst
andsecondyearsofthesaidlateKingPhilipandQueenMary,intituled,An
Actfortherevivingofthreestatutesmadeforthepunishmentofheresies,and
alsothesaidthreestatutesmentionedinthesaidAct,andbythesameAct
revived,andallandeverybranches,articles,clauses,andsentencescontained
inthesaidseveralActsandstatutes,andeveryofthem,shallbefromthelast
dayofthissessionofParliamentdeemedandremainutterlyrepealed,void,and
ofnoneeffect,toallintentsandpurposes;anythinginthesaidseveralActsor
anyofthemcontained,oranyothermatterorcausetothecontrary
notwithstanding.
Andtotheintentthatallusurpedandforeignpowerandauthority,spiritualand
temporal,mayforeverbeclearlyextinguished,andnevertobeusedorobeyed
within[Page447]thisrealm,oranyotheryourmajesty'sdominionsorcoun
tries,mayitpleaseyourhighnessthatitmaybefurtherenactedbytheauthority
aforesaid,thatnoforeignprince,person,prelate,state,orpotentate,spiritualor
temporal,shallatanytimeafterthelastdayofthissessionofParliament,use,
enjoy,orexerciseanymannerofpower,jurisdicdiction,superiority,authority,
preeminenceorprivilege,spiritualorecclesiastical,withinthisrealm,orwithin
anyotheryourmajesty'sdominionsorcountriesthatnowbe,orhereaftershall
be,butfromthenceforththesameshallbeclearlyabolishedoutofthisrealm,
andallotheryourhighness'sdominionsforever;anystatute,ordinance,
custom,constitutions,oranyothermatterorcausewhatsoevertothecontrary
inanywisenotwithstanding.

Andthatalsoitmaylikewisepleaseyourhighness,thatitmaybeestablished
andenactedbytheauthorityaforesaid,thatsuchjurisdictions,privileges,
superiorities,andpreeminences,spiritualandecclesiastical,asbyanyspiritual
orecclesiasticalpowerorauthorityhaveheretoforebeen,ormaylawfullybe
exercisedorusedforthevisitationoftheecclesiasticalstateandpersons,and
forreformation,order,andcorrectionofthesame,andofallmanneroferrors,
heresies,schisms,abuses,offences,contempts,andenormities,shallforever,
byauthorityofthispresentParliament,beunitedandannexedtotheimperial
crownofthisrealm.
Andthatyourhighness,yourheirsandsuccessors,kingsorqueensofthis
realm,shallhavefullpowerandauthoritybyvirtueofthisAct,byletterspatent
underthegreatsealofEngland,toassign,name,andauthorize,whenandas
oftenasyourhighness,yourheirsorsuccessors,shallthinkmeetand
convenient,andforsuchandsolongtimeasshallpleaseyourhighness,your
heirsorsuccessors,suchpersonorpersonsbeingnaturalbornsubjectstoyour
highness,yourheirsorsuccessors,asyourmajesty,yourheirsorsuccessors,
shallthinkmeet,toexercise,use,occupy,and[Page448]executeunderyour
highness,yourheirsandsuccessors,allmannerofjurisdictions,privileges,and
preeminences,inanywisetouchingorconcerninganyspiritualorecclesiastical
jurisdiction,withintheseyourrealmsofEnglandandIreland,oranyotheryour
highness'sdominionsorcountries;andtovisit,reform,redress,order,correct,
andamendallsucherrors,heresies,schisms,abuses,offences,contempts,and
enormitieswhatsoever,whichbyanymannerspiritualorecclesiasticalpower,
authority,orjurisdiction,canormaylawfullybereformed,ordered,redressed,
corrected,restrained,oramended,tothepleasureofAlmightyGod,the
increaseofvirtue,andtheconservationofthepeaceandunityofthisrealm,
andthatsuchpersonorpersonssotobenamed,assigned,authorized,and
appointedbyyourhighness,yourheirsorsuccessors,afterthesaidletters
patenttohimorthemmadeanddelivered,asisaforesaid,shallhavefullpower
andauthority,byvirtueofthisAct,andofthesaidletterspatent,underyour
highness,yourheirsandsuccessors,toexercise,use,andexecuteallthe
premises,accordingtothetenorandeffectofthesaidletterspatent;anymatter
orcausetothecontraryinanywisenotwithstanding.
