Defendant,
Teresa Chrisman, of the Florence County Sheriffs Department, being first duly sworn
states that:
Count 1: AGGRAVATED BATTERY
The above-named defendant on or about Saturday, November 07, 2015, in the Town of
Aurora, Florence County, Wisconsin, did cause great bodily harm to Michael Patrick Mortl,
by an act done with intent to cause great bodily harm to that person, contrary to sec.
940.19(5), 939.50(3)(e), 973.047(1f), 973.046(1 r) Wis. Stats.
Upon conviction for this offense, a Class E Felony, the defendant may be fined not more
than Fifty Thousand Dollars ($50,000), or imprisoned not more than fifteen (15) years, or
both.
And furthermore, invoking the provisions of Wisconsin Statute 973.046(1f), if the court
imposes a sentence or places a person on probation, the court shall require the person to
provide a biological specimen to the state crime laboratories for deoxyribonucleic acid
analysis. The court shall inform the person that he or she may request expungement under
s. 165.77 (4).
And furthermore, invoking the provisions of Wisconsin Statute 973.046(1 r), if the court
imposes a sentence or places a person on probation, the court shall impose a
deoxyribonucleic acid analysis surcharge, calculated as follows: (a) For each conviction for
a felony, $250 (b) For each conviction for a misdemeanor, $200.
Count 2: MISDEMEANOR THEFT
The above-named defendant on or about Saturday, November 07, 2015, in the Town of
Aurora, Florence County, Wisconsin, did intentionally conceal, retain possession of, take
and carry away, transfer, or use the movable property of Michael Patrick Mortl, without
consent and with intent to permanently deprive the owner of possession of the property,
contrary to sec. 943.20(1)(a) and (3)(a), 939.51 (3)(a) Wis. Stats.

Upon conviction for this offense, a Class A Misdemeanor, the defendant may be fined not
more than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9) months
or both.

Count 3: DISORDERLY CONDUCT


The above-named defendant on or about Saturday, November 07, 2015, in the Town of
Aurora, Florence County, Wisconsin, while in a private or pro place, did engage in abusive,
boisterous, indecent, profane, violent, unreasonably loud or otherwise disorderly conduct,
under circumstances in which such conduct tended to cause or provoke a disturbance,
contrary to sec. 947.01(1), 939.51(3)(b) Wis. Stats.
Upon conviction for this offense, a Class B Misdemeanor, the defendant may be fined not
more than One Thousand Dollars ($1,000), or imprisoned not more than ninety (90) days,
or both.
PROBABLE CAUSE:
Complainant relies on the official officers reports which are attached and incorporated by
reference. The author is a sworn member of law enforcement. I have worked with the
officer before and found him to be truthful and reliable. I believe the reports were
generated in the scope of his employment and in the ordinary course of business of law
enforcement. I believe the reports are truthful and reliable as records kept in the ordinary
course of business. I have used reports of this kind and found them to be truthful and
reliable in the past.
Copies of all other pertinent documents are attached to this complaint and incorporated
herein as if fully set forth.
Based on the foregoing, the complainant believes this complaint to be true and correct.

I, Deputy Tom Williams, along with Aurora Rescue squad and Beacon Paramedics, was sent
out to the C&R in the town of Aurora for a 40 year old maie who was unconscious and bleeding
from the nose and mouth.
I was on STH 70 West of Bonnie View Rd. so I requested Dispatch contact Dickinson County or
Kingsford Public Safety for Mutual Aid.
I arrived on scene and Aurora Rescue personal. Beacon Paramedics and Kingsford Public
Safety Officers were already there. Rescue personal and Beacon Paramedics were attending
to a male, later identified as Michael Patrick Modi II M/W DOB 01-25-75.1 could see that
Michael had blood on his face and was still unconscious. He was also groaning and making
gurgling sounds.
Kingsford Public Safety Officers were speaking with a female, identified as Rebecca Marie
Peterson F/W DOB 07-03-78, and the cab driver, identified as Patrick Green, M/W DOB 11-2284.
I asked Rebecca how she knew Michael and she stated that she had been dating Michael for
about a week. She did not know his address but did know that he lived in Niagara.
She said that they were in the bar this evening with her friend. Misty. They were playing pool
and a guy who identified himself as "Joe" came up and introduced himself and started playing
pool with them. She said that her and Misty left and Michael told her that he would call her
when he got home. She stated twenty minutes went buy and he did not call. She tried to call
him and he did not answer. A short time later her phone rang and it showed Michaels number
on her caller ID. She answered the phone and the voice on the other end was not Michael's.
She asked who it was and the male identified himself as Joe.
Joe told her that he knocked him out with one punch. Rebecca asked him why and he stated
he and Michael got into an argument and he hit Michael. Rebecca told him that she wanted to
talk with Michael but Joe asked her if she was one of the girts from the bar. She acknowledged
this and Joe kept asking her If she wanted to hang out.
She kept telling him that she wanted to talk with Michael and was told that Michael couldn't talk.
She stated that she believed that Joe put the phone by Michael because she could hear
gurgling and coughing.
Joe then told her that he could try and get him up. She then heard "terrible noises that she
said sounded like stomping and coughing.
Rebecca then hung up and called a cab to bring her to the C&R to pick up Michael.
She stated that the cab picked her up and brought her there. She said that when they got there
that they saw Michael lying on the ground and Joe was standing over him. She stated that they

