CASE SUMMARY
PROCEDURAL POSTURE: Plaintiff driver and passenger
sought review of the decision of the Court of Common Pleas
of Northampton County (Pennsylvania), which entered a
judgment in favor of defendant driver and car owner in
plaintiffs' action in trespass for personal injuries and property
damage
from
a
motor
vehicle
accident.
OVERVIEW: The accident took place at an intersection at
night. The jury returned a verdict for defendants and plaintiffs
appealed. On appeal, the court affirmed the judgment of the
court of common pleas. The court held that it was within the
discretion of the common pleas court to refuse to admit a
photograph that defendants claimed was misleading. The
court noted that the jury had the benefit of many other
photographs and lengthy testimony from a civil engineer and
county surveyor. The court refused to find that the discretion
of the common pleas court in refusing to admit the
photograph was clearly erroneous. The court further ruled
that the court of common pleas did not abuse its discretion
in limiting the cross-examination of one defendant.
OUTCOME: The court affirmed the judgment of the court of
common pleas.