AndforthebetterobservationandmaintenanceofthisAct,mayitpleaseyour
highnessthatitmaybefurtherenactedbytheauthorityaforesaid,thatalland
everyarchbishop,bishop,andallandeveryotherecclesiasticalperson,and

otherecclesiasticalofficerandminister;ofwhatestate,dignity,preeminence,
ordegreesoeverheortheybeorshallbe,andallandeverytemporaljudge,
justice,mayor,andotherlayortemporalofficerandminister,andeveryother
personhavingyourhighness'sfeeorwages,withinthisrealm,oranyyour
highness'sdominions,shallmake,take,andreceiveacorporaloathuponthe
evangelist,beforesuchpersonorpersonsasshallpleaseyourhighness,your
heirsorsuccessors,underthegreatsealofEnglandto[Page449]assignand
name,toacceptandtotakethesameaccordingtothetenorandeffecthereafter
following,thatistosay:
'I,A.B.,doutterlytestifyanddeclareinmyconscience,thatthequeen's
highnessistheonlysupremegovernorofthisrealm,andofallotherher
highness'sdominionsandcountries,aswellinallspiritualorecclesiastical
thingsorcauses,astemporal,andthatnoforeignprince,person,prelate,state
orpotentate,has,oroughttohave,anyjurisdiction,power,superiority,
preeminence,orauthorityecclesiasticalorspiritual,withinthisrealm;and
thereforeIdoutterlyrenounceandforsakeallforeignjurisdictions,powers,
superiorities,andauthorities,anddopromisethatfromhenceforthIshallbear
faithandtrueallegiancetothequeen'shighness,herheirsandlawful
successors,andtomypowershallassistanddefendalljurisdictions,pre
eminences,privileges,andauthoritiesgrantedorbelongingtothequeen's
highness,herheirsandsuccessors,orunitedandannexedtotheimperialcrown
ofthisrealm.SohelpmeGod,andbythecontentsofthisbook.'
Andthatitmaybealsoenacted,thatifanysucharchbishop,bishop,orother
ecclesiasticalofficerorminister,oranyofthesaidtemporaljudges,justiciaries,
orotherlayofficerorminister,shallperemptorilyorobstinatelyrefusetotake
orreceivethesaidoath,thatthenhesorefusingshallforfeitandlose,only
duringhislife,allandeveryecclesiasticalandspiritualpromotion,benefice,
andoffice,andeverytemporalandlaypromotionandoffice,whichhehas
solelyatthetimeofsuchrefusalmade;andthatthewholetitle,interest,and
incumbency,ineverysuchpromotion,benefice,andotheroffice,asagainst
suchpersononlysorefusing,duringhislife,shallclearlyceaseandbevoid,as
thoughthepartysorefusingweredead.
Andthatalsoallandeverysuchpersonandpersonssorefusingtotakethesaid
oath,shallimmediatelyaftersuchrefusalbefromthenceforth,duringhislife,
disabled[Page450]toretainorexerciseanyofficeorotherpromotionwhich
he,atthetimeofsuchrefusal,hasjointly,orincommon,withanyotherperson

orpersons.
Andthatallandeverypersonandpersons,thatatanytimehereaftershallbe
preferred,promoted,orcollatedtoanyarchbishopricorbishopric,ortoany
otherspiritualorecclesiasticalbenefice,promotion,dignity,office,orministry,
orthatshallbebyyourhighness,yourheirsorsuccessors,preferredor
promotedtoanytemporalorlayoffice,ministry,orservicewithinthisrealm,
orinanyyourhighness'sdominions,beforeheortheyshalltakeuponhimor
themtoreceive,use,exercise,supply,oroccupyanysucharchbishopric,
bishopric,promotion,dignity,office,ministry,orservice,shalllikewisemake,
take,andreceivethesaidcorporaloathbeforementioned,upontheevangelist,
beforesuchpersonsashaveorshallhaveauthoritytoadmitanysuchpersonto
anysuchoffice,ministry,orservice,orelsebeforesuchpersonorpersonsas
byyourhighness,yourheirsorsuccessors,bycommissionunderthegreatseal
ofEngland,shallbenamed,assigned,orappointedtoministerthesaidoath.