got out of the cab and Joe tried to put him in the cab. He was unable to and dropped Michael
on the ground with his head bouncing of the pavement. She also told me that Joe had
Michaels wallet and cell phone. Joe started to walk away and she told him to return the wallet
and phone. Joe returned the wallet and kept the phone. He then walked off towards the
Michigan border. She was able to tell me that Michael's phone number was 906-396-9145.

I asked both Rebecca and Patrick for their addresses and phone numbers. I gave them
statement forms and told them that our office would be contacting them later on in the day to
get the statement forms from them.
Both Patrick and Rebecca stated several times during our conversation that they did not know
who Joe was and had never remembered seeing him before. They also told me that they were
sure that Tim Payette, the owner of the C&R would know who Joe was.
Rescue personal loaded Michael into the ambulance and were getting ready to transport him to
Dickinson County Memorial Hospital. Rebecca asked if she would be able to go to the hospital
and I told her it was up to her. She talked to Patrick and he agreed to give her a ride there.
i followed Aurora Rescue to the hospital. On the way there, I contacted Dispatch and requested
that they try to do a "ping" on Michael's phone. Dispatch later contacted me and informed me
that the company would not perform a ping because the person with the phone was not in
immediate danger.
Michael was immediately taken for a CT scan when he arrived at the hospital. I was able to
take a photo of his facial injuries once he was returned to the Emergency Department.
I was also able to speak with the doctor and was told that Michael did have a severe brain
bleed along with bruising and swelling to the back of his head and neck. The doctor also
informed me that she was requesting that Michael be flown to Aurora Baycare in Green Bay
due to the severity of his brain bleed.
Rebecca was waiting in a room adjacent to the lobby and she requested to speak with me. She
told me that she had located a number in the phone book for Michael's parents. She stated she
tried to call the number but got an answering machine and left a message.
I also called the number and left a message for them to call our office. Michael's father called a
short time later. (called him back and informed him of Michael's injuries and that he was going
to be flown to Aurora Baycare in Green Bay.
Rebecca also requested to speak with me again. She told me that she had just remembered
that Joe had given her his phone number while she was speaking to him and told her to call
him once things settled down. She told me she wrote the number on a piece of paper but left it
at home. She also stated that she remembered Joe telling her that he would return Michael's
phone to the C&R. I gave her a copy of my card and told her to call our office once she
returned home and give the number to the on duty deputies.
I also contacted Chief Deputy Gribble by phone and informed him of what was going on.
I cleared from the hospital and returned to the C&R parking lot to search for evidence. I located
several pools of blood on the North portion of the parking lot near CTH N. This was in the area
where Joe was lying when I arrived.
I photographed the blood, both scaled and unsealed. See attached. I also found a pair of
glasses near one of the pools and I took them into evidence.

I then went to Tim Payette's residence. Lights were on in the residence and (could see the TV
was on. I tried knocked on the door for approximately 5 minutes and did not get an answer.
I then cleared and returned to our office.
Chief Deputy Gribble was there when I returned and I informed him that I had attempted to
contact Tim Payette but was unable to get an answer at the door. Chief Deputy Gribble stated
that he and Deputy Chrisman would attempt to follow up on this.
11-18-2015
I returned to work on 11-08-15 and was informed by Deputy Chrisman that Michael's phone
had been found at 605 Birch St. in Kingsford. She told me that the residence belonged to
Jennifer Clements and Craig Charette. She was at the residence and was going to retrieve the
phone.
Deputy Chrisman also told me that she had worked with Kingsford Public Safety today and has
a couple of names and photographs of some possible suspects. Deputy Chrisman also met
with Rebecca and showed some photos of possible suspects on Facebook but Rebecca did not
recognize any of them. Deputy Chrisman also informed me that Michael was in serious
condition and in a medically induced coma.
I also received a call at our office from Rebecca. She told me that after speaking with Deputy
Chrisman, she remembered that Joe had told her that he was in a band with Jeremy Fende.
Rebecca went to her mother's house and looked up Jeremy Fende on Facebook. She stated
that she saw a photo on Fende's Facebook page of the baind Midwest Crew. She immediately
recognized one of the men as Joe. She then went to the band's Facebook page and there were
several other photos with him in them.
Rebecca then called her sister and her sister knew the man as Joe Supa. I told Rebecca that I
would have Deputy Chrisman call her as Deputy Chrisman was still in the Aurora area. I told
Rebecca that I would also have Deputy Chrisman come to her mom's residence to view the
photos.
I spoke with Deputy Chrisman and she stated that she did get this name from Kingsford Public
Safety. She she told me his full name was Joseph James Supa, M/W DOB 08-25-81, and his
last known address was 445 Hemlock St. in Kingsford. Deputy Chrisman told me that she
would contact Rebecca.
I was contacted a short time later by Deputy Chrisman. She told me that she had gone to
Rebecca's mother's house and Rebecca positively identified Joseph from the photos that she
discovered on facebook. Deputy Chrisman showed her a photo she had of Joe Supa and she
again said she was sure this was the "Joe" she spoke with in the bar and that had told her he
"hit" Mike.
I gave Dispatch the needed information for them to enter a Temporary Felony Warrant for
Substantial Battery.
I then went to Kingsford Public Safety and met with Sgt. Menengini and Sgt. Wood. They were
able to provide a phone number for Joseph. The number was 906-221 -0893.1 called the
number and got Josephs voicemail. I left a message for him to call our office.
I then followed Sgt. Menengini and Wood to the residence of Joseph's mother and step father.
We knocked on the door and it was answered by his step father. We asked if Joseph was there

