AFFIDAVIT OF TANOD SAKSI

I, TANOD SAKSI, 40 years old, Barangay Tanod of Barangay

Subangdaku, residing in Wireless, Mandaue City, Cebu, Philippines after
having been duly sworn in accordance with law do hereby depose and
state:
That I am the Barangay Tanod in-duty on the night of December 22,
2014;
That while patrolling around the area of Wireless, Mandaue City I
heard a woman shouting for help and a child crying vehemently;
That while I arrived outside the residence of Maria Gikulata, I saw
that she was punched by the accused in the abdomen twice and slapped
repeatedly on her face in front of the child;
That I immediately went inside their residence even without their
authority and helped Maria Gikulata escape from the battering;
That I escorted Maria Gikulata immediately to Barangay
Subangdaku Police Station to report the incident;
That I am executing this affidavit to attest the veracity of the foregoing
facts and to be a witness of the complaint filed in court against Pedro
Salbahis for the crime of Serious Physical Injury in Relation to RA 9262.

JUANA BATA

I, JUANA BATA, 4 years old, residing in Wireless, Mandaue City,

Cebu, Philippines after having been duly sworn in accordance with law do
hereby depose and state:
That I am the minor child of MARIA GIKULATA with PEDRO
SALBAHIS;
That I often hear my mother and father bickering and quarreling with
each other;
That my father would often come home late and drunk;
That my father would threaten my mother to separate me from our
residence in Wireless, Mandaue City;
That my father would sometimes vehemently spank me if he comes
home drunk;
That my father maltreated my mother by uttering words of profanities
against her;
That in the night of December 22, 2014, my father came home very
drunk and upon entering our room, he physically assaulted my mother by
punching her abdomen twice and slapping her at least six times in my
presence;

That we are both helpless and I could not do anything but cry;
That fortunately, Tanod Saksi, came to our rescue when he heard my
mothers plea for help;
That I went with my mother to immediately report the incident in
Barangay Subangdaku Police Station;
That I am executing this affidavit to attest the veracity of the foregoing
facts and to be a witness of the complaint filed in court against Pedro
Salbahis for the crime of Serious Physical Injury in Relation to RA 9262.