Andthatitmaylikewisebefurtherenactedbytheauthorityaforesaid,thatif
anysuchpersonorpersons,asatanytimehereaftershallbepromoted,
preferred,orcollatedtoanysuchpromotionspiritualorecclesiastical,benefice,
office,orministry,orthatbyyourhighness,yourheirsorsuccessors,shallbe
promotedorpreferredtoanytemporalorlayoffice,ministry,orservice,shall
anddoperemptorilyandobstinatelyrefusetotakethesameoathsotohimto
beoffered;thatthenheortheysorefusingshallpresentlybejudgeddisabledin
thelawtoreceive,take,orhavethesamepromotionspiritualorecclesiastical,
thesametemporaloffice,ministry,orservicewithinthisrealm,oranyother
yourhighness'sdominions,toallintents,constructions,andpurposes.
[Page451]Andthatitmaybefurtherenactedbytheauthorityaforesaid,that
allandeverypersonandpersonstemporal,suingliveryorousterlemainoutof
thehandsofyourhighness,yourheirsorsuccessors,beforehisortheirlivery
orousterlemainsuedforthandallowed,andeverytemporalpersonorpersons
doinganyhomagetoyourhighness,yourheirsorsuccessors,orthatshallbe
receivedintoservicewithyourhighness,yourheirsorsuccessors,shallmake,
take,andreceivethesaidcorporaloathbeforementioned,beforethelord
chancellorofEngland,orthelordkeeperofthegreatsealforthetimebeing,or
beforesuchpersonorpersonsasbyyourhighness,yourheirsorsuccessors,
shallbenamedandappointedtoacceptorreceivethesame.
Andthatalsoallandeverypersonandpersonstakingorders,andallandevery

otherpersonandpersonswhichshallbepromotedorpreferredtoanydegreeof
learninginanyuniversitywithinthisyourrealmordominions,beforeheshall
receiveortakeanysuchorders,orbepreferredtoanysuchdegreeoflearning,
shallmake,take,andreceivethesaidoathbythisActsetforthanddeclaredas
isaforesaid,beforehisortheirordinary,commissary,chancellororvice
chancellor,ortheirsufficientdeputiesinthesaiduniversity.
Providedalways,andthatitmaybefurtherenactedbytheauthorityaforesaid,
thatifanyperson,havinganyestateofinheritanceinanytemporalofficeor
offices,shallhereafterobstinatelyandperemptorilyrefusetoacceptandtake
thesaidoathasisaforesaid,andafter,atanytimeduringhislife,shall
willinglyrequiretotakeandreceivethesaidoath,andsodotakeandacceptthe
sameoathbeforeanypersonorpersonsthatshallhavelawfulauthorityto
ministerthesame;thattheneverysuchperson,immediatelyafterhehasso
receivedthesameoath,shallbevested,deemed,andjudgedinlikeestateand
possessionofthesaidoffice,ashewasbeforethesaidrefusal,and[Page
452]shallandmayuseandexercisethesaidofficeinsuchmannerandformas
heshouldormighthavedonebeforesuchrefusal,anythinginthisAct
containedtothecontraryinanywisenotwithstanding.