and his step father told us that he was there about an hour ago. His step father was asked to
go check again to make sure Joseph was not there. He went back inside and came back to the
door and stated that Joseph was not there.

Sgt. Menengini asked him if Joseph lived there and he told us that he stays there from time to
time. Sgt. Menengini asked him if he stayed there last night and he stated he did. I asked him if
it looked like Joseph may have been in a fight last night and he stated no.
Sgt. Menengini asked him if Joseph stays in a bedroom or sleeps on the couch and he stated
that he sleeps in a bedroom. Sgt. Menengini asked if we could come in and take a look In the
bed room and he told us that he would rather not have us do that.
Sgt. Menengini told him that I needed to speak with Joseph about an incident that occurred at
the C&R last night and asked him to have Joseph call Kingsford Public Safety or come there.
Joseph's step father stated he would do that.
Joseph's step father was slow to answer our questions and was some what apprehensive to
answer them
We then cleared from there and checked another address on Hoadley St. in East Kingsford and
Joseph was not there.
I then cleared.
I was contacted a short time later by Dispatch and was informed that Sgt. Menengini had called
and stated that Joseph had contacted their office and was going to come there.
I returned to Kingsford Public Safety and a male and female were standing out by their vehicle.
I asked the male if he was Joseph and he stated he was. I told him I was the officer that
needed to speak to him and asked him to go inside with me, which he did.
Sgt. Menengini brought us to their interview room. I turned on a voice recorder to audibly record
the interview. I told Joseph that I needed to speak with him about what happened at the C&R
last night. I asked him if he was there and if he was in a fight. He stated he was but he was just
defending himself. He went onto say that he even tried to get back into the bar to get Tim
Payette to help him.
I then stopped Joseph and told him that before he went any further, I was going to inform him of
his rights. He then asked if he was in trouble. (told him again that I was going to read him his
rights first. I read him his rights off of a department Adult in Custody form. I checked off and
initialed each right after I read it to him. I then asked him if he understood his rights and if he
was willing to make a statement.
He then asked if he was being charged. I told him that the victim was in the hospital in Green
Bay. I told him that he had a brain bleed and was in a coma. I also told him that I had a witness
that positively identified him as the one who assaulted the victim. I told him because of the
positive identification, he had a Felony Warrant out for his arrest.
Joseph began to tremble and started crying. He stated again that he was just defending himself
and he did not do this. He asked if the bar had surveillance footage and I told him that it was
not working.
I then asked him again if he would be willing to make a statement and he told me that he
wanted to and asked me if he needed a lawyer, i told him that was his choice. He then stated
he would like to make a statement but wanted to speak with a lawyer first.

I ended the interview and told him that Kingsford would be taking him into custody and
transporting him to the Dickinson County Jail on our warrant. I told him that he would be
brought in front of a judge for an Extradition Hearing and he could decided if he wanted to
waive extradition or fight it.
I leh the room and notified Sgt. Menengini and Wood. They came into the room and took
Joseph into custody.
I then contacted Dickinson County Dispatch and had them run Joseph and confirm the warrant
with our Dispatch, which they did.
I also spoke with Joseph again and gave him a copy of my card. I told him to contact our office
if he changed his mind.
Sgt. Menengini and Wood then transported him to the Dickinson County Jail.
I also met up with Patrick Green later on in the evening. Patrick did have his statement done
and gave it to me.
I told him that ( had a picture of a male and that I was going to show it to him and asked him if
he could tell me if he recognized the male. I showed him the picture and he stated that it was
the male that was involved with the incident at the C&R. Patrick then added this to his
statement. See attached.