AndforthemoresureobservationofthisAct,andtheutterextinguishmentof
allforeignandusurpedpowerandauthority,mayitpleaseyourhighness,thatit
maybefurtherenactedbytheauthorityaforesaid,thatifanypersonorpersons
dwellingorinhabitingwithinthisyourrealm,orinanyotheryourhighness's
realmsordominions,ofwhatestate,dignity,ordegreesoeverheortheybe,
aftertheendofthirtydaysnextafterthedeterminationofthissessionofthis
presentParliament,shallbywriting,printing,teaching,preaching,express
words,deedoract,advisedly,maliciously,anddirectlyaffirm,hold,standwith,
setforth,maintain,ordefendtheauthority,preeminence,powerorjurisdiction,
spiritualorecclesiastical,ofanyforeignprince,prelate,person,state,or
potentatewhatsoever,heretoforeclaimed,used,orusurpedwithinthisrealm,or
anydominionorcountrybeingwithinorunderthepower,dominion,or
obeisanceofyourhighness,orshalladvisedly,maliciously,anddirectlyputin
ureorexecuteanythingfortheextolling,advancement,settingforth,
maintenance,ordefenceofanysuchpretendedorusurpedjurisdiction,power,
preeminence,orauthority,oranypartthereof;thattheneverysuchpersonand
personssodoingandoffending,theirabettors,aiders,procurers,and
counsellors,beingthereoflawfullyconvictedandattainted,accordingtothe
dueorderandcourseofthecommonlawsofthisrealm,forhisortheirfirst

offenceshallforfeitandloseuntoyourhighness,yourheirsandsuccessors,all
hisandtheirgoodsandchattels,aswellrealaspersonal.
Andifanysuchpersonsoconvictedorattaintedshallnothaveorbeworthof
hispropergoodsandchattelsto[Page453]thevalueoftwentypounds,atthe
timeofhisconvictionorattainder,thattheneverysuchpersonsoconvictedand
attainted,overandbesidestheforfeitureofallhissaidgoodsandchattels,shall
haveandsufferimprisonmentbythespaceofonewholeyear,withoutbailor
mainprize.
Andthatalsoallandeverythebenefices,prebends,andotherecclesiastical
promotionsanddignitieswhatsoever,ofeveryspiritualpersonsooffending,
andbeingattainted,shallimmediatelyaftersuchattainderbeutterlyvoidtoall
intentsandpurposes,asthoughtheincumbentthereofweredead;andthatthe
patronanddonorofeverysuchbenefice,prebend,spiritualpromotionand
dignity,shallandmaylawfullypresentuntothesame,orgivethesame,insuch
mannerandformasifthesaidincumbentweredead.
Andifanysuchoffenderoroffenders,aftersuchconvictionorattainder,do
eftsoonscommitordothesaidoffences,oranyofthem,inmannerandform
aforesaid,andbethereofdulyconvictedandattainted,asisaforesaid;thatthen
everysuchoffenderandoffendersshallforthesamesecondoffenceincurinto
thedangers,penalties,andforfeituresordainedandprovidedbythestatuteof
ProvisionandPraemunire,madeinthesixteenthyearofthereignofKing
RichardII.
Andifanysuchoffenderoroffenders,atanytimeafterthesaidsecond
convictionandattainder,dothethirdtimecommitanddothesaidoffences,or
anyofthem,inmannerandformaforesaid,andbethereofdulyconvictedand
attainted,asisaforesaid;thattheneverysuchoffenceoroffencesshallbe
deemedandadjudgedhightreason,andthattheoffenderandoffenderstherein,
beingthereoflawfullyconvictedandattainted,accordingtothelawsofthis
realm,shallsufferpainsofdeath,andotherpenalties,forfeitures,andlosses,as
incasesofhightreasonbythelawsofthisrealm.
Andalsothatitmaylikewisepleaseyourhighness,that[Page454]itmaybe
enactedbytheauthorityaforesaid,thatnomannerofpersonorpersonsshallbe
molestedorimpeachedforanyoftheoffencesaforesaidcommittedor
perpetratedonlybypreaching,teaching,orwords,unlessheortheybethereof

lawfullyindictedwithinthespaceofonehalfyearnextafterhisortheir
offencessocommitted;andincaseanypersonorpersonsshallfortunetobe
imprisonedforanyofthesaidoffencescommittedbypreaching,teaching,or
wordsonly,andbenotthereofindictedwithinthespaceofonehalfyearnext
afterhisortheirsuchoffencesocommittedanddone,thatthenthesaidperson
soimprisonedshallbesetatliberty,andbenolongerdetainedinprisonforany
suchcauseoroffence.
Providedalways,andbeitenactedbytheauthorityaforesaid,thatthisAct,or
anythingthereincontained,shallnotinanywiseextendtorepealanyclause,
matter,orsentencecontainedorspecifiedinthesaidActofrepealmadeinthe
saidfirstandsecondyearsofthereignsofthesaidlateKingPhilipandQueen
Mary,asdoesinanywisetouchorconcernanymatterorcaseofPraemunire,
orthatdoesmakeorordainanymatterorcausetobewithinthecaseof
Praemunire;butthatthesame,forsomuchonlyastouchesorconcernsany
caseormatterofPraemunire,shallstandandremaininsuchforceandeffectas
thesamewasbeforethemakingofthisAct,anythinginthisActcontainedto
thecontraryinanywisenotwithstanding.
Providedalso,andbeitenactedbytheauthorityaforesaid,thatthisAct,or
anythingthereincontained,shallnotinanywiseextendorbeprejudicialtoany
personorpersonsforanyoffenceoroffencescommittedordone,orhereafter
tobecommittedordone,contrarytothetenorandeffectofanyActorstatute
nowrevivedbythisAct,beforetheendofthirtydaysnextaftertheendofthe
sessionofthispresentParliament;anythinginthisActcontainedoranyother
matterorcausetothecontrarynotwithstanding.
[Page455]Andifithappenthatanypeerofthisrealmshallfortunetobe
indictedofandforanyoffencethatisrevivedormadePraemunireortreason
bythisAct,thatthenhesobeingindictedshallhavehistrialbyhispeers,in
suchlikemannerandformasinothercasesoftreasonhasbeenused.
[2]Providedalways,andbeitenactedasisaforesaid,thatnomanneroforder,
Act,ordetermination,foranymatterofreligionorcauseecclesiastical,hador
madebytheauthorityofthispresentParliament,shallbeaccepted,deemed,
interpreted,oradjudgedatanytimehereafter,tobeanyerror,heresy,schism,
orschismaticalopinion;anyorder,decree,sentence,constitution,orlaw,
whatsoeverthesamebe,tothecontrarynotwithstanding.

Providedalways,andbeitenactedbytheauthorityaforesaid,thatsuchperson
orpersonstowhomyourhighness,yourheirsorsuccessors,shallhereafter,by
letterspatent,underthegreatsealofEngland,giveauthoritytohaveorexecute
anyjurisdiction,power,orauthorityspiritual,ortovisit,reform,order,or
correctanyerrors,heresies,schisms,abuses,orenormitiesbyvirtueofthisAct,
shallnotinanywisehaveauthorityorpowertoorder,determine,oradjudge
anymatterorcausetobeheresy,butonlysuchasheretoforehavebeen
determined,ordered,oradjudgedtobeheresy,bytheauthorityofthecanonical
Scriptures,orbythefirstfourgeneralCouncils,oranyofthem,orbyanyother
generalCouncilwhereinthesamewasdeclaredheresybytheexpressandplain
wordsofthesaidcanonicalScriptures,orsuchashereaftershallbeordered,
judged,ordeterminedtobeheresybytheHighCourtofParliamentofthis
realm,withtheassentoftheclergyintheirConvocation;anythinginthisAct
containedtothecontrarynotwithstanding.
Andbeitfurtherenactedbytheauthorityaforesaid,that[Page456]noperson
orpersonsshallbehereafterindictedorarraignedforanytheoffencesmade,
ordained,revived,oradjudgedbythisAct,unlesstherebetwosufficient
witnesses,ormore,totestifyanddeclarethesaidoffenceswhereofheshallbe
indictedorarraigned;andthatthesaidwitnesses,orsomanyofthemasshall
belivingandwithinthisrealmatthetimeofthearraignmentofsuchpersonso
indicted,shallbebroughtforthinperson,facetoface,beforethepartyso
arraigned,andthereshalltestifyanddeclarewhattheycansayagainsttheparty
soarraigned,ifherequirethesame.
Providedalso,andbeitfurtherenactedbytheauthorityaforesaid,thatifany
personorpersonsshallhereafterhappentogiveanyrelief,aid,orcomfort,or
inanywisebeaiding,helping,orcomfortingtothepersonorpersonsofany
thatshallhereafterhappentobeanoffenderinanymatterorcaseof
Praemunireortreason,revivedormadebythisAct,thatthensuchrelief,aid,or
comfortgivenshallnotbejudgedortakentobeanyoffence,unlesstherebe
twosufficientwitnessesattheleast,thatcanandwillopenlytestifyanddeclare
thatthepersonorpersonsthatsogavesuchrelief,aid,orcomforthadnotice
andknowledgeofsuchoffencecommittedanddonebythesaidoffender,atthe
timeofsuchrelief,aid,orcomfortsotohimgivenorministered;anythingin
thisActcontained,oranyothermatterorcausetothecontraryinanywise
notwithstanding.
AndwhereonepretendedsentencehasheretoforebeengivenintheConsistory

inPaul'sbeforecertainjudgesdelegate,bytheauthoritylegatineofthelate
CardinalPole,byreasonofaforeignusurpedpowerandauthority,against
RichardChetwood,Esq.,andAgneshiswife,bythenameofAgnesWoodhall,
atthesuitofCharlesTyrril,gentleman,inacauseofmatrimonysolemnized
betweenthesaidRichardandAgnes,asbythesamepretendedsentencemore
plainlydothappear,fromwhichsentencethesaid[Page457]Richardand
AgneshaveappealedtotheCourtofRome,whichappealdoesthereremain,
andyetisnotdetermined:mayitthereforepleaseyourhighness,thatitmaybe
enactedbytheauthorityaforesaid,thatifsentenceinthesaidappealshall
happentobegivenatthesaidCourtofRomeforandinthebehalfofthesaid
RichardandAgnes,forthereversingofthesaidpretensedsentence,beforethe
endofthreescoredaysnextaftertheendofthissessionofthispresent
Parliament,thatthenthesameshallbejudgedandtakentobegoodand
effectualinthelaw,andshallandmaybeused,pleaded,andallowedinany
courtorplacewithinthisrealm;anythinginthisActoranyotherActorstatute
containedtothecontrarynotwithstanding.
AndifnosentenceshallbegivenattheCourtofRomeinthesaidappealfor
thereversingofthesaidpretendedsentencebeforetheendofthesaid
threescoredays,thatthenitshallandmaybelawfulforthesaidRichardand
Agnes,andeitherofthem,atanytimehereafter,tocommence,take,sue,and
prosecutetheirsaidappealfromthesaidpretendedsentence,andforthe
reversingofthesaidpretendedsentence,withinthisrealm,insuchlikemanner
andformaswasusedtobepursued,ormighthavebeenpursued,withinthis
realm,atanytimesincethetwentyfourthyearofthereignofthesaidlateKing
HenryVIII,uponanysentencesgiveninthecourtorcourtsofanyarchbishop
withinthisrealm.
Andthatsuchappealassohereaftershallbetakenorpursuedbythesaid
RichardChetwoodandAgnes,oreitherofthem,andthesentencethathereinor
thereuponshallhereafterbegiven,shallbejudgedtobegoodandeffectualin
thelawtoallintentsandpurposes;anylaw,custom,usage,canon,constitution,
oranyothermatterorcausetothecontrarynotwithstanding.
Providedalso,andbeitenactedbytheauthorityaforesaid[Page458],that
wherethereisthelikeappealnowdependinginthesaidCourtofRome
betweenoneRobertHarcourt,merchantofthestaple,andElizabethHarcourt,
otherwisecalledElizabethRobins,oftheonepart,andAnthonyFydell,
merchantstranger,ontheotherpart,thatthesaidRobert,Elizabeth,and

Anthony,andeveryofthem,shallandmay,fortheprosecutingandtryingof
theirsaidappeal,haveandenjoythelikeremedy,benefit,andadvantage,in
likemannerandformasthesaidRichardandAgnes,oranyofthem,has,may,
oroughttohaveandenjoy;thisActoranythingthereincontainedtothe
contraryinanywisenotwithstanding.
